Hernando County Planning & Zoning CommissionMinutes - October 9, 2006Page 15 of 28not be split unless the AG is rezoned for another use, and any future rezonings of the property would bedone at the owner’s expense. It is also understood that the petitioner must obtain all permits from Hernando County and meet allapplicable land development regulations, for either construction or use of the property, and complete allapplicable development review processes.Mr. Weissinger added that staff’s recommendation would correct a ministerial error that was made severalyears ago regarding the property classification.Vice Chairman Palmieri asked for public comment. No one came forward.Comm. Covell questioned if this approval would set a precedent. Mr. Weissinger replied that all the pastrecords supported that an error had been made. The only precedence would be for very similar situationswhere someone provided sufficient evidence supporting that an error was made in recording a prior zoningaction.MOTIONComm. Covell moved to recommend the BCC approve staff’s recommendations. Comm. Widmarseconded the motion and the motion carried 5-0.Joseph Selway for MSW, LLC - Rezoning - H0698Purpose:Location:Rezoning from Agricultural (AG) and PDP(SF)/Planned Development Project(SingleFamily) to PDP(MF)/Planned Development Project (Multifamily)West side of Croom Rital Road, east end of Park Ridge Drive, approximately 1400' northof Cortez Boulevard (SR 50)Representative:Nicholas W. Nicholson, PE, Nicholson Engineering Associates, Inc.The applicant is requesting to rezone from AG and PDP(SF) to PDP(MF). The property is located on thewest side of Croom Rital Road, east end of Park Ridge Drive, approximately 1400' north of CortezBoulevard. The staff report indicates that rezoning from AG to PDP(MF) would be inappropriate based on thefollowing conclusions:1. The proposed request is inconsistent with the locational criteria for high density residentialdevelopment as provided for in the adopted comprehensive plan.2. The intensity of the proposed request would be incompatible with the established single familyneighborhood to the west.3. The proposed rezoning is inconsistent with the County’s adopted Comprehensive Plan.F:\WPDATA\CJB\MINUTES\2006\100906min.wpd
