HR MATTERSChanging TackPost-Brexit changes to employment law, newguidance on staff suspensions, and confirmation thatsupport of a football club is not a protected belief.AUTHOR – Gareth EdwardsAN employment tribunalheld that support fora football club is not aprotected philosophicalbelief under the EqualityAct 2010.In the case of McClung v Doosan BabcockLtd and others ETS/4110538/2019, theclaimant, Mr McClung, is a staunchand lifelong supporter of GlasgowRangers Football Club. He describes hissupport of the club as a way of life andas important to him as attending churchwould be to a Christian.McClung worked as subcontractor forDoosan Babcock, and claimed a managerthere denied him further work becauseshe was a Celtic fan. He brought claimsfor unfair dismissal and discrimination.There were a number of issues todetermine in relation to McClung'sclaims, including his employmentstatus. The case concerns the question ofwhether McClung's support of Rangersqualified as a protected belief undersection 10 of the Act.The tribunal held that his belief,whilst strong and genuinely held, wasnot a protected belief under the Act. Itconsidered the five Grainger criteria fordetermining whether a belief qualifiesfor protection under the Act, namelythat the belief must be genuinely held;it must be a belief and not an opinion orviewpoint based on the present state ofinformation available; it must be a beliefas to a weighty and substantial aspectof human life and behaviour; it mustattain a certain level of cogency,seriousness, cohesion and importance;it must be worthy of respect in ademocratic society, not be incompatiblewith human dignity and not conflictwith the fundamental rights of others.The tribunal accepted that the beliefwas genuinely held. However, theremaining criteria were not met. Further,an explanatory note to the Act stated thatsupport for a football club would not bea protected belief. There is a differencebetween a belief, which is the acceptanceof something a person believes to be true,and support, which is being interestedin and concerned for the successof something.In addition, the tribunal held thatsupporting a football team was notequivalent to a belief in somethingweighty and substantial; support forRangers does not invoke the samerespect in a democratic society as issuessuch as ethical veganism.This case distinguishes between theconcept of support and the conceptof belief.Acas issues new guidance on suspensionsACAS has published employer guidance onhow to manage staff suspensions during formaldisciplinary and grievance investigations.The new guidance, Suspension during aninvestigation at work, covers a number of keyissues, including deciding whether to suspendan employee, how they should be suspended,how to support their mental well-being, anddealing with pay and holiday during thesuspension period.The guidance reflects the fact that suspensionshould not be an automatic response toconcerns or allegations being raised. However,in some circumstances suspension might beappropriate, for example, in order to preservethe integrity of an investigation, and where thereare no viable alternatives to suspension whichwould achieve the same result. The guidancesets out ways employers can approach the topicof suspension fairly and sensitively, so that itcan be properly seen as a temporary and neutralact, and so that the individual's wellbeing can beproperly protected.The guidance acknowledges that in somesituations it might be appropriate to take legaladvice before suspending an employee, forexample, if there is any question over pay orthe fairness of the suspension. It is also goodpractice to put everything in writing, so theterms of suspension are clear from the outset.Suspension should be no longer than necessaryand the decision to suspend should be keptunder review.Shake-up of employment rights expectedTHE Government has introduced theRetained EU Law (Revocation and Reform)Bill 2022-2023 to the House of Commons.The bill could prompt a significant shakeupof established employment rights.Broadly speaking, the bill is intended toconfer more power on the Government tooperate free of the constraints of retainedEU law that derives from the European❝The guidance setsout ways employerscan approach thetopic of suspensionfairly and sensitively,so that it can beproperly seen asa temporary andneutral act.❝Union, which was retained within UKdomestic law following Brexit. Under theBill, EU-derived subordinate legislationand retained EU legislation will berevoked across the UK at the end of 2023.Much of UK employment law derivesfrom EU law, including TUPE and theWorking Time Regulations (which containholiday rights and set out the parametersof the working week).
