FINANCE, INVESTMENT & AUDIT The Finance, Investment and Audit Committee is headed by the Honorary Treasurer, Mr Eng Aik Meng. He is in charge of all matters pertaining to the Association’s finances, investments, accounts audit and surplus funds of the Association. The Association is financially strong as reflected in the Audited Financial Statements of the Association for the financial year ended 31 December 2009. OPERATIONAL COMMITTEES’ REPORTS INTERNATIONAL COMMITTEE Councillor Mr Esben Poulsson is the Chairman of the International Committee. A summary of the main issues that have been addressed by the Committee during the period in review is as follows: Global Competition Developments In light of the international nature of the shipping industry, the Committee continued monitoring developments in competition law in China, Hong Kong and India. The Committee also continued to monitor updates relating to competition law in the European Union. In particular, the Committee welcomed the adoption of the European Commission’s new Block Exemption Regulation, revising the current exemption for shipping consortia from the EC Treaty’s ban on restrictive business practices (Article 81). The Committee further noted that, whilst most members have been able to comply with European Commission requirements, some concerns remain with regard to determining market share threshold. Singapore Competition Developments On 1 January 2006, the provisions on anticompetitive agreements, decisions and practices and abuse of dominance for the Singapore Competition Act 2004 came into force. In anticipation of the entry into force of the provisions, an SSA Working Group was formed in 2005 with a view to securing a Block Exemption Order for liner shipping conferences. After a succession of meetings in 2005 and 2006, the Competition Commission of Singapore (CCS) passed the Block Exemption Order (BEO) for Liner Shipping came into force on 1 January 2006, to last for a period of 5 years. As the BEO will expire on 31 December 2010, the Committee was reactivated to engage the CCS in consultation with a view towards discussing a possible renewal of the BEO. The Committee has met with the CCS on 2 February this year. On 23 April, the Committee again met with the consultant appointed by the CCS. On both occasions, the Committee explained on the importance of the BEO and the impact to Singapore as a shipping hub and international maritime centre if it is not renewed.
