ARTICLE IV – DEFINITIONSFor the purpose of this Resolution, certain terms are <strong>here</strong>in defined. Words used in thepresent tense shall include the future; the singular number shall include the plural and the pluralthe singular; the word “shall” is mandatory and not directory; the word “building” shall includethe word “structure”; the word “used” shall include the words “arranged,” “designed,”“constructed,” “altered,” “converted,” or “intended to be used”; and a “person” shall mean, inaddition to any individual, a firm, corporation, association, or any legal entity which may ownand/or use land or buildings. *(added eff. 5/9/99, NI #3, 1999)ACCESSORY USE OR STRUCTURE: A use or structure subordinate to the principal use of abuilding on the lot or tract and serving a purpose customarily incidental to the use of theprincipal building.ADULT BOOK STORE: An establishment which utilizes ten (10) percent or more of its retailselling area for the purpose of retail sale or rental for the purposed of display or coin or slugoperated,or electronically, electrically or mechanically controlled still or motion picturemachines, projectors, or other image-producing devices, books, magazines, periodicals, films,tapes and cassettes which are distinguished by their emphasis on adult materials as defined inthis section and which excludes minors by reason of age. *ADULT ENTERTAINMENT USE: Any premises, enterprise, business or place open to some orall members of the public at or in which t<strong>here</strong> is an emphasis on adult materials as defined in thissection and excludes any minor by reason of age. Adult uses include but are not limited to: adultbookstores, adult motion picture theater, adult mini-motion picture theaters, adult massageparlors, adult health clubs and adult cabarets. *ADULT CABARET: An establishment that provides dancing or other live entertainment inwhich persons appear in a state of nudity to perform their duties and the establishment featuresentertainment or services which constitute adult material as defined in this section and excludesany minor by reason of age. *ADULT HEALTH CLUB: An establishment that provides equipment and facilities forexercising and improving physical fitness w<strong>here</strong> employees and/or patrons appear in a state ofnudity to perform their duties and excludes any minor by reason of age. *ADULT MASSAGE PARLOR: An establishment that administers therapeutic manipulation forpayment and excludes any minor by reason of age. *ADULT MATERIAL: Any book, magazine, newspaper, pamphlet, poster, print, picture, slide,transparency, figure, image, description, motion picture film, phonographic record or tape, orother tangible thing, or any service, capable of arousing interest through sight, sound, or touch,and:a. Which material is distinguished or characterized by an emphasis on matter displaying,describing, or representing sexual activity, masturbation, sexual excitement, nudity,bestiality or human bodily functions of elimination; orb. Which service is distinguished or characterized by an emphasis on sexual activity,masturbation, sexual excitement, nudity, bestiality, or human bodily functions ofelimination.9
