THE TERRITORY<br />

As diferenças mais significativas entre o novo<br />

enquadramento legal dos planos regionais de<br />

ordenamento do território, estabelecido pelo o<br />

Decreto-Lei n.º 380/99, e o regime jurídico que<br />

enquadrou a realização de grande parte dos<br />

PROT, o Decreto-Lei n.º 176-A/88, referem-se à<br />

sua “natureza” e ”vinculação”. Enquanto no<br />

Decreto-Lei n.º 176-A/88 os PROT tinham um<br />

carácter programático e normativo, e as suas<br />

normas e princípios vinculavam entidades<br />

públicas e privadas, segundo o Decreto-Lei<br />

n.º 380/99, os PROT definem a estratégia<br />

regional de desenvolvimento territorial,<br />

deixando de vincular entidades privadas, ainda<br />

que, ao servirem de enquadramento aos<br />

PMOT, condicionem a sua elaboração.<br />

No que respeita à cobertura territorial, as<br />

zonas de maior pressão urbanística<br />

encontram-se cobertas por PROT em<br />

elaboração, em vigor ou em revisão, à<br />

excepção da Área Metropolitana do Porto e da<br />

Lezíria do Tejo. No entanto, apenas o<br />

PROTAML, o PROZOM e o PROZEA foram<br />

recentemente aprovados (todos em 2002),<br />

encontrando-se as restantes oito áreas<br />

cobertas com PROT em fase de elaboração ou<br />

aprovados no início da década de 90.<br />

The most significant differences between the<br />

new legal guidelines governing regional<br />

planning, set out in Law Decree 380/99, and<br />

those previously in force for many of the PROT,<br />

i.e. Law Decree 176-A/88, refer to their “nature”<br />

and “how binding they are”. Whereas according<br />

to Law Decree 176-A/88, PROT were considered<br />

to be of a legislative and pragmatic nature and<br />

both private and public bodies were bound by<br />

their rules and regulations, now according to<br />

Law Decree 380/99, PROT set out the strategy<br />

for regional planning but are no longer binding<br />

on private bodies. Given that they serve as a<br />

master plan for municipal plans (PMOT)<br />

regional plans still determine whether and how<br />

these are drawn up.<br />

In terms of national coverage, areas of greater<br />

urban pressure fall under PROT whatever their<br />

stage of development: being drawn up, being<br />

carried out or being revised. Exceptions are the<br />

metropolitan area of Porto and the floodplains<br />

of the Tejo. However only the PROTAML,<br />

PROZOM and PROZEA were recently approved<br />

(all in 2002), and the other eight areas covered<br />

by PROT are in the development stage or were<br />

approved in the early nineties.<br />
