Pharmaceutical Products
Spriggs & Hollingsworth represents some of the world’s largest pharmaceutical
manufacturers in individual cases and serial litigation involving personal
injuries alleged to be associated with the use of prescription drugs. We handle these
matters from the earliest pre-trial proceedings through Daubert hearings, trials
and appeals, and we often appear as national trial counsel.
Our clients have achieved tremendous success on a national basis. We have
made defense verdicts stick in jurisdictions like southern Mississippi and eastern
Texas. We have preserved Daubert rulings and made good law in the circuits to the
benefit of the entire industry. We have litigated complex regulatory-based issues,
such as federal preemption and Sunshine Act confidentiality. We have reduced massive
potential liabilities to ordinary risks acceptable in the course of business.
We also offer our clients the benefit of expertise on prescription drug registration
and labeling issues. We work with the Food & Drug Administration as
appropriate to advance our clients’ interests.
Medical Device Products Liability
The Firm represents medical device manufacturers in serial and individual
personal-injury litigation. We have both handled cases from their inception and
taken over and turned around troubled litigation after cases were well underway.
We aggressively defend cases based on the science, with particular attention to
challenging questionable causation evidence and opinions advanced by the plaintiffs.
In one case, we terminated an exploration by the plaintiffs’ bar into litigation
over a particular medical device (with multiple plaintiffs’ firms soliciting clients)
by taking the first major case filed over the device to trial in Texas. We secured a
defense verdict after less than one hour of deliberations. This victory has, to date at
least, deterred any further filings regarding that device.
Toxic Torts & Products Liability
Since its inception in 1982, the Firm has been recognized as one of the
nation’s premier defenders of toxic tort and products liability claims. Our expertise
dates to the original “contamination” suits involving DDT and chlordane/heptachlor
and continues through the most cutting-edge litigation involving pharmaceutical
products, international and domestic pesticide use, groundwater and
land mass chemical plumes, and fungible consumer products. We try cases for
some of the largest companies in the world, and we know how to advance litigation
strategy and business strategy in tandem.
We defend class actions, mass tort suits, serial litigation, and individual
claims. Our clients’ wins – before juries, before judges in Daubert and other proceedings,
and in strategic Alternative Dispute Resolution settings – have been in
forums from coast-to-coast against allegations limited only by the creative bounds
of the plaintiffs’ bar.
Environmental
Our environmental practice encompasses the full spectrum of business, regulatory,
and litigation issues that companies regularly confront. We advise clients on
the meaning and impact of state and federal regulatory requirements with respect to
all environmental media. We evaluate, design, and audit compliance programs and
assist our clients in managing environmental aspects of business transactions. We
represent companies in permit, enforcement, and other administrative proceedings.
