Th e Public Liability Insurance protects
members where a third party makes a
claim, caused by the negligence of the
member, for personal injury or damage to
property, not belonging to the member,
when outside the car.
Th e Professional Indemnity Insurance
covers members in case of action taken
against them by a third party for
professional error, negligence or omission
in the professional advice they give to the
public.
Sounds great... but why would I need it?
These two policies are so important that
if you decide to move into teaching
business fleet drivers or on behalf of local
authorities, colleges or other public sector
bodies, they will insist on you having such
cover in place before employing you. It is
also a requirement to have such insurance
in place if you are going to hire facilities for
classroom tuition.
Why would I need it? The cover protects
you should a pupil or another third party
bring a legal action against you for
damages.
As an ADI you are expected to maintain
the highest standards at all times when
supervising learners, but if ever your
standards should slip, or are perceived to
have slipped by a court, and someone else
is hurt, then you are vulnerable to a claim
made against you.
How does it work? An example case
would be where, during a lesson, you and
your pupil are involved in a car crash, in
which the pupil is injured.
Subsequently the pupil claims his/her
injuries were due to your poor tuition and
supervision of the lesson. They contract a
solicitor on a no-win, no-fee basis and
proceed to being a civil case against you for
damages.
What can the ADI do? As a member of
the MSA GB, you would enact the free
Professional Indemnity cover that comes
as part of membership. It protects you for
up to £5 million of legal costs and damages.
Any court case would still be a trying
experience but at least you would be
covered financially.
If you were not covered you would have
to either contract a solicitor out of your
own pocket and fight the claim or agree to
pay damages to the pupil. Either way you
will be out of pocket.
