‘House style’ for all SpC<br />
1.31. We recognise that currently the template style of the new SpCs in the<br />
Supporting Documents is not consistent. We will aim to address this in the Second<br />
Consultation.<br />
Modernising <strong>licence</strong> <strong>conditions</strong><br />
1.32. In order to add clarity <strong>and</strong> in an effort to remove any ambiguity we have,<br />
where possible, taken steps to update the structure <strong>and</strong> wording of some existing<br />
<strong>conditions</strong> by replacing any unclear text with clear <strong>and</strong> plain English. This general<br />
exercise of making <strong>conditions</strong> more user-friendly is referred to as „modernising‟<br />
throughout this document.<br />
1.33. The <strong>conditions</strong> under this <strong>informal</strong> consultation are working drafts which are<br />
still being developed in working groups. We are conscious that further development<br />
may be required to ensure that the drafting focuses on provisions which work within<br />
the context of a statutory enforcement regime focussed on the licensee‟s, rather<br />
than the Authority‟s, compliance with the terms of the <strong>licence</strong>, but at the same time<br />
provides clear, transparent <strong>and</strong> fair processes for the new mechanisms included<br />
under <strong>RIIO</strong> (for instance, the annual iteration process, Network Innovation<br />
Competition (NIC), Network Innovation Allowance (NIA) etc). This is work in<br />
progress <strong>and</strong> further, more careful consideration of <strong>conditions</strong>, including refinements<br />
to drafting will be worked up in consultation with licensees ahead of the Second<br />
Consultation.<br />
Responding to this consultation<br />
1.34. We welcome responses in any format. However, for ease of reference, any<br />
interested parties with specific comments about the drafting of a particular<br />
condition(s) are requested to use the response template. 10 Where possible, specific<br />
comments on the <strong>licence</strong> drafting should include alternative wording.<br />
1.35. The purpose of this consultation is to seek views on whether our proposed<br />
<strong>licence</strong> drafting reflects the policy position set out in the <strong>T1</strong> IP Documents, the <strong>GD1</strong><br />
IP Documents <strong>and</strong> the FP Documents. This document is not seeking views on the<br />
policy itself. Views on any specific policy matters as set out in the <strong>T1</strong> IP Documents<br />
or <strong>GD1</strong> IP Documents should be sent to us as a response to the those consultations.<br />
Proposed next steps<br />
1.36. We will conduct the Second Consultation in the autumn. Subject to that<br />
consultation, this will be followed by the requisite 28 day statutory consultation in<br />
December 2012.<br />
