6.0 THE STRATEGIC PLANNING FEE 6.1 Issues Examined From 1 November 2002, NSW consent authorities began collecting a 'strategic planning fee' on certain development applications to assist in rolling out PlanFirst and implementing planning system reform. The EP&A Further Amendment (Fees) Regulation 2002 authorises the collection of the additional fee as part of the development application fee. The fee is payable on development applications valued at over $50,000 that involve the erection of a building, the carrying out of work, or the demolition of a building or work. The fee does not apply to complying development. The fee is 64 cents for every $1000 of the estimated cost of the proposed development. Consent authorities are able to retain a $5 administration fee per development application (DA) that the additional fee applies to, to assist in transfer/remittal. All councils and four State government consent authorities are responsible for collecting the fee and remitting the amount collected (minus the $5 per DA that may be retained), on a monthly basis to the Director-General of the Department of Infrastructure, Planning and Natural Resources. Consent authorities are also responsible for submitting a monthly report to the Department that provides details of the DAs that the additional fee was applicable to, the amount retained by consent authorities and the total amount remitted to the Department. As at 31 July 2003, $8.5 million had been collected (substantially more than the $6 million originally projected). Original Purpose for Collecting the Fee The EP&A Regulation authorises the collection of the fee and what it can be used for - that is - • monitoring and review of the provisions of environmental planning instruments that control development or are required to be considered by consent authorities when dealing with DAs. (For the purpose of assessing their effectiveness in achieving their intended effect and making recommendations for improvement). • monitoring and review of the efficiency and effectiveness of practices and procedures followed by consent authorities in dealing with DAs. Revenue from the fee was to be used to part fund the development of regional strategies and to provide funding assistance to local councils to undertake strategic planning and encourage innovation in the delivery of new local plans. In particular, it was envisaged that funding could be made available for: • developing key local planning components - eg: a strategic position on major development and land management issues; review and consolidation of controls or development of indicators. • demonstration projects - eg: electronic delivery of plans; collaborative proposals involving two or more councils; projects testing 'new' planning methods such as the translation of regionally focussed natural resource planning information into local plans.
