Resources, boundaries and gouvernance: What future for mar<strong>in</strong>e resources <strong>in</strong> Micronesia?<br />
and about 35 <strong>in</strong> Yap after <strong>the</strong>y were caught conduct<strong>in</strong>g illegal fish<strong>in</strong>g and poach<strong>in</strong>g<br />
activities on <strong>the</strong> reefs of Ngulu, Nukuoro and Kap<strong>in</strong>gamarangi Atolls.<br />
A group of 10 vessels was sighted ga<strong>the</strong>r<strong>in</strong>g sea cucumbers and reef fish at Ngulu<br />
Atoll <strong>in</strong> Yap, and islanders <strong>the</strong>re reported <strong>the</strong>m to <strong>the</strong> national and state governments.<br />
When Yap State’s request for help from <strong>the</strong> national coastguard 24 was not met, local<br />
officials put toge<strong>the</strong>r a small armada of skiffs and outboard motor boats, armed<br />
<strong>the</strong>m with police officers and able citizens, and sailed around 120 km across <strong>the</strong><br />
open ocean to Ngulu. There, <strong>the</strong>y were able to successfully catch around 35 illegal<br />
fishermen and confiscate some of <strong>the</strong>ir vessels.<br />
Larger groups of illegal fishermen, mostly from Vietnam and some from Ch<strong>in</strong>a,<br />
were caught on <strong>the</strong> atolls of Nukuoro and Kap<strong>in</strong>gamarangi, south of Pohnpei. The<br />
sailors were mostly from Vietnam while <strong>the</strong> ship owners were identified as be<strong>in</strong>g<br />
ei<strong>the</strong>r Ch<strong>in</strong>ese or Vietnamese. Many sailors <strong>in</strong> particular have claimed that <strong>the</strong>y<br />
were trafficked to work on <strong>the</strong> vessels, o<strong>the</strong>rs submitted claims of be<strong>in</strong>g smuggled<br />
and want<strong>in</strong>g to seek asylum. Figur<strong>in</strong>g out <strong>the</strong> circumstances and <strong>the</strong> extent of illegal<br />
activities by <strong>the</strong>se poachers has been a challenge for local authorities due to language<br />
barriers and <strong>the</strong> vary<strong>in</strong>g accounts of <strong>the</strong> persons <strong>in</strong>terviewed. One confiscated vessel<br />
with its crew under house arrest was able to escape from Pohnpei Harbor dur<strong>in</strong>g a<br />
typhoon <strong>in</strong> April 2015 under life threaten<strong>in</strong>g circumstances. After <strong>the</strong> typhoon <strong>the</strong>y<br />
were caught a second time for illegal fish<strong>in</strong>g activities exactly where <strong>the</strong>y had been<br />
arrested <strong>the</strong> first time. There has <strong>the</strong>refore been talk of organised crime and traffick<strong>in</strong>g<br />
through <strong>in</strong>vestors or ship owners pressur<strong>in</strong>g crews and capta<strong>in</strong>s not to return home<br />
empty-handed lest <strong>the</strong>y or <strong>the</strong>ir families back home experience fur<strong>the</strong>r exploitation<br />
or aggression by <strong>the</strong>ir employers. While local governments and <strong>the</strong> International<br />
Organization for Migration (IOM) are try<strong>in</strong>g to assist as best <strong>the</strong>y can, it is difficult<br />
to identify or connect <strong>the</strong>se activities with <strong>in</strong>cidents of human traffick<strong>in</strong>g or human<br />
smuggl<strong>in</strong>g.<br />
In Palau, a Ch<strong>in</strong>ese poacher was accidentally shot and killed <strong>in</strong> March 2015 <strong>in</strong> an<br />
attempt to arrest him and a group of 25 poach<strong>in</strong>g fishermen and confiscate <strong>the</strong>ir<br />
vessels. Ra<strong>the</strong>r than receiv<strong>in</strong>g apologies from Ch<strong>in</strong>a for <strong>the</strong> illegal breach<strong>in</strong>g of its<br />
boundaries and <strong>the</strong>ft of its mar<strong>in</strong>e resources by some of its citizens, <strong>the</strong> Palauan<br />
government received threats. Accusations of <strong>the</strong> maltreatment of its citizens and<br />
human rights violations were made <strong>in</strong> what was clearly an accident that took place<br />
when <strong>the</strong> Ch<strong>in</strong>ese citizens resisted arrest and fled <strong>the</strong> crime scene (unnamed<br />

It is <strong>the</strong> western most state while Pohnpei, where <strong>the</strong> FSM’s three coastguard ships are usually stationed,<br />
is 3 hours away by air plane, equivalent to <strong>the</strong> distance between Frankfurt, Germany and Moscow,<br />
Russia. It would have probably taken a FSM coastguard vessel up to three days to get to Ngulu Atoll on<br />
<strong>the</strong> western edge of Yap State, by which time <strong>the</strong> poachers would have easily escaped.<br />
