The proposed request is inconsistent with the County’s adopted Comprehensive Plan and theCounty’s land development regulations.Pursuant to the findings of fact outlined in the staff’s report, it is recommended the Planning and ZoningCommission recommend the Board of County Commissioners adopt a resolution denying the petitioner’srequest to rezone from R-1B to PDP(GC) with a reduction in setbacks.Mr. Nicholson, under oath, read into record portions of a staff report from a previous rezoning petition[James Berentine et al. H-05-68] indicating staff’s opinion that PDP(OP) zoning with limited C-1 useswas appropriate on the subject property. He then reviewed a revised site plan submitted on October 2,2006, and asked to postpone the petition to allow staff additional time to review the new plan.Vice Chairman Palmieri asked for public comment. The following people spoke under oath regarding thepetition: Joanne Flynn, Cheryl Atkinson, Clyde McFarlin, Robert Fowle, Joan Corcione, and WilliamBudlin opposed the proposed commercial development and asked to keep the area residential. JacquelineWest, Angie Pruitt, Brenda Moran, and Doug Lowrey were in favor of the commercial development.Under rebuttal, Mr. Nicholson pointed out C-1 and C-2 development in the vicinity and considered theirrequest infill zoning. He discussed concerns with using the small lots abutting US 41 for residential uses.Comm. Widmar and Mr. Mixson discussed possible road improvements if the petition was approved. Mr.Greif advised Comm. Widmar that the request would not meet the infill commercial policy but OP zoningmay be appropriate as a unified project. Discussion ensued.Comm. Covell, Comm. Preston, and Vice Chairman Palmieri agreed with staff’s recommendation fordenial. They would not support commercial or office professional uses on the property.MOTIONComm. Smith moved that the Planning and Zoning Commission postpone consideration of thepetition until their November 13, 2006, meeting at 9:00 a.m. Comm. Covell seconded the motion.Responding to Comm. The petitioner has indicated the height extension is necessary toaccommodate two future carries.Pursuant to the findings of fact outlined in the staff’s report, it is recommended the Planning and ZoningCommission recommend the Board of County Commissioners adopt a resolution approving the petitioner’srequest to modify a public service facility overlay district for communication tower to increase the heightwith the following performance conditions:1. The petitioner must obtain all permits from Hernando County and meet all applicable landdevelopment regulations, for either construction or use of the property, and complete all applicabledevelopment review processes.2. All development must occur generally in compliance with the approved site plan.3. The tower is approved up to a maximum of 140' in height.4. The petitioner must provide the name and phone number of the contact person for the facility on asign on the gate, fence, or access point to the site, whichever is most adjacent to the public access.Mr. Garcia, under oath, discussed their request to increase tower height to accommodate a new carrier.Vice Chairman Palmieri asked for public comment. No one came forward.Comm. Covell noted the applicant’s letter dated August 1, 2006, requested a tower height of 145' withappurtenances. Mr. Greif noted the applicant requested an additional 25' but staff did not object tomodifying condition #3.MOTIONComm. Smith moved to recommend approval to the BCC per staff’s recommendations with thefollowing modified performance conditions:3. The tower is approved up to a maximum of 140' 145' in height.Comm.
