SECTION 602.11ESSENTIAL SERVICESEssential services as defined by these regulations shall be permitted asauthorized under any franchise or that may be regulated by any law of the State of <strong>Ohio</strong>; it beingthe intention <strong>here</strong>of to exempt such essential services from the application of these regulations.SECTION 603SECTION 603.1SUPPLEMENTAL REGULATIONSPRINCIPAL BUILDINGNo more than one (1) principal building shall be permitted on any lot inany district unless otherwise specifically stated in these regulations, or as permitted in districtregulations.SECTION 603.2REDUCTION OF LOT REQUIREMENTSNo space which, for the purpose of a building or land use, has beencounted or calculated as part of a side yard, rear yard, front yard, or other open space required bythese regulations may, by reason of change in ownership or otherwise, be counted or calculatedto satisfy the yard or other are requirements for any other use or structure.SECTION 603.3VISIBILITY AT CORNER LOTSNo obstruction to view in excess of two (2) feet in height shall be placedon any corner lot within a triangular area formed by the street right-of-way lines and a lineconnecting them at points thirty (30) feet from the intersection of the street lines, except thatstreet trees are permitted which are pruned at least eight (8) feet above the established grade ofthe roadway so as not to obstruct clear view by motor vehicle drivers.SECTION 603.4INCONSISTENCIESIn the event any of the requirements or regulatory provisions of theseregulations are found to be inconsistent one with another, the more restrictive or greaterrequirements shall be deemed in each case to be applicable.SECTION 603.5 SWIMMING POOLS (Amended eff. 9/26/99, NI #6, 1999)Public or private in-ground or above-ground swimming, wading, or otherpools containing over one and one-half (1-1/2) feet of water depth shall be considered asstructures for the purpose of permits and shall conform to all required yard setback lines, Theconstruction, plumbing, and electrical requirements, inspection, and other safety facilities shallbe regulated by the county or state codes.CLASSIFICATION: Swimming pools are classified as commercial (public) or family (private).Commercial pools are intended for use by the public. Family pools are intended to be usedsolely by the property owner, family and friends.PERMITS: In-ground and above-ground swimming pools, as well as, wading poolscontaining over 1-1/2 feet of water require a zoning permit and must conform to all requiredsetback depths for an accessory structure in the <strong>Zoning</strong> Resolution for <strong>Nimishillen</strong> <strong>Township</strong> inwhich it is proposed.26
