Case Preparation<br />

The purpose of this exercise is to help you prepare your brief. Be concise<br />

and complete.<br />

Before proceeding with a classification <strong>grievance</strong> there are a few steps that<br />

may be helpful in the preparation of a case, always taking into<br />

consideration that retroactive entitlement for classification<br />

complaints is from the filing date of the <strong>grievance</strong> per the<br />

Collective Agreement (Article 18.4.1.1).<br />

Some colleges have utilized an internal review process or practice that has<br />

in some cases resulted in a member receiving a reclassification outside of<br />

the <strong>form</strong>al <strong>grievance</strong> process.<br />

Where this practice exists it is important that retroactivity be considered<br />

and where possible you should seek confirmation from the employer (in<br />

writing) that if an adjustment is made it will be retroactive to the date of<br />

the request. Many members use the per<strong>form</strong>ance evaluation process to<br />

<strong>form</strong>alize a review.<br />

When meeting with the member for the first time you should review with<br />

them the <strong>grievance</strong> procedure, including the critical <strong>grievance</strong> timelines<br />

and the hearing process. Indicate to the member that he/she will be<br />

expected to provide the evidence to support their case and that a<br />

significant amount of time will be required.<br />
