Kesenjangan beban perkara<br />
Jumlah perkara yang <strong>di</strong>periksa oleh bagian perdata<br />
Mahkamah Agung bergantung pada kese<strong>di</strong>aan para<br />
pihak yang berperkara untuk mengajukan permohonan<br />
kasasi. Perkara perdata memakan biaya yang besar<br />
<strong>dan</strong> menyita waktu serta memerlukan pengorbanan-<br />
pengorbanan lain dari para pihak. Seringkali para pihak<br />
yang berperkara jera mengajukan kasasi karena besarnya<br />
biaya atau waktu yang tersita untuk mendapatkan<br />
putusan. Akibatnya, sejumlah isu tertentu masih tetap<br />
berada <strong>di</strong> luar jangkauan penga<strong>di</strong>lan kasasi. Dan yang<br />
paling penting, isu-isu hukum dari perkara-perkara yang<br />
berasal dari ‘kelas menengah’ 37 yang <strong>di</strong>putus oleh judex<br />
factie tidak bisa mencapai Mahkamah Agung. Demikian<br />
pula halnya dengan isu-isu hukum yang hanya masuk ke<br />
arbitrase, terutama oleh para pelaku usaha.<br />
Singkat kata, penga<strong>di</strong>lan kasasi perdata sulit <strong>di</strong>jangkau<br />
oleh sejumlah pihak yang berperkara <strong>dan</strong> oleh karenanya<br />
penga<strong>di</strong>lan ini tidak dapat menjalankan fungsinya secara<br />
optimal. Meskipun kasasi dapat <strong>di</strong>lakukan atas dasar<br />
kepentingan penyeragaman penerapan hukum, hal ini<br />
hanya memberikan suatu solusi yang terbatas. Hanya<br />
se<strong>di</strong>kit perkara yang cocok untuk <strong>di</strong>dasarkan pada<br />
tujuan ini <strong>di</strong>karenakan faktor-faktor seperti dasar faktual<br />
(fakta) yang terlalu minim <strong>dan</strong> tidak a<strong>dan</strong>ya adu argumen<br />
hukum oleh para pihak yang bersengketa. Oleh karena<br />
itulah esensi masalah ini cenderung tetap tersembunyi.<br />
Hal ini <strong>di</strong>bahas secara lebih terperinci <strong>di</strong> sub-bab 4.2 <strong>di</strong><br />
bawah.<br />
Besarnya tumpukan perkara yang melebihi kemampuan<br />
Satu masalah yang <strong>di</strong>hadapi sektor perdata adalah<br />
relatif besarnya jumlah perkara yang tidak <strong>di</strong>kasasikan,<br />

masyarakat rata-rata), biaya proses kasasi sangatlah mahal.<br />
Gaps in caseload<br />
The volume of cases heard by the civil sector of the<br />
Supreme Court is dependent on the willingness of<br />
litigants to appeal in cassation. Civil litigation is costly<br />
and time-consuming and also requires other sacrifices by<br />
the parties. Often litigants are deterred from appealing<br />
in cassation by the expense or by the time taken to<br />
obtain judgment. As a result, certain subjects remain<br />
beyond the reach of the cassation court. Above all,<br />
legal issues from the ‘middle segment’ 37 of the cases<br />
heard by the courts of fact may not reach the Supreme<br />
Court, as is also true of subjects that are referred only to<br />
arbitration, mainly by businesses.<br />
In short, the civil cassation court is hard to reach<br />
for some litigants and is therefore prevented from<br />
performing its function to the full. Although cassation<br />
procee<strong>di</strong>ngs can be instituted in the interests of the<br />
uniform application of the law, this provides only a<br />
limited solution. No more than a handful of cases are<br />
suitable for this purpose due to such factors as the<br />
meagre factual basis and the absence of legal argument<br />
between opposing parties. The essence of the problem<br />
therefore tends to remain hidden. This is dealt with in<br />
more detail in section 4.2 below.<br />
Excessive caseload<br />
A problem that faces the civil sector is the relatively<br />
large number of cases that are not suitable for cassation,<br />
given the remit of the Supreme Court. 38 Even with<br />
