MY MINIMUM LENGTH OF STAYIf you are sent to TJJD without a specific sentence, or determinate sentence setby the court, you will have a minimum length of stay – the minimum time youmust spend in a TJJD facility. TJJD has a formula to determine your minimumlength of stay based on the severity of your committing offense and other risksyou might pose. This section will help you determine your minimum length ofstay. If you have any questions about determining your minimum length of stay,be sure to ask a TJJD staff member for help.Note: If you are a determinate sentenced offender, this section does not apply toyou because your court has set a specific sentence for you to serve. Instead of aminimum length of stay, you have a minimum period of confinement, which is thetime you must spend in a secure facility before being paroled. This amount oftime is set in state law: 10 years for capital murder; three years for an aggravatedcontrolled substance felony or a first degree felony; two years for a seconddegree felony; and one year for a third degree felony.Severity RatingThe first part of determining your minimum length of stay is figuring out yourseverity rating – High, Moderate, or Low. This is based on your committingoffense.If you used a weapon or committed a sexual felony or a felony against a person,your rating is:High – Capital Offense, All 1 st Degree Felonies, 2 nd Degree Murder,Manslaughter, or Sexual AssaultModerate – All Other 2 nd Degree Felonies, All 3 rd Degree and State Jail FeloniesIf you did not use a weapon or commit a sexual felony or a felony against aperson, your rating is:Moderate – 1 st Degree FeloniesLow – 2 nd Degree, 3 rd Degree, and State Jail Felonies24
Assessment RatingThe second part of determining your minimum length of stay is figuring out yourassessment rating – High, Medium, or Low. This is based on your risk to thecommunity as shown by your prior offense(s) and referral history. This part is abit harder than figuring out your severity rating.
