United States Court of Appeals for the Ninth Circuit. Judgment reversed,
and case remanded to the United States Court of Appeals for
the Ninth Circuit for further proceedings consistent with the opinion
of this Court. Opinion by Justice Alito. Opinion by Justice Scalia, with
whom Justice Thomas joins, concurring in the judgment. Opinion by
Justice Thomas, concurring in the judgment. Justice Kagan took no
part in the consideration or decision of this case.
No. 09–587. Kelly Harrington, Warden, Petitioner v. Joshua Richter.
On writ of certiorari to the United States Court of Appeals for the
