National Roofing Industry Pension Plan<br />

Work in Disqualified Employment<br />

The Board of Trustees of the National Roofing<br />

Industry Pension Plan (the “NRIPP”) has<br />

adopted rules to help protect the funding<br />

of benefits provided by the NRIPP. These rules are<br />

necessary to ensure a continuing level of contributions<br />

to the NRIPP now and in the future.<br />

This article reviews the rules that apply to you<br />

(assuming you are a participant in the NRIPP) should<br />

you work for an employer in the Industry that does<br />

not have a collective bargaining agreement (“CBA”)<br />

with the United Union of Roofers, Waterproofers and<br />

Allied Workers (the “International Union”) or one of<br />

its affiliated Local Unions. The complete rules for<br />

Disqualified Employment, summarized in this article,<br />

are in the NRIPP Plan Document, which governs all<br />

NRIPP benefits that are due you or your beneficiary.<br />

The detailed rules related to Disqualified Employment<br />

also are summarized in the NRIPP’s Summary Plan<br />

Description (the “SPD”). If there are any inconsistencies<br />

between this article or the SPD and the NRIPP<br />

Plan Document, the NRIPP Plan Document will control.<br />

You may obtain both the NRIPP Plan Document<br />

and the SPD from the Fund Office (contact information<br />

provided at the end of this article). Capitalized<br />

terms not defined in this article will take their meanings<br />

from the NRIPP Plan Document.<br />

DISQUALIFIED EMPLOYMENT<br />

Disqualified Employment is work on or after August 1,<br />

1990, with an employer in the Industry, including selfemployment,<br />

that does not have a CBA (1) with the<br />

International Union, (2) any subordinate labor organization<br />

affiliated with the International Union, or<br />

(3) any organization of building trades affiliated with<br />

an entity described in (1) or (2) that requires contributions<br />

to a pension plan maintained pursuant to the<br />

terms of such CBA. Disqualified Employment can be<br />

“cured” only once as noted below.<br />

If you work for a Contributing Employer, then<br />

you are not working in Disqualified Employment.<br />

A Contributing Employer is any employer, including<br />

local unions, required to make contributions to<br />

the Trust Fund, either by provisions of a CBA with<br />

the International Union or a written Participation<br />

Agreement with the Trustees.<br />

INDUSTRY<br />

The “Industry” means the industry that employs<br />

Employees engaged in work over which any Union<br />

has, or claims to have, jurisdiction, as set forth in the<br />

Constitution and By-Laws of the International Union.<br />

EFFECT OF DISQUALIFIED EMPLOYMENT<br />

If you work in Disqualified Employment that has<br />

not been cured, the following will occur:<br />

• Your early retirement benefit, if you are<br />

eligible for such benefit, will be further reduced<br />

from what it otherwise would have been;<br />

• Your beneficiary will not be eligible to receive<br />

a lump-sum death benefit upon your death<br />

before your benefit commencement date; and<br />

• You will not be eligible for a Disability<br />

Pension in the event of your “Total and<br />

Permanent” Disability.<br />

CURE<br />

You can eliminate the effects of Disqualified Employment,<br />

that is “cure” the effect of Disqualified Employment,<br />

and become eligible for full NRIPP benefits<br />

again if, after engaging in Disqualified Employment,<br />

you become employed in Covered Employment for a<br />

period of time such that contributions on your behalf<br />

with respect to at least 1,000 hours are required to<br />

be made to the NRIPP by one or more Employers.<br />

However, you may “cure” the effect of Disqualified<br />

Employment only once. If you again work in Disqualified<br />

Employment, the effects of the rule will again<br />

apply to you and no additional “cure” is available.<br />
