BSIA Briefing Security personnel operating in the retail sector are not only a vital form of protection against criminals, but also very often the first impression portrayed of a store’s brand. That being so, it’s critical that security personnel are well-trained, professional and presentable to ensure that losses are reduced and brand integrity constantly maintained. In the UK, private security personnel are regulated by the Security Industry Authority (SIA), an independent body reporting to the Home Secretary under the Terms and Conditions of the Private Security Industry Act 2001. The SIA issues licences to private security personnel who operate in the spheres of security guarding, door supervision, close protection, Cash and Valuables in Transit, Public Space Surveillance (CCTV), key holding and vehicle immobilisation. This ensures that those operating within the private security industry are ‘fit and proper’ and have undertaken the necessary training and achieved the required qualifications to do so. However, the current regulatory ambit doesn’t extend to the in-house security sector. In practice, this means that many retailers in the UK could be employing their own security staff who are not subject to the same licensing, training or qualification requirements as those employed by a private security company. Within the pages of the security Regulator’s In-House Licensing Review Outcome Report (published in May 2009), the recommendation is that: ‘There is no clearly defined or substantiated risk to public protection to be addressed and so we are unable, at this time, to make a case which would justify extending the SIA’s remit to include the licensing of inhouse security officers.’ Despite this, the report does acknowledge that there are two sides to the debate. First, the private security industry has long maintained that in-house security guarding should be subject to the same legislative and regulatory conditions to ensure there’s a level playing field. It has also been argued by the industry that, if the in-house sector was regulated, then a significant number of individuals would be unable to obtain an SIA licence. Furthermore, the in-house sector is subject to some form of regulation in other countries, among them the Republic of Ireland and France. Although many organisations employing inhouse security staff will have their own robust policies and procedures in place for the recruitment and training of security staff, it cannot be guaranteed that all are trained to the necessary level since there’s no legislative or regulatory requirement for them to be so. Showing Respect: Conducting Security Searches According to the 2016 Retail Crime Survey published in February by the British Retail Consortium, the cost of crime in the retail sector has continued to rise. As the first line of defence within many retail environments, security personnel have a key role to play in the fight against criminality. Here, James Kelly discusses how using high quality, professional security personnel can help to reduce both the financial and reputational impacts of crime for today’s businesses Respecting the individual Recently, the British Security Industry Association (BSIA) was asked to comment on the experience of a supermarket customer who had been stopped and searched in front of a crowd of other shoppers 1 . The experience left the woman involved feeling humiliated. The female concerned was also of the belief that she had been racially profiled. While retailers are perfectly within their rights to stop and question customers they suspect may be attempting to steal from their premises, they absolutely must have proper grounds for doing so, while any searches should be carried out with respect. To this end, the BSIA has published a Code of Practice for Security Searches 2 specifically for companies that offer a search service to customers (and would, in appropriate cases, be subject to the provisions of the Private Security Industry Act 2001), as well as businesses that directly employ in-house security staff.
