ABUJA—THE Senate<br />

has begun the process<br />

of overrid<strong>in</strong>g President<br />

Muhammadu <strong>Buhari</strong>’s<br />

veto on the Constitution of<br />

the Federal Republic of<br />

Nigeria, 1999(Fourth<br />

Alteration, No.28) Bill,<br />

2018.<br />

It was one of the bills the<br />

President had decl<strong>in</strong>ed<br />

assent to out of the several<br />

bills that were passed by<br />

the National Assembly and<br />

forwarded to him to sign<br />

<strong>in</strong>to law.<br />

Also yesterday, five other<br />

constitution amendment<br />

bills earlier rejected by the<br />

President, passed second<br />

read<strong>in</strong>g.<br />

They <strong>in</strong>clude the<br />

Petroleum Industry<br />

Governance Bill, 2019;<br />

National Institute for<br />

Hospitality and Tourism<br />

Bill, 2019; National<br />

Research and Innovation<br />

Council Bill, 2019; Stamp<br />

Duties Act (Amendment)<br />

Bill, 2019; National<br />

Agricultural Seed Council<br />

Bill, 2019; Agricultural<br />

Credit Guarantee Scheme<br />

Fund (Amendment) Bill,<br />

2019; and Independent<br />

National Electoral<br />

Commission, INEC Act<br />

(Amendment)Bill, 2019.<br />

Unlike the budget<br />

timel<strong>in</strong>e bill, the five other<br />

bills will be presented to the<br />

President for assent.<br />

President <strong>Buhari</strong> had<br />

and they will be forwarded<br />

to the House of<br />

Representatives for<br />

the 1999 Constitution by<br />

mak<strong>in</strong>g it mandatory for the<br />

president and governor of<br />

a state to lay the annual<br />

budget estimates before<br />

parliament, three months to<br />

the end of a f<strong>in</strong>ancial year.<br />

It will be recalled that<br />

President <strong>Buhari</strong> had <strong>in</strong><br />

2018 decl<strong>in</strong>ed assent to the<br />

constitution amendment<br />

bill on the grounds that<br />

Section 2 (b) and 3 (b) of<br />

the proposal ‘appear not to<br />

take full cognisance of the<br />

provisions of Section 58 (4)<br />

of the 1999 constitution.’<br />

The move to override<br />

President <strong>Buhari</strong>’s veto was<br />

sequel to Senate<br />

consideration and adoption<br />

of the report of the Senator<br />

David Umaru (APC, Niger<br />

East) led Technical<br />

Committee on Decl<strong>in</strong>ed<br />

Assent to bills by the<br />

President.<br />

While reject<strong>in</strong>g the<br />

President’s submission, the<br />

Umaru-led panel had<br />

posited that the bill was not<br />

<strong>in</strong> conflict with the 1999<br />

constitution, as claimed by<br />

the President.<br />

The purpose of the bill, the<br />

Committee expla<strong>in</strong>ed, was<br />

to ensure that Nigeria<br />

reverts to the January to<br />

December budget cycle.<br />

“It should be understood<br />

that this Bill seeks to make<br />

it mandatory for Mr.<br />

President and Governor of<br />

a State to cause to be<br />

prepared and laid before<br />

parliament, estimates of the<br />

revenues and expenditure<br />

of the federation for the<br />

next f<strong>in</strong>ancial year, not later<br />

than 90 days to the end of<br />

a f<strong>in</strong>ancial year. And for the<br />

parliament to pass the<br />

Appropriation Bill before<br />

the commencement of the<br />

next f<strong>in</strong>ancial year.<br />

“The legislative <strong>in</strong>tent<br />

beh<strong>in</strong>d this Bill Is to ensure<br />

that we run a normal<br />

f<strong>in</strong>ancial year. From the<br />

word<strong>in</strong>gs of the provisions,<br />

there was no stipulation<br />

that Mr. President must<br />

assent to any Bill with<strong>in</strong> a<br />

specified period.”<br />

the session, referred the<br />

bills to the Committee on<br />

Constitutional Review.<br />

...passes Police<br />

Reform Bill,<br />

approves s<strong>in</strong>gle<br />

5-year tenure for<br />

IGP<br />

Senate yesterday, also<br />

passed the Police Reform<br />

Bill, approv<strong>in</strong>g a statutory<br />

five year S<strong>in</strong>gle term for the<br />

Inspector - General of<br />

Police, IGP.<br />

The Senate <strong>in</strong> provid<strong>in</strong>g<br />

for five year s<strong>in</strong>gle tenure<br />

for any IGP appo<strong>in</strong>ted, said<br />

that the tenure of such an<br />

office is statutory not<br />

withstand<strong>in</strong>g his or her<br />

retirement age.<br />

The Senate has also<br />

approved a jail term of two<br />

years and a f<strong>in</strong>e of<br />

N1million for a Police officer<br />

found guilty of be<strong>in</strong>g<br />

<strong>in</strong>volved <strong>in</strong> extra- judicial<br />

kill<strong>in</strong>g.<br />

The Senate also approved<br />

a two year jail term or N5m<br />

f<strong>in</strong>e as punishment for any<br />

impersonator as Policeman<br />

or Police officer, while<br />

discipl<strong>in</strong>ary<br />

is<br />

recommended for any<br />

Police officer who brutalises<br />

or killed an <strong>in</strong>nocent<br />

citizen.<br />

The Bill was read the<br />

third time and passed.<br />

Accord<strong>in</strong>g to the Senate,<br />

appo<strong>in</strong>tment of such an<br />

officer as Inspector General<br />

of Police, will also be<br />

subjected to confirmation of<br />

the Upper Legislative<br />

Chamber as it is for all<br />

service chiefs, Chief Justice<br />

of Nigeria, CJN, M<strong>in</strong>isters,<br />

Ambassadors, Heads of<br />

Statutory Commissions and<br />

Agencies .<br />

The passage of the Bill for<br />

an Act to repeal the Police<br />

Act CAP P19 laws of the<br />

Federation of Nigeria, 2004<br />

and enact the Nigeria Police<br />

Act, 2019 to provide for the<br />

framework for the Police<br />

Service and ensure<br />

cooperation and<br />

partnership between the<br />

Police and communities <strong>in</strong><br />

ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g peace and<br />

combat<strong>in</strong>g crime and for<br />

related matters, was sequel<br />

to the consideration of the<br />

report of the Police Affairs<br />

Reform Bill, 2019(SB.683)<br />

as presented by the<br />

High Court sitt<strong>in</strong>g <strong>in</strong><br />

Lagos, yesterday,<br />

dismissed a suit by<br />

Spectrum Wireless<br />

Communications Limited<br />

aga<strong>in</strong>st Emerg<strong>in</strong>g Markets<br />

Telecommunications<br />

Services, EMTS, owners of<br />

9mobile, challeng<strong>in</strong>g the<br />

sale of the company.<br />

Trial judge, Justice CJ<br />

Aneke <strong>in</strong> a rul<strong>in</strong>g on the<br />

prelim<strong>in</strong>ary objections by<br />

counsel to EMTS upheld<br />

the defendant’s argument<br />

that there was no direct<br />

sharehold<strong>in</strong>g relationship<br />

between Spectrum<br />

Wireless and EMTS,<br />

thereby vest<strong>in</strong>g on<br />

Spectrum the right to sue<br />

EMTS to protect its alleged<br />

sharehold<strong>in</strong>g <strong>in</strong> EMTS.<br />

The court also upheld the<br />

defendant’s position that<br />

there is no privity of contract<br />

between EMTS and<br />

Spectrum as Spectrum is<br />

not a shareholder <strong>in</strong> EMTS<br />

and cannot be said to have<br />

been directly affected by the<br />

actions of its shareholders;<br />

The court further held<br />

that the defendant’s<br />

position that if at all<br />

Spectrum has a right of<br />

company it orig<strong>in</strong>ally<br />

<strong>in</strong>vested <strong>in</strong> and not EMTS.<br />

The court consequently<br />

upheld the submission of<br />

counsel to EMTS that not<br />

be<strong>in</strong>g a shareholder of<br />

EMTS, Spectrum lacks the<br />

locus standi to br<strong>in</strong>g the<br />

suit aga<strong>in</strong>st EMTS on the<br />

basis of any decision taken<br />

by the shareholders of<br />

EMTS.<br />

The court therefore,<br />

upheld the defendant’s<br />

argument that Spectrum<br />

lacks the locus standi to<br />

sue, add<strong>in</strong>g that the<br />

concept of “<strong>in</strong>direct<br />

sharehold<strong>in</strong>g/economic<br />

<strong>in</strong>terest” claimed by<br />

Spectrum is unknown to<br />

Nigerian law, which only<br />

recognises members of a<br />

company as those named<br />

<strong>in</strong> its Register of Members.<br />

Kassim Shettima threw his<br />

weight beh<strong>in</strong>d the Senate<br />

Leader, Senator Ahmad<br />

Lawan (APC, Yobe North)<br />

for the Senate Presidency<br />

<strong>in</strong> the 9th Senate, some<br />

concerned citizens of the<br />

state, yesterday, said that<br />

the governor was on his<br />

own.<br />

A statement yesterday <strong>in</strong><br />

Abuja by Yakubu Umar,<br />

spokesman and on behalf<br />

of Concerned Borno<br />

Citizens, said: “It is rather<br />

surpris<strong>in</strong>g that while the<br />

state is count<strong>in</strong>g on the<br />

governor’s support for<br />

Senator Ndume, he is<br />

clearly seen work<strong>in</strong>g<br />

aga<strong>in</strong>st the aspiration.<br />

N8.83 trillion budget report<br />

Similarly, the House at<br />

the plenary also called on<br />

the Federal Government to<br />
