3) Dairying and animal and poultry husbandry on lots greater than one (1)acre but not greater than five (5) acres when at least thirty-five (35) percent of the lots in thesubdivision are developed with at least one (1) building, structure, or improvement that is subjectto real property taxation or that is subject to the tax on manufactured homes under Section4503.06 of the Revised <strong>Code</strong>. After thirty-five (35) percent of the lots are so developed, dairyingand animal and poultry husbandry shall be considered nonconforming use of the land andbuildings or structures pursuant to Section 519.19 of the Revised <strong>Code</strong>.(C) Such sections confer no power on any township zoning commission, board oftownship trustees, or board of zoning appeals to prohibit in a district zoned for agricultural,industrial, residential, or commercial uses, the use of any land for a farm market w<strong>here</strong> fifty (50)percent or more of the gross income received from the market is derive from produce raised onfarms owned or operated by the market operator in a normal crop year. However, a board oftownship trustees, as provided in section 519.02 of the Revised <strong>Code</strong>, may regulate such factorspertaining to farm markets as size of the structure, size of parking areas that may be required, setback building lines, and egress or ingress, w<strong>here</strong> such regulation is necessary to protection thepublic health and safety. (Amended eff. 12/13/1998)SECTION 310.2PUBLIC UTILITIESPublic utilities will be governed in accordance with <strong>Ohio</strong> Revised<strong>Code</strong>, Section 519.211 and any amendments made t<strong>here</strong>to. (Amended eff. 12/13/1998)SECTION 310.3RETAIL ESTABLISHMENTS AND ALCOHOLIC BEVERAGESSuch sections confer no power on any board of county commissioners,board of township trustees, or board of zoning appeals to prohibit the sale or use ofalcoholic beverages in areas w<strong>here</strong> the establishment and operation of any retail business,hotel, lunchroom, or restaurant is permitted. <strong>Ohio</strong> Revised <strong>Code</strong> 519.21 (Amended eff.1/7/95)SECTION 310.4OIL AND GAS DRILLINGSection 1509.39 of the <strong>Ohio</strong> Revised <strong>Code</strong>, as enacted July 25, 1980,allows the adoption of health and safety standards which are not less restrictive than theprovisions of the <strong>Ohio</strong> Revised <strong>Code</strong> or any rules adopted t<strong>here</strong>under by the Division ofOil and Gas; however, this section prohibits township enforcement or requirements ofpermits for such oil and gas well operations except for the permit provided for in Section4513.34 of the <strong>Ohio</strong> Revised <strong>Code</strong>, concerning overweight vehicles. <strong>Ohio</strong> Revised <strong>Code</strong>1509.39 (Amended eff. 1/7/1995) (Amended eff. 12/13/1998)SECTION 310.5OUTDOOR ADVERTISINGOutdoor advertising classified as business use. For the purpose ofSections 519.02 to 519.25, inclusive, of the <strong>Ohio</strong> Revised <strong>Code</strong>, outdoor advertising shall beclassified as a business use and be permitted in all districts zoned for industry, business, or trade,or lands used for agricultural purposes.6
