for writ <strong>of</strong> certiorari to <strong>the</strong> <strong>United</strong> <strong>States</strong> <strong>Court</strong> <strong>of</strong> Appeals for <strong>the</strong><br />

Ninth Circuit. Motion <strong>of</strong> respondent for leave to proceed in forma pauperis<br />

granted. Petition for writ <strong>of</strong> certiorari granted. Judgment vacated,<br />

and case remanded to <strong>the</strong> <strong>United</strong> <strong>States</strong> <strong>Court</strong> <strong>of</strong> Appeals for<br />

<strong>the</strong> Ninth Circuit with instructions to dismiss <strong>the</strong> appeal. Opinion per<br />

curiam. Justice Ginsburg, Justice Breyer, and Justice Sotomayor would<br />

remand <strong>the</strong> case to <strong>the</strong> Ninth Circuit for that court’s consideration<br />

<strong>of</strong> mootness in <strong>the</strong> first instance. Justice Kagan took no part in <strong>the</strong><br />
