THE COSTA BLANCA<br />

has been out in force at<br />

this week’s World Travel<br />

Market fair in London,<br />

with a one point six million<br />

euro plan unveiled<br />

by Valencian president<br />

Ximo Puig to deal with<br />

any negative effects<br />

caused by Brexit.<br />

Puig had talks with<br />

British tour operators<br />

and with representatives<br />

of the Association<br />

of British Travel Agents<br />

(ABTA), as he launched<br />

what he dubbed as his<br />

“Anti-Brexit Plan”,<br />

though no actual breakdown<br />

of the expenditure<br />

was produced.<br />

The president said the<br />

plan included having a<br />

strong presence this week<br />

for the Costa Blanca at<br />

the fair, with a number<br />

of councils from across<br />

the region represented including<br />

Benidorm, Altea,<br />

<strong>Alicante</strong>, Guardamar, and<br />

Torrevieja.<br />

Puig also said that as<br />

part of the plan, the Valencian<br />

government is<br />

to have a meeting with<br />

tour operators and local<br />

chambers of commerce<br />

on December 3rd to push<br />

forward with a strategy,<br />

which would also include<br />

promoting the Costa<br />

Blanca as a winter holiday<br />

destination.<br />

He also pointed to record-breaking<br />

figures for<br />

passengers flying into <strong>Alicante</strong>-Elche<br />

airport, and<br />

the upward turn in foreign<br />

tourist numbers choosing<br />

the Valencian region as a<br />

holiday destination.<br />

Other snippets from<br />

the World Travel Market<br />

included the news that<br />

ABTA are to hold their<br />

BRITAIN!<br />

annual conference in Benidorm<br />

in 2021, and that operator<br />

Jet2 have said that their<br />

UK bookings for packages to<br />

the Costa Blanca for next year<br />

have already shown a six per<br />

cent rise on this year’s figures.

Summit moves to Spain<br />

THE offices of Pensions Life<br />

have issued the following<br />

statement to people affected<br />

by the collapse of Continental<br />

Wealth Management (CWM)<br />

and that are currently seeking<br />

legal redress.<br />

“It is now confirmed that Pension<br />

Life's lawyer, Antonio Bertomeu<br />

of Bertomeu Abogados in<br />

Denia, will be taking over the<br />

case of the three complainants<br />

against Continental Wealth Management<br />

(Trust); Jody Smart;<br />

Darren Kirby and Alan Gorringe.<br />

This case is a much simpler<br />

AFTER increasingly violent anti-government<br />

protests in Chile<br />

forced the country to step<br />

down from hosting COP25, the<br />

climate summit conference,<br />

Spain’s offer to stage it has<br />

been accepted.<br />

The high profile event will now be<br />

in Madrid from 2 to 13 December.<br />

This has thrown up some problems,<br />

not least for one of the highest<br />

profile attendees, Swedish<br />

teenager and activist Greta Thunberg<br />

who was travelling by boat<br />

and train to Santiago and now has<br />

to completely reroute and make<br />

her way to Madrid.<br />

Ms Thunberg refuses to use<br />

more obvious forms of transport<br />

such as flying and has asked if<br />

anyone can “give her a lift” in a<br />

low carbon fashion.<br />

change – think they may struggle<br />

to get here with new visas, transport<br />

and accommodation being<br />

In turn they worry that the<br />

western countries will be disproportionately<br />

an agenda that suits their high<br />

carbon style of existence.<br />

New lawyer for financial scandal victims<br />

fraud and the judge will not have<br />

any difficulty coming to a decision.<br />

However, the 17-lead-case<br />

matter is considerably more complex<br />

and the judge had held back<br />

her acceptance of the case pending<br />

hearing the testimony of the<br />

defendants in the former case.<br />

This is extremely good news for<br />

all existing and future complainants<br />

as it means that Antonio will<br />

be able to have a dialogue with<br />

the judge to explain the parallels,<br />

similarities and differences between<br />

the two cases.<br />

Antonio will be preparing a short<br />

statement after his formal appointment<br />

tomorrow and we will be forwarding<br />

this on to all members.”<br />

THE BRITISH embassy in<br />

Madrid has been told by the<br />

Spanish authorities about<br />

a new quick appointment<br />

system for people trying to<br />

get a residencia certificate<br />

in <strong>Alicante</strong> Province.<br />

A “next day” online booking<br />

service has been created<br />

in <strong>Alicante</strong> City, with 180<br />

appointments being opened<br />

up every day, with British<br />

officials saying that there is<br />

a lot of availability each day.<br />

It means anybody can take<br />

advantage of the new resource<br />

in <strong>Alicante</strong>, as opposed<br />

to going to the police stations<br />

in Orihuela, Torrevieja,<br />

Denia and Benidorm.<br />

The additional opening<br />

can also be used to apply<br />

for "caracter permanente" if<br />

you have been a resident for<br />

more than five years.<br />

Four decades<br />

of caring<br />

Reduced pension options for non-UK residents<br />

I have been advising in Spain now<br />

for over 7 years, and during this<br />

time have seen many changes to<br />

pension rules. The biggest change<br />

by far was the introduction of<br />

Pension freedoms in 2015, where<br />

people now have the option to<br />

access their pension from 55 and<br />

essentially have the flexibility to<br />

take what they want, when they<br />

want it.<br />

Pension Freedoms extended to<br />

expats living here in Spain and I<br />

have sat down with hundreds of<br />

clients over the years and discussed<br />

their individual pension plans and<br />

advised them on their options.<br />

About a month ago, I sat down<br />

with a client who had a personal<br />

pension with Aegon. She has lived<br />

in Spain for many years and she<br />

contacted me as she was reaching<br />

retirement age and wanted to<br />

understand what her options were<br />

and how she went about accessing<br />

her pension. At the meeting she<br />

completed a letter of authority<br />

which allowed me to contact her<br />

pension company on her behalf<br />

and discuss her specific plan.<br />

When I received the information<br />

back from them I was shocked<br />

to understand that because<br />

she is a ‘non-UK resident’ her<br />

options were limited to either<br />

take the pension in full (her<br />

pension was over £100k so<br />

the tax implications would be<br />

catastrophic), to purchase an<br />

annuity (something which we<br />

wouldn’t advise with annuity<br />

rates so low), or to transfer to<br />

a different scheme. She had<br />

no option to leave her pension<br />

where it was and access it<br />

flexibly. I was convinced that<br />

they’d made a mistake so called<br />

them for clarification, and during<br />

the phone call, they confirmed<br />

that the member had limited<br />

options as she was a non-UK<br />

resident.<br />

This member had planned her<br />

whole retirement based on her<br />

having flexible access to her<br />

pension, so it potentially changed<br />

her entire future plans. For this<br />

client, I was able to find a solution<br />

by moving her pension to a UK<br />

based pension called a SIPP,<br />

where she could not only benefit<br />

from having a local adviser here in<br />

Spain, but also it meant she could<br />

take advantage of full flexible<br />

access.<br />

This is not an isolated incident,<br />

and we’re seeing more and more<br />

schemes effectively refusing to<br />

give ongoing service to non-<br />

UK residents, meaning our only<br />

option is often to transfer them to<br />

a scheme that will allow non-UK<br />

residents.<br />

My advice to anyone with a<br />

pension that they are yet to<br />

access is to understand what<br />

options are available to non-UK<br />

residents. Whether you contact<br />

the scheme direct, or instruct a<br />

financial adviser to do so, do it<br />

sooner rather than later so you<br />

DENIA’S Santa Lucia Residence<br />

for the elderly is<br />

one of only two in the Marina<br />

Alta that is run by the<br />

town hall and celebrates<br />

its 40th anniversary this<br />

month.<br />

There are a number of<br />

events to celebrate this, with<br />

the highlight being a specially<br />

made documentary<br />

showing the history of the<br />

centre from its founding by<br />

Carmelite nuns to the present<br />

day where 130 people<br />

use the service.<br />

Events down the year include<br />

100th birthday parties<br />

and even a wedding, all<br />

featured in the film which<br />

will be shown at the centre<br />

on 21 November followed by<br />

snacks and drinks.<br />

There will also be an exhibition<br />

in the Casa de la Cultura<br />

Rafa’s Valencia move<br />

TENNIS STAR Rafa Nadal is<br />

to launch a new centre for<br />

needy children in Valencia<br />

City this month, as part of<br />

his charitable foundation.<br />

It has taken three months<br />

to renovate the councilowned<br />

building in the Natzaret<br />

area of the city, which<br />

has serious social exclusion<br />

problems, with the Nadal<br />

Foundation offering it as a<br />

centre for 40 children.<br />

It will not be a residential<br />

centre, but will offer day<br />

facilities including meals,<br />

hands-on play, and child<br />

counselling.<br />

This is the Foundation's<br />

second centre of its type,<br />

with the first one opened<br />

on Nadal’s home island of<br />

Mallorca five years ago,<br />

with a good track record of<br />

success helping hundreds<br />

of children.<br />

forward and take the Mallorca<br />

experience to Valencia,<br />

where we have detected a<br />

specific need in the Natzaret<br />

the Foundation, who married<br />

Nasty tricks, not treats<br />

FOUR CHILDREN who decided to celebrate<br />

Halloween last week by setting<br />

fire to rubbish containers in Torrevieja,<br />

including using a home-made<br />

Molotov cocktail, were arrested by<br />

the Guardia Civil.<br />

The teenagers, aged 16 and 17, decided<br />

to dress up in black clothes and<br />

rather than opting TO throw eggs, they<br />

decided to go on a fire spree around<br />

Nueva Torrevieja.<br />

The Guardia were tipped off about<br />

the fire-raising kids late last Thursday<br />

night, who even videoed their misdeeds<br />

on their mobile phones.<br />

As Guardia officers swooped on them,<br />

the teens tried to unsuccessfully escape<br />

from their clutches, and one of them tried<br />

in vein to erase his mobile phone footage<br />

which featured him carrying a petrol can<br />

and throwing a Molotov cocktail.<br />

CCTV of knifeholding<br />

robber<br />

Bank stick up<br />

TWO MEN have been<br />

arrested over a robbery<br />

at an Orihuela<br />

City bank in mid-October,<br />

and locking a bank<br />

teller in the bathroom.<br />

Details of the incident<br />

only emerged this<br />

week, with the robbery<br />

happening on Thursday<br />

October 17th.<br />

A man entered the<br />

unnamed bank branch<br />

and brandished a gun in<br />

front of a male bank employee,<br />

who gave them<br />

12 thousand euros from<br />

the safe, and then he<br />

was locked in the bathroom,<br />

as the robber then<br />

beat a hasty retreat.<br />

The Spanish nationals,<br />

aged 32 and 63, were<br />

detained by the National<br />

Police 11 days later,<br />

with one of them refused<br />

bail by an Orihuela<br />

court.<br />

Arrested robber<br />

Vicious duo caught<br />

TWO VIOLENT robbers<br />

have been arrested by<br />

the Guardia Civil, after a<br />

spate of shop hold-ups<br />

on the Orihuela Costa and<br />

Torrevieja.<br />

The men, who are Spanish<br />

and middle-aged, have been<br />

charged with ten offences, including<br />

five counts of robbery<br />

with violence.<br />

Last month saw the duo<br />

strike in four businesses,<br />

namely a chemist, a realestate<br />

agency, a hairdressing<br />

salon, and an electrical<br />

dealership.<br />

The spate of robberies created<br />

real concern amongst<br />

business owners, with the<br />

men brazenly entering the<br />

various premises during<br />

regular shopping hours.<br />

The duo would threaten<br />

sales staff with a knife and demand<br />

any money or valuables<br />

that were on the premises.<br />

The crooks, who wore hoodies,<br />

would also ask for car<br />

keys and the PIN number of<br />

any bank cards.<br />

The Guardia Civil in Pilar<br />

de la Horadada took charge<br />

of the investigation, and using<br />

witness statements and<br />

CCTV footage, they managed<br />

over a few days to pin<br />

down where the men where,<br />

close to a shopping area,<br />

but the second man was detained<br />

It was discovered that he<br />

had been on the run from<br />

a Madrid jail for over five<br />

months, after failing to return,<br />

having been given a<br />

day release pass.<br />

He had been the subject of<br />

over 50 criminal charges, and<br />

once on the run with the help<br />

of his accomplice, the Guardia<br />

discovered they were behind<br />

other crimes further north in<br />

<strong>Alicante</strong> Province, including<br />

stealing a car in Novelda.<br />

SANTA POLA council says<br />

that 13 thousand mattresses<br />

containers, or simply thrown<br />

into roads”, added Ramirez.<br />

“We at first thought it was<br />

residents coming to their<br />

summer homes that were<br />

changing their mattresses,<br />

but the sheer numbers involved<br />

means that simply is<br />

not the case”.<br />

Delays earlier this year in<br />

applying for a residencia have<br />

been largely cleared up, with<br />

a new quick appointment service<br />

introduced in <strong>Alicante</strong><br />

City, and the good news is that<br />

in the south of <strong>Alicante</strong> Province,<br />

more appointments are<br />

available in Orihuela City.<br />

To get an <strong>Alicante</strong> City<br />

appointment, you need the<br />

following requirements:-<br />

1. If you are pensioner, you<br />

need your state pension<br />

paid directly into a Spanish<br />

account, which has<br />

been used on a regular<br />

basis for three months,<br />

ahead of applying for a<br />

residencia. You also need<br />

a S-1 certificate.<br />

2. If you are not working,<br />

you need a seven thousand<br />

euro average balance<br />

per person in your<br />

Spanish account over the<br />

last three months.<br />

3. Married dependant applicants<br />

without their own<br />

health care provision or<br />

financial means will need<br />

an up-to-date marriage<br />

certificate(no older than<br />

three months from the<br />

issue date) plus a legal<br />

translation from a Spanish-registered<br />

translator.<br />

Don’t forget that you<br />

should apply for a Spanish<br />

residency card if:<br />

• You’ve spent more than<br />

90 days in Spain.<br />

• You want to be legal in<br />

Spain.<br />

• You want to be legible for<br />

the Spanish healthcare<br />

system.<br />

Let’s examine those three<br />

points in more detail.<br />

EXTRA TIME FOR RESIDENCIAS<br />

You’re staying in Spain<br />

for over 90 days<br />

It’s all down to the law, and<br />

clearly states that if you<br />

spend more than 90 days in<br />

a 180 day period in Spain<br />

(or any other country in the<br />

Schengen area), then you<br />

must apply for a residency<br />

card, which in effect is a stay<br />

permit. The embassies of<br />

the EU have stipulated that<br />

as long as no other citizens<br />

from the Schengen area are<br />

obliged to obtain a Visa for<br />

the UK, then British citizens<br />

will have a reciprocal agreement<br />

to not require a Visa for<br />

the Schengen zone, but the<br />

90 day rule will still apply.<br />

If you are from the UK,<br />

the Brexit issue is clouding<br />

the waters, but essentially<br />

you have to get yourself covered<br />

with a residencia, pure<br />

and simple, and we at Sun<br />

Lawyers can get that sorted<br />

for you and your partner and<br />

family.<br />

The proposed UK-EU withdrawal<br />

agreement allows<br />

residencias to continue, but<br />

they will then be swapped<br />

over to a different card, which<br />

the Spanish government said<br />

earlier this year would be a<br />

straight-forward process.<br />

That looks like being the<br />

case as well in a no-deal Brexit<br />

scenario according to Madrid,<br />

but you must get a residencia<br />

right now, and time is<br />

ticking by quickly, with under<br />

three months to go before the<br />

new January deadline.<br />

You want to be legal<br />

in Spain<br />

This is a simple matter of<br />

“peace of mind”, as doing everything<br />

according to Spanish<br />

rules can only bring benefits,<br />

and Sun Lawyers have the expertise<br />

to tell you what’s what!<br />

As an example, an EU person<br />

that is residing in Spain,<br />

once you have obtained your<br />

Spanish residency card, you<br />

then you have a period to<br />

switch your EU licence for a<br />

Spanish driving licence.<br />

Yes, EU driving licences are<br />

valid in Spain (as long as they<br />

have not expired), but since it<br />

looks likely that the UK will<br />

be leaving soon the EU, then<br />

you will see on the British<br />

Consulate website a recommendation<br />

that if you are resident<br />

in Spain, you need to stay<br />

within the law and swap over<br />

to a Spanish licence, rather<br />

than going through all kinds<br />

of hassles, some of which could<br />

cost you time and money.<br />

That’s just one example<br />

over being legal, and we<br />

at Sun Lawyers have the<br />

checklist that you need to<br />

make sure that you will be<br />

fine for many years to come.<br />

You want to use the<br />

Spanish healthcare<br />

system<br />

Essentially there are two<br />

main categories here:<br />

• Limited and temporary<br />

healthcare in Spain. At<br />

present, this must be done<br />

through the EHIC health<br />

card, but this does not include<br />

ongoing treatments<br />

and as, yet no bi-lateral<br />

agreement has been<br />

signed to continue with<br />

this for UK citizens once<br />

the UK leaves the EU.<br />

• Permanent all-inclusive<br />

healthcare in Spain. Right<br />

now, state pensioners<br />

from other EU member<br />

states can transfer their<br />

rights to health care from<br />

their country of origin<br />

with the S1, E121 & E106.<br />

In the future, we will see<br />

if it is still the case for UK<br />

citizens, depending on negotiations<br />

between UK<br />

and Spain in the case of a<br />

no-Brexit deal and what<br />

future deals are struck<br />

with the EU.<br />

Requirements for nonworkers<br />

and early retirees<br />

to qualify is to have proof<br />

of Spanish residence during<br />

at least a year and then<br />

they can begin contributions<br />

(Convenio Especial).<br />

by the Royal Naval Association<br />

Torrevieja Branch<br />

at their annual Trafalgar<br />

Night celebration, on the<br />

21st October 2019, at the<br />

MASA Hotel in Torrevieja.<br />

The RNA Torrevieja<br />

branch members were honoured<br />

that WWII veteran<br />

Joe Billet joined them and<br />

privileged to have a significant<br />

contingent of guests,<br />

families and friends.<br />

Veterans and current serving<br />

personnel of the Royal<br />

Navy and Royal Marines<br />

with their partners, friends<br />

and guests dined and danced<br />

to live music by the Campoverde<br />

Reef Band, maintained<br />

Naval Traditions and<br />

socialised on a grand scale<br />

during the evening; where<br />

there was much merriment,<br />

'swinging of the lamp' and<br />

'black cat stories'; otherwise<br />

known as 'stories and<br />

Ambassador’s<br />

message<br />

THE UK ambassador to<br />

Spain, has penned an<br />

open letter to British residents<br />

with the latest on<br />

Brexit, now that the October<br />

31st departure date<br />

has slipped by.<br />

Hugh Elliott, who has<br />

been in post for nearly three<br />

months, has also emphasised<br />

the need for expats to<br />

make sure that they are registered<br />

to vote in December’s<br />

UK general election.<br />

These are the contents of<br />

Elliott’s letter:-<br />

“You will all have seen<br />

that the EU has agreed the<br />

UK’s request for a further<br />

extension. This means that<br />

the UK will not now be<br />

leaving the EU on the 31st<br />

of October. The extension<br />

sets a new deadline of the<br />

31st of January 2020.”<br />

“I met with some of the<br />

citizens’ rights groups last<br />

week in Madrid and we<br />

talked about recent developments,<br />

about the continuing<br />

feeling of uncertainty and<br />

about the concerns of British<br />

nationals living in Spain.”<br />

“The three month extension<br />

removes the immediate<br />

which protects citizens’ rights<br />

“For as long as we remain<br />

as resident in Spain and registered<br />

for healthcare. And<br />

to ensure that you have exchanged<br />

your driving licence<br />

and checked your passport<br />

validity.”<br />

election will be held on the<br />

12th of December. If you are<br />

For ‘Peat’s<br />

Sake’ make<br />

the change<br />

GARDENERS are being<br />

urged to change their<br />

growing habits and ditch<br />

the use of peat to protect<br />

the planet.<br />

The Garden Organic charity<br />

has launched a campaign<br />

for peat-free gardening and<br />

horticulture.<br />

Announcing the new drive,<br />

its chief executive James<br />

Campbell said: “Thousands<br />

of plants are purchased<br />

which have been grown in a<br />

peat-based medium.<br />

“We believe most gardeners,<br />

organic or otherwise,<br />

would turn their back on peat<br />

if they knew the full picture.”<br />

He added: “Reducing peat<br />

use in horticulture is absolutely<br />

vital for protecting our<br />

planet.”<br />

Launching it’s ‘For Peat’s<br />

Sake’ campaign the organisation<br />

warns that the use<br />

of peat is wiping out rare<br />

ecosystems – wild areas<br />

which are home to a wealth<br />

of plants, birds and insects –<br />

and is also rapidly increasing<br />

carbon emissions.<br />

It says that peat is the<br />

largest and most efficient<br />

land-based store of carbon,<br />

and the world’s second largest<br />

carbon store after the<br />

oceans.<br />

The charity is now urging<br />

gardeners to go peat-free<br />

in their own growing and to<br />

spread the word in their local<br />

communities.<br />

James Campbell added:<br />

“We wholeheartedly believe<br />

that if consumers are provided<br />

with the facts, they<br />

will readily swap their peatbased<br />

compost for homemade<br />

or peat-free.”<br />

The organisation says:<br />

“You can make your own potting<br />

composts. It’s not difficult,<br />

it saves money and it<br />

saves peat!”<br />

Peat has traditionally been<br />

used in compost because it is<br />

good at both holding water<br />

and retaining nutrients.<br />

But Garden Organic says<br />

that garden plants don’t<br />

need peat. And it is urging<br />

gardeners to create their<br />

own potting mixes using<br />

compost they have created.<br />

It adds that if people do<br />

need to buy a bag of ‘compost’<br />

because they haven’t<br />

the space to create their<br />

own, they need to make sure<br />

it is ‘peat free’.<br />

The organisation says alternatives<br />

have “improved<br />

hugely” over the past few<br />

years and many are now outperforming<br />

peat products.<br />

And that is a message<br />

backed by the RHS, which<br />

says: “Peat-free compost can<br />

perform very well.”

to three months specifically<br />

to help them relax.<br />

Energy saving tips<br />

One easy mistake that new<br />

property owners might make<br />

in Spain, especially if they’ve<br />

just been on holiday every<br />

year in the summer, is the<br />

fact that it does get cold in<br />

the winter!<br />

Electricity bills rise over the<br />

winter months as the heaters<br />

come on, and there are ways<br />

right across your home to make<br />

save money and to help the environment<br />

by looking at energy<br />

efficiency.<br />

The shift to a new cleaner and<br />

more sustainable use of energy is<br />

quite straight-forward, from optimising<br />

the use of the refrigerator<br />

to doing a full energy audit.<br />

A basic way to save would<br />

be to choose wisely when using<br />

energy equipment in the home.<br />

You don't have to make any investments<br />

for this as it involves<br />

things to reduce consumption<br />

and improve performance, relating<br />

to appliances, heating,<br />

kitchen equipment or water<br />

management.<br />

When it comes to the fridge<br />

you can optimise the number<br />

of times it is opened, ensure to<br />

clean the back periodically, and<br />

that it is at least five centimetres<br />

away from the wall to help<br />

You can adjust the thermostat<br />

to prevent it from cooling<br />

more than necessary, and your<br />

Also, adjust the thermostat between<br />

should be regulated<br />

between 18 and 21 degrees and<br />

timers can be added to the radiators<br />

to ensure that they only<br />

work as long as necessary, and<br />

put them under the windows or<br />

in the coldest walls of the home<br />

(those that are in contact with<br />

the outside).<br />

With the water system, it is<br />

recommended to collect the cold<br />

water that comes out of the<br />

shower before it gets hot, and<br />

use it for washing.<br />

If you don't have a double<br />

flush cistern in the sink, place<br />

a bottle inside the cistern to reduce<br />

the consumption of water<br />

in each use and, of course, reduce<br />

the length of time that you<br />

have a shower.<br />

Another way to save at home<br />

is to install equipment that reduces<br />

the energy demand needed<br />

to maintain thermal comfort<br />

in your home<br />

Examples include timers for<br />

electric water heaters and bases<br />

with switches to turn off all unused<br />

equipment.<br />

You can also use energy-saving<br />

bulbs or LEDs that have lower<br />

electrical power than conventional<br />

bulbs, as well as putting<br />

in strips along your windows<br />

and doors to keep the heat in.<br />

In some cases, you might think<br />

An important first licence<br />

If you are buying a brandnew<br />

off-plan property in<br />

Spain, then you have to<br />

get hold of a Licence of<br />

First Occupancy (LFO).<br />

This is a vital certificate<br />

as it essentially certifies<br />

that all the legal hoops have<br />

been gone through, and it<br />

is issued by the local Town<br />

Hall.<br />

The LFO or Licencia de<br />

Primera Ocupación must be<br />

in place before you sign any<br />

sales contract, and is also<br />

sometimes referred to as a<br />

Cédula de Hab it ab il idad.<br />

The Licence of First Occupation<br />

generally needs to<br />

be renewed after 10 years,<br />

although in some regions of<br />

Spain it can be five or even<br />

15 years.<br />

Once the building of the<br />

property has been completed,<br />

the developer of the property<br />

will need to apply to the<br />

Town Hall for its Licence of<br />

First Occupation or LFO.<br />

If the authorities are satisfied<br />

that the development<br />

complies with local planning<br />

laws and what was specified<br />

in the original building<br />

licence, the Licence of First<br />

Occupation can be granted<br />

and will indicate that the<br />

developer has fulfilled all of<br />

their obligations.<br />

The granting of the licence<br />

shows that the property is<br />

fit for human habitation and<br />

may now be occupied for residential<br />

use. It also verifies<br />

that the property has now<br />

been fully legalised.<br />

An individual property<br />

will have its own LFO,<br />

whereas if the property is<br />

part of a complex, for example<br />

an apartment in a<br />

phase of an urbanisation,<br />

it will have a grouped or<br />

shared LFO to cover all of<br />

the properties within that<br />

particular phase.<br />

It’s important to reiterate<br />

that the Licence of First Occupation<br />

only applies to new<br />

build or off-plan properties<br />

and not to resale properties.<br />

It is unlikely that you will<br />

ever be asked for one if for<br />

example the property is 20<br />

or 30 years old.<br />

This is because firstly,<br />

LFO’s did not exist until<br />

after 1979. Secondly, without<br />

an LFO you are unable<br />

to get connected to<br />

the utility services such as<br />

for water, electricity and<br />

telecommunications.<br />

Instead, you would have<br />

to use the builders supply,<br />

which would be minimal<br />

and definitely not sufficient<br />

enough for you to live<br />

off long-term. Besides, the<br />

builders supply would eventually<br />

be cut off leaving you<br />

with no water or electricity<br />

and in effect, in limbo.<br />

After the first 10 years,<br />

you will need to replace the<br />

Licence of First Occupation<br />

with a Habitation Licence,<br />

also referred to as a Licencia<br />

de Habitabilidad.<br />

If you previously purchased<br />

a property and do<br />

not have a habitation certificate,<br />

you can check with<br />

your local town hall to see if<br />

they have a copy, which they<br />

should have if there is one.<br />

If there isn’t one, you will<br />

need to pay for this and may<br />

also need a technical report<br />

from a professional architect<br />

to confirm that the property<br />

is habitable.<br />

If you are looking to buy a<br />

new property, then you simply<br />

have to get an LFO to<br />

live there legally.<br />

from 700 to a 1,000) they<br />

flew out of the traps with<br />

one intent, to win and win<br />

convincingly.<br />

Like a red tide, the slow,<br />

sometimes ponderous, play<br />

of their opponents was simply<br />

swept aside as wave after<br />

wave of attacks rolled on.<br />

Albatera looked visibly<br />

shaken as their clearly undermanned<br />

midfield struggled<br />

to cope with quick<br />

closing and precise passing.<br />

The first goal though came<br />

from a blunder from the<br />

man in middle who, failing<br />

to spot that he was at least<br />

two metres offside, allowed<br />

Lucas (7) to run on and<br />

slide the ball underneath<br />

the advancing keeper. The<br />

home bench and crowd were<br />

incandescent, but the goal<br />

Further attacks came and<br />

within minutes Monte had<br />

their deserved second when<br />

I’ve witnessed recently by<br />

a Montesinos side. Clearly<br />

driven on by a large, noisy<br />

crowd, they rose imperiously<br />

to the big occasion. Monte’s<br />

passing was quick and inventive.<br />

Their movement<br />

was always intelligent and<br />

purposeful. They worked<br />

hard to get the ball back<br />

when they occasionally lost<br />

it. Their game management<br />

was sublime and they always<br />

played at their tempo.<br />

They always looked comfortable<br />

and in control. I think<br />

we’re talking about all the<br />

hallmarks of championship<br />

winning sides, aren’t we?<br />
