Part IV, What Happens if My Pr<strong>of</strong>essional License is Sanctioned? This is the f<strong>in</strong>al article <strong>in</strong> a four part series address<strong>in</strong>g health pr<strong>of</strong>essional licensure <strong>in</strong>vestigations and adm<strong>in</strong>istrative actions <strong>in</strong> <strong>Michigan</strong>. In the first article, I presented how licens<strong>in</strong>g <strong>in</strong>vestigations are <strong>in</strong>itiated and the factors impact<strong>in</strong>g the Donna J. Craig, <strong>in</strong>itiation <strong>of</strong> a pr<strong>of</strong>essional RN, JD licensure <strong>in</strong>vestigation. <strong>The</strong> second article focused on a health care pr<strong>of</strong>essional’s rights when be<strong>in</strong>g <strong>in</strong>terviewed by an <strong>in</strong>vestigator from the Department <strong>of</strong> Licens<strong>in</strong>g and Regulatory Affairs, Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g. In the third article, important steps a health care pr<strong>of</strong>essional should take after an <strong>in</strong>vestigator’s <strong>in</strong>terview were discussed. In this f<strong>in</strong>al article I will discuss the health care pr<strong>of</strong>essional’s rights <strong>in</strong> defend<strong>in</strong>g aga<strong>in</strong>st an adm<strong>in</strong>istrative compla<strong>in</strong>t, should one be issued, possible outcomes to the health care pr<strong>of</strong>essional, and the report<strong>in</strong>g <strong>of</strong> any sanctions that may be imposed. Once an <strong>in</strong>vestigation is completed, the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g makes a determ<strong>in</strong>ation as to whether the health care pr<strong>of</strong>essional’s actions or <strong>in</strong>actions violated <strong>Michigan</strong>’s public health code. Follow<strong>in</strong>g its review, the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g may take any number <strong>of</strong> actions <strong>in</strong>clud<strong>in</strong>g: clos<strong>in</strong>g the file if the <strong>in</strong>vestigation did not show a violation <strong>of</strong> the public health code; issu<strong>in</strong>g a formal adm<strong>in</strong>istrative compla<strong>in</strong>t; summarily suspend<strong>in</strong>g a health care pr<strong>of</strong>essional’s license if the public’s health, safety, or welfare requires emergency action; or issue a cease and desist order requir<strong>in</strong>g a health care pr<strong>of</strong>essional to cease a particular conduct. Except when no adm<strong>in</strong>istrative action is taken and the file is closed, the health care pr<strong>of</strong>essional must respond to an adm<strong>in</strong>istrative compla<strong>in</strong>t, cease and desist order, or a summary suspension. If the health care pr<strong>of</strong>essional does not respond with<strong>in</strong> 30 days, he/she loses the right to object to the allegations and is deemed to agree with statements and allegations set forth <strong>in</strong> the adm<strong>in</strong>istrative compla<strong>in</strong>t, and the basis for the summary suspension or cease and desist order. While it can be emotional and disturb<strong>in</strong>g to discover that an adm<strong>in</strong>istrative action has been issued, it is very important that the health care pr<strong>of</strong>essional does not lose his/her rights by delay<strong>in</strong>g or procrast<strong>in</strong>at<strong>in</strong>g <strong>in</strong> respond<strong>in</strong>g with<strong>in</strong> the 30 day period. When a health care pr<strong>of</strong>essional receives an adm<strong>in</strong>istrative compla<strong>in</strong>t he/she is given the opportunity to request a compliance conference where the health care pr<strong>of</strong>essional is given the opportunity to show why the adm<strong>in</strong>istrative compla<strong>in</strong>t is <strong>in</strong>accurate or why his/her actions do not violate the public health code. <strong>The</strong> compliance conference is also the time to discuss a possible resolution. Even if the compliance conference results <strong>in</strong> a proposed resolution, it is not f<strong>in</strong>al until the matter is approved by the full board’s discipl<strong>in</strong>ary subcommittee. Individuals present at a compliance conference are a Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g representative, a member <strong>of</strong> the respective licensure board, the health care pr<strong>of</strong>essional, and his/her attorney. If, at the compliance conference, there is no resolution or the health care pr<strong>of</strong>essional disagrees with the proposed resolution, the health care pr<strong>of</strong>essional has the right to an adm<strong>in</strong>istrative hear<strong>in</strong>g before an adm<strong>in</strong>istrative law judge. At the adm<strong>in</strong>istrative hear<strong>in</strong>g, the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g and the health care pr<strong>of</strong>essional have the ability to call witnesses, cross exam the other’s witnesses, <strong>in</strong>troduce evidence, etc. <strong>The</strong> adm<strong>in</strong>istrative law judge determ<strong>in</strong>es if there are grounds for discipl<strong>in</strong>ary action after hear<strong>in</strong>g and view<strong>in</strong>g testimony and evidence. At the conclusion <strong>of</strong> the adm<strong>in</strong>istrative hear<strong>in</strong>g, the adm<strong>in</strong>istrative law judge prepares a memorandum cit<strong>in</strong>g his/ her f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> the facts and conclusions related to the applicable law. This memorandum is then transmitted to the appropriate board’s discipl<strong>in</strong>ary subcommittee. <strong>The</strong> adm<strong>in</strong>istrative law judge does not recommend or impose penalties. Similarly, if the health care pr<strong>of</strong>essional receives a cease and desist order or a summary suspension <strong>of</strong> his/her license, the health care pr<strong>of</strong>essional also has the ability to request an adm<strong>in</strong>istrative hear<strong>in</strong>g to determ<strong>in</strong>e if there are valid grounds for a cease and desist order or summary suspension. <strong>The</strong> same adm<strong>in</strong>istrative hear<strong>in</strong>g process occurs before an adm<strong>in</strong>istrative law judge, who will also prepare a memorandum his/her f<strong>in</strong>d<strong>in</strong>gs and conclusions on the applicable law, which will be submitted to the appropriate board’s discipl<strong>in</strong>ary subcommittee. If an adm<strong>in</strong>istrative compla<strong>in</strong>t, cease and desist order or summary suspension is not dismissed, the board’s discipl<strong>in</strong>ary subcommittee may impose one or more sanctions aga<strong>in</strong>st the health care pr<strong>of</strong>essional. <strong>The</strong> range <strong>of</strong> sanctions <strong>in</strong>cludes: • Reprimand • 1-2 year probation period with quarterly reports from a supervisor • Plac<strong>in</strong>g a limitation on the pr<strong>of</strong>essional license • Suspension <strong>of</strong> a pr<strong>of</strong>essional license • Revocation <strong>of</strong> a pr<strong>of</strong>essional license • Payment <strong>of</strong> restitution • Imposition <strong>of</strong> a f<strong>in</strong>e In addition to the aforementioned sanctions, if there is an issue <strong>of</strong> mental or physical impairment or substance use disorder by the health care pr<strong>of</strong>essional, at any time dur<strong>in</strong>g the adm<strong>in</strong>istrative process either the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g, discipl<strong>in</strong>ary subcommittee or an adm<strong>in</strong>istrative law judge may require the health care pr<strong>of</strong>essional to complete an education program, tra<strong>in</strong><strong>in</strong>g program, treatment program, and/or mental, physical, or pr<strong>of</strong>essional competence exam<strong>in</strong>ation. After an adm<strong>in</strong>istrative discipl<strong>in</strong>ary action becomes f<strong>in</strong>al, the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g publishes a list <strong>of</strong> discipl<strong>in</strong>ed health care pr<strong>of</strong>essionals. In addition, the Department <strong>of</strong> Community Health reports discipl<strong>in</strong>ary actions to appropriate licensed health facilities and agencies. On an annual basis the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g also transmits the list to the library <strong>of</strong> <strong>Michigan</strong> and each county clerk <strong>in</strong> the state. It is important that all health care pr<strong>of</strong>essionals know that if any sanction is imposed by a board’s discipl<strong>in</strong>ary subcommittee, the sanction is posted on the <strong>in</strong>dividual’s licens<strong>in</strong>g page and is visible to the public and any future employer who is consider<strong>in</strong>g the employment <strong>of</strong> the health care pr<strong>of</strong>essional. <strong>The</strong> sanction rema<strong>in</strong>s a permanent part <strong>of</strong> the health care pr<strong>of</strong>essional’s licens<strong>in</strong>g <strong>in</strong>formation which is posted on the Bureau <strong>of</strong> Pr<strong>of</strong>essional Licens<strong>in</strong>g’s website. Sanctions are also reported to a national database. Due to the potential that an <strong>in</strong>cident can result <strong>in</strong> a licensure <strong>in</strong>vestigation, adm<strong>in</strong>istrative action, and ultimate sanction, it is important that health care pr<strong>of</strong>essionals know and exercise their rights if faced with a licensure <strong>in</strong>vestigation or adm<strong>in</strong>istrative action.
