Life after Doha: Some reflections in the run up to the 9th WTO Ministerial Conference on Bali

This is a book chapter that I wrote for an edited volume commissioned by the World Trade Institute in Berne, University Pelita Harapan and the Economic Research Institute for ASEAN and East Asia (ERIA), both in Jakarta. My chapter discusses how the multilateral trading system came to become intractibly bogged down in the Doha Round and argues that the WTO is still the best organization the world has for tacking a number of increasingly pressing issues. re<str<strong>on</strong>g>in</str<strong>on</strong>g>s from a hapless S<str<strong>on</strong>g>up</str<strong>on</strong>g>erchai Panitchpakdi <str<strong>on</strong>g>after</str<strong>on</strong>g> a series of <str<strong>on</strong>g>in</str<strong>on</strong>g>decisive green room meet<str<strong>on</strong>g>in</str<strong>on</strong>g>gs <br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> ma<str<strong>on</strong>g>in</str<strong>on</strong>g> protag<strong>on</strong>ists simply repeat<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>the</str<strong>on</strong>g>ir well-­‐known positi<strong>on</strong>s. 22<br />

Ultimately, <str<strong>on</strong>g>the</str<strong>on</strong>g> July package 23 rek<str<strong>on</strong>g>in</str<strong>on</strong>g>dled some hope am<strong>on</strong>g develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g country members, that <br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>cerns had not simply been forgotten <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> scramble <str<strong>on</strong>g>to</str<strong>on</strong>g> make <str<strong>on</strong>g>the</str<strong>on</strong>g> round about little <br />

more than better market access for agricultural and n<strong>on</strong>-­‐agricultural products, especially by big <br />

developed countries and efficient emerg<str<strong>on</strong>g>in</str<strong>on</strong>g>g market exporters. Thus, <str<strong>on</strong>g>the</str<strong>on</strong>g> text <strong>on</strong> agriculture that <br />

emerged from <str<strong>on</strong>g>the</str<strong>on</strong>g> July 2004 meet<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> Geneva specifically provided that develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries <br />

"must be able <str<strong>on</strong>g>to</str<strong>on</strong>g> pursue agricultural policies that are <br />

s<str<strong>on</strong>g>up</str<strong>on</strong>g>portive of <str<strong>on</strong>g>the</str<strong>on</strong>g>ir development goals, poverty reducti<strong>on</strong> <br />

strategies, food security and livelihood c<strong>on</strong>cerns". 24 This <br />

commitment was given more operati<strong>on</strong>ally effective character <br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> July package by <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g language, <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> secti<strong>on</strong> <strong>on</strong> <br />

market access, subject <str<strong>on</strong>g>to</str<strong>on</strong>g> which develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries would be <br />

permitted <str<strong>on</strong>g>to</str<strong>on</strong>g> list a certa<str<strong>on</strong>g>in</str<strong>on</strong>g> number of tariff l<str<strong>on</strong>g>in</str<strong>on</strong>g>es as sensitive <br />

products, and <str<strong>on</strong>g>to</str<strong>on</strong>g> exclude <str<strong>on</strong>g>the</str<strong>on</strong>g>se products <str<strong>on</strong>g>to</str<strong>on</strong>g> a large degree from <br />

any liberalizati<strong>on</strong>. 25 In additi<strong>on</strong>, and also under market access, <br />

develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries were <str<strong>on</strong>g>to</str<strong>on</strong>g> be given a special safeguard <br />

mechanism by which <str<strong>on</strong>g>the</str<strong>on</strong>g>y would be allowed <str<strong>on</strong>g>to</str<strong>on</strong>g> raise tariffs <strong>on</strong> a <br />

number of pre-­‐selected products above bound rates <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <br />

event of an import surge. 26 , On cot<str<strong>on</strong>g>to</str<strong>on</strong>g>n, <str<strong>on</strong>g>the</str<strong>on</strong>g> July package stated <br />

that as a negotiat<str<strong>on</strong>g>in</str<strong>on</strong>g>g issue, it would be addressed "ambitiously, <br />

expeditiously, and specifically" <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> broader framework of <str<strong>on</strong>g>the</str<strong>on</strong>g> agriculture negotiati<strong>on</strong>s, that at <br />

least allowed some <str<strong>on</strong>g>to</str<strong>on</strong>g> hope (as it turns out very forlornly) that a resoluti<strong>on</strong> <strong>on</strong> this issue might <br />

come so<strong>on</strong>er ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than later and might not be held hostage <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> S<str<strong>on</strong>g>in</str<strong>on</strong>g>gle Undertak<str<strong>on</strong>g>in</str<strong>on</strong>g>g. F<str<strong>on</strong>g>in</str<strong>on</strong>g>ally, <br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> July package put <str<strong>on</strong>g>in</str<strong>on</strong>g> writ<str<strong>on</strong>g>in</str<strong>on</strong>g>g a commitment orig<str<strong>on</strong>g>in</str<strong>on</strong>g>ally champi<strong>on</strong>ed by Pascal Lamy that LDCs <br />

would be released from any obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> make reducti<strong>on</strong> commitments, <str<strong>on</strong>g>the</str<strong>on</strong>g>reby giv<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>the</str<strong>on</strong>g>m <br />

what some participants <str<strong>on</strong>g>to</str<strong>on</strong>g>ok <str<strong>on</strong>g>to</str<strong>on</strong>g> call<str<strong>on</strong>g>in</str<strong>on</strong>g>g "a round for free". 27<br />
