Development of the Legislative Framework<br />

The legislative framework governing the distribution of<br />

electricity is based upon the following laws:<br />

Act No. 458/2000 Sb. on the Conditions for Doing<br />

Business and Exercising State Administration in the Energy<br />

Sectors and amending certain acts (the Energy Act)<br />

Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources and<br />

amending certain acts (the Act on Supported Energy<br />

Sources)<br />

Act No. 406/2000 Sb. on Energy Management.<br />

A new act was adopted in 2<strong>012</strong>:<br />

Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources,<br />

adopted May 30, 2<strong>012</strong>.<br />

During 2<strong>012</strong> the above acts were directly amended as follows:<br />

Act No. 458/2000 Sb. (the Energy Act) was amended by<br />

Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources<br />

Act No. 406/2000 Sb. on Energy Management was amended<br />

by Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources.<br />

The principal reasons and objectives for adopting the new<br />

Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources were<br />

the following:<br />

a new model for supporting electricity from supported<br />

sources, decentralized electricity generation, and<br />

biomethane; and a new method by which the market<br />

operator pays support for electricity from these sources<br />

support in the form of purchase price in mandatory<br />

purchasing of electricity from supported sources through a<br />

mandatory purchaser<br />

support in the form of a green bonus in market<br />

purchasing of electricity from renewable sources through<br />

the market operator<br />

funds for supporting the aforementioned sources of<br />

electricity, decentralized generation of electricity, and<br />

biomethane will be obtained from a contribution in support<br />

of electricity, decentralized generation, and biomethane<br />

included in the price of electricity for electricity consumers,<br />

and from subsidies approved by the Government of the<br />

Czech Republic.<br />

The principal reasons and objectives for amending Act No.<br />

458/2000 Sb. (the Energy Act) through Act No. 165/2<strong>012</strong> Sb.<br />

on Supported Energy Sources were to:<br />

enable consumers who enter into contracts on supplies of<br />

electricity and/or gas outside of the license holder’s usual<br />

business premises to withdraw from the contract at any<br />

time up to five days prior to commencement of supplies<br />

under the signed contract<br />

expand the powers and responsibilities of the Ministry of<br />

Industry and Trade in conjunction with the implementation<br />

of Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources<br />

treat the rights and obligations of the market operator in<br />

conjunction with the implementation of Act No. 165/2<strong>012</strong> Sb.<br />

on Supported Energy Sources<br />

treat the rights and obligations of transmission and<br />

distribution grid operators in dispatch (grid control) in<br />

conjunction with the implementation of Act No. 165/2<strong>012</strong> Sb.<br />

on Supported Energy Sources<br />

expand the authorities of the State Energy Inspection in<br />

conducting inspection activities.<br />

The principal reason and objective for amending Act<br />

No. 406/2000 Sb. on Energy Management through Act<br />

No. 165/2<strong>012</strong> Sb. on Supported Energy Sources was to:<br />

bring the language of the act into accordance with<br />

Act No. 165/2<strong>012</strong> Sb. on Supported Energy Sources.<br />

Other Changes to Legislation in 2<strong>012</strong><br />

The following regulations were promulgated in 2<strong>012</strong> that<br />

implement the above acts and/or implementing regulations:<br />

Decree No. 348/2<strong>012</strong> Sb. of October 12, 2<strong>012</strong> amending<br />

Decree No. 140/2009 Sb. on price regulation in the energy<br />

sectors and on price regulation procedures<br />

The reason for promulgating this decree was to change the<br />

method for setting prices to cover costs associated with<br />

supporting electricity generation from supported sources,<br />

decentralized electricity generation, and biomethane in<br />

conjunction with the new Act No. 165/2<strong>012</strong> Sb. on<br />

Supported Energy Sources.
