It reflects sunlight straight onto neighbouring Kazu Kano’s house. THE OIL company which sponsored Great Neighbours Awards has not proved very neighbourly. BP sponsored a national campaign “Great Neighbour Awards” last year designed to encourage neighbourliness. But Edgeware residents say BP is anything but neighbourly. When the Edgeware BP was allowed to expand, neighbours were told the effect on them would be “quite benign” and “less than minor.” Now, resident Kazu Kano’s view from his deck and study is of a 20m long, almost 5m high white wall, which reflects glare from the sun into his home. Residents have now accused the city council of abandoning them, after being told nothing could be done. They spent more than six months trying to fight the expansion, but it was approved by hearing commissioner David Mountfort. “I do not believe the redevelopment of the service station will cause the severity of effects the neighbours anticipate and will The Star in fact be quite benign,” he said in his ruling. But neighbour Rob Hull said yesterday Mr Mountfort got it wrong. “They got it wrong, so is there really no comeback? Surely council has a responsibility to mitigate the effect of the mistake they made,” he said. They asked BP to plant more trees and to paint the wall a different colour to reduce the glare. BP refused. City council head of building consenting John Higgins said it was too late to appeal the decision, and the city council did not have any more plans to meet with BP. Said Cr Cotter: “BP have come back and said no, they’re not David Mountfort Pauline Cotter going to do anything extra that the consent conditions did not require of them, and so that’s the end of it and there’s nothing anybody can do now.” She said there needed to be changes to the resource consent process to keep it from favouring businesses, and “get more compassion in the system.” Mr Hull said that was not good enough. “What I’d like to hear from Lianne Dalziel and Pauline is why didn’t you defend our residential amenity?” he said. “The council should have protected us and opposed the application but they didn’t, they recommended that it went ahead,so once they’ve done that it’s almost a done deal.” A city council spokeswoman said they were not able to get hold of Mayor Dalziel to respond to questions from The Star. BIG BOX: Established trees which used to line the fence were ripped out to make way for the new BP building, as part of the expansion. Cr Cotter said she had tried to advocate for the residents and had organised meetings for them, but she did not believe there was anything more she could have done. The resource consent hearing was kept limited, so while 37 neighbours signed a petition opposing the submission, only two were able to speak at the hearings. They also had limited funds, so while BP was able to bring in a team of lawyers and expert witnesses, the residents could not afford to. BP spokeswoman Shelley Brady said it had talked to neighbours about what colour to paint a fence, and offered to donate leftover gravel to them. “BP has gone above and beyond the consent requirements in order to support the numerous ad hoc requests that we continue to receive from neighbours,” she said. When asked if she agreed BP had been a bad neighbour in this case, she said: “We are committed to continuing our ongoing conversations with neighbours and the community and we will continue to work with them wherever we can reasonably do so.” Mr Hull responded: “Yeah that’s not right at all, they’ve been terrible. But that’s what we expected, our main bitch is with the council.” Is Hendo back in Sol Square? •From page 1 The main block, at 179 Tuam St, is on a 2157 sq m site and was originally insured for just under $14 million. Sol Square was originally developed by Mr Henderson as a hospitality, retail and accommodation precinct in the early 2000s, becoming one of the city’s most popular night spots. In 2009 and 2010 several companies connected with Mr Henderson were put into liquidation and six of his Sol Square bars were sold by receivers. Mr Henderson also declared bankruptcy in 2010. City councillor Jamie Gough said he hadn’t heard of the sale and was surprised by the news.
