John Henry Langford started selling hotels in S A in 1959 and the Company that he founded remains<br />

active today.<br />

John Richard Langford joined his father’s Company in 1979 at age 25 after working on an outback<br />

New Hurdle a Bitter Blow<br />

The next few weeks loom as<br />

amongst the most critical for<br />

hospitality.<br />

Not only do we learn when we arrive<br />

at that magical “90% over 12 years<br />

of age” vaccination rate, but we<br />

also will get an appreciation of the<br />

ambitions of Government and the<br />

public service to remain in control<br />

of our businesses.<br />

The roadmap announced on<br />

October 26 had most of us<br />

concerned and confused.<br />

Venues that benefit from domestic<br />

tourism have breathed a sigh of<br />

relief but for the rest, it was another<br />

setback. I’m no mathematician, but<br />

the amount of people required to<br />

be vaccinated at the long promised<br />

“80% over 16” rate versus the new<br />

bar of “90% over 12” does appear a<br />

disturbing figure.<br />

The AHA|SA is hearing reports the<br />

vaccination rates in this state have<br />

stalled. Not surprising, those keen<br />

to get vaccinated have done so.<br />

Those of us whose fortunes depend<br />

on everyone else doing the right<br />

thing are at the mercy of those<br />

whose income is not dependant<br />

on the State freeing restrictions.<br />

The fate of our Christmas season<br />

– critical to venues most damaged<br />

by the restrictions - rests with<br />

not just the anti-vaxers but the<br />

vaccination apathetic.<br />

The AHA|SA has enthusiastically<br />

taken up the Premier’s invitation at<br />

the October 26 media conference<br />

to work with Government to get the<br />

best outcome. There remain more<br />

questions than answers.<br />

1) When will we hit 90% over 12?<br />

2) What restrictions will remain?<br />

3) What will the obligation be<br />

on venues to have their staff<br />

vaccinated?<br />

4) What will the obligation be on<br />

venues to only allow vaccinated<br />

patrons into their venues?<br />

5) Will there be a transition period<br />

for functions already booked in<br />

good faith, unaware that<br />

patrons may need to be double<br />

vaccinated?<br />

Beyond the obvious frustration for<br />

industry that the goalposts have<br />

been moved, my major concern is it<br />

smacks of a public service reluctant<br />

to lose control of our business.<br />

Do they envisage a day where they<br />

won’t have their fingers in our lives?<br />

Over the next few weeks, the<br />

interstate experience will give us<br />

a preview of what our lives will<br />

look like beyond the 90% target. It<br />

is critical we return to having only<br />

one public service body - logically<br />

Consumer and Business Services<br />

- deciding limits and associated<br />

trading conditions. History says SA<br />

Health has rarely empathised with<br />

the plight of our members and our<br />

staff since March 2020.<br />

On <strong>November</strong> 1, it was frightening<br />

to read The Advertiser’s report of the<br />

Chief Health Officer suggesting that<br />

restrictions, including mask wearing,<br />

would need to remain in place for<br />

300 days after <strong>November</strong> 23.<br />

For too long now we have been<br />

strangled by health red tape and<br />

regulations for the greater good<br />

of our COVID-19 response. We<br />

understood and accepted this.<br />

Equally, we have every right to<br />

believe those days will very soon<br />

disappear.<br />

Remember when we were “all in<br />

this together”?<br />

MENTAL HEALTH CONCERN<br />

You could not be blamed for feeling<br />

COVID-19 is the only health issue<br />

requiring attention.<br />

For too many in our industry, the<br />

20-month white knuckle ride<br />

around lockdowns and restrictions<br />

has taken its toll on our people’s<br />

mental health.<br />

This is coupled with the fact for<br />

almost two years we have been<br />

telling customers what they can<br />

and cannot do, whilst patiently<br />

explaining to patrons that we don’t<br />

make the rules. Yet the fact we<br />

are obliged to enforce them has<br />

resulted in operators and staff<br />

enduring sustained abuse as we<br />

have been forced to become the<br />

frontline “Covid cops” on the beat.<br />

The exhausting prospect of<br />

enforcing vaccine passports<br />

to battle fatigued customers<br />

heightens those concerns.<br />

Industry mental health issues now<br />

sit squarely alongside economic<br />

considerations at the top of the<br />

AHA|SA agenda.<br />

This is why we have partnered<br />

with EML to contribute $110,000<br />

towards tailored, industry-specific<br />

mental health programmes. During<br />

the year we have also supported a<br />

range of community programmes<br />

with a focus on mental health.<br />

Last month, the AHA|SA - through<br />

members contributions to the<br />

Independent Gaming Corporation -<br />

pledged $10,000 to Erin and Soda’s<br />

Mental Health awareness month in<br />

conjunction with the Breakthrough<br />

Foundation. This follows a similar<br />

commitment to Will and Dave’s<br />

Undies Drive on 5AA in July,<br />

supporting Katherine House and<br />

the Hutt Street Centre.<br />

We do understand there will be<br />

a need to continue that support<br />

into 2022.<br />

TWO SPEED HOTEL ECONOMY<br />

We must remain mindful that<br />

COVID-19 has produced a two<br />

speed hotel economy and it<br />

impacts people in different ways.<br />

Many of our CDB venues,<br />

particularly our accommodation<br />

hotels, are in real trouble, along<br />

with our members who don’t enjoy<br />

the benefit of significant gaming or<br />

retail revenue.<br />

For the second consecutive year<br />

it was impossible to judge the<br />

prestigious best live music venue at<br />

our recent Awards for Excellence.<br />

Our venues are the natural home<br />

of live music and getting the<br />

musicians, technicians and of<br />

course our venues back on their<br />

feet is a priority.<br />

Those most impacted by the<br />

COVID-19 regulations are deserving<br />

of the greatest consideration.<br />

They have been left behind with<br />

minimal Government support after<br />

JobKeeper finished.<br />

It need not be restricted to<br />

handouts. Other countries such as<br />

England, Japan and Norway have<br />

assisted on-premise venues with<br />

a cut in beer excise. The AHA|SA<br />

has long agitated this federal tax<br />

is far too high. We are currently the<br />

fourth highest beer taxed country<br />

in the world, and will rise to third in<br />

2023, overtaking Japan. Norway is<br />

the highest, but after they reduced<br />

their beer tax by 10%, the gap is<br />

narrowing. Last week, Great Britain<br />

reacted to the COVID-19 plight of<br />

pubs by offering the biggest tax<br />

cut for beer in 50 years, in what the<br />

Chancellor described as ‘a long term<br />

investment in British pubs’.<br />

A reduction in our crippling beer tax<br />

would assist COVID-19 struggling<br />

pubs and boost employment. Any<br />

such announcement would go down<br />

very well with the punters on the eve<br />

of a Federal election.<br />

CONGRATULATIONS<br />

Our 20<strong>21</strong> Awards for Excellence was<br />

a sensational night. Congratulations<br />

to our joint winners for Best Overall<br />

Hotel, the Bridgeport and Marion<br />

Hotels. The Bridgeport is a tribute<br />

to the vision and investment by Ian<br />

Tregoning and Graham Hobbs and<br />

a real boost for our regions. As a<br />

back-to-back winner of Best Overall<br />

Hotel, the Marion is the reward for a<br />

stunning rejuvenation by the Hurley<br />

family and a wonderful addition<br />

to the hospitality landscape of the<br />

southern suburbs.<br />

Best of luck to all our winners in<br />

next year’s National Awards.<br />

The Arena – It’s a No-Brainer<br />

From a hotel and hospitality industry perspective, the<br />

development of the Adelaide Riverbank Arena is an<br />

essential piece of infrastructure whose development<br />

must be a priority if Adelaide is to compete successfully<br />

in the new post COVID-19 world.<br />

The promised new arena is to be first and foremost<br />

an outstanding contemporary live entertainment<br />

venue but importantly with much needed convention/<br />

exhibition adaptability and additional capacity, that<br />

also provides unsurpassed facilities and match-day<br />

experience for professional court sports. Simply put<br />

it is a multi-faceted solution that give the greatest<br />

possible flexibility to ensure South Australia is able to<br />

bid for any and every type of business event, cultural,<br />

entertainment and commercial gathering and yes,<br />

even a range of professional court sports.<br />

The Adelaide Riverbank Arena will significantly<br />

strengthen the Adelaide Riverbank Precinct’s<br />

competitive advantage and positioning as a world<br />

leading event, entertainment, and tourism precinct.<br />

It’s a crucial part of a bigger jigsaw puzzle that will<br />

place Adelaide as a competitive and desirable<br />

destination on par with any similar offering in the<br />

southern hemisphere, South East Asia and the world.<br />

Just because South Australians think Adelaide is a<br />

great place to visit doesn’t make it so in the eyes of<br />

the world. Adelaide and South Australian has some<br />

massive competition from other Australian State<br />

capitals with bigger populations and easier access and<br />

a range of international destinations like Hong Kong.<br />

Singapore, New Zealand just to name a few. That’s<br />

why the Arena model as part of an expanded Adelaide<br />

Convention Centre offering is crucial.<br />

The Adelaide Entertainment Centre on Port Road<br />

is nearing the end of its useful life and its capacity<br />

is clearly too small to enable the world’s biggest<br />

entertainment acts to be commercially viable. It’s also<br />

completely isolated from the CBD, the riverbank and<br />

the multitude of other City attractions that make up a<br />

capital city experience.<br />

If the Arena expansion does not proceed, Adelaide<br />

is going to increasingly miss out on more concert<br />

tours, the bigger business events and yes some<br />

outstanding professional sporting opportunities.<br />

That’s the harsh reality.<br />

The value of national and international business events,<br />

cultural and entertainment and sporting events is a<br />

simple equation. It’s measured in greatly increased<br />

bed nights, further investment in infrastructure, greater<br />

appeal of Adelaide and South Australia as a state to<br />

invest and significant additional and permanent jobs.<br />

It’s a no-brainer.<br />

Can we afford an expanded convention, entertainment,<br />

and sporting facility with our health system under such<br />

pressure?<br />

Well of course we can and must.<br />

The cost of the Arena is spread over a number of<br />

years, there will be the sale of the Port Road site and<br />

importantly the total Convention facility on the riverbank<br />

will generate significant additional annual value of<br />

around $69 million to South Australian economy when<br />

operational. Then there is the additional revenue from<br />

additional bed nights, tours, transport, and hospitality<br />

shared by a multitude of SA based services and<br />

suppliers.<br />

The Arena is much more than a basketball court - it’s<br />

a crucial piece of infrastructure ensuring the Adelaide<br />

Convention Centre complex continues to maintain<br />

and create business activity and opportunity and so<br />

importantly additional tourism, entertainment, and<br />

business events revenue for the State Government<br />

and the tourism and hospitality industry and of course<br />

many more jobs well into the future!<br />

It’s a no-brainer!<br />

Scott’s Spot<br />

Hello all and welcome to the <strong>November</strong> edition of<br />

Scott’s Spot. This month’s edition will cover the usual<br />

short stories, photos and random observations over<br />

the last month.<br />

This month, the spotlight will be on a short, heartwarming<br />

story from the Owen Arms Hotel <br />

which reinforces the importance of community<br />

and friendships that this industry thrives on.<br />

REGIONAL MEETINGS<br />

There was one Regional this month which covered<br />

the Adelaide Metropolitan area down at The Palais in<br />

Semaphore where we had over 100 members and<br />

corporate partners attend. A massive thanks to Steve<br />

and Bob Karpluk along with functions manager, Vicki<br />

Konnis, for hosting this event on a beautiful, October<br />

Spring day.<br />

I’m sure by now, you’re all listening to the AHA|SA<br />

podcast, “Our Shout”. I have had the pleasure of<br />

interviewing hotel identities and recently met Damian<br />

Peterson, Publican at The Hotel Metropolitan .<br />

We had to start with a soothing ale before the hardhitting<br />

questions were<br />

Here is the touching story of long-term customer, Keith,<br />

in the words of Owen Arms publican, Cathy Gregory.<br />

Keith moved to Owen in 1992 and our family bought and<br />

moved into the Owen Arms Hotel about two<br />

weeks later.<br />

Keith was an Englishman with a broad accent and bushy<br />

grey sideburns. He was also a loyal customer, regularly<br />

frequenting our hotel over three decades.<br />

Obviously, you get to know a bloke pretty well over 30<br />

years. He was a passionate Crows supporter, he loved<br />

soccer and was apparently pretty good at it when he<br />

was younger. He loved to read, he loved answering the<br />

questions on the Chase TV show, he loved West End<br />

Draught and he really did not like seafood or mushrooms.<br />

As life goes…Keith got sick and very sadly after a short<br />

illness, he passed away. After his funeral in Balaklava the<br />

wake was of course at the Owen Arms Hotel, and later<br />

that afternoon the funeral directors drove the hearse to<br />

Owen, and everybody stood each side of the main road<br />

in front of the pub with a West End pint, saying “cheers”<br />

to Keith as he did his last drive by the hotel in the back of<br />

the hearse on his way to the crematorium.<br />

A few weeks later, Keith’s brother came to the hotel and<br />

handed my husband a pale blue urn and said, “This is<br />

Keith.” His kids have a little bit of him each in a locket<br />

around their necks and he requested before he died that<br />

the rest of him had to come to the pub!<br />

Well, this has never happened to us before, we were<br />

shocked and we didn’t really know what to do. We were<br />

sort of proud that he wanted to stay at the pub, but my<br />

husband said, “Where do we put him?”<br />

I said to put him next to the TV in the front bar - he can<br />

hear the Chase clearly and he can watch all the Crows<br />

games. So that’s what we did.<br />

We have a few concerns about what the protocol is when<br />

you take custody of a light blue urn…<br />

If we sell the hotel, does he stay with the hotel or do we<br />

take him with us?<br />

When we die, do we leave him to our kids?<br />

Do we make him part of the lease agreement when we<br />

sell and list him as part of the plant and equipment?<br />

These questions all remain unanswered but, in the<br />

meantime, he’s safe up there next to the TV in his blue<br />

On the road<br />

urn, and if anyone wants to have a chat with him, they<br />

ask bar staff if he can come down and we put him on the<br />

bar, and they can have a beer with him and then he goes<br />

back up next to the TV.<br />

This story is so beautiful and, frankly, put a tear to my<br />

eye when reading and compiling for this edition.<br />

Susie Rankine of Owen, having a beer with him, as she<br />

often does.<br />

beautiful thing!<br />

Finally, it’s time to farewell Phil and Maz Turner who<br />

are retiring after being publicans at The Marree Hotel <br />

for 10 years. Enjoy!<br />

Two hotels have been crowned the<br />

best in South Australia at the 20<strong>21</strong><br />

Hotel Industry Awards for Excellence,<br />

held at the Adelaide Entertainment<br />

Centre. Bridgeport Hotel in<br />

Murray Bridge and the Marion Hotel <br />

have both been named SA’s Best<br />

Overall Hotel in 20<strong>21</strong>.<br />

Passion and perseverance has<br />

transformed the Bridgeport Hotel<br />

into a true masterpiece. After 25<br />

years of ownership and 11 years<br />

of planning and development,<br />

owners Graham Hobbs and Ian<br />

Tregoning have realised their<br />

vision with the opening of the<br />

stunning re-developed 100-room<br />

Bridgeport Hotel.<br />

Proudly overlooking the famous<br />

Murray River, the $45 million redevelopment<br />

has retained its local<br />

identity, whilst completing an<br />

extensive new development. The<br />

Bridgeport offers everything from<br />

stylish accommodation, quality<br />

dining, a bustling sports bar, and<br />

extensive meeting and events<br />

facilities. It also introduced<br />

a ground-breaking jobs program<br />

for the long-term unemployed in<br />

the region.<br />

Also winning the top prize for<br />

the second year in a row was the<br />

Marion Hotel. The $20 million<br />

transformation of the Hurley<br />

Hotel Group pub was completed<br />

in September 2019, and the<br />

hotel continues to set incredible<br />

standards in food and beverage,<br />

functions, accommodation, retail<br />

and gaming.<br />

Some of Adelaide’s newest<br />

accommodation hotels have made<br />

their mark in this year’s awards.<br />

Hotel Indigo Adelaide Markets <br />

has won Best Boutique/Superior<br />

Hotel Accommodation for its vibrant<br />

145-room hotel near the Adelaide<br />

Central Markets.<br />

Eos by SkyCity has won Best Deluxe<br />

Hotel Accommodation, providing<br />

guests with a true luxury experience,<br />

and an opportunity to experience<br />

modern hospitality at its finest.<br />

Oval Hotel has also taken home<br />

a prize, winning the Best Restaurant<br />

– Accommodation Division for the<br />

hotel’s flagship dining experience,<br />

Five Regions Restaurant. Five<br />

Regions offers a new take on<br />

seasonal degustation dining, with<br />

its “wine comes first” approach to<br />

menu design, showcasing the very<br />

best wines of SA’s world-renowned<br />

wine regions.<br />

Marion Hotel wins Best Overall Hotel for second year in a row.<br />

All winners will go on to compete<br />

in the National AHA Awards in<br />

Hobart on 7 February 2022.<br />

2KW has won Best Restaurant<br />

– General Division for the second<br />

year in a row, and Best Outdoor<br />

and Non-enclosed Facility. Once<br />

again setting the highest standards<br />

in food and beverage and menu<br />

design, Executive Chef Trent Lymn<br />

has been at the helm for four years.<br />

His passion for SA produce is<br />

evident with every menu he creates.<br />

The judges also loved the outdoor<br />

rooftop space, with its year round<br />

adaptability – a perfect rooftop<br />

oasis with exceptional service and<br />

attention to detail.<br />

Many country hotels were<br />

recognised, including the Dalrymple<br />

Hotel in Stansbury, which won<br />

the award for Best Bistro Casual<br />

Dining – Country. The judges were<br />

impressed by Head Chef William<br />

Glazbrook’s ability to merge the<br />

traditional pub food expected by<br />

so many in the country, with more<br />

refined dishes with a modern<br />

Australian theme and a touch of<br />

Since opening in 1854, The Cremorne Hotel has<br />

been an impressive landmark on Unley Road.<br />

Duxton Pubs Group acquired the property in March<br />

20<strong>21</strong> and traded for a month before closing the main<br />

bar and dining room for renovations, which are now<br />

complete.<br />

“We identified the hotel as having huge potential to<br />

return a food-focussed venue back to the community,<br />

whilst continuing the tradition of being an iconic<br />

suburban drinking destination,” said Joshua Hillary,<br />

Group General Manager.<br />

DESIGN<br />

The recent refurbishment was headed by Sarah<br />

Matthews and Kara Walsh (interior), working with<br />

Carlo Panozzo of Folland Panozzo Architects.<br />

Minimal structural changes were made to The<br />

Cremorne—the main work was installing a wall and<br />

doorway from the central area of the hotel through<br />

to the sports bar and gaming room.<br />

“This was intended to create a point of difference<br />

between these areas and the main hotel operation,”<br />

said Joshua.<br />

“It gives patrons the ability to have a space unique<br />

to the experience they are setting out to have, be it<br />

watching sport or punting, or dining with family or<br />

friends, or enjoying a drink and some live music in<br />

the sunny courtyard.”<br />

Those familiar with The Cremorne may notice the<br />

ceilings in the main bar have been lifted, and lighter<br />

tones have been incorporated in the fixtures and<br />

furniture, resulting in a “much brighter and open” style.<br />

Local company Agostino and Brown supplied all of<br />

the bar stools, booths and tables in the dining, bar and<br />

lounge areas.<br />

diverse, and according to Joshua, a point of difference<br />

“We’ve tried to cater to the local market with a balanced<br />

and exciting food and beverage offering that lends itself<br />

to being enjoyed in whichever way the guests choose,”<br />

he said.<br />

“We have a range of 18 tap beers made up of key<br />

favourites from Coopers, Lion and CUB, alongside<br />

a number of local craft offerings from Big Shed,<br />

dining, and patrons can expect “traditional pub classics.”<br />

FUTURE PLANS<br />

Further renovations are set to take place in early<br />

2022. There are plans to make changes to the façade<br />

of the hotel and freshen up the sports bar and TAB.<br />

The screening between the beer garden and Unley<br />

Road is also rumoured to be due for a makeover, and<br />

there are suggestions that the drive through bottle<br />

shop is in line for a significant upgrade.<br />

The redevelopment coincides with the development<br />

of a seven-storey apartment complex directly across<br />

Unley Road. That project is reported to be worth<br />

$41 million and includes 59 apartments and a retail<br />

complex<br />

to Jumbo, an elephant that was once a star attraction at<br />

the hotel.<br />

The ABC reported: “Named Jumbo at the time, Tommy<br />

was… bought by the licensee of Adelaide's Cremorne<br />

Gardens Hotel, an Unley establishment that wanted<br />

South Australia's first elephant in its adjacent zoo, which<br />

already had a monkey, emu, kangaroo and parrots.<br />

“But Tommy was a five-year-old youngster who would<br />

regularly wander into the neighbours' yard where he<br />

pulled washing off the line or played with washing tubs<br />

because he loved water.”<br />

AHA|SA Metropolitan meeting. The informative meeting for AHA|SA hotel<br />

members was followed by network with corporate partners. We also<br />

welcomed a short presentation from SA ALP Leader Peter Malinauskas.<br />

Respect at Work Legislation:<br />

What it Means for Your Business<br />

In September this year the Federal<br />

Government introduced the new<br />

Respect at Work Legislation. In<br />

this article we look at the recent<br />

legislative changes and what the<br />

implications are for businesses<br />

moving forward.<br />

RESPECT AT WORK REPORT<br />

In 2018, the Federal Government<br />

(the Government) announced that<br />

there would be a national inquiry<br />

into sexual harassment in Australian<br />

workplaces. The Government<br />

commissioned the national Sex<br />

Discrimination Commissioner, Ms<br />

Kate Jenkins to oversee the inquiry.<br />

The Terms of Reference of the<br />

Inquiry was to review and report on<br />

workplace sexual harassment and<br />

make recommendations in relation<br />

to the following:<br />

• its prevalence, nature and<br />

reporting in Australian workplaces<br />

• the role of technology<br />

• its drivers, including risk factors<br />

for particular population groups<br />

or in different workplace settings<br />

• the current legal framework<br />

• existing measures to address it<br />

and examples of good practice<br />

• its impacts on individuals<br />

and businesses, including its<br />

economic impact<br />

In January 2020, the Sex<br />

Discrimination Commissioner<br />

released the Respect@Work<br />

Report: National Inquiry into<br />

Sexual Harassment in Australian<br />

Workplaces. One of the overarching<br />

recommendations from the report<br />

was the importance of legislative<br />

amendments to simplify and<br />

clarify the overarching legal<br />

frameworks to ensure that<br />

employers and employees are<br />

able to effectively address sexual<br />

harassment in the workplace.<br />

SEX DISCRIMINATION AND<br />

FAIR WORK (RESPECT AT<br />

WORK) AMENDMENT ACT 20<strong>21</strong><br />

In response to the National Inquiry<br />

and a number of recommendations<br />

from the Respect@Work Report,<br />

in June this year the Government<br />

introduced into Federal Parliament<br />

the Sex Discrimination and Fair<br />

Work (Respect at Work) Amendment<br />

Bill 20<strong>21</strong>.<br />

Having passed through Parliament<br />

the Sex Discrimination and Fair<br />

Work (Respect at Work) Amendment<br />

Act 20<strong>21</strong> (Cth) (Respect at Work<br />

Act) commenced on 11 September<br />

20<strong>21</strong>. The Respect at Work Act<br />

makes amendments to the Fair<br />

Work Act 2009 (Cth), the Sex<br />

Discrimination Act 1984 (Cth)<br />

and the Australian Human Rights<br />

Commission Act 1986 (Cth).<br />

So what are the major amendments:<br />

EXPANDED COVERAGE OF THE<br />

SEX DISCRIMINATION ACT<br />

The Respect at Work Act amends<br />

the Sex Discrimination Act to<br />

ensure that the Sex Discrimination<br />

Act’s provisions are closely aligned<br />

with terms used in model Work<br />

Health and Safety laws such as the<br />

concepts of a ‘worker’ and ‘PCBU’<br />

(persons conducting a business<br />

or undertaking). The use of these<br />

terms ensures that the coverage<br />

of the Sex Discrimination Act is<br />

expanded to include persons not<br />

previously covered under the Act<br />

including interns, volunteers and<br />

self-employed.<br />

The Sex Discrimination Act has also<br />

been expanded to include members<br />

of parliament, their staff, judges<br />

and public servants at all levels of<br />

government.<br />

The Sex Discrimination Act has<br />

also been amended to include the<br />

term “in connection with” such<br />

that a worker, PCBU, employee or<br />

employer does not have to actually<br />

be performing their work duties at<br />

the time the sexual harassment<br />

occurs in order for the harassment<br />

to be covered under the Sex<br />

Discrimination Act. The worker,<br />

PCBU, employee or employer could<br />

for example be visiting an offsite<br />

venue to attend an organised<br />

work event or function, visiting the<br />

workplace out of hours or be on a<br />

designated break from their shift.<br />

HARASSMENT ON THE<br />

GROUND OF SEX<br />

In addition to sexual harassment<br />

and sexual discrimination, the<br />

Sex Discrimination Act has been<br />

amended to include a new sexbased<br />

harassment provisions.<br />

The amendment makes it expressly<br />

clear that it is unlawful to harass a<br />

person on the ground of their sex.<br />

Under the amendments a person<br />

harasses another person on the<br />

ground of sex if they engage in<br />

unwelcome conduct of a seriously<br />

demeaning nature<br />

by reason of the person’s sex in<br />

circumstances in which, in line<br />

with the existing test for sexual<br />

harassment, a reasonable person<br />

would have anticipated that the<br />

person harassed would be offended,<br />

humiliated or intimidated.<br />

Harassment on the ground of<br />

sex will include harassment by<br />

reason of:<br />

• The sex of the person harassed;<br />

or<br />

• A characteristic that generally<br />

relates to persons of the sex of<br />

the person harassed; or<br />

• A characteristic that is generally<br />

attributed to persons of the sex<br />

of the person harassed.<br />

VICTIMISATION<br />

The Sex Discrimination Act has<br />

been amended to introduce a new<br />

provision that makes it unlawful to<br />

victimise a person if they have taken<br />

action, or propose to take action,<br />

in relation to a discrimination or<br />

harassment claim.<br />

Victimising conduct can now<br />

form the basis of a civil action<br />

for unlawful discrimination in<br />

addition to a criminal complaint<br />

under the Sex Discrimination<br />

Act. So a person could make a<br />

complaint to the Australian Human<br />

Rights Commission (AHRC) and<br />

additionally undertake civil action<br />

against an alleged perpetrator.<br />

TERMINATION OF<br />

COMPLAINTS TO THE AHRC<br />

The Sex Discrimination Act<br />

allows for the President of the<br />

AHRC to terminate a complaint<br />

on discretionary grounds.<br />

Previously such complaints could<br />

be terminated on discretionary<br />

grounds by the President if the<br />

complaint was lodged more than 6<br />

months after the alleged conduct<br />

occurred. The Respect at Work Act<br />

has amended the timeframe such<br />

that the President will only have<br />

discretionary grounds to terminate<br />

the complaint if it is lodged more<br />

than 24 months after the alleged<br />

unlawful conduct took place.<br />

STOP SEXUAL<br />

HARASSMENT ORDER<br />

The Respect at Work Act amends<br />

the existing anti-bullying legislation<br />

in the Fair Work Act, to make it clear<br />

that within that jurisdiction, the Fair<br />

Work Commission (FWC) can make<br />

an order to stop sexual harassment<br />

in the workplace.<br />

The FWC can make an order to<br />

stop sexual harassment, where<br />

it is satisfied that the worker has<br />

been sexually harassed at work by<br />

one or more individuals, and it is<br />

satisfied that there is a risk that the<br />

worker will continue to be sexually<br />

harassed at work by the individual<br />

or individuals.<br />

The FWC must be satisfied that the<br />

harassment has occurred to make<br />

an order, and orders would not be<br />

available in cases where there is no<br />

risk of harassment occurring again,<br />

for example when the person who<br />

harassed the worker is no longer<br />

employed at the workplace.<br />

UNFAIR DISMISSAL<br />

The Respect at Work Act has<br />

amended the Fair Work Act to<br />

clarify that sexual harassment can<br />

be conduct amounting to a valid<br />

reason for dismissal in determining<br />

whether a dismissal was harsh,<br />

unjust or unreasonable.<br />

Sexual harassment has also been<br />

included on the list of conduct that<br />

constitutes ‘serious misconduct’ in<br />

the Fair Work Regulations.<br />

MISCARRIAGE LEAVE<br />

The Respect at Work Act also<br />

varies the existing entitlement to<br />

compassionate leave in the Fair<br />

Work Act to enable an employee<br />

to take up to two days of paid<br />

compassionate leave (unpaid<br />

for casuals) if the employee, or<br />

employee’s current spouse or de<br />

facto partner, has a miscarriage.<br />

Miscarriage is defined as the<br />

spontaneous loss of the embryo or<br />

fetus before 20 weeks’ gestation.<br />

This is based on the general medical<br />

meaning of miscarriage.<br />

IMPLICATIONS FOR<br />

BUSINESSES<br />

In light of the introduction of the<br />

new Respect at Work legislation we<br />

recommend that employers should<br />

review the following areas:<br />

Existing Policies & Procedures<br />

Employers should review their<br />

existing sexual harassment policies<br />

and procedures to incorporate<br />

areas such as the new ground<br />

of sex-based harassment, the<br />

expanded coverage under the Sex<br />

Discrimination Act and the FWC’s<br />

new ability to make orders to stop<br />

sexual harassment in the workplace.<br />

Internal Complaints/Grievance<br />

Procedures<br />

Any procedures with respect to<br />

complaint handling and grievance<br />

disputes should also be reviewed<br />

to ensure they are consistent with<br />

the Respect at Work legislative<br />

changes.<br />

Any internal complaints mechanism<br />

should be easily understood<br />

and widely publicised to ensure<br />

that staff are fully aware of what<br />

they can do in the event they<br />

wish to make a complaint in<br />

relation to sexual harassment or<br />

discrimination.<br />

Leave Policies<br />

Employers are encouraged to<br />

review any existing policies on<br />

leave entitlements to ensure they<br />

are updated to incorporate the two<br />

days of paid compassionate leave<br />

(unpaid for casuals) if the employee,<br />

or employee’s current spouse or de<br />

facto partner, has a miscarriage.<br />

Training<br />

Training on sexual harassment and<br />

discrimination should be provided to<br />

any new employees as part of their<br />

overall onboarding process. This<br />

ensures that new staff members<br />

understand what the expected<br />

behaviours of the company are,<br />

what constitutes sexual harassment<br />

and what to do in the event that<br />

an employee wishes to make a<br />

complaint.<br />

For existing employees refresher<br />

training should also be provided on<br />

these topics as part of their ongoing<br />

professional development.<br />

AHA|SA Supports Mental Health Fundraiser<br />

Australian Hotels Association of<br />

South Australia General Manager,<br />

Ian Horne, has made a $10,000<br />

song dedication in Erin and<br />

Soda’s Feelgood Friday Jukebox<br />

for Breakthrough Mental Health<br />

Research Foundation fundraiser.<br />

The AHA|SA GM told the show the<br />

donation was inspired by a tough<br />

couple of years for SA’s hospitality<br />

industry, which has been among<br />

the hardest hit during the covid<br />

pandemic.<br />

He said more than 25,000 South<br />

Aussies were stood down from<br />

hospitality jobs during the first<br />

lockdown, in March 2020. He said<br />

the mental impact from that has<br />

been evident across the industry.<br />

“It took until the end of June to<br />

get a large number of them back<br />

(into jobs). And of course, that<br />

(uncertainty) creates havoc for<br />

people,” Horne said.<br />

In a Mix 102.3 first, Erin and Soda<br />

are swapping their breakfast<br />

request show, every Friday for<br />

the rest of October to raise funds<br />

for Breakthrough Mental Health<br />

to Assist Many Children’s Charities<br />

The Liquor Industry Golf Club (LIGC)<br />

holds an annual golf day in February<br />

each year to support Children’s<br />

Next year’s event for the LIGC<br />

Charity Golf Day will be held on<br />

Sequoia Lodge is the only place in the world you can<br />

find four world-class wine regions within a 50 kilometre<br />

radius.<br />

The recently-opened luxury lodge sits on Mount Lofty,<br />

above the Piccadilly Valley in the Adelaide Hills. It<br />

officially opened its doors in August, after more than<br />

a year of delays due to COVID-19.<br />

David Horbelt, Sequoia owner and an experienced<br />

hotelier, purchased the estate over a decade ago.<br />

Some five years later, Jesse Kornoff, Estate General<br />

Manager, joined the project. Jesse’s career had spanned<br />

all manner of hotels—predominately five-star—from<br />

boutique properties around Australian to 480-room<br />

resorts in Queensland, but luxury accommodation was<br />

The duo wanted Sequoia to be a place to connect<br />

with the land via intimate, on-site experiences. The<br />

Peramangk people are the traditional custodians of<br />

the Adelaide Hills, and at Sequoia, guests can listen to<br />

Aboriginal elders explain what Mount Lofty means to<br />

their people.<br />

Guests can also enjoy sunrise yoga or a guided nature<br />

walk, stargaze, relax in the artisan spring-fed hot pool,<br />

or take part in a ‘Maker and Somm’ session where a<br />

local winemaker will join a Sequoia sommelier to taste<br />

and discuss their wines.<br />

Some of the off-site experiences include going behind<br />

the scenes at R.M. Williams, driving a luxury car<br />

through the Adelaide Hills thanks to a collaboration with<br />

Prancing Horse, visiting Cleland Wildlife Park to hold a<br />

koala, or going on a private truffle hunt.<br />

Jesse called COVID-19 a “blessing in disguise” for<br />

Sequoia and many regional hotels.<br />

He said the closed borders gave the lodge “a level of<br />

market cut through” that may have otherwise taken a<br />

number of years to achieve.<br />

The lodge is currently sitting at close to 90% capacity,<br />

and has been very popular with locals. According to<br />

Jesse, it is the first product of its kind to open in over<br />

ten years (Saffire Freycinet Tasmania was the most<br />

recent).<br />

“If you were coming to SA and you wanted to stay<br />

in the best hotel, you’d choose to come and stay at<br />

Mount Lofty House,” said Jesse.<br />

“However, if you were wanting to come and experience<br />

something you couldn’t have anywhere else in the<br />

world, you would come to Sequoia.<br />

“I think we’re going to be exceptionally busy for a<br />

long time.”<br />

Our Purpose - To provide the hotel industry the capacity to respond<br />

to community concerns related to the harm associated with gambling<br />

by contributing to early intervention and support for problem gamblers<br />

and their families.<br />

Our Goal - A compliant and proactive hotel industry that works with<br />

regulators, gambling help services, and players to limit the harm<br />

caused by gambling.<br />

Gaming Care is the hotels responsible gambling early intervention<br />

agency, and is an initiative of the AHA|SA. Gaming Care’s role to<br />

assist venues to minimise the harm caused by problematic gambling<br />

behaviour in all South Australian hotels with gaming machines by<br />

working directly with venue staff, Gambling Help Services, other<br />

relevant organisations and stakeholders.<br />

Assisting hotel staff in the early identification and support of<br />

patrons and staff who may be experiencing difficulty with their<br />

gaming behaviour.<br />

Developing and promoting initiatives, programs and policies<br />

designed to facilitate the early identification of problematic<br />

gambling behaviour.<br />

Assisting hotel staff in providing responsible gambling service,<br />

on or with the capacity to influence the service, by training<br />

in responsible service of gambling. This helps reduce harm<br />

through the creation of a responsible gambling culture within<br />

the venue.<br />

Gaming Care has developed a Responsible Gambling Document for<br />

venues which details the ways in which staff training and measures for<br />

intervention with problem gamblers are implemented, and the roles of<br />

staff in the implementation of the code.<br />
