The subject property is located on the east side of Deltona Boulevard, approximately 275'south of Oak Grove Street.Subsequent to submittal of the request by the petitioner, the staff further reviewed the statutoryrequirements relative to these types of facilities. The staff has requested the County Legal Office reviewthe request and advise staff to the statutory requirements. At the writing of the staff report, the final legalopinion had not been received; consequently, staff recommends a 30 day postponement.The Planning Staff recommends the Planning and Zoning Commission postpone consideration of therequest for 30 days in order for staff to receive clarification from the County Attorney’s office regardingthe status of recent statutory amendments.Mr. Weissinger explained that the Florida Legislature made recent changes regarding the community homecategory. He opined that a 30 day postponement should be sufficient. Mr. Pianta added that the Countyneeded to revise the Land Development Regulations to accommodate the recent changes, and the applicantneeded to provide additional information to staff regarding the type of clients to be served at the proposedfacility.Vice Chairman Palmieri asked for public comment. No one came forward.MOTIONComm. Smith moved that the Planning and Zoning Commission postpone consideration of thepetition until their November 13, 2006, meeting at 9:30 a.m. Comm. Covell seconded the motionand the motion carried 5-0.Hernando County Board of County Commissioners - Rezoning - H0697Purpose: Rezoning from AG (Agricultural) and C-3 (Neighborhood Commercial) to C-3(Neighborhood Commercial)Location:West side of McIntyre Road, south side of Croom RoadRepresentative:Hernando CountyThe applicant is requesting to rezone an approximately 1.14 acre site from AG and C-3 to C-3. Theproperty is located on the south side of Croom Road, west side of McIntyre Road.It is recommended that the Planning and Zoning Commission recommend the Board of CountyCommissioners adopt a resolution approving the petitioner’s request to rezone from AG and C-3 to C-3.As a note, the subject property is part of a larger parent parcel comprising approximately 49,000 squarefeet, which is split zoned AG and C-3. The Agricultural portion of the site does not meet the minimumlot size requirements for the AG district (there is no minimum lot size for C-3). The zoning action willnot create two separate parcels and the agricultural portion of the property could not be split or transferredas currently zoned.
