In a departure from <strong>the</strong> Wako draft, <strong>the</strong> Harmonized draft provided for election <strong>of</strong> <strong>the</strong>se nom<strong>in</strong>ees by way<br />

<strong>of</strong> electoral college as opposed to nom<strong>in</strong>ation by political parties. <strong>The</strong> draft however reta<strong>in</strong>ed <strong>the</strong> provision<br />

requir<strong>in</strong>g <strong>the</strong> members so elected to serve for not more than one term as specially elected MPs. It <strong>the</strong>n<br />

m<strong>and</strong>ated Parliament to enact legislation promot<strong>in</strong>g <strong>the</strong> representation, <strong>in</strong> Parliament, <strong>of</strong> women, persons<br />

with disabilities, <strong>youth</strong>, ethnic <strong>and</strong> o<strong>the</strong>r m<strong>in</strong>orities, <strong>and</strong> marg<strong>in</strong>alized communities. 69<br />

Follow<strong>in</strong>g debate <strong>and</strong> receipt <strong>of</strong> comments <strong>the</strong>reon, <strong>the</strong> Committee <strong>of</strong> Experts submitted its Report <strong>and</strong><br />

revised Harmonized Draft Constitution, to <strong>the</strong> Parliamentary Select Committee on <strong>the</strong> Review <strong>of</strong> <strong>the</strong><br />

Constitution, on 8th January, 2010. In <strong>the</strong> revised draft, <strong>the</strong> positions <strong>of</strong> nom<strong>in</strong>ated Members represent<strong>in</strong>g<br />

special <strong>in</strong>terests would now be filled through political party lists based on proportional representation. 70<br />

f ) <strong>The</strong> Constitution <strong>of</strong> Kenya 2010<br />

<strong>The</strong> Constitution <strong>of</strong> Kenya 2010 was promulgated on 27th August 2010 by <strong>the</strong>n President Mwai Kibaki <strong>in</strong><br />

a colourful ceremony at Uhuru Park. This was after majority <strong>of</strong> Kenyans voted <strong>in</strong> favour <strong>of</strong> <strong>the</strong> Constitution<br />

on 4th August 2010. This Constitution signified a great change for <strong>the</strong> people <strong>of</strong> Kenya as it represented<br />

<strong>the</strong>ir will <strong>and</strong> <strong>the</strong>ir desires.<br />
