Opinion Per Curiam
No. 09–940. United States, Petitioner v. Juvenile Male. On petition
for writ of certiorari to the United States Court of Appeals for the
Ninth Circuit. Motion of respondent for leave to proceed in forma pauperis
granted. Petition for writ of certiorari granted. Judgment vacated,
and case remanded to the United States Court of Appeals for
the Ninth Circuit with instructions to dismiss the appeal. Opinion per
curiam. Justice Ginsburg, Justice Breyer, and Justice Sotomayor would
remand the case to the Ninth Circuit for that court’s consideration
of mootness in the first instance. Justice Kagan took no part in the
consideration or decision of this case.

for writ of certiorari to the United States Court of Appeals for the
Ninth Circuit. Motion of respondent for leave to proceed in forma pauperis

for writ of certiorari to the Court of Appeals of Kentucky. Motion of
respondent for leave to proceed in forma pauperis granted. Petition

to the Court of Appeals of Kentucky for further consideration in light
of Davis v. United States, 564 U. S. ––– (2011).
