I. Periodic review <strong>of</strong> placement<br />

Legal framework<br />

260. Children may be separated from <strong>the</strong>ir parents by judicial decision only, taking into<br />

consideration <strong>the</strong> best interests <strong>of</strong> children when <strong>the</strong>ir safety, health and care are<br />

compromised. If <strong>the</strong> decision <strong>of</strong> <strong>the</strong> family court judge is placement with ano<strong>the</strong>r family or<br />

in an institution, <strong>the</strong> time period is three months (renewable), as indicated above. This child<br />

protective services measure may be replaced or renewed through a decision stating grounds,<br />

depending on how <strong>the</strong> child’s situation develops.<br />

261. Officials at shelters are bound by <strong>the</strong> obligations pertaining to custody rights,<br />

including care, and must be in continuous contact with <strong>the</strong> family court judge, providing<br />

him or her a psychological and social report on children in <strong>the</strong>ir care.<br />

J. Abuse and neglect, including physical and psychological recovery and<br />

social reintegration<br />

262. Children taken into shelters who have been victims <strong>of</strong> abandonment, neglect or<br />

abuse receive psycho-social support and child care with a view to <strong>the</strong>ir social reintegration.<br />

In<strong>for</strong>mation on <strong>the</strong> status <strong>of</strong> <strong>the</strong> legislation is included in annex II.<br />

263. The table below indicates <strong>the</strong> number <strong>of</strong> child victims <strong>of</strong> abuse, according to data<br />

from <strong>the</strong> Division <strong>of</strong> <strong>the</strong> vice squad and <strong>the</strong> <strong>of</strong>fice <strong>for</strong> <strong>the</strong> protection <strong>of</strong> juveniles<br />

(DVSOPJ).<br />
