Powers of Attorney<br />
People often confuse the term attorney<br />
with the term executor. An attorney is<br />
someone that you appoint to act for you<br />
while you are alive. This may be a general<br />
power of attorney, in one off situations, for<br />
example, if you are going to be away when<br />
a document is required to be signed. An<br />
enduring power of attorney allows your<br />
attorney or attorneys to act if you lose<br />
mental capacity. This is important if you<br />
have a health issue or accident that leaves<br />
you lacking mental capacity and requiring<br />
an attorney to make decisions for you.<br />
Having enduring powers of attorney set up<br />
to cover your personal care and welfare and<br />
another to cover property is a key safeguard<br />
to protect your wishes if you can no longer<br />
make these decisions or communicate them<br />
yourself.<br />
An attorney’s power to act ends when<br />
you die. This is commonly not understood,<br />
and some attorneys believe that they<br />
can continue to deal with the deceased’s<br />
property including the bank accounts. It<br />
is another common misconception that<br />
money to cover the funeral expenses needs<br />
to be withdrawn before the bank accounts<br />
are frozen. Firstly, the attorney is no longer<br />
authorised to act and secondly it is not<br />
necessary as most banks have a process of<br />
allowing the payment of funeral expenses<br />
before probate is granted by application<br />
from the executors or their lawyer.<br />
When you die your latest Will becomes<br />
effective and the person or persons you<br />
have named as executors are able to start<br />
their role of dealing with your estate. Your<br />
executor’s first duty is to deal with your<br />
funeral arrangements. If you have expressed<br />
a wish in your Will for burial or cremation<br />
or for a particular service or to not have a<br />
funeral service at all, your executors can<br />
take these into account. Your executors are<br />
not bound to follow the wishes expressed<br />
in your Will regarding your funeral<br />
arrangements, so it is a good idea to discuss<br />
these with the person or persons you are<br />
appointing to check that they are agreeable<br />
to carrying out your preference. It is also<br />
helpful to let the persons you are appointing<br />
know where your original Will is held and<br />
where you keep a copy.<br />
Setting up enduring powers of attorney<br />
allows you to decide who you want to act<br />
for you while you are alive and particularly<br />
for when you cannot make decisions<br />
yourself. Without these deeds someone<br />
would need to apply to the court to be your<br />
welfare guardian and/or property manager<br />
if you lost mental capacity. And completing<br />
a Will allows you to appoint the people you<br />
trust to carry out your funeral wishes and to<br />
state how your assets are to be distributed.<br />
If you die without a Will someone needs to<br />
apply to the High Court to administer your<br />
estate and the distribution is set out in a<br />
formula in the Administration Act 1969.<br />
