Megan Bernard, Editor John Gately III, of Winnetka, entered a plea of not guilty to the August murder of his brother-in-law and attempting to kill his sister, plus dozens of other charges, in court on Sept. 25. Gately, 66, a New Trier graduate, was charged with one count of homicide for the killing of his brother-in-law Stephen Shapiro, 72, of Northfield, and one count of attempted homicide for trying to kill Joan Shapiro, Stephen’s wife and Gately’s sister, at their residence on Aug. 13. On Sept. 14, he was indicted on 80 total charges for the murder and attempted murder, plus home invasion, residential burglary, aggravated discharge of a firearm and aggravated unlawful restraint, among others, according to the case docket at the Circuit Court of Cook County. Preceding in front of Judge Michael J. Hood, Gately, wearing glasses and tan Department of Corrections scrubs, was arraigned and agreed that if he fails to appear, a trial will in his absence can be held. This is Gately’s fourth appearance in court. Details of the Northfield murder were disclosed at his Aug. 16 bonding hearing, where he was denied bail. At his second hearing, his Chicago-based attorney Michael J. Petro withdrew from the case after Gately was “indigent,” Petro previously told The Winnetka Current. Most recently, Gately — now represented by public defender David McMahon — was ordered to specimen collection for indictment. McMahon has not appeared in court yet, as Elizabeth Tarzia, the attorney supervisor from the public defender’s office, has substituted in for him. According to press release from Thursday, Sept. 27, the juvenile was charged with two felony counts of unlawful use of a weapon for possession of a handgun; one felony count of unlawful use of a weapon for possession of handgun ammunition; and one misdemeanor account of unlawful use of a firearm under 18. The juvenile was transferred to Cook County Juvenile Detention and a hearing date is pending. Ray Lechner, superintendent of Wilmette District 39, said in a letter sent out to parents Thursday afternoon, “It is with a heavy heart that I share with you an update I just received from our police chief. … The news is truly heartbreaking.” Lechner went on to say, “We continue to remind students to share important information they may see or hear. We are continuing the review of our safety practices and will be reporting on the results in the near future.” Later in the letter, Lechner added, “Our community has understandably been shaken by the incident, but please remember to this is an incredibly difficult time for the family.” On Sept. 16, a concerned parent of the student contacted the Wilmette Police after discovering loaded firearms in the child’s bedroom.
