1. Obtenção de Número de Identificação Fiscal (NIF) Português<br />
O Número de Identificação Fiscal (doravante abreviadamente “NIF”), também conhecido como<br />
“Número de Contribuinte” identifica uma entidade fiscal contribuinte <strong>em</strong> <strong>Portugal</strong>. As pessoas<br />
coletivas têm um NIPC (Número de Identificação de Pessoa Coletiva), atribuído pelo Registo<br />
Nacional de Pessoas Colectivas.<br />
A obtenção de NIF constitui um passo fundamental para qu<strong>em</strong> pretende residir e/ou investir ou<br />
exercer algum tipo de atividade profissional <strong>em</strong> <strong>Portugal</strong>.<br />
É obrigatório para qu<strong>em</strong> pretende comprar ou arrendar um imóvel <strong>em</strong> <strong>Portugal</strong>.<br />
A obtenção de autorização de residência <strong>em</strong> <strong>Portugal</strong>, para e qualquer tipo de autorização de<br />
residência t<strong>em</strong>porária e/ou permanente, pressupõe a prévia obtenção de NIF.<br />
O NIF é ainda obrigatório para celebração de contrato de trabalho, exercício de uma atividade<br />
profissional independente e constituição de uma <strong>em</strong>presa <strong>em</strong> <strong>Portugal</strong>. Na prática, não é possível<br />
exercer qualquer atividade profissional e/ou económica, n<strong>em</strong> tanto investir <strong>em</strong> <strong>Portugal</strong><br />
s<strong>em</strong> a prévia obtenção de um NIF.<br />
O NIF é atribuído pela Autoridade Tributária e Aduaneira (“AT”), devendo ser requerido online<br />
no website “Portal das Finanças”.<br />
O procedimento para a obtenção de NIF difere consoante o requerente seja residente/nacional<br />
de Estado M<strong>em</strong>bro da União Europeia ou residente/nacional de Estado Terceiro, designadamente:<br />
1.1. Cidadão nacional da União Europeia/EEE<br />
Documentos a apresentar:<br />
i. Cópia certificada do documento de identificação válido (passaporte ou cartão de identidade<br />
ou título de residência de país da UE);<br />
ii. Comprovativo de morada <strong>em</strong>itido há menos de 3 meses (i.e.: fatura, extrato bancário,<br />
certidão de morada);<br />
iii. Procuração (no caso de o pedido de atribuição de NIF ser solicitado por procurador, nomeadamente<br />
advogado).<br />
Não sendo obrigatório, os cidadãos residentes no EEE pod<strong>em</strong> também nomear um representante<br />
fiscal.<br />
1.2. Cidadão nacional de Estado Terceiro<br />
Se o requerente for residente/nacional de um Estado Terceiro, fora da União Europeia ou do<br />
Espaço Económico Europeu (EEE), t<strong>em</strong> de nomear um Representante Fiscal <strong>em</strong> <strong>Portugal</strong>,<br />
que, na prática, atua como intermediário entre o Estrangeiro não residente e a Autoridade<br />
Tributária e Aduaneira <strong>em</strong> quaisquer questões fiscais relacionadas com a sua atividade e/ou<br />
impostos <strong>em</strong> <strong>Portugal</strong>. De acordo com a circular nº 90054 de 06-06-2022, a nomeação de representante<br />
fiscal não é obrigatória para o pedido de NIF, mas apenas quando vier a ser sujeito<br />
de uma relação tributária, seja para a aquisição de um imóvel <strong>em</strong> <strong>Portugal</strong> ou para o exercício<br />
de atividade própria no país.<br />
O Representante Fiscal é legalmente responsável por cumprir as obrigações declarativas, assegurando<br />
o cumprimento dentro <strong>dos</strong> prazos legais e informar o Representado sobre todas as<br />
<strong>Guia</strong> <strong>dos</strong> <strong>Investidores</strong> e <strong>Residentes</strong> <strong>Estrangeiros</strong> <strong>em</strong> <strong>Portugal</strong><br />
obrigações fiscais, prazos e eventuais contraordenações fiscais. T<strong>em</strong> ainda o direito, <strong>em</strong> nome do Representado,<br />
de reclamar, impugnar ou recorrer, caso seja necessário.<br />
Pode ser Representante Fiscal qualquer indivíduo ou pessoa coletiva que aceite a função, desde que residente<br />
<strong>em</strong> <strong>Portugal</strong> ou, no segundo caso, com sede <strong>em</strong> território português.<br />
A morada para onde será enviada a senha de acesso ao Portal das Finanças, b<strong>em</strong> como toda a correspondência<br />
fiscal será a residência fiscal/sede do representante fiscal.<br />
Posteriormente, aquando da obtenção de autorização de residência <strong>em</strong> <strong>Portugal</strong> o titular do NIF poderá<br />
registar a sua residência fiscal <strong>em</strong> <strong>Portugal</strong>, deixando de necessitar de Representante Fiscal junto da Autoridade<br />
Tributária e Aduaneira.<br />
O pedido de atribuição do NIF é realizado online devendo ser submetido obrigatoriamente pelo Representante<br />
Fiscal do cidadão estrangeiro ou por Mandatário com poderes para o efeito.<br />
Documentos a apresentar:<br />
i. Cópia certificada do documento de identificação válido (passaporte ou cartão de identidade);<br />
ii. Comprovativo de morada (fatura, extrato bancário, por ex<strong>em</strong>plo);<br />
iii. Declaração de nomeação e aceitação de Representante Fiscal;<br />
iv. Identificação do Representante Fiscal.<br />
2. Abertura de conta bancária<br />
A abertura de conta bancária <strong>em</strong> <strong>Portugal</strong> é, de igual modo, um procedimento fundamental à obtenção de<br />
autorização de residência, uma vez que o requerente deve ser titular de uma conta bancária aberta <strong>em</strong> instituição<br />
de crédito autorizada ou registada <strong>em</strong> território nacional junto do Banco de <strong>Portugal</strong> e d<strong>em</strong>onstrar que<br />
t<strong>em</strong> meios de subsistência suficientes <strong>em</strong> <strong>Portugal</strong>, de acordo com o legalmente estabelecido.<br />
S<strong>em</strong> prejuízo do exposto, com uma conta bancária <strong>em</strong> <strong>Portugal</strong> há uma clara desburocratização no pagamento<br />
de despesas e consumos do quotidiano. O mesmo se aplica relativamente às r<strong>em</strong>unerações da atividade<br />
profissional e/ou <strong>dos</strong> investimentos realiza<strong>dos</strong> <strong>em</strong> que os vencimentos serão normalmente transferi<strong>dos</strong><br />
para uma conta bancária portuguesa.<br />
Note-se, contudo, que os procedimentos para a abertura de conta bancária pod<strong>em</strong> variar de acordo com a<br />
Instituição de Crédito escolhida.<br />
No entanto, <strong>em</strong> termos gerais, o cidadão estrangeiro terá de apresentar os seguintes documentos:<br />
i. Passaporte ou documento de identificação;<br />
ii. Número fiscal do país de orig<strong>em</strong> ou onde resida,;<br />
iii. Comprovativo de proveniência de fun<strong>dos</strong> (Declaração de IRS; Declaração da entidade Patronal com<br />
descrição <strong>dos</strong> montantes venci<strong>dos</strong>; Contrato de Trabalho; Declaração anual de Rendimentos; comprovativo<br />
de distribuição de dividen<strong>dos</strong>, etc);<br />
iv. Comprovativo de morada;<br />
v. Indicação de Email e tel<strong>em</strong>óvel;<br />
vi. Indicação de Estado civil.<br />
Tratando-se de requerente que pretenda a obtenção de autorização de residência para atividade de investimento<br />
(Visto Gold), e de acordo com o montante do investimento que pretende realizar <strong>em</strong> <strong>Portugal</strong>, deve<br />
apresentar documentos comprovativos de meios financeiros para a realização da atividade de investimento.<br />

3. Alojamento<br />
Qualquer cidadão estrangeiro que queira estabelecer a sua residência <strong>em</strong> território Português, independent<strong>em</strong>ente<br />
do tipo de autorização de residência que venha a solicitar terá de fazer prova que, por qualquer<br />
meio legal, dispõe de Alojamento.<br />
Exceciona-se do supra mencionado as autorizações de residência para atividade de investimento – Visto<br />
Gold – que pela sua natureza permit<strong>em</strong> que o titular não tenha que residir <strong>em</strong> <strong>Portugal</strong>.<br />
O cidadão estrangeiro poderá optar por arrendar ou comprar um imóvel para nele residir com a sua família.<br />
3.1. Arrendar um imóvel <strong>em</strong> <strong>Portugal</strong><br />
O arrendamento de um imóvel constitui provavelmente a opção mais económica e imediata para obter alojamento<br />
<strong>em</strong> <strong>Portugal</strong> nomeadamente por ser um processo com menos custos e formalidades e maior rapidez<br />
quando comparado com a aquisição de um imóvel.<br />
Note-se, contudo, que o contrato de arrendamento está sujeito a forma escrita e, tratando-se de um contrato<br />
para habitação não poderá ser inferior a um ano. No que diz respeito às rendas, é prática comum que se defina<br />
a antecipação de rendas, assim como uma caução destinada a garantir o cumprimento das obrigações<br />
legais do contrato. A antecipação de rendas e prestação de caução está limitada, por disposição legal, ao<br />
montante máximo equivalente a dois meses de renda.<br />
A caução é devolvida com o término do contrato de arrendamento, verificado que não há pagamentos ou<br />
compensações a realizar como é ex<strong>em</strong>plo: o pagamento de rendas ou outras obrigações pecuniárias não<br />
cumpridas, a reparação do imóvel e/ou substituição <strong>dos</strong> móveis e/ou eletrodomésticos, limpeza do imóvel,<br />
reposição do estado original do imóvel. Note-se, porém, que <strong>em</strong> regra não são devidas quaisquer compensações<br />
<strong>em</strong> deteriorações decorrentes do normal e prudente uso do imóvel e bens que o compõe.<br />
No que diz respeito aos documentos a apresentar pelo cidadão estrangeiro, será s<strong>em</strong>pre necessário ter (ou<br />
obter) um número de contribuinte português nos termos referi<strong>dos</strong> no ponto 1.<br />
Alguns proprietários, como forma de garantia da idoneidade <strong>dos</strong> inquilinos e do cumprimento das obrigações<br />
contratuais, solicitam outros documentos <strong>em</strong> momento prévio à celebração do contrato de arrendamento,<br />
como declarações de impostos, recibos de ordenado, comprovativos de depósitos bancários, entre outros.<br />
3.2. Comprar um Imóvel <strong>em</strong> <strong>Portugal</strong><br />
S<strong>em</strong> prejuízo do acima exposto o cidadão estrangeiro poderá s<strong>em</strong>pre optar pela compra de um imóvel <strong>em</strong><br />
<strong>Portugal</strong>, o que lhe poderá significar uma otimização do seu investimento trazendo diversas vantagens.<br />
Atualmente, o mercado imobiliário português apresenta-se como um <strong>dos</strong> mais atrativos do mundo captando<br />
cada vez mais investidores estrangeiros com um exponencial de crescimento anual.<br />
O bom posicionamento do mercado imobiliário português deve-se, sobretudo, à qualidade da oferta, condições<br />
político-sociais, livre circulação pelos países do Espaço Schengen, relações económicas privilegiadas<br />
entre <strong>Portugal</strong>, Brasil, Angola e Moçambique e excelentes condições de vida que <strong>Portugal</strong> t<strong>em</strong> para oferecer<br />
aos cidadãos estrangeiros.<br />
Acresce que o Global Peace Index de 2023, <strong>Portugal</strong> é o sétimo país mais seguro do mundo e quarto país<br />
mais seguro da Europa. Possui um clima mediterrâneo, beleza natural e uma riqueza cultural e gastronómica<br />
únicas, proporcionando uma excelente e barata qualidade de vida a qu<strong>em</strong> opta por residir no país, para<br />
além de constituir uma porta de entrada para a Europa.<br />

O povo português é reconhecido internacionalmente como amável e hospitaleiro, mostrando-<br />
-se s<strong>em</strong>pre disponível para ajudar e receber to<strong>dos</strong> aqueles que visitam e resid<strong>em</strong> no país.<br />
Mantendo a posição de melhor destino turístico europeu desde 2017 com o fluxo de turistas a aumentar<br />
anualmente, o investimento <strong>em</strong> imobiliário <strong>em</strong> <strong>Portugal</strong> constitui um ativo com enorme potencial de valorização<br />
e retorno.<br />
Assim, a imag<strong>em</strong> de <strong>Portugal</strong> como um país de excelência para viver e investir t<strong>em</strong> vindo a ser reconhecida<br />
internacionalmente.<br />
Não obstante, a aquisição de um imóvel <strong>em</strong> <strong>Portugal</strong> acarreta alguns custos e implica o pagamento de impostos<br />
independent<strong>em</strong>ente da sua cidadania ou local de residência.<br />
3.2.1. Impostos e outros custos inerentes à compra de um imóvel <strong>em</strong> <strong>Portugal</strong><br />
A. Imposto Municipal sobre Transmissões Onerosas de Imóveis (IMT)<br />
O Imposto Municipal Sobre as Transmissões Onerosas de Imóveis (IMT) é o imposto devido pelo adquirente<br />
na aquisição de Imóveis <strong>em</strong> <strong>Portugal</strong>, sendo que o valor de imposto a pagar varia consoante a natureza do<br />
Imóvel, finalidade e preço de aquisição.<br />
Há, contudo, casos <strong>em</strong> que é possível ao adquirente beneficiar de isenção de pagamento de IMT, nomeadamente<br />
nos seguintes casos:<br />
i. Imóveis para habitação permanente com valor de aquisição ou valor patrimonial tributário (sendo considerado<br />
o de maior valor) até a €97.064,00;<br />
ii. Imóveis para habitação permanente com valor de aquisição ou valor patrimonial tributário (sendo considerado<br />
o de maior valor), sitos nas Regiões Autónomas da Madeira e Açores, até € 121.330,00;<br />
iii. Prédios adquiri<strong>dos</strong> para revenda (sendo requisito necessário que a Sociedade tenha por objeto social<br />
a atividade de compra e venda para revenda);<br />
iv. Imóveis sujeitos a obras de reabilitação urbana - No entanto, este benefício fiscal apenas é reconhecido<br />
caso tenham mais de 30 anos ou estejam localiza<strong>dos</strong> <strong>em</strong> áreas de reabilitação urbana e desde<br />
que as respetivas obras de reabilitação sejam iniciadas no prazo máximo de dois anos após a data de<br />
aquisição do imóvel ;<br />
v. Prédios ou parte de prédios rústicos <strong>em</strong> áreas florestais abrangidas por uma Zona de Intervenção Florestal<br />
(ZIF);<br />
vi. Prédios classifica<strong>dos</strong>, individualmente, como de interesse nacional, público ou municipal;<br />
vii. Prédios adquiri<strong>dos</strong> por instituições de crédito <strong>em</strong> processos de execução, falência/ insolvência ou <strong>em</strong><br />
dação <strong>em</strong> cumprimento;<br />
viii. Prédios adquiri<strong>dos</strong>, reabilita<strong>dos</strong> ou construí<strong>dos</strong> para afetação ao Programa de Apoio ao Arrendamento.<br />
ix. Aquisições de Prédios Urbanos ou frações autónomas de prédios urbanos desti- na<strong>dos</strong> exclusivamente<br />
a arrendamento para habitação permanente efetuadas por Fun<strong>dos</strong> de Investimento Imobiliário para<br />
Arrendamento Habitacional (FIIAH);<br />
x. No âmbito de operações de restruturação societária, nomeadamente fusões e cisões.<br />
B. Imposto de Selo (IS)<br />
O Imposto de Selo é pago na data de aquisição do imóvel, correspondendo o seu valor à taxa fixa de 0,8%<br />
sobre valor de aquisição ou valor patrimonial tributário, sendo considerado o de maior valor.<br />
C. Outros Custos<br />
Além da obrigatoriedade de pagamento de IMT e IS, o cidadão estrangeiro que pretenda adquirir um imóvel<br />

<strong>em</strong> <strong>Portugal</strong> terá que ter <strong>em</strong> conta outros custos, nomeadamente os custos notariais inerentes à escritura<br />
pública de compra e venda ou documento particular autenticado, cujo valor dependerá do caso concreto,<br />
assim como os <strong>em</strong>olumentos devi<strong>dos</strong> à Conservatória do Registo Predial <strong>em</strong> virtude registo de propriedade<br />
legalmente exigido no montante de € 250,00.<br />
D. Imposto Municipal sobre Imóveis (IMI)<br />
O IMI é um imposto que incide sobre o Valor Patrimonial Tributário do imóvel, devendo ser pago anualmente,<br />
sendo devido a 31 de Dez<strong>em</strong>bro do ano a que respeita pelo proprietário do imóvel <strong>em</strong> questão.<br />
A taxa a aplicar é definida por cada município <strong>em</strong> <strong>Portugal</strong>, com base nos intervalos de taxas previstas no<br />
Código do Imposto Municipal sobre Imóveis (CIMI), sendo que estes para prédios urbanos (imóveis para habitação<br />
e terrenos para construção) estão entre os 0,3% e os 0,45%. To<strong>dos</strong> os proprietários de imóveis <strong>em</strong><br />
<strong>Portugal</strong> deverão efetuar o pagamento deste imposto no mês de maio. No entanto, é permitido o pagamento<br />
faseado <strong>em</strong> mais do que uma prestação.<br />
3.3. Rentabilizar imóveis<br />
Tendo adquirido imóvel <strong>em</strong> <strong>Portugal</strong>, caso o mesmo não se destine à habitação permanente, a opção natural<br />
será rentabilizá-los através do arrendamento. Dependendo do respetivo tipo (para férias ou de longa duração),<br />
os requisitos legais e as implicações fiscais serão distintos.<br />
3.3.1. Arrendamento de Longa Duração e implicações fiscais<br />
To<strong>dos</strong> os contratos de arrendamento de longa duração dev<strong>em</strong> ser declara<strong>dos</strong> nas Finanças. O registo pode<br />
ser feito online de forma simples numa página própria daquele serviço (o prazo para registo será o último<br />
dia do mês seguinte ao da assinatura do contrato), e do mesmo deverão constar as informações básicas do<br />
contrato – identificação <strong>dos</strong> contratantes, identificação do imóvel, duração do contrato e valor da renda mensal.<br />
Este registo implica ainda o pagamento do respetivo imposto de selo no valor de 10% da renda mensal.<br />
Posteriormente ao registo do contrato e durante o seu curso, o proprietário t<strong>em</strong> a obrigação de <strong>em</strong>itir os respetivos<br />
recibos de renda – o qual pode igualmente ser feito de forma simples e online naquele mesmo site.<br />
Finalmente e quanto à carga fiscal aplicável a estes contratos, a mesma difere consoante a duração do<br />
mesmo.<br />
Exist<strong>em</strong> assim 4 escalões de tributação:<br />
• Contratos até 5 anos: é aplicável uma taxa de 25%. Contratos com esta duração não sofr<strong>em</strong> redução.<br />
• Contratos entre 5 e 10 anos: é aplicada uma taxa de 15%, e por cada renovação do contrato com igual<br />
duração será aplicada uma redução e dois pontos percentuais, até ao limite de 10%;<br />
• Contratos entre 10 e 20 anos: aplicada uma taxa de 10%;<br />
• Contratos superiores a 20 anos: aplicada uma taxa de 5%.<br />
3.3.2. Alojamento Local e implicações fiscais<br />
O alojamento local é uma alternativa ao arrendamento de longa duração que, à partida, poderá trazer maiores<br />
rendimentos, mas que traz consigo vários outros requisitos legais e um regime fiscal distinto.<br />
Para começar, o imóvel terá de constar de um registo próprio, que é efetuado através do Balcão do Empreendedor<br />
ou junto da câmara municipal do município onde se encontra. Para poder ser feito este registo,<br />
o imóvel deverá cumprir alguns requisitos legais previstos no regime legal do alojamento local (Decreto-Lei<br />
n.º 128/2014, de 20 de agosto cujas últimas alterações foram introduzidas pela Lei n.º 56/2023 de 06 de<br />
outubro).<br />

De referir, no entanto, que desde outubro de 2023, para as modalidades de apartamentos e estabelecimentos<br />
de hospedag<strong>em</strong>, apenas são aceites novos pedi<strong>dos</strong> de registo de alojamento local se os mesmos se<br />
situar<strong>em</strong> <strong>em</strong> territórios legalmente classifica<strong>dos</strong> como de interior e baixa densidade populacional ou se os<br />
mesmos se situar<strong>em</strong> nas Regiões Autónomas.<br />
A exploração deste tipo de estabelecimentos pressupõe que se efetue declaração de início de atividade<br />
junto da autoridade tributária, nomeadamente da atividade de prestação de serviços de alojamento. Este<br />
início de atividade poderá igualmente ser feito na página de internet da Autoridade Tributária. De igual forma,<br />
aquando da cessação desta atividade, deverá efetuar a respetiva declaração. O enquadramento fiscal<br />
destes rendimentos irá depender de alguns fatores.<br />
Em sede de IRS (Rendimento das Pessoas Singulares) dependerá, logo à partida, se o volume de negócios<br />
ilíquido é igual ou inferior a €200.000,00.<br />
Em caso negativo (se aquele volume de negócios for superior), o contribuinte é obrigado a dispor de contabilidade<br />
organizada, isto é, a contratar um Contabilista Certificado (CC) que fique encarregue de proceder aos<br />
registos contabilísticos e contas (equivalente às Sociedades) sendo que o imposto será apurado de acordo<br />
com contabilidade do sujeito passivo, corrigido de acordo com as regras do IRS.<br />
Em caso positivo (o volume de negócios é igual ou inferior a € 200.000,00) então o contribuinte poderá<br />
optar pelo regime de contabilidade organizada (no qual, tal como no ex<strong>em</strong>plo anterior, a determinação do<br />
rendimento efetua-se com base na contabilidade de acordo com as regras estabelecidas no Código do IRC),<br />
ou pelo regime simplificado, no qual o imposto aplicável a estes rendimentos é fixado <strong>em</strong> 35%. Em sede de<br />
IRS, e <strong>em</strong> alternativa, os sujeitos passivos pod<strong>em</strong> optar pela tributação segundo as regras da categoria F<br />
(rendimentos prediais).<br />
4. Obtenção de Residência Legal <strong>em</strong> <strong>Portugal</strong><br />
4.1. O programa de Vistos Gold<br />
Lançado <strong>em</strong> 2012 com o objetivo de atrair investimento estrangeiro para <strong>Portugal</strong>, o programa português<br />
de Vistos Gold revelou-se um verdadeiro sucesso, tornando-se num <strong>dos</strong> mais populares da Europa e do<br />
Mundo para a obtenção de autorização de residência t<strong>em</strong>porária através da efetiva concretização uma das<br />
atividades de investimento previstas na Lei n.º 23/2007, de 04 de Julho.<br />
De entre os diversos tipos de autorizações de residência que exist<strong>em</strong> <strong>em</strong> <strong>Portugal</strong> o Visto Gold foi <strong>dos</strong> que<br />
mais se destacou a este nível e mais investimento estrangeiro direto trouxe para <strong>Portugal</strong>, particularmente<br />
pelas diversas vantagens que oferece aos seus titulares, nomeadamente:<br />
• Viajar e circular livr<strong>em</strong>ente pelos países da UE do espaço Schengen, s<strong>em</strong> a necessidade de visto para<br />
o efeito;<br />
• Entrar livr<strong>em</strong>ente <strong>em</strong> <strong>Portugal</strong> com dispensa de visto de residência, permitindo, também, residir, trabalhar<br />
e estudar no país;<br />
• Possibilidade do investidor permanecer apenas 7 dias por ano <strong>em</strong> território Português s<strong>em</strong> que a respetiva<br />
autorização de residência t<strong>em</strong>porária seja cancelada;<br />
• Solicitar a autorização de residência para familiares através do procedimento de reagrupamento familiar;<br />
• Após cinco anos de legal residência <strong>em</strong> <strong>Portugal</strong>, os titulares de visto gold pod<strong>em</strong> solicitar a concessão<br />
de Autorização de Residência Permanente e/ou a nacionalidade portuguesa, por naturalização, verifica<strong>dos</strong><br />
os requisitos legalmente estabeleci<strong>dos</strong>.<br />
4.1.1. Modalidades de Investimento elegíveis para Visto Gold<br />
O cidadão estrangeiro poderá solicitar uma Autorização de Residência para Atividade de Investimento, <strong>em</strong><br />
virtude do investimento efetivamente realizado numa das seguintes modalidades:<br />

i. A criação de, pelo menos, 10 postos de trabalho - pode ser inferior <strong>em</strong> 20% quando a atividade seja<br />
efetuada <strong>em</strong> territórios de baixa densidade.<br />
ii. Transferência de capitais no montante igual ou superior a 500 mil euros, que seja aplicado <strong>em</strong> atividades<br />
de investigação desenvolvidas por instituições públicas ou privadas de investigação científica, integradas<br />
no sist<strong>em</strong>a científico e tecnológico nacional- - pode ser inferior <strong>em</strong> 20% quando a atividade seja<br />
efetuada <strong>em</strong> territórios de baixa densidade.<br />
iii. Transferência de capitais no montante igual ou superior a 250 mil euros, que seja aplicado <strong>em</strong> investimento<br />
ou apoio à produção artística, recuperação ou manutenção do património cultural nacional, através<br />
de serviços da administração direta central e periférica, institutos públicos, entidades que integram<br />
o setor público <strong>em</strong>presarial, fundações públicas, fundações privadas com estatuto de utilidade pública,<br />
entidades intermunicipais, entidades que integram o setor <strong>em</strong>presarial local, entidades associativas<br />
municipais e associações públicas culturais, que prossigam atribuições na área da produção artística,<br />
recuperação ou manutenção do património cultural nacional - pode ser inferior <strong>em</strong> 20% quando a atividade<br />
seja efetuada <strong>em</strong> territórios de baixa densidade.<br />
iv. Transferência de capitais no montante igual ou superior a 500.000 mil euros, destina<strong>dos</strong> à aquisição<br />
de partes de organismos de investimento coletivo não imobiliários, que sejam constituí<strong>dos</strong> ao abrigo da<br />
legislação portuguesa, cuja maturidade, no momento do investimento, seja de, pelo menos, cinco anos<br />
e, pelo menos, 60% do valor <strong>dos</strong> investimentos seja concretizado <strong>em</strong> sociedades comerciais sediadas<br />
<strong>em</strong> território nacional;<br />
v. Transferência de capitais no montante igual ou superior a 500.000 mil euros, destina<strong>dos</strong> à constituição<br />
de uma sociedade comercial com sede <strong>em</strong> território nacional, conjugada com a criação de cinco postos<br />
de trabalho permanentes, ou para reforço de capital social de uma sociedade comercial com sede <strong>em</strong><br />
território nacional, já constituída, com a criação de, pelo menos, cinco postos de trabalho permanentes<br />
ou manutenção de, pelo menos, dez postos de trabalho, com um mínimo de cinco permanentes, e por<br />
um período mínimo de três anos.<br />
Tais modalidades de atividades de investimento ficam sujeitas a avaliação a cada dois anos quanto aos<br />
seus impactos na atividade científica, cultural e na promoção do investimento direto estrangeiro e criação<br />
de postos de trabalho.<br />
4.1.2. Organismos de Investimento Coletivo<br />
(requisitos de elegibilidade <strong>dos</strong> Vistos Gold)<br />
Como se desenvolverá no ponto 4.1.3, <strong>em</strong> 07 de outubro de 2023 entraram <strong>em</strong> vigor alterações significativas<br />
no Regime de Autorização de Residência por Investimento. Neste sentido, a obtenção do Visto Gold por<br />
via de investimento imobiliário direto ou indireto deixou assim de ser possível.<br />
Deste modo, como solução alternativa destaca-se a modalidade de investimento mediante a transferência<br />
de capitais no montante igual ou superior a € 500.000,00 euros que dev<strong>em</strong> ser destina<strong>dos</strong> à aquisição de<br />
unidades de participação <strong>em</strong> Organismos de Investimento Coletivo (“OIC”).<br />
Quais as vantagens?<br />
• Segurança: modelo de investimento e regras definidas no Regulamento de Gestão, que limitam a atuação<br />
da Sociedade Gestora, que está obrigada a seguir a política de investimento ali definida. A atuação<br />
da sociedade gestora na gestão do Organismo de Investimento Coletivo é fiscalizada pelo Banco Depositário<br />
e pela CMVM, esta última atuando quer no âmbito do campo regulatório quer no âmbito da<br />
supervisão comportamental e prudencial.<br />
• Regulação e Supervisão: um OIC registado <strong>em</strong> <strong>Portugal</strong> é regulado e supervisionado pela Comissão<br />
do Mercado de Valores Mobiliários e, de acordo do com a lei fiscal <strong>em</strong> vigor, pela Autoridade Tributária<br />
e Aduaneira. Estes eleva<strong>dos</strong> níveis de regulamentação garant<strong>em</strong> que o OIC cumpra a legislação portuguesa,<br />
a legislação fiscal e a proposta de plano de investimento aprovada pelos investidores do fundo.<br />
• Administração: Gestão e Representação: Os OIC´s pod<strong>em</strong> ser geri<strong>dos</strong>, administra<strong>dos</strong> e representa<strong>dos</strong><br />
por Sociedades Gestoras de Organismos de Investimento Coletivos (SGOIC) ou por Sociedades de<br />
<strong>Guia</strong> <strong>dos</strong> <strong>Investidores</strong> e <strong>Residentes</strong> <strong>Estrangeiros</strong> <strong>em</strong> <strong>Portugal</strong><br />
Capital de Risco (SCR), que têm por objeto a administração <strong>dos</strong> referi<strong>dos</strong> OIC. As SGOIC pod<strong>em</strong> gerir<br />
qualquer tipo de OIC, desde que não se circunscrevam exclusivamente a OIA (Organismos de Investimento<br />
Alternativo) <strong>em</strong> Capital de Risco, enquanto as SCR apenas pod<strong>em</strong> gerir OIA, devendo, pelo<br />
menos, um <strong>dos</strong> OIA sob gestão ser qualificado como OIA <strong>em</strong> Capital de Risco e não podendo os OIA<br />
Imobiliário representar mais de metade <strong>dos</strong> OIA sob gestão.<br />
• Taxas e Impostos: modalidade menos dispendiosa, quando comparada por ex<strong>em</strong>plo com a opção de<br />
investimento imobiliário, não t<strong>em</strong> lugar a pagamento de impostos e outros custos associa<strong>dos</strong> à compra<br />
de um imóvel <strong>em</strong> <strong>Portugal</strong> (vd. ponto 3.2.1).<br />
• Eficiência Fiscal: dependendo da estrutura tributária do fundo e do investidor, um investimento <strong>em</strong> um<br />
fundo pode gerar eficiências tributárias significativas. Certos casos permit<strong>em</strong> a isenção da retenção na<br />
fonte sobre os rendimentos gera<strong>dos</strong> pelo fundo, particularmente se os investidores não for<strong>em</strong> residentes<br />
fiscais <strong>em</strong> <strong>Portugal</strong>.<br />
• Diversificação: A legislação portuguesa determina que os fun<strong>dos</strong> tenham um certo nível de diversificação.<br />
Exist<strong>em</strong> limitações que determinam qual percentual um ativo específico ou um investimento do<br />
fundo deverá constituir na carteira total do fundo. Isso permite a diversificação <strong>dos</strong> investimentos dentro<br />
do fundo e uma redução do risco para os investidores participantes, ou seja, reforça a segurança e<br />
retorno no investimento.<br />
• Conhecimento: ao contrário das outras modalidades de investimento com o mesmo montante mínimo de<br />
investimento legalmente exigido de (€ 500.000,00 euros), esta modalidade de investimento permite, <strong>em</strong><br />
virtude da gestão realizada pela SGOIC, um menor conhecimento sobre os diversos sectores mercado<br />
Português b<strong>em</strong> como um menor acompanhamento da atividade de investimento porquanto a administração<br />
do OIC cabe à Sociedade Gestora, quando estes sejam heterogeri<strong>dos</strong>; como a transferência de<br />
capitais no montante igual ou superior a € 500.000,00, destina<strong>dos</strong> à constituição de uma sociedade<br />
comercial com sede <strong>em</strong> território nacional, conjugada com a criação de cinco postos de trabalho permanentes,<br />
ou para reforço de capital social de uma sociedade comercial com sede <strong>em</strong> território nacional, já<br />
constituída, com a criação ou manutenção de postos de trabalho, com um mínimo de cinco permanentes,<br />
e por um período mínimo de três anos, são modelos de investimento que requer<strong>em</strong> a intervenção de<br />
vários intervenientes, consultores técnicos e de um conhecimento sobre o sector imobiliário e construção<br />
no primeiro caso e sobre o sector <strong>em</strong>presarial e do trabalho no segundo. Por este motivo, parec<strong>em</strong>,<br />
à partida, mais complexos para o investidor que não pode estar presente <strong>em</strong> <strong>Portugal</strong> para acompanhar<br />
o desenvolvimento do seu investimento.<br />
O processo de subscrição de um OIC poderá d<strong>em</strong>orar substancialmente menos até estar concluído, quando<br />
comparado com as d<strong>em</strong>ais atividades de investimento, o que permitirá ao investidor iniciar o processo<br />
de obtenção do Golden Visa com alguma celeridade. Não obstante, a maior ou menor rapidez dependerá<br />
s<strong>em</strong>pre da tomada de decisão, rapidez na obtenção <strong>dos</strong> documentos necessários à obtenção do número<br />
de identificação fiscal português (vd. ponto 1), à abertura de Conta Bancária <strong>em</strong> <strong>Portugal</strong> (vd. ponto 2) e ao<br />
processo de KYC e Compliance legalmente imposto.<br />
Destarte, esta é uma modalidade de investimento pouco dispendiosa, com grande eficiência fiscal, elevado<br />
grau de segurança e com a particularidade de que, <strong>em</strong> função do Regulamento de Gestão do Fundo, os<br />
rendimentos anuais e a eventual valorização do capital pod<strong>em</strong> ser significativamente mais altos que nas<br />
d<strong>em</strong>ais modalidades de investimento.<br />
Relativamente à documentação necessária, exige a seguinte documentação geral (<strong>em</strong> todo muito s<strong>em</strong>elhante<br />
às restantes modalidades):<br />
• Passaporte Válido;<br />
• (Quando o investidor resida <strong>em</strong> território Português):<br />
o Documento comprovando a cobertura do Serviço Nacional de Saúde Português, ou<br />
o Documento comprovando a cobertura de um seguro de saúde reconhecido internacionalmente,<br />
• Registo Criminal do requerente do país de orig<strong>em</strong> ou de residência, devidamente legalizado pelo competente<br />
Posto Consular Português e traduzido para língua portuguesa (válido por três meses após a sua<br />
data de <strong>em</strong>issão);<br />

• Comprovativo de pagamento da taxa de submissão de pedido de ARI.<br />
A diferença está na documentação específica relacionada com o tipo de investimento <strong>em</strong> uni- dades de participação,<br />
pelo que concomitant<strong>em</strong>ente com os documentos gerais, dev<strong>em</strong> ser apresenta<strong>dos</strong> os seguintes<br />
documentos:<br />
• Declaração da instituição bancária autorizada ou registada <strong>em</strong> território nacional no Banco de <strong>Portugal</strong>,<br />
atestando a transferência efetiva de valor igual ou superior ao mínimo exigido (€ 500.000,00);<br />
• Certificado comprovativo da titularidade das unidades de participação, livre de ónus e encargos, <strong>em</strong>itido<br />
pelo Banco Depositário.<br />
• Declaração, <strong>em</strong>itida pela sociedade gestora do respetivo fundo de investimento, atestando a viabilidade<br />
do plano de capitalização, a maturidade de, pelo menos, cinco anos, e aplicação de, pelo menos, 60 por<br />
cento do investimento <strong>em</strong> sociedades comerciais sediadas <strong>em</strong> território nacional.<br />
• O processo de obtenção do Golden Visa nesta modalidade só pode iniciar-se quando a atividade de<br />
investimento tiver concluída. Acresce que, o investidor t<strong>em</strong> de garantir que a subscrição no OIC pelo<br />
período mínimo de 5 anos e, ainda, cumprir com os requisitos t<strong>em</strong>porais mínimos de permanência <strong>em</strong><br />
território português. (vd. 4.1.4).<br />
4.1.3. Alterações ao Regime Jurídico <strong>dos</strong> Vistos Gold, <strong>em</strong> vigor a partir de 07 de outubro de 2023<br />
A Lei n.º 56/2023 de 6 de outubro de 2023, denominada por “Programa Mais Habitação” veio impl<strong>em</strong>entar<br />
novas alterações ao regime jurídico <strong>dos</strong> Vistos Gold <strong>em</strong> <strong>Portugal</strong>, de forma a retirar do leque de investimentos<br />
elegíveis para efeitos de atribuição de uma autorização de residência para atividade de investimento<br />
qualquer investimento relacionado com bens imóveis.<br />
No entanto, os pedi<strong>dos</strong> de concessão e renovação de autorização de residência para atividade de investimento<br />
ao abrigo do quadro legal <strong>em</strong> vigor até o dia 07 de outubro de 2023, b<strong>em</strong> como os correspondentes<br />
pedi<strong>dos</strong> de reagrupamento familiar não serão afeta<strong>dos</strong> pelas alterações previstas na Lei melhor identificada<br />
<strong>em</strong> epígrafe.<br />
Tais alterações reflet<strong>em</strong>-se a dois aspetos distintos.<br />
Por um lado, foram revogadas as seguintes modalidades de investimento:<br />
a) Transferência de capitais no montante igual ou superior a € 1.500.000,00;<br />
b) Aquisição de bens imóveis de valor igual ou superior a € 500.000,00;<br />
c) Aquisição de bens imóveis, cuja construção tenha sido concluída há, pelo menos, 30 anos ou localiza<strong>dos</strong><br />
<strong>em</strong> área de reabilitação urbana e realização de obras de reabilitação <strong>dos</strong> bens imóveis<br />
adquiri<strong>dos</strong>, no montante global igual ou superior a € 350.000,00.<br />
Por outro lado, as modalidades de investimento elegíveis para a Autorização de Residência para Investidor<br />
(ARI), que subsist<strong>em</strong> com a mais recente alteração à Lei 23/2007, de 4 de julho, nomeadamente, o Investimento<br />
<strong>em</strong> UP`s de OIC e a Transferência de fun<strong>dos</strong> para a constituição ou reforço de capital social com a<br />
criação ou manutenção de postos de trabalho têm agora requisitos mais restritos para a sua elegibilidade.<br />
Vistos Gold<br />
Com o novo regime legal das ARI a aquisição de Unidades de Participação <strong>em</strong> Organismos de Investimento<br />
Coletivo, apenas será considerada um investimento elegível para fins de obtenção de “Golden Visa” caso<br />
estes OIC não invistam direta ou indiretamente <strong>em</strong> imobiliário.<br />

De igual modo, relativamente ao investimento <strong>em</strong> sociedades comerciais portuguesas os requisitos de elegibilidade<br />
desta modalidade de investimento foram altera<strong>dos</strong>, mantendo-se o critério quantitativo mínimo do<br />
investimento realizado <strong>em</strong> € 500.000,00 euros, alterando, contudo, os requisitos quanto à contratação de<br />
trabalhadores pela respetiva sociedade, nos termos infra:<br />
a) com constituição de uma sociedade comercial é necessária a criação de 5 postos de trabalho<br />
permanentes;<br />
b) quando seja realizado o aumento de capital de uma sociedade comercial é necessária a criação<br />
de 5 postos de trabalho ou a manutenção de pelo menos 10 postos de trabalho, sendo que pelo<br />
menos 5 destes postos dev<strong>em</strong> ser permanentes e por um período mínimo de 3 anos.<br />
4.1.4. Duração<br />
O visto gold t<strong>em</strong> a duração mínima de 5 (cinco) anos, não obstante o requerente poder continuar a solicitar<br />
a sua renovação após esse período, desde que se mantenham os requisitos mínimos exigi<strong>dos</strong> legalmente<br />
para o efeito.<br />
4.1.5. Procedimentos para a obtenção e renovação do Visto Gold<br />
4.1.5.1. Concessão/Candidatura:<br />
Para a submissão do pedido de autorização de residência para atividade de investimento dev<strong>em</strong> verificar-se<br />
cumulativamente os seguintes passos:<br />
i. Obter um número de contribuinte fiscal português e abrir uma conta bancária portuguesa;<br />
ii. Realizar uma das modalidades de investimento previstas na lei;<br />
iii. Submeter a candidatura online com os documentos legalmente exigíveis e pagar a taxa de análise;<br />
iv. Uma vez aprovada a candidatura online é necessário agendar, junto de uma delegação da AIMA - Agência<br />
para a Integração, Migrações e Asilo, competente para o efeito, atendimento ao balcão para entrega<br />
do processo documento físico e integral e subsequente recolha de da<strong>dos</strong> biométricos.<br />
v. Após a aprovação final da concessão da autorização de residência, efetuar o pagamento da taxa de<br />
<strong>em</strong>issão de título de residência ARI.<br />
Os pedi<strong>dos</strong> de ARI pendentes ao abrigo do regime atual até a entrada <strong>em</strong> vigor da presente lei, isto é, até 7<br />
de outubro de 2023, mantêm-se váli<strong>dos</strong>, desde que estejam verificadas as seguintes condições:<br />
a) Se encontr<strong>em</strong> a aguardar decisão junto das entidades competentes, anteriormente a data de<br />
entrada <strong>em</strong> vigor da presente Lei; ou<br />
b) Se encontr<strong>em</strong> pendentes de procedimentos de controlo prévio nas câmaras municipais, anteriormente<br />
a data da entrada <strong>em</strong> vigor da presente Lei.<br />
4.1.5.2. Renovações<br />
O processo de renovação determina a conversão da autorização de residência numa autorização de residência<br />
para imigrantes <strong>em</strong>preendedores, devendo o requerente cumprir, entre outros, com os seguintes<br />
requisitos:<br />
i. Manter os critérios quantitativos mínimos de investimento; e<br />
ii. Permanecer e comprovar o cumprimento do prazo de estada mínima <strong>em</strong> território português, nomeadamente,<br />
de 7 dias segui<strong>dos</strong> ou interpola<strong>dos</strong> <strong>em</strong> relação ao 1º ano ou de 14 dias, segui<strong>dos</strong> ou interpola<strong>dos</strong><br />
<strong>em</strong> relação aos subsequentes perío<strong>dos</strong> de 2 anos.<br />
O pedido de renovação pode ser realizado entre os 90 (noventa) e os 30 (trinta) dias anteriores à caducidade<br />
do título de residência ARI da seguinte forma:<br />
a) Proceder à marcação de um agendamento junto da AIMA para entrega de toda a documentação<br />
legalmente exigível e recolha de da<strong>dos</strong> Biométricos;<br />
b) Após a aprovação final da renovação do golden visa, da autorização de residência, deve-se<br />

4.2. Vistos de Residência<br />
Os vistos pod<strong>em</strong> ser de curta duração, estada t<strong>em</strong>porária, para a obtenção de autorização de residência<br />
(vistos de residência), ou para procura de trabalho.<br />
O visto de curta duração destina-se a permitir a entrada <strong>em</strong> território português ao seu titular para fins de<br />
trânsito, de turismo e de visita ou acompanhamento de familiares que sejam titulares de visto de estada<br />
t<strong>em</strong>porária.<br />
O visto de estada t<strong>em</strong>porária destina-se a permitir a entrada para estadas <strong>em</strong> <strong>Portugal</strong> por período inferior a<br />
um ano. Este visto é válido pela duração da estada e para múltiplas entradas <strong>em</strong> território nacional.<br />
O visto para obtenção de autorização de residência é válido para duas entradas durante o prazo de quatro<br />
meses, período durante o qual o seu titular deverá solicitar junto da AIMA um título para fixação da sua<br />
residência.<br />
Por fim, o visto para procura de trabalho habilita o seu titular a entrar e permanecer <strong>em</strong> território nacional<br />
com finalidade de procura de trabalho.<br />
Qualquer cidadão estrangeiro oriundo de Estado Terceiro, não pertencente à União Europeia, que pretenda<br />
residir <strong>em</strong> <strong>Portugal</strong> t<strong>em</strong> de solicitar um visto para fixação de residência, como é o caso <strong>dos</strong> denomina<strong>dos</strong><br />
Vistos D2, D3 e D7.<br />

Os titulares de Autorização de Residência ao abrigo <strong>dos</strong> vistos D2, D3 e D7 beneficiam de uma série de<br />
vantagens, nomeadamente:<br />
i. Viajar e circular livr<strong>em</strong>ente pelos países da UE do espaço Schengen, s<strong>em</strong> a necessidade de visto para<br />
o efeito;<br />
ii. Residir, trabalhar e estudar <strong>em</strong> <strong>Portugal</strong>, se assim o quiser<strong>em</strong>;<br />
iii. Usufruir do serviço nacional de saúde português;<br />
iv. Acesso ao direito e aos tribunais;<br />
v. Os familiares do requerente pod<strong>em</strong> solicitar o reagrupamento familiar, nomeadamente:<br />
a. Cônjuges;<br />
b. O parceiro que mantenha, <strong>em</strong> território nacional ou fora dele, com o cidadão estrangeiro residente<br />
uma união de facto, devidamente comprovada nos termos da lei;<br />

e. Os menores adota<strong>dos</strong> pelo requerente quando não seja casado, pelo requerente ou pelo cônjuge,<br />
por efeito de decisão da autoridade competente do país de orig<strong>em</strong>, desde que a lei desse<br />
país reconheça aos adota<strong>dos</strong> direitos e deveres idênticos aos da filiação natural e que a decisão<br />
seja reconhecida por <strong>Portugal</strong>;<br />
f. Entea<strong>dos</strong> do requerente;<br />
g. Os ascendentes na linha reta e <strong>em</strong> 1.º grau do residente ou do seu cônjuge, desde que se encontr<strong>em</strong><br />
a seu cargo;<br />
h. Os irmãos menores, desde que se encontr<strong>em</strong> sob tutela do residente, de harmonia com decisão<br />
proferida pela autoridade competente do país de orig<strong>em</strong> e desde que essa decisão seja reconhecida<br />
por <strong>Portugal</strong>.<br />
vi. No final de cinco anos, os titulares de Autorização de Residência ao abrigo <strong>dos</strong> vistos D2, D3 e D7 (e/<br />
ou os respetivos familiares) pod<strong>em</strong> solicitar:<br />
a. A concessão de Autorização de Residência Permanente, cumprindo os pressupostos legais da<br />
Lei de <strong>Estrangeiros</strong> e do Decreto Regulamentar n.º 84/07 de 5 de nov<strong>em</strong>bro <strong>em</strong> vigor; e/ou<br />
b. A Nacionalidade Portuguesa, por naturalização, verifica<strong>dos</strong> os pressupostos estabeleci<strong>dos</strong> na<br />
Lei da Nacionalidade (Lei n.º 37/81, de 3 de Outubro).<br />
4.2.2. Benefícios Fiscais<br />
<strong>Portugal</strong> oferece um regime fiscal favorável para estrangeiros que pretendam tornar-se residentes fiscais<br />
no país.<br />
O estatuto de Residente não Habitual (RNH) é um estatuto especial que visa atrair profissionais que des<strong>em</strong>penh<strong>em</strong><br />
atividades de elevado valor acrescentado ou propriedade intelectual, além de cidadãos reforma<strong>dos</strong><br />
que benefici<strong>em</strong> de pensões obtidas no estrangeiro.<br />
Este estatuto foi aprovado <strong>em</strong> 2009 e, para usufruir do mesmo durante 10 anos consecutivos, o cidadão estrangeiro<br />
t<strong>em</strong> de ser considerado residente segundo a lei portuguesa e não ter sido tributado como residente<br />
fiscal <strong>em</strong> <strong>Portugal</strong> nos cinco anos anteriores ao pedido do estatuto.<br />
No entanto, foi anunciada a sua revogação a partir de 1 de janeiro de 2024.<br />
Neste sentido, as pessoas interessadas <strong>em</strong> beneficiar deste estatuto poderão fazê-lo até o dia 31 de dez<strong>em</strong>bro<br />
de 2023, e caso sejam aceites, poderão beneficiar deste regime por um período de 10 anos.<br />
4.2.3. Procedimento para obtenção de qualquer tipo de Visto de Residência<br />
Os vistos D2, D3 ou D7 são solicita<strong>dos</strong> junto do Posto Consular competente do país de orig<strong>em</strong> ou do país de<br />
residência (através do website https://www.vfsglobal.com/en/individuals/index.html), mediante a marcação<br />
de um agendamento presencial, onde o requerente irá submeter a sua candidatura, através da apresentação<br />
do respetivo formulário juntamente com a documentação geral e a documentação específica exigida<br />
para cada tipo de visto de residência.<br />
Documentação Geral:<br />
a. Requerimento <strong>em</strong> modelo próprio;<br />
b. Passaporte válido por mais 3 meses para além da duração da estada prevista;<br />
c. Fotografias tipo passe, atualizadas e <strong>em</strong> boas condições de identificação do requerente;<br />
d. Seguro de viag<strong>em</strong> válido, que permita cobrir as despesas necessárias por razões médicas, incluindo<br />
assistência médica urgente e eventual repatriamento;<br />
e. Autorização para consulta do registo criminal português pela AIMA;<br />
f. Certificado de registo criminal do país de orig<strong>em</strong> ou do país onde o requerente resida há mais<br />
de um ano (os menores de 16 anos estão isentos da apresentação <strong>dos</strong> documentos relativos ao<br />

registo criminal);<br />
g. Comprovativo de condições de alojamento;<br />
a. A prova de condições de alojamento pode ser feita através da apresentação de um contrato de<br />
arrendamento de longa duração, com a duração mínima de 1 (um) ano, ou mediante documentos<br />
que atest<strong>em</strong> que o requerente é proprietário de um imóvel <strong>em</strong> <strong>Portugal</strong>.<br />
h. Comprovativo da existência de meios de subsistência tal como defini<strong>dos</strong> por portaria <strong>dos</strong> m<strong>em</strong>bros<br />
do Governo competentes.<br />
Um <strong>dos</strong> requisitos fundamentais para a atribuição de qualquer tipo de Visto de residência é a prova de que o<br />
requerente dispõe de meios de subsistência por um período não inferior a 12 meses que lhe permitam viver<br />
<strong>em</strong> <strong>Portugal</strong>, ou que estará <strong>em</strong> condições de os vir a obter após a sua entrada.<br />
Nos termos do n.º 1, do artigo 2.º do disposto na Portaria n.º 1563/2007 de 11/12, o critério de determinação<br />
do valor mínimo <strong>dos</strong> meios de subsistência é efetuado por referência ao salário mínimo nacional <strong>em</strong> vigor,<br />
que <strong>em</strong> 2023 é de € 760,00 (setecentos e sessenta euros), com uma valoração per capita por cada m<strong>em</strong>bro<br />
do agregado familiar a reagrupar, conforme o quadro que se segue:<br />

No entanto, a prova da posse de meios de subsistência pode igualmente efetuar-se mediante apresentação<br />
de termo de responsabilidade, subscrito por cidadão nacional ou cidadão estrangeiro habilitado, com<br />
documento de residência <strong>em</strong> <strong>Portugal</strong>.<br />
4.2.4. Visto CPLP<br />

e de curta duração) se tratar de um nacional de um Estado da CPLP, onde se encontre <strong>em</strong> vigor o Acordo<br />
CPLP celebrado <strong>em</strong> Luanda, a 17 de julho de 2021, é automaticamente comunicado à AIMA a <strong>em</strong>issão do<br />
visto, sendo deste modo:<br />
i. Dispensado prévio parecer da AIMA;<br />
ii. O pedido de visto deve ser decidido num prazo de 60 dias, conta<strong>dos</strong> da apresentação do pedido;<br />
iii. Os competentes serviços para a <strong>em</strong>issão do visto (Embaixadas ou Consula<strong>dos</strong>) proced<strong>em</strong> à consulta<br />
direta da base de da<strong>dos</strong> do SIS;<br />
iv. É apenas recusada a <strong>em</strong>issão de visto no caso de indicação no SIS de interdição de entrada e permanência<br />
ou o requerente menor não disponha de autorização parental ou documento equivalente e<br />
durante o período de estada <strong>em</strong> território nacional não esteja acompanhado de qu<strong>em</strong> exerce responsabilidade<br />
parental.<br />
Caso opte por obter visto de residência CPLP, terá o requerente de apresentar pedido de autorização de<br />
residência no prazo máximo de 90 dias, conta<strong>dos</strong> da primeira entrada <strong>em</strong> <strong>Portugal</strong>, sendo que a decisão de<br />
atribuição de visto será tomada no prazo máximo de 60 dias.<br />
Este visto t<strong>em</strong> duração inicial de um ano, renovável por perío<strong>dos</strong> sucessivos de dois anos. Estes vistos<br />
dev<strong>em</strong> ser liminarmente deferi<strong>dos</strong> (exceto se o requerente estiver identificado no Sist<strong>em</strong>a de Informação<br />
Schengen como sendo objeto de indicação para efeitos de regresso ou de recusa de entrada e de permanência).<br />
Não é necessária a apresentação presencial para requerimento do visto.<br />
Ficam dispensa<strong>dos</strong> da apresentação <strong>dos</strong> seguintes documentos, para <strong>em</strong>issão de visto:<br />
- Seguro de viag<strong>em</strong> válido, que permita cobrir as despesas necessárias por razões médicas, incluindo<br />
assistência médica urgente e eventual repatriamento;<br />
- Comprovativo da existência de meios de subsistência;<br />
- Cópia do título de transporte de regresso, salvo quando seja solicitado visto de residência.<br />
A concessão de visto de residência CPLP confere ao seu titular o direito de requerer a autorização de residência<br />
CPLP, exceto nos casos <strong>em</strong> que a permanência <strong>em</strong> território português constitua perigo ou grave<br />
ameaça para a ord<strong>em</strong> pública, a segurança nacional, ou a saúde pública.<br />
4.3. O Visto D2<br />
O Visto D2 consiste num visto de residência para o exercício de atividade profissional independente ou<br />
para imigrantes <strong>em</strong>preendedores e Start Up Visa.<br />
Documentação Específica:<br />
Quanto a atividade profissional independente:<br />
i. Contrato de sociedade ou proposta escrita de contrato de prestação de serviços no âmbito de profissões<br />
liberais; e, se aplicável declaração <strong>em</strong>itida pela entidade competente <strong>em</strong> como se encontra habilitado a<br />
exercer a atividade <strong>em</strong> <strong>Portugal</strong>;<br />
Quanto a imigrantes <strong>em</strong>preendedores:<br />
i. Tenham efetuado operações de investimento;<br />
ii. Comprov<strong>em</strong> possuir meios financeiros disponíveis <strong>em</strong> <strong>Portugal</strong>, incluindo os decorrentes de financiamento<br />
obtido junto de instituição financeira <strong>em</strong> <strong>Portugal</strong>, e d<strong>em</strong>onstr<strong>em</strong>, por qualquer meio, a intenção<br />
de proceder a uma operação de investimento <strong>em</strong> território português, devidamente descrita e identificada<br />
ou,<br />

4.4. O Visto D3<br />
O Visto D3 é o visto de residência para atividades altamente qualificadas, cujo exercício requer competências<br />
técnicas especializadas, de carácter excecional ou uma qualificação adequada para o respetivo<br />
exercício.<br />
Assim, este Visto abrange to<strong>dos</strong> os cidadãos estrangeiros oriun<strong>dos</strong> de esta<strong>dos</strong> terceiros, que tenham sido<br />
admiti<strong>dos</strong> como estudantes de ensino superior ao nível de doutoramento ou como investigadores a colaborar<br />
num centro de investigação reconhecido pelo Ministério da Educação e Ciência, ou que venham a<br />
des<strong>em</strong>penhar uma atividade de docência num estabelecimento de ensino superior ou altamente qualificada.<br />
Documentação Específica:<br />
Para atividade docente, altamente qualificada ou cultural:<br />
i. Contrato de trabalho ou promessa de contrato de trabalho ou contrato de prestação de serviços; ou,<br />
ii. Carta convite <strong>em</strong>itida por instituição de ensino ou de formação profissional; ou,<br />
iii. Termo de responsabilidade de <strong>em</strong>presa certificada nos termos defini<strong>dos</strong> por portaria <strong>dos</strong> m<strong>em</strong>bros do<br />
Governo responsáveis pelas áreas da administração interna e da economia; ou,<br />
iv. Carta convite <strong>em</strong>itida por <strong>em</strong>presa ou entidade que realize <strong>em</strong> território nacional uma atividade cultural<br />
reconhecida pelo m<strong>em</strong>bro do Governo responsável pela área da cultura como de interesse para o país,<br />
ou como tal definida na lei; ou,<br />
v. Carta convite <strong>em</strong>itida por centro de investigação.<br />
Nota: Para os efeitos de prova de meios de subsistência, dev<strong>em</strong> ser ti<strong>dos</strong> <strong>em</strong> consideração os meios provenientes<br />
de contrato de trabalho ou promessa de contrato de trabalho. A prova de meios de subsistência<br />
pode ser efetuada através de apresentação de termo de responsabilidade pela entidade de acolhimento de<br />
trabalhadores.<br />
Para atividade altamente qualificada exercida por trabalhador subordinado:<br />
i. Contrato de trabalho ou de promessa de contrato de trabalho válidas com, pelo menos, um ano de duração,<br />
a que corresponda uma r<strong>em</strong>uneração anual de, pelo menos, 1,5 vezes o salário anual bruto médio<br />
nacional ou três vezes o valor indexante de apoios sociais (IAS);<br />
ii. No caso de profissão regulamentada, seja titular de qualificações profissionais elevadas, devidamente<br />
comprovadas com respeito do disposto na Lei n.º 9/2009, de 4 de março, ou <strong>em</strong> lei específica relativa<br />
ao reconhecimento das qualificações profissionais, necessárias para o acesso e exercício da profissão<br />
indicada no contrato de trabalho ou de promessa de contrato de trabalho;<br />
iii. No caso de profissão não regulamentada, seja titular de qualificações profissionais elevadas adequadas<br />
à atividade ou setor especificado no contrato de trabalho ou de promessa de contrato de trabalho. Para<br />
efeitos de <strong>em</strong>prego <strong>em</strong> profissões pertencentes aos grandes grupos 1 e 2 da Classificação Internacional<br />
Tipo (CITP), indicadas por Resolução do Conselho de Ministros, mediante parecer prévio da Comissão<br />
Permanente da Concertação Social, como profissões particularmente necessitadas de trabalhadores<br />
nacionais de Esta<strong>dos</strong> terceiros, o limiar salarial previsto na alínea a) do n.º 1 deve corresponder a, pelo<br />
menos, 1,2 vezes o salário bruto médio nacional, ou duas vezes o valor do IAS.<br />
Nota: Para os efeitos de prova de meios de subsistência, dev<strong>em</strong> ser ti<strong>dos</strong> <strong>em</strong> consideração os meios provenientes<br />
de contrato de trabalho ou promessa de contrato de trabalho. A prova de meios de subsistência<br />
pode ser efetuada através de apresentação de termo de responsabilidade pela entidade de acolhimento de<br />
trabalhadores.<br />
Em caso de dúvida quanto ao enquadramento da atividade e para efeitos de verificação da adequação da<br />
experiência profissional do nacional de Estado terceiro, os ministérios responsáveis pelas áreas do <strong>em</strong>prego<br />
e da educação e ciência <strong>em</strong>it<strong>em</strong> parecer prévio à concessão do visto.<br />
<strong>Guia</strong> <strong>dos</strong> <strong>Investidores</strong> e <strong>Residentes</strong> <strong>Estrangeiros</strong> <strong>em</strong> <strong>Portugal</strong><br />
4.5. O Tech Visa<br />
O Tech Visa t<strong>em</strong> como objetivo garantir que quadros altamente qualifica<strong>dos</strong>, estrangeiros à União Europeia,<br />
possam aceder aos <strong>em</strong>pregos cria<strong>dos</strong> pelas <strong>em</strong>presas portuguesas de forma simplificada.<br />
O programa dirige-se a <strong>em</strong>presas inseridas no mercado global, com sede ou estabelecimento estável no território<br />
nacional, que pretendam atrair para <strong>Portugal</strong> quadros técnicos qualifica<strong>dos</strong> e especializa<strong>dos</strong>, oriun<strong>dos</strong><br />
de esta<strong>dos</strong> terceiros e residentes fora da União Europeia.<br />
As <strong>em</strong>presas que pretendam ser certificadas para contratar cidadãos estrangeiros terão de apresentar candidatura<br />
através da plataforma eletrónica do IAPMEI, que é a entidade responsável pela certificação das<br />
<strong>em</strong>presas candidatas, envolvendo várias entidades, com a AIMA e a Direção-Geral <strong>dos</strong> Assuntos Consulares,<br />
no processo de atribuição de vistos de residência para os profissionais contrata<strong>dos</strong> pelas <strong>em</strong>presas<br />
certificadas.<br />
Após decisão favorável, a <strong>em</strong>presa certificada t<strong>em</strong> acesso à <strong>em</strong>issão de Termos de Responsabilidade para<br />
os trabalhadores estrangeiros contrata<strong>dos</strong> ou que pretende contratar, através de formulário disponibilizado<br />
eletronicamente pelo IAPMEI.<br />
Assim, a certificação Tech Visa simplifica os procedimentos de obtenção de visto e autorização de residência<br />
junto <strong>dos</strong> Postos Consulares, com possibilidade de dispensa de agendamento presencial e s<strong>em</strong> obrigação<br />
de apresentação de contrato ou contrato promessa e junto da AIMA, s<strong>em</strong> obrigação de apresentação<br />
de contrato.<br />
4.6. O Visto D7<br />
Os cidadãos estrangeiros, que não sejam nacionais de Esta<strong>dos</strong> M<strong>em</strong>bros UE, do Espaço Económico Europeu<br />
e Suíça, que pretendam des<strong>em</strong>penhar funções religiosas, viver <strong>em</strong> congregação, residir <strong>em</strong> <strong>Portugal</strong><br />
como reforma<strong>dos</strong> ou viver de rendimentos próprios pod<strong>em</strong> requerer a obtenção de um Visto D7.<br />
Para além da documentação geral referida no ponto 3.1., os requerentes de Visto D7 dev<strong>em</strong> apresentar<br />
junto do Consulado Português do país de orig<strong>em</strong> ou do país de residência, os seguintes documentos específicos:<br />
i. No caso de cidadão estrangeiro reformado:<br />
a. documento comprovativo da reforma e do respetivo montante que aufere no país de orig<strong>em</strong> ou<br />
de residência;<br />
ii. No caso de cidadão estrangeiro que viva de rendimentos de bens móveis ou imóveis, da propriedade<br />
intelectual ou de aplicações financeiras:<br />
a. documento comprovativo da existência e montante de tais rendimentos; prova de que possui<br />
rendimentos que permitam garantir a subsistência <strong>em</strong> <strong>Portugal</strong>.<br />
iii. Quanto aos cidadãos estrangeiros religiosos:<br />
a. certificado da igreja ou comunidade a que pertençam, desde que reconhecidas pela ord<strong>em</strong><br />
jurídica portuguesa.<br />
4.6.1. Visto de Residência para o Exercício de Profissão Prestada de Forma R<strong>em</strong>ota para fora do<br />
território nacional<br />
Este visto de residência t<strong>em</strong>porária é concedido a trabalhadores independentes e que prest<strong>em</strong> trabalho<br />
subordinado, quando estas atividades sejam prestadas de forma r<strong>em</strong>ota, permitindo a fixação de residência<br />
<strong>em</strong> <strong>Portugal</strong>.<br />
Aplica-se aos denomina<strong>dos</strong> digital nomads, isto é, pessoas singulares e coletivas domiciliadas fora do território<br />
nacional que comprov<strong>em</strong> o vínculo laboral ou a prestação de serviços de forma r<strong>em</strong>ota para fora<br />

Uma vez aprovado, a secção consular do país de orig<strong>em</strong> ou de residência <strong>em</strong>ite a vinheta do Visto (D2, D3<br />
ou D7) no passaporte do requerente, o qual é válido por um período de 4 meses e permite duas entradas<br />
<strong>em</strong> <strong>Portugal</strong>.<br />
Durante esse período, o requerente terá de comparecer a um agendamento na AIMA <strong>em</strong> <strong>Portugal</strong>, para<br />
solicitar uma autorização de residência t<strong>em</strong>porária, através da entrega <strong>em</strong> suporte papel de toda a documentação<br />
legalmente exigida e onde serão recolhi<strong>dos</strong> os seus da<strong>dos</strong> biométricos para a <strong>em</strong>issão de título<br />
de residência.<br />
4.7. Visto para procura de trabalho<br />
4.9.1. Custo da Autorização de Residência T<strong>em</strong>porária<br />
O Visto de procura de trabalho é concedido a cidadãos não nacionais de esta<strong>dos</strong> da União Europeia que<br />
procuram trabalho subordinado <strong>em</strong> <strong>Portugal</strong>. Este visto é <strong>em</strong>itido pelo prazo de 120 dias, com extensão por<br />
60 dias.<br />
À data da <strong>em</strong>issão do visto, o requerente é dispensado de apresentar contrato de trabalho ou proposta de<br />
contrato de trabalho, desonerando a entidade <strong>em</strong>pregadora de disponibilizar oferta de trabalho junto do<br />
IEFP (como acontece com os vistos de trabalho dependente).<br />
Se o requerente não preencher a finalidade do visto, isto é, constituição de uma atividade laboral, terá o<br />
mesmo de abandonar o país e apenas poderá instruir novo processo para obtenção de visto para procura<br />
de trabalho, um ano após o termo de validade do visto anterior.<br />

O pedido de prorrogação de permanência apresentado por titular de visto para procura de trabalho deve ser<br />
acompanhado de comprovativo de inscrição junto do IEFP, I. P., e de declaração do requerente com indicação<br />
da manutenção das condições da estada prevista.<br />
NOTA: Aos d<strong>em</strong>ais requisitos de atribuição de visto e concessão de autorização de residência aplica-se o<br />
disposto para o visto de residência t<strong>em</strong>porária e autorização de residência t<strong>em</strong>porária.<br />
4.9.2. Duração do Título de Residência T<strong>em</strong>porária<br />
Nos termos do n.º 1, do artigo 75.º da Lei n.º 23/2007, de 04 de julho, as autorizações de residência t<strong>em</strong>porárias<br />
são válidas pelo período de um ano contado a partir da data da <strong>em</strong>issão do respetivo título e são<br />
renováveis por perío<strong>dos</strong> sucessivos de dois anos. Destaque-se que desde a 2020, <strong>em</strong> função da pand<strong>em</strong>ia<br />
causada pela Covid-19, a título provisório e excecional, os títulos de residência são <strong>em</strong>iti<strong>dos</strong> com validade<br />
de dois anos e renova<strong>dos</strong> por perío<strong>dos</strong> sucessivos de três anos.<br />
Relativamente à Autorização de Residência T<strong>em</strong>porária para atividade de docência, altamente qualificada<br />
ou cultural, o requerente pode ser dispensado de visto de residência s<strong>em</strong>pre que tenha entrado ou permanecido<br />
legalmente <strong>em</strong> <strong>Portugal</strong>.<br />
4.9.3. Ausências de <strong>Portugal</strong> – Causas de Cancelamento da Autorização de Residência T<strong>em</strong>porária<br />
O Título de Residência T<strong>em</strong>porária implica que o cidadão estrangeiro resida habitualmente <strong>em</strong> <strong>Portugal</strong>, sob<br />
pena de lhe ser cancelada a respetiva autorização de residência.<br />

O n.º 2 do artigo 85.º da Lei n.º 23/2007, de 04 de julho, prevê os casos <strong>em</strong> que o residente tenha deixado<br />
de residir no País que levam ao cancelamento da Autorização de Residência T<strong>em</strong>porária.<br />
Assim sucederá caso o titular de autorização residência t<strong>em</strong>porária estiver ausente seis meses consecutivos<br />
ou oito meses interpola<strong>dos</strong>, durante o período de validade total da autorização de residência.<br />
Estas ausências prolongadas indiciam que o titular da autorização já não reside no País, mantendo por<br />
razões de conveniência o título de residente, pelas facilidades que lhe confere nomeadamente para efeitos<br />
de entrada e circulação no espaço da União Europeia.<br />
No entanto, para evitar o risco de cancelamento da autorização de residência t<strong>em</strong>porária, a ausência para<br />
além <strong>dos</strong> limites previstos na Lei deve ser justificada mediante pedido apresentado no SEF antes da saída<br />
do residente do território nacional ou, <strong>em</strong> casos excecionais, após a sua saída (por ex<strong>em</strong>plo, necessidade<br />
de dar assistência pessoal a um familiar grav<strong>em</strong>ente doente, residente <strong>em</strong> país terceiro, pode ser considerado<br />
um caso excecional).<br />
Assim, não é cancelada a autorização de residência aos cidadãos que estejam ausentes por perío<strong>dos</strong> superiores<br />
aos acima mencionado, quando comprov<strong>em</strong> que durante a sua ausência de território nacional<br />
desenvolveram atividade profissional ou <strong>em</strong>presarial ou de natureza cultural ou social.<br />
4.10. Autorização de Residência Permanente ou Aquisição de Nacionalidade<br />
Portuguesa, por Naturalização<br />
Decorri<strong>dos</strong> 5 anos de residência legal <strong>em</strong> <strong>Portugal</strong>, o requerente poderá optar por solicitar uma Autorização<br />
de Residência Permanente e/ou a Nacionalidade Portuguesa, desde que preencha os requisitos e condições<br />
das respetivas legislações.<br />
O pedido de concessão de Autorização de Residência Permanente é formulado mediante agendamento,<br />
entregue presencialmente com impresso próprio assinado pelo requerente ou pelo seu representante legal<br />
<strong>em</strong> qualquer direção ou delegação regional da AIMA, que o pode r<strong>em</strong>eter, após instrução e decisão, para a<br />
direção ou delegação regional da área de residência do requerente.<br />
Além de outra documentação legalmente exigida, o pedido deve ser acompanhado de comprovativo de<br />
conhecimento de português básico, mediante apresentação de:<br />
i. Certificado de habilitações <strong>em</strong>itido por estabelecimento português de ensino oficial ou de ensino particular<br />
ou cooperativo reconhecido nos termos legais, ou<br />
ii. Tratando-se de pessoa que tenha frequentado estabelecimento de ensino oficial ou de ensino particular<br />
ou cooperativo reconhecido nos termos legais <strong>em</strong> país de língua oficial portuguesa, mediante certificado<br />
de habilitações <strong>em</strong>itido por esse estabelecimento de ensino, ou<br />
iii. Certificado de aproveitamento no curso de português básico <strong>em</strong>itido pelo IEFP, ou<br />
iv. Certificado de aproveitamento no curso de português básico <strong>em</strong>itido por estabelecimento de ensino<br />
oficial ou de ensino particular ou cooperativo legalmente reconhecido, ou<br />
v. Certificado de conhecimento de português básico, mediante a realização de teste <strong>em</strong> Centro de Avaliação<br />
de Português como Língua Estrangeira (CAPLE), reconhecido pelo Ministério da Educação e<br />
Ciência, ou, ainda<br />
vi. Certificado de conclusão do nível A2 ou superior <strong>em</strong> curso de Português Língua de Acolhimento,<br />
promovido por estabelecimentos de ensino da rede pública, pela rede de centros de gestão direta e<br />
participada do Instituto do Emprego e da Formação Profissional, I. P., e pela rede de Centros Qualifica<br />
(ou por outras entidades públicas e privadas com experiência comprovada no trabalho com populações<br />
migrantes, com as quais aquelas entidades ou o ACM. IP celebr<strong>em</strong> protocolos), nos termos da Portaria<br />
n.º 183/2020, de 5 de agosto.<br />
<strong>Guia</strong> <strong>dos</strong> <strong>Investidores</strong> e <strong>Residentes</strong> <strong>Estrangeiros</strong> <strong>em</strong> <strong>Portugal</strong><br />
O Título de Residência Permanente é <strong>em</strong>itido por um período de cinco anos, devendo ser renovado de cinco<br />
<strong>em</strong> cinco anos.<br />
Caso do o titular de autorização de residência permanente venha a se ausentar do território português<br />
durante 24 (vinte e quatro) meses segui<strong>dos</strong> ou 30 (trinta) meses interpola<strong>dos</strong> num período de três anos, a<br />
autorização de residência permanente pode ser cancelada, salvo se comprovar que durante a sua ausência<br />
de território nacional desenvolveu atividade profissional ou <strong>em</strong>presarial ou de natureza cultural<br />
ou social.<br />
Por outro lado, os estrangeiros maiores ou <strong>em</strong>ancipa<strong>dos</strong> à face da lei portuguesa, que residam legalmente<br />
no território português, há pelo menos cinco anos, desde que conheçam suficient<strong>em</strong>ente a língua portuguesa,<br />
não tenham sido condena<strong>dos</strong>, com trânsito <strong>em</strong> julgado da sentença, pela prática de crime punível com<br />
pena de prisão de máximo igual ou superior a três anos, segundo a lei portuguesa e não constituam perigo<br />
ou ameaça para a segurança ou a defesa nacional, pelo seu envolvimento <strong>em</strong> atividades relacionadas com<br />
a prática do terrorismo, nos termos da respetiva lei, pod<strong>em</strong> solicitar a nacionalidade portuguesa, por naturalização.<br />
O pedido é feito mediante requerimento dirigido ao Ministro da Justiça, acompanhado da documentação<br />
legalmente exigida (incluindo o comprovativo de conhecimento básico da língua portuguesa), apresentado<br />
eletronicamente por Advogado ou enviado pelo correio para a Conservatória <strong>dos</strong> Registos Centrais.<br />
5. Investimento na Zona Franca da Madeira<br />
5.1. As sociedades da Zona Franca da Madeira<br />
O Centro Internacional de Negócios da Madeira (CINM), usualmente designado como Zona Franca da Madeira<br />
(ZFM), foi criado nos anos 80 como um instrumento de desenvolvimento regional.<br />
Essencialmente, t<strong>em</strong> a vantag<strong>em</strong> de trazer um conjunto de incentivos, nomeadamente de cariz fiscal, visando<br />
atrair investimento externo para a Região.<br />
A Lei n.º 21/2021 de 20 de abril, entre outras alterações,prorroga pelo menos até 31 de dez<strong>em</strong>bro de 2027<br />
o regime do CINM / ZFM.<br />
Os principais benefícios fiscais e respetivo regime reg<strong>em</strong>-se pelo artigo 36.º-A e n.ºs 4 a 20 do artigo 33.º<br />
ambos do Estatuto <strong>dos</strong> Benefícios Fiscais (EBF).<br />
Ao abrigo do artigo 36.º-A do Estatuto <strong>dos</strong> Benefícios fiscais, o qual consagra o Regime IV da ZFM tal como<br />
consensualizado com a Comissão Europeia, to<strong>dos</strong> os tipos de sociedade previstos na lei portuguesa e inclusive<br />
sucursais, holdings/SGPS, unipessoais e estabelecimentos estáveis poderão instalar-se no CINM e<br />
beneficiar do inerente regime.<br />
De referir que os atuais benefícios aplicam-se a entidades registadas no CNIM desde 01 de janeiro de 2013<br />
até 31 de dez<strong>em</strong>bro de 2023 e aplicam-se até 31 de dez<strong>em</strong>bro de 2027.<br />

5.2. Benefícios da ZFM<br />

De referir, ainda, que a aplicação desse benefício encontra-se limitado por via de plafonds máximos à matéria<br />
coletável que venha a ser apurada<br />
6. Acesso ao Serviço Nacional de Saúde (SNS) Português<br />
O Número de Utente é atribuído a cada pessoa para a identificar no acesso aos serviços das unidades públicas<br />
de cuida<strong>dos</strong> de saúde do Serviço Nacional de Saúde (SNS).<br />
O cidadão estrangeiro com autorização de residência, permanência ou visto de trabalho <strong>em</strong> <strong>Portugal</strong> pode<br />
solicitar o número de utente do SNS.<br />
Caso não tenha residência legal ou visto de trabalho, terá de pedir um atestado de residência na sua junta<br />
de freguesia, que comprove que se encontra <strong>em</strong> <strong>Portugal</strong> há mais de 90 dias.<br />
Documentos a apresentar:<br />
i. Se t<strong>em</strong> cidadania estrangeira e t<strong>em</strong> autorização de residência ou permanência <strong>em</strong> <strong>Portugal</strong>, o requerente<br />
deverá apresentar os seguintes documentos no Centro de Saúde da sua área de residência:<br />
a. Autorização de residência / permanência ou visto de trabalho;<br />
b. Número de Identificação Fiscal (NIF).<br />
ii. Se t<strong>em</strong> cidadania estrangeira, não t<strong>em</strong> autorização de residência ou permanência ou visto de trabalho, mas<br />
vive <strong>em</strong> <strong>Portugal</strong> há mais de 90 dias, o requerente deverá solicitar:<br />
a. Um atestado de residência na sua junta de freguesia, que comprove que se encontra <strong>em</strong> <strong>Portugal</strong><br />
há mais de 90 dias.<br />
b. De seguida, bastará ao cidadão estrangeiro apresentar o atestado de residência e o NIF para se<br />
inscrever no Centro de Saúde e obter o número de utente. Com um número de utente vai poder ter<br />
acesso aos serviços e estabelecimentos do SNS.<br />
iii. Se t<strong>em</strong> cidadania estrangeira, vive <strong>em</strong> <strong>Portugal</strong> há menos de 90 dias, mas não t<strong>em</strong> residência permanente<br />
<strong>em</strong> <strong>Portugal</strong>, o requerente poderá fazer uma inscrição provisória, devendo para o efeito contactar<br />
a Linha Saúde 24 (808 24 24 24), onde lhe serão dadas indicações sobre a criação de um número<br />
de utente provisório.<br />

Em alternativa, ou mesmo simultaneamente, o cidadão estrangeiro pode contratar um seguro de saúde <strong>em</strong><br />
<strong>Portugal</strong>.<br />
7. Trabalhar <strong>em</strong> <strong>Portugal</strong><br />
7.1. Obter um número de Segurança Social<br />
Caso um cidadão estrangeiro queira exercer uma atividade profissional <strong>em</strong> <strong>Portugal</strong>, necessitará para o<br />
efeito de obter um Número de Identificação de Segurança Social (NISS), quer essa atividade seja por conta<br />
de outr<strong>em</strong> (caso <strong>dos</strong> trabalhadores dependentes) ou por conta própria (caso <strong>dos</strong> trabalhadores independentes).<br />
As instituições portuguesas, nomeadamente a Segurança Social, possibilita a obtenção de um NISS na<br />
hora, através de mecanismos bastante simples.<br />
7.2. Trabalhadores Dependentes / por Conta de Outr<strong>em</strong>:<br />
Os cidadãos estrangeiros que não tenham Número de Identificação da Segurança Social (NISS), pod<strong>em</strong> pedir<br />
o NISS online. Se começar a trabalhar por conta de outr<strong>em</strong>, é a entidade <strong>em</strong>pregadora que faz o pedido<br />
do NISS junto da Segurança Social.<br />
Considerando o caso de trabalhadores dependentes, para obtenção do NISS, a entidade patronal deverá<br />
proceder de acordo com os pontos abaixo, tendo na sua posse a documentação seguinte:<br />
o preencher o formulário disponível no portal da Segurança Social<br />
o anexar uma cópia digitalizada do documento de identificação<br />
o ter visto de trabalho.<br />
Se o pedido for feito pela entidade <strong>em</strong>pregadora ou representante legal de cidadão estrangeiro, será ainda<br />
necessário<br />
o Procuração (documento original) ou Declaração de Autorização a Terceiros - PA12<br />
o Documento de identificação da pessoa que seja representante legal (Passaporte, Autorização de<br />
Residência ou outro documento de identificação civil do país de orig<strong>em</strong>)<br />
Sendo a entidade <strong>em</strong>pregadora a efectuar o pedido, esta funciona como representante legal do trabalhador.<br />
O pedido do NISS é gratuito.<br />
7.3. Trabalhadores Independentes/ Abertura de Atividade na ATA<br />
No caso de o cidadão estrangeiro pretender desenvolver a sua atividade profissional como trabalhador<br />
independente, deverá efetuar ele próprio o pedido de atribuição de NISS através do endereço de <strong>em</strong>ail<br />
ISS-Pedido-NISS@seg-social.pt, devendo, para o efeito, anexar a documentação necessária digitalizada.<br />
7.4. Pedido de NIF e Abertura de Atividade na ATA<br />
Deverá ainda registar-se junto da Autoridade Tributária, para obtenção de NIF (Número de Identificação<br />
Fiscal) <strong>em</strong> qualquer das situações (trabalhador dependente ou independente) e abertura de atividade no<br />
caso de trabalhador estrangeiro qual poderá fazer de forma simples na sua área pessoal online do Portal<br />
das Finanças ou pessoalmente numa Repartição de Finanças.<br />
A obtenção de NIF é gratuita.<br />
O pedido de número de utente não t<strong>em</strong> qualquer custo e não é obrigatório para os titulares de um Visto Gold,<br />
<strong>em</strong>bora seja s<strong>em</strong>pre recomendável.<br />

8. Criação de uma Empresa <strong>em</strong> <strong>Portugal</strong> / Abertura de Sucursais<br />

Se o cidadão estrangeiro prentender a criação de uma nova <strong>em</strong>presa, ou a abertura de uma sucursal de<br />
uma <strong>em</strong>presa existente, atualmente a forma de o fazer <strong>em</strong> <strong>Portugal</strong> é bastante simples, sendo possível alcançá-lo<br />
de forma quase imediata através <strong>dos</strong> serviços “Empresa na hora” e “Sucursal na hora”, disponíveis<br />
<strong>em</strong> balcões especializa<strong>dos</strong> e existentes <strong>em</strong> todo o território nacional.<br />
Os documentos escritos <strong>em</strong> língua estrangeira dev<strong>em</strong> ser acompanha<strong>dos</strong> da tradução correspondente (com<br />
exceção de quando estiver<strong>em</strong> redigi<strong>dos</strong> <strong>em</strong> língua inglesa, francesa ou espanhola e o funcionário dominar<br />
essa língua).<br />
Para criar uma <strong>em</strong>presa com o serviço Empresa na Hora, é preciso:<br />
• Escolher uma firma da lista pré-aprovada na internet ou da lista no balcão Empresa na Hora, ou apresentar<br />
um certificado de admissibilidade de firma (CAF), previamente aprovado, pelo Registo Nacional<br />
de Pessoas Coletivas;<br />
• Escolher um <strong>dos</strong> modelos de pactos pré-aprova<strong>dos</strong>;<br />
• Indicar um Técnico Oficial de Contas (TOC), escolher um da Bolsa de TOCs disponibilizada ou entregar<br />
a declaração de início de atividade <strong>em</strong> qualquer serviço de Finanças (até 15 dias depois da criação da<br />
<strong>em</strong>presa);<br />
• Que os sócios da <strong>em</strong>presa tenham depositado o valor do capital social da <strong>em</strong>presa ou declar<strong>em</strong> que o<br />
valor será depositado <strong>em</strong> dinheiro ou entregue nos cofres da sociedade.<br />
Se os sócios for<strong>em</strong> pessoas singulares, precisam de:<br />
i. Apresentar o respetivo documento de identificação (Cartão de Cidadão, Bilhete de Identidade, Passaporte<br />
ou Autorização de Residência);<br />
ii. Indicar os seus Números de Identificação Fiscal (NIF).<br />
Se os sócios for<strong>em</strong> pessoas coletivas, é necessário apresentar<br />
i. O Cartão de Identificação de Pessoa Coletiva ou o código de acesso ao Cartão Eletrónico;<br />
ii. A ata de deliberação da Ass<strong>em</strong>bleia-Geral atribuindo aos representantes legais poder para criar a <strong>em</strong>presa;<br />
iii. Os documentos de identificação <strong>dos</strong> representantes legais da <strong>em</strong>presa que se quer criar (Cartão de<br />
Cidadão, Bilhete de Identidade, passaporte ou autorização de residência);<br />
iv. A certidão da escritura ou o documento de constituição ou pacto social atualizado das pessoas coletivas.<br />
Finalmente, para pedir o Número de Identificação de Pessoa Coletiva (NIPC) de uma <strong>em</strong>presa estrangeira<br />
que pretenda desenvolver atividade <strong>em</strong> <strong>Portugal</strong> será necessário fazer o respetivo pedido através de um<br />
formulário próprio (RNPC – Modelo 2) e instruí-lo com os documentos exigíveis consoante a natureza e o tipo<br />
da entidade estrangeira, sendo igualmente possível realizá-lo online através do portal eportugal.gov.pt. Este<br />
pedido está sujeito ao pagamento de <strong>em</strong>olumentos no montante de € 50.<br />
9. O Regime Fiscal <strong>dos</strong> <strong>Residentes</strong> Não Habituais (RNH)<br />
<strong>Portugal</strong> oferece um regime fiscal favorável e atrativo para estrangeiros que pretendam tornar-<br />
-se residentes fiscais no país e que não tenham sido tributa<strong>dos</strong> como tal nos últimos 5 anos. O estatuto de<br />
Residente Não Habitual (NHR) é um estatuto que visa atrair profissionais que des<strong>em</strong>penh<strong>em</strong> atividades de<br />
elevado valor acrescentado ou propriedade intelectual, além de pessoas que benefici<strong>em</strong> de rendimentos<br />
obti<strong>dos</strong> no estrangeiro.<br />
Este estatuto foi aprovado <strong>em</strong> 2009 e, para usufruir do mesmo durante 10 anos consecutivos, o cidadão<br />
estrangeiro t<strong>em</strong> de ser considerado residente segundo a lei portuguesa e não ter sido considerado como<br />
residente fiscal <strong>em</strong> <strong>Portugal</strong> nos cinco anos imediatamente anteriores ao inicio da residência.<br />
Foi anunciado pelo Governo a intenção de terminar com o regime do residente não habitual com efeitos a<br />
partir de 1 de Janeiro de 2024. A proposta de orçamento de estado de 2024 apresentada pelo Governo à<br />
Ass<strong>em</strong>bleia de República prevê que o regime se mantenha <strong>em</strong> vigor para qu<strong>em</strong> se torne residente fiscal <strong>em</strong><br />
<strong>Portugal</strong> até 31 de Dez<strong>em</strong>bro de 2023.<br />
To<strong>dos</strong> os sócios da <strong>em</strong>presa a criar têm de estar presentes aquando da realização do pedido de constituição<br />
da entidade.<br />
Constitu<strong>em</strong> atividades de elevado valor acrescentado, para efeitos de atribuição do estatuto de residente<br />
não habitual, as que constam da tabela seguinte:<br />

9.1. Procedimento<br />
O pedido de inscrição como residente não habitual deverá ser efetuado até 31 de março, inclusive, do ano<br />
seguinte àquele <strong>em</strong> que se torne residente no território português.<br />
Para efeitos de atribuição do estatuto de residente não habitual <strong>em</strong> <strong>Portugal</strong>, é necessário efetuar as seguintes<br />
etapas:<br />
a. Obtenção de um número de identificação fiscal português (NIF);<br />
b. Inscrição como residente fiscal <strong>em</strong> <strong>Portugal</strong> junto da Autoridade Tributária e Aduaneira;<br />
c. Inscrição como residente não habitual.<br />
O cidadão a qu<strong>em</strong> lhe seja atribuído o estatuto de residente não habitual é tributado segundo este regime<br />
pelo período improrrogável de 10 (dez) anos, a partir do ano, inclusive, da sua inscrição como residente <strong>em</strong><br />
<strong>Portugal</strong>, desde que <strong>em</strong> cada um desses anos seja considerado residente no território nacional.<br />
Caso deix<strong>em</strong> de ser considera<strong>dos</strong> residentes, não perd<strong>em</strong> o respetivo estatuto, sendo que, voltam a beneficiar<br />
do mesmo no ano <strong>em</strong> que volt<strong>em</strong> a ser considera<strong>dos</strong> residentes fiscais <strong>em</strong> <strong>Portugal</strong>, gozando do mesmo<br />
pelos anos r<strong>em</strong>anescentes desse período.<br />

Assim, <strong>em</strong>bora os titulares de autorização de residência para atividade de investimento (ARI) não estejam<br />
obriga<strong>dos</strong> a solicitar o estatuto de residente não habitual <strong>em</strong> <strong>Portugal</strong>, trata-se de um regime fiscal mais<br />
favorável que t<strong>em</strong> ganho cada vez mais a simpatia <strong>dos</strong> beneficiários de Visto Gold.<br />

por ex<strong>em</strong>plo, o falecido vivia num país que não é o seu país de orig<strong>em</strong>, os herdeiros resid<strong>em</strong> num país<br />
diferente; ou o falecido deixou bens <strong>em</strong> diversos países.<br />
10.2. O Regulamento Europeu <strong>em</strong> matéria de sucessões:<br />
Para evitar as dificuldades de, numa sucessão transnacional, ter<strong>em</strong> de iniciar-se procedimentos sucessórios<br />
nos vários países envolvi<strong>dos</strong> e com regimes legais diferentes, a União Europeia (UE), <strong>em</strong> 2012, adotou<br />
legislação destinada a facilitar o planeamento e a gestão das sucessões transnacionais — o Regulamento<br />
«Sucessões» [Regulamento (UE) n.º 650/2012], aplicável desde 17 de agosto de 2015.<br />
Este Regulamento europeu t<strong>em</strong> o seu âmbito de aplicação aos países da UE, com exceção, por ex<strong>em</strong>plo,<br />
da Irlanda e Dinamarca, e nomeadamente não prejudica a aplicação de outras convenções internacionais<br />
sobre a matéria.<br />
O regulamento estabelece normas simplificadoras quanto aos seguintes aspetos:<br />
1) Órgãos competentes para tratar da sucessão:<br />
O regulamento determina como princípio, que as autoridades competentes para tratar da sucessão transnacional<br />
são os órgãos jurisdicionais do Estado-M<strong>em</strong>bro <strong>em</strong> que o falecido tinha a última residência habitual<br />
no momento do óbito;<br />
2) Lei aplicável à sucessão:<br />
O regulamento define como regra geral que a lei aplicável ao conjunto da sucessão é a lei do Estado onde<br />
o falecido tinha residência habitual no momento do óbito, mesmo que não seja a lei de um Estado-M<strong>em</strong>bro<br />
da UE.<br />
Excecionalmente, se as circunstâncias do caso concreto d<strong>em</strong>onstrar<strong>em</strong> que o falecido tinha uma relação<br />
claramente mais estreita com um país diferente do da sua última residência habitual, será aplicada à sucessão<br />
a legislação do respetivo país (por ex<strong>em</strong>plo, se o falecido se tiver mudado para o país da sua última<br />
residência pouco antes da sua morte).<br />
3) Possibilidade de escolha da lei aplicável à sucessão<br />
Ainda no que toca à lei aplicável à sucessão, o regulamento estabelece que o cidadão pode definir a lei<br />
que depois se aplicará a sucessão da sua herança, podendo escolher lei de país do qual seja nacional no<br />
momento da escolha ou no momento da sua morte. Tal escolha pode incidir sobre lei de um Estado-M<strong>em</strong>bro<br />
da UE ou de um país não pertencente à UE e, neste último caso, o cidadão deverá garantir que a lei escolhida<br />
permite tal opção e aplicação. Se tiver múltiplas nacionalidades, pode escolher a lei de qualquer um<br />
desses países.<br />
Esta escolha pode ser feita <strong>em</strong> testamento ou <strong>em</strong> declaração autónoma de igual formalidade e a validade<br />
dessa declaração é determinada pelas regras da lei escolhida.<br />
A lei aplicável à sucessão abrange a transmissão de to<strong>dos</strong> os bens do de cujus, ou seja, <strong>dos</strong> bens móveis,<br />
contas bancárias, imóveis, etc, independent<strong>em</strong>ente do local onde estão situa<strong>dos</strong> (mesmo que se encontr<strong>em</strong><br />
<strong>em</strong> vários países) e regula questões como:<br />
a) qu<strong>em</strong> são os beneficiários da sucessão (caso não exista testamento);<br />
b) a transferência da propriedade <strong>dos</strong> bens para os herdeiros e legatários<br />
c) a quota-parte da herança que cabe a cada herdeiro e, sendo o caso, o que nos termos da lei<br />
deve ser reservada para o cônjuge e filhos;<br />
d) os poderes <strong>dos</strong> herdeiros, executores testamentários e administradores da herança, incluindo<br />
de vender bens e pagar aos credores;<br />
e) o grau de liberdade do testador para decidir a qu<strong>em</strong> deixa os seus bens e eventual consideração<br />
<strong>Guia</strong> <strong>dos</strong> <strong>Investidores</strong> e <strong>Residentes</strong> <strong>Estrangeiros</strong> <strong>em</strong> <strong>Portugal</strong><br />
de doações feitas durante a vida pelo “de cujus” para proteção das quotas reservadas aos seus<br />
filhos e cônjuge;<br />
f) as condições da aceitação ou repúdio da herança;<br />
g) o modo como os seus bens dev<strong>em</strong> ser administra<strong>dos</strong> antes de ser<strong>em</strong> partilha<strong>dos</strong> e entregues<br />
aos sucessores;<br />
h) a responsabilidade pelas dívidas da herança..<br />
O regulamento impõe restrições à aplicação da lei escolhida, designadamente a autoridade do Estado-M<strong>em</strong>bro<br />
da UE que trata da sucessão pode recusar-se a aplicar lei que seja contrária a princípios fundamentais<br />
de ord<strong>em</strong> pública do Estado que trata da sua sucessão (por ex<strong>em</strong>plo, a autoridade do Estado que trata da<br />
sucessão pode recusar-se a aplicar disposições que discrimin<strong>em</strong> os herdeiros <strong>em</strong> razão do género).<br />
Assim como no caso de a legislação do país onde estão situa<strong>dos</strong> determina<strong>dos</strong> bens imóveis (um prédio ou<br />
uma parcela de terreno) ou determinadas <strong>em</strong>presas (por ex<strong>em</strong>plo, uma exploração agrícola) tiver regras especiais<br />
obrigatórias aplicáveis à sucessão desses bens baseadas <strong>em</strong> considerações económicas, familiares<br />
ou sociais (i.e., para preservar a unidade de uma exploração agrícola numa zona agrícola), a autoridade<br />
do Estado-M<strong>em</strong>bro da UE que trata da sucessão aplicará essas regras à sucessão <strong>dos</strong> bens <strong>em</strong> questão,<br />
mesmo que não seja a lei aplicável à sucessão <strong>dos</strong> restantes bens;<br />
4) Reconhecimento, executoriedade e execução das decisões<br />
O regulamento UE declara que as decisões judiciais <strong>em</strong> matéria sucessória proferidas num Estado-M<strong>em</strong>bro<br />
serão automaticamente reconhecidas, aceites e executadas noutros Esta<strong>dos</strong>-M<strong>em</strong>bros da UE, prevendo<br />
ainda, para o caso de tais decisões ser<strong>em</strong> contestadas, um procedimento simplificado para que sejam<br />
declaradas executórias, facilitando assim que, por ex<strong>em</strong>plo, um documento notarial <strong>em</strong> matéria sucessória<br />
(testamento, certificado sucessório, etc) <strong>em</strong>itido num Estado‐M<strong>em</strong>bro da UE seja aceite e declarado executório<br />
noutro Estado-M<strong>em</strong>bro da EU ao abrigo dessas regras simplificadas; e<br />
5) O certificado sucessório europeu<br />
Trata-se de um documento que pode ser solicitado pelos herdeiros, pelos legatários, pelos executores testamentários<br />
e pelos administradores <strong>dos</strong> bens do falecido e que atesta a sua qualidade para exercer<strong>em</strong> os<br />
seus direitos noutro Estado-M<strong>em</strong>bro da UE.<br />
O certificado pode ser solicitado a um tribunal ou outra autoridade competente que, nos termos da legislação<br />
nacional, tenha competência <strong>em</strong> matéria sucessória, entidade que, assim, <strong>em</strong>ite um documento autêntico<br />
(quanto ao conteúdo e à autenticidade da assinatura).<br />
O certificado sucessório europeu produz os mesmos efeitos <strong>em</strong> to<strong>dos</strong> os Esta<strong>dos</strong>-M<strong>em</strong>bros independent<strong>em</strong>ente<br />
do país europeu onde é <strong>em</strong>itido e dispensa formalidades especiais de reconhecimento.<br />
10.3. O Testamento<br />
O testamento é o ato unilateral e revogável pelo qual uma pessoa dispõe, para depois da morte, de to<strong>dos</strong><br />
os seus bens ou de parte deles.<br />
O ato testamentário caracteriza-se por ser:<br />
a) revogável na medida <strong>em</strong> que o testador t<strong>em</strong> a faculdade de revogá-lo, no todo ou <strong>em</strong> parte;<br />
A revogação pode ser::<br />
(ii) expressa: por declaração (expressa) do seu autor nesse sentido;<br />
(iii) real, quando o seu cumprimento se torna inviável pelo facto de o testador não ter deixado<br />
quaisquer bens;<br />
(iv) tácita, quando o testador faz um novo testamento e, não fazendo qualquer alusão ao<br />
anterior, as novas disposições são incompatíveis com as do precedente;<br />
b) pessoal, porque não pode ser feito por meio de representante;<br />

1. Obtaining a Portuguese Tax Identification Number (NIF)<br />
The NIF - Tax Identification Number, also known as “Número de Contribuinte” identifies a tax paying entity in<br />
<strong>Portugal</strong>, whether it is a company or an individual. The NIF is only attributed to natural persons and autonomous<br />
patrimonies. Legal persons have the NIPC (Identification Number for Legal Persons), assigned by the<br />
RNPC.<br />
Obtaining the NIF is a fundamental step for those who intend to reside and/or work/ invest or carry out any<br />
type of professional activity in <strong>Portugal</strong>.<br />
It is compulsory for anyone wishing to buy or lease a property in <strong>Portugal</strong>.<br />
On the other hand, the acquisition of legal residence in <strong>Portugal</strong>, for applications for any type of t<strong>em</strong>porary<br />
residence permit, always requires the prior obtaining of a NIF.<br />
The NIF is also mandatory to sign a work contract, to exercise an independent professional activity and to<br />
open a company in <strong>Portugal</strong>. In the practice, it is not possible to do anything in <strong>Portugal</strong> without having a NIF.<br />
The NIF is attributed by the Portuguese Tax and Customs Authority and can be requested at any tax office<br />
counter or online on the website “Portal das Finanças”.<br />
The procedure differs depending on whether the applicant is a resident citizen or national of the European<br />
Union/European Economic Area or national citizen of a third state.<br />
1.1. 1.1. National Citizen of EU/EEA<br />
Documents to be submitted:<br />
i. Certified copy of valid identification document (passport or identity card or an EU country residence permit);<br />
ii. Proof of address with less than 3 months (for example: invoice, bank stat<strong>em</strong>ent, etc)<br />
iii. Power of Attorney (in case the request of attribution of NIF is requested by a proxy, namely a lawyer).<br />
1.2. National citizen of a Third State<br />
Without prejudice of the afor<strong>em</strong>entioned documents, if the applicant is a resident/national citizen of a Third<br />
State, outside the European Union or the European Economic Area (EEA), it is mandatory to appoint a Tax<br />
Representative in <strong>Portugal</strong>, which is, in practice, a formal link between the Tax and Customs Authority (AT)<br />
and the foreign citizen to deal with the tax issues related with it activity. According to the report number<br />
90054, of 06-06-2022, the appointment of a Tax Representative is not mandatory for the issuance of a NIF<br />
(Portuguese Tax Identification Number), but only when the applicant en- ters in a tax relationship, either for<br />
the acquisition of a property in <strong>Portugal</strong> or for the exercize of own activity in the country, among others.<br />
It is also not mandatory to appoint a tax representative for the taxable individuals that joined the public service<br />
of electronic notifications associated to the single digital address, with exception to the foreseen for legally<br />
equivalent entities that cease activity.<br />
<strong>Portugal</strong> Investment and Residency Guide for Foreigners<br />
that they are residents in <strong>Portugal</strong> or, in the second case, with their headquarters in Portuguese territory.<br />
The tax address to whom their password for accessing the Finance Portal will be sent, and all tax correspondence<br />
will be the tax residence/headquarters of the tax representative.<br />
Later, when the foreign citizen obtains a residence permit in <strong>Portugal</strong> he can disaggregate his tax representative.<br />
In case the application for the NIF is done online, it must be done by the foreign citizen’s Fiscal Representative<br />
or by a lawyer with a proxy.<br />
Documents to be submitted:<br />
i. Certified copy of valid identification document (passport or identity card);<br />
ii. Proof of address (for example: invoice, bank stat<strong>em</strong>ent);<br />
iii. Declaration of appointment and acceptance of the Fiscal Representative;<br />
iv. Identification of the Tax Representative.<br />
2. Opening a bank account in <strong>Portugal</strong><br />
Opening a bank account in <strong>Portugal</strong> is also a fundamental procedure for obtaining a residence permit, as<br />
the applicant must hold a bank account with a credit institution authorized or registered in <strong>Portugal</strong> with the<br />
Bank of <strong>Portugal</strong> and d<strong>em</strong>onstrate that they have sufficient means of subsistence in <strong>Portugal</strong>, in accordance<br />
with the law.<br />
Notwithstanding the above, with a bank account in <strong>Portugal</strong> there is a clear reduction in bureaucracy when it<br />
comes to paying for everyday expenses and consumption. The same applies to earnings from professional<br />
activity and/or investments made, where the earnings will normally be transferred to a Portuguese bank<br />
account.<br />
It should be noted, however, that the procedures for opening a bank account may vary according to the credit<br />
institution chosen.<br />
However, in general terms, the foreign citizen will have to submit the following documents:<br />
i. Passport or identification document;<br />
ii. Tax number of the country of origin or residence;<br />
iii. Proof of source of funds (tax return; <strong>em</strong>ployer’s stat<strong>em</strong>ent describing amounts due; <strong>em</strong>ployment contract;<br />
annual income stat<strong>em</strong>ent; proof of dividend distribution, etc);<br />
iv. Proof of address;<br />
v. Email and cell phone details;<br />
vi. Indication of marital status.<br />
In the case of applicants wishing to obtain a residence permit for an investment activity (Gold Visa), and<br />
depending on the amount of the investment they intend to make in <strong>Portugal</strong>, they must submit documents<br />
proving they have the financial means to carry out the investment activity.<br />
The Tax Representative is legally responsible for collecting the duties and taxes owed by the foreign citizen,<br />
complying with reporting obligations, ensuring compliance within the legal deadlines, and informing the Represented<br />
of all tax obligations, deadlines and any tax offences. The tax representative also have the right to<br />
complain, challenge or appeal, if necessary. The right belongs to the represented (taxable person)and the<br />
Tax Representative can represent him in that matter.<br />
Any individual or legal entity that accepts the position to be one, may be a Fiscal Representative, provided<br />

Any foreign citizen wishing to transfer their residence to <strong>Portugal</strong>, regardless of the type of residence permit<br />
they apply for, must prove that they have accommodation by any legal means.<br />

Foreign nationals may choose to rent or buy a property to live in with their family.<br />
3.1. Leasing a property in <strong>Portugal</strong><br />
Renting a property is probably the most economical and immediate option for obtaining accommodation in<br />
<strong>Portugal</strong>, namely because it involves fewer costs and formalities and is quicker than buying a property.<br />
It should be noted, however, that the rental contract must be in writing and, in the case of a housing contract,<br />
it cannot be for less than one year. As far as rents are concerned, it is common practice for rents to be paid<br />
in advance, as well as a security deposit to guarantee compliance with the contract’s legal obligations. The<br />
advance payment of rent and the provision of a security deposit are limited by law to a maximum amount<br />
equivalent to two months’ rent.<br />
The security deposit is returned at the end of the lease, provided that there are no payments or compensations<br />
to be made, such as: payment of rents or other unfulfilled pecuniary obligations, repair of the property<br />
and/or replac<strong>em</strong>ent of furniture and/or appliances, cleaning of the property, restoration of the property’s original<br />
condition. It should be noted, however, that as a rule, no compensation is due for damage resulting from<br />
the normal and prudent use of the property and its assets.<br />
As far as the documents to be presented by the foreign national are concerned, it will always be necessary<br />
to have (or obtain) a Portuguese tax number under the terms mentioned in point 1.<br />
Some landlords, as a way of guaranteeing the suitability of tenants and compliance with contractual obligations,<br />
request other documents prior to signing the lease, such as tax returns, pay slips, proof of bank<br />
deposits, etc.<br />
3.2. Buying a property in <strong>Portugal</strong><br />
Notwithstanding the above, foreign citizens can always choose to buy a property in <strong>Portugal</strong>, which can mean<br />
optimizing their investment and bringing several advantages.<br />

more foreign investors with exponential annual growth.<br />
The good position of the Portuguese real estate market is mainly due to the quality of the offer, political and<br />

3.2.1. Taxes and other costs of buying a property in <strong>Portugal</strong><br />
A. Municipal Property Transfer Tax (IMT)<br />
The Municipal Tax on Onerous Transfer of Real Estate (IMT) is the tax to be paid by the buyer on the acquisition<br />
of the real estate in <strong>Portugal</strong>, and the amount of tax to be paid is dependant on the nature of the asset,<br />
purpose and price of acquisition.<br />
It is possible to be ex<strong>em</strong>pted from paying IMT, if one of the following it<strong>em</strong>s applies to the specific case:<br />
i. Properties for permanent dwelling with a acquisition value or taxable patrimonial value (the higher value<br />
is considered) lower than €93.333,00 Euros;<br />
ii. Properties located in the Autonomous Regions of Madeira or Azores with a taxable or deeded patrimonial<br />
value of €116,664.00 Euros;<br />
iii. Buildings for resale (provided that the activity is the purchase of buildings for resale);<br />
iv. Urban properties, autonomous fractions of urban properties destined exclusively for rental for permanent<br />
dwelling purposes, which are held by the following entities: State, Autonomous Regions, local authorities,<br />
associations and federations of municipalities governed by public law, as well as any of their services,<br />
establishments and organisms, even if personalized, including public institutes of a non-business nature;<br />
v. Property acquired for urban rehabilitation works - However, in order to have access to this tax benefit,<br />
the person acquiring the property has the obligation to start the respective rehabilitation works within a<br />
maximum period of maximum period of two years after the date of acquisition of the property. It should be<br />
noted that in order to benefit from this ex<strong>em</strong>ption a series of requir<strong>em</strong>ents must be met.<br />
vi. Property or part of a rustic property in forest areas covered by a Forest Intervention Zone (FIZ);<br />
vii. Property(ies) individually classifies, as being of national, public or municipal interest;<br />
viii. Properties acquired by credit institutions in execution, bankruptcy/insolvency or in lieu of payment.<br />
The Municipal Property Transfer Tax (IMT) is not the only tax to consider when buying a property in <strong>Portugal</strong>.<br />
B. Stamp Duty (IS)<br />
Stamp Duty is paid on the date of acquisition of the property, corresponding to a fixed rate of 0.8% on the<br />
price of the property or the tax value, the higher price is considered.<br />
C. Other Costs<br />
Besides the compulsory payment of IMT and IS, the foreign citizen who intends to buy a property in <strong>Portugal</strong><br />
will have to take into account other costs, namely the notarial costs inherent to the public deed of purchase<br />
and sale or private document with official certification, whose value will depend on the specific case, as well<br />
as the fees due to the Land Registry Office for the registration of the property in the name of the buyer, which<br />
corresponds to about €250.00 per property.<br />
D. Municipal Property Tax (IMI)<br />
The Municipality Property Tax (IMI) is a tax levied on the Patrimonial Taxable Value of the prop- erty and must<br />

be paid annually, by whom is registered as the owner on the 31st of Dec<strong>em</strong>ber of the year to which the tax<br />
is due.<br />
The rate to be applied is defined by each municipality in <strong>Portugal</strong>, but should take into con- sideration the<br />
calculation of IMI, based on a table with intervals provided for in the Municipal Property Tax Code (CIMI),<br />
with the interval for urban buildings (residential property and land for construction) varying between 0.3%<br />
and 0.45%.<br />
All property owners in <strong>Portugal</strong> must pay this tax in the month of May. However a phased payment in more<br />
than one instalment is allowed.<br />
3.3. Making real estate profitable<br />
Having acquired property in <strong>Portugal</strong>, if it is not intended as a permanent residence, the natural option is to<br />
make the property profitable by renting it. Depending on the respective type (holiday or long-term), the legal<br />
requir<strong>em</strong>ents and tax implications will be different.<br />
3.3.1. Long-term lease and tax implications<br />
All long term rental contracts must be declared to the Portuguese Tax Office. The registration can be made<br />
online in a simple way in a specific page of that service, until the last day of the month following the signature<br />
of the contract and should contain the basic information of the contract - identification of the contracting<br />
parties, identification of the property, duration of the contract and value of the monthly rent. This registration<br />
also implies the payment of the respective stamp duty of 10% of the monthly rent.<br />
After the registration of the contract and during its term, the owner has the obligation to issue the respective<br />
rental receipts - which can also be done in a simple way and online on that same website.<br />
There are therefore 4 tax brackets:<br />
• Contracts of up to 5 years: a rate of 25% applies. Contracts of this duration are not reduced.<br />
• Contracts between 5 and 10 years: a rate of 15% is applied, and for each renewal of the contract of the<br />
same duration a reduction of two percentage points will be applied, up to a limit of 10%;<br />
• Contracts between 10 and 20 years: a rate of 10% is applied;<br />
• Contracts of more than 20 years: a rate of 5%.<br />
3.3.2. Local accommodation and tax implications<br />
Local accommodation is an alternative to long term rentals, which may bring higher income at first, but brings<br />
with it several other legal requir<strong>em</strong>ents and a different tax regime.<br />
To begin with, the property must have its own register, which is made through the “Balcao do Empreendedor”<br />
or at the town hall of the municipality where it is located. In order for this registration to be made, the<br />
property must comply with some legal requir<strong>em</strong>ents set out in the local accommodation law (Decree-Law no.<br />
128/2014, of 20 august which the last changes dated from the Law n.º 56/2023 06 october”.<br />
It should be noted, however, that since October 2023, for apartments and lodging establishments,<br />
new applications for registration of local accommodation are only accepted if they are located in territories<br />
legally classified as inland and low population density or if they are located in the Autonomous<br />
Regions.<br />
The exploration of this type of establishment presupposes that a declaration of commenc<strong>em</strong>ent of activity is<br />
filed within the tax authority, namely for the activity of provision of accommodation services/ hotel services.<br />
This declaration can also be made on the AT’s website. Similarly, when this activity ceases, you should make<br />

the respective declaration stating that the registered property will no longer serve as a local accommodation<br />
in <strong>Portugal</strong>.<br />
The tax framework for this type of income will depend on several factors.<br />
For IRS (Personal Income Tax) purposes, it depends from the outset whether the gross turnover is equal to<br />
or less than €200,000.00.<br />
If it’s a negative case, (if that turnover is higher), the taxpayer is obliged to have an organized accounting,<br />
i.e. to hire a Certified Accountant (CA) responsible for carrying out the accounting records and accounts<br />
(equivalent to Companies) and the tax will be calculated in accordance with the taxable person’s accounting,<br />
adjusted in accordance with the rules of the IRS. If it’s a positive case, (the turnover is equal or inferior to<br />
€200.000,00) then the taxpayer may opt for the organized accounting regime (in which, as in the previous<br />
example, the determination of the income is made on an accounting basis according to the rules established<br />
in the IRC Code), or for the simplified regime, in which the tax applicable to this income is fixed at 35%, and<br />
as an alternative, taxable persons may opt for the taxation according to the rules of category F (property<br />
income).<br />
4. Obtaining Legal Residence in <strong>Portugal</strong><br />
4.1. The Golden Visa Program<br />
Launched in 2012 with the aim of attracting foreign investment to <strong>Portugal</strong>, the Portuguese Golden Visa<br />
program has proved a real success, becoming one of the most popular in Europe and the World to obtain a<br />
t<strong>em</strong>porary residence permit through one of the investment modalities provided for in Law 23/2007, of July 04.<br />
Among the various types of residence permits available in <strong>Portugal</strong>, the Golden Visa stood out as one of the<br />
most prominent, bringing substantial foreign direct investment into <strong>Portugal</strong>. This is particularly due to the<br />
several advantages it offers to its holders, including::<br />
• Travel and move freely within the EU countries of the Schengen area, without the need for a visa to do so;<br />
• Enter freely into <strong>Portugal</strong> with no need for a residence visa, also allowing you to live, work and study in<br />
the country;<br />
• Extend the Golden Visa to family m<strong>em</strong>bers through family reunification;<br />
• Upon 5 years of legal residency in <strong>Portugal</strong>, holders of golden visas may request a Permanent Residence<br />
Permit and/or the acquisition of Portuguese nationality, by naturalization, once the requir<strong>em</strong>ents of the<br />
Nationality Law in force have been met.<br />
4.1.1. Types of Investment eligible for a Golden Visa<br />
The foreign citizen may apply for a Residence Permit for Investment Activity (ARI), by way of investment<br />
in one of the following investment activities: (According to the modifications made by the Decree-Law n.º<br />
14/2021 of February 12th.)<br />
The creation of at least 10 jobs – it may be lower by 20% when the activity is carried out in low-density areas.<br />
i. Capital transfers of 500 thousand Euros or more, which must be applied in research activities to be developed<br />
by public or private scientific research institutions, and that should be integrated in the national<br />
scientific and technological syst<strong>em</strong>- – it may be lower by 20% when the activity is carried out in low-density<br />
areas.<br />
ii. Capital transfers of 250 thousand Euros or more, to be applied in investment or support of artistic<br />
production, recovery or maintenance of the Portuguese national cultural heritage, through central and<br />
peripheral direct administration services, public institutes, entities that are part of the public business<br />
sector, public foundations, private foundations with public utility status, intermunicipal entities, entities<br />

that are an integrated part of the local business sector, municipal associative entities and public cultural<br />
associations, which pursue attributions in the area of artistic production, recovery or maintenance of<br />
national cultural heritage- it may be lower by 20% when the activity is carried out in low-density areas.<br />
iii. Transfer of capital in the amount equal to or greater than € 500.000 , intended for the acquisition of participation<br />
units in non-real estate collective investment undertakings established under Portuguese law,<br />
with a maturity of at least five years at the time of investment, and at least 60% of the investment value<br />
is realized in commercial companies headquartered in national territory;<br />
iv. Transfer of capital in the amount equal to or greater than € 500.000 , intended for the incorporation of a<br />
commercial company headquartered in national territory, combined with the creation of five permanent<br />
job positions, or for the increase of the share capital of an already established commercial company<br />
headquartered in national territory, with the creation of at least five permanent job positions or the maintenance<br />
of at least ten job positions, with a minimum of five being permanent, for a minimum period of<br />
three years.<br />
4.1.2. Collective Investment Undertakings<br />
(Golden Visa elegality requir<strong>em</strong>ents)<br />
As developed in section 4.1.3, on October 7, 2023, significant changes come into force in the Investment<br />
Residence Permit Regime. The obtaining of the Golden Visa through direct or indirect real estate investment<br />
is no longer possible.<br />
Therefore, an alternative solution is the investment through capital transfers in an amount equal to or higher<br />
than €500,000.00 for the acquisition of participation units in Collective Investment Undertakings (hereinafter<br />
CIU).<br />
What are the advantages?<br />
• Security: investment model and rules are internationally similar and there are no substantial discrepancies;<br />
furthermore, the regulatory scrutiny carried out by the CMVM (Portuguese Securities Market Comission),<br />
particularly through prudential and behavioral supervision, be- stows gives an additional degree of<br />
security.<br />
• Regulation and Supervision: CIU registered in <strong>Portugal</strong> is regulated is regulated and supervised by the<br />
Securities Market Commission (CMVM) and, in accordance with the current tax law, by the Tax and Customs<br />
Authority. These high levels of regulation ensure that the fund complies with Portuguese law, tax law<br />
and the proposed investment plan approved by the fund’s investors.<br />
• Administration, Manag<strong>em</strong>ent and Representation: OICs may be managed, administered, and represented<br />
by Collective Investment Entity Manag<strong>em</strong>ent Companies (SGOICs), which are responsible for managing<br />
the said Funds solely in the interest of Participants and in accordance with the rules stipulated in their<br />
respective Manag<strong>em</strong>ent Regulations.<br />
• Taxes and Fees: less expensive, when compared with the property investment option, for example, no<br />
taxes or other costs are payable when purchasing property in <strong>Portugal</strong> (see point 3.2.1);<br />
• Tax Efficiency: depending on the tax structure of the fund and the investor, an investment in a fund may<br />
generate significant tax efficiencies. Certain cases allow for ex<strong>em</strong>ption from withholding tax on income<br />
generated by the fund, particularly if investors are not tax resident in <strong>Portugal</strong>.<br />
• Diversification: Portuguese law requires funds to have a certain level of diversification. There are limitations<br />
which determine what percentage a specific asset or fund investment should constitute in the total<br />
portfolio of the fund. This allows for the diversification of investments within the fund and a reduction of<br />
risk for participating investors, i.e. enhances investment security and returns.<br />
• Knowledge: unlike the other investment options available to the same amount (€500,000.00), this investment<br />
modality option, due to the manag<strong>em</strong>ent performed by the SGOIC, allows for less knowledge about<br />
various sectors of the Portuguese market as well as reduced monitoring of investment activity, as the administration<br />
of the OIC is the responsibility of the Manag<strong>em</strong>ent Company, when they are heteromanaged.<br />
The acquisition and execution of rehabilitation works on real estate of a value equal to or higher than<br />
Euro 350.000,00 thousand; as well as the transfer of capital in the amount equal to or higher than Euro<br />

500.000.00, intended for the incorporation of a commercial company with registered office in <strong>Portugal</strong>,<br />
in conjunction with the creation of five permanent jobs, or to increase the share capital of a commercial<br />
company with registered office in <strong>Portugal</strong>, already existing, with the creation or maintenance of jobs,<br />
with a minimum of five permanent jobs, for a minimum period of three years, are investment models<br />
which require the intervention of several intervening parties, technical consultants and knowledge of the<br />
real estate and construction sector in the first case and of the business and labor sector in the second.<br />
For this reason, they se<strong>em</strong>, from the outset, more complex for the investor who cannot be present in<br />
<strong>Portugal</strong> to accompany the development of his investment.<br />
The subscription process of a OIC may take substantially less time until it is concluded, when compared<br />
with the other investment activities, which will allow the investor to start the obtaining process of the Golden<br />
Visa very quickly. Notwithstanding, the speed will always depend on the decision making, the speed and<br />
time expended with obtaining the necessary documents, for the obtaing of the Portuguese Tax Identification<br />
Number (NIF) and opening of a Bank Account in <strong>Portugal</strong> (see point 2).<br />
Thus, this is a cost-effective investment modality with significant tax efficiency, a high degree of security,<br />
and the particularity that, depending on the Fund’s Manag<strong>em</strong>ent Rules and Regulations, annual returns and<br />
potential capital appreciation can be significantly higher than in other investment modalities.<br />
Regarding the necessary documentation, the following general documentation is required (very similar to<br />
the other modalities):<br />
• Valid Passport;<br />
• Evidence of medical assistance cover for the Applicant, if residing in <strong>Portugal</strong>:<br />
o Document proving coverage by the Portuguese National Health Service, or<br />
o Document proving the coverage of an internationally recognized health insurance,<br />
• Criminal record of the applicant from the country of origin or residence, issued up to three months before<br />
the submission of the application duly legalized by the competent Portuguese Embassy and Translated<br />
into Portuguese;<br />
• Tax identification number of the applicant from the country of origin or in which the applicant has lived for<br />
more than one year;<br />
• Application form for the issuance of a residence permit, in which authorization for the consultation of the<br />
Portuguese Criminal Record should be granted;<br />
• Declaration under sol<strong>em</strong>n oath in which the Applicant declares to comply with the minimum t<strong>em</strong>poral and<br />
quantitative requir<strong>em</strong>ents of the investment activity in <strong>Portugal</strong>.;<br />
• Receipt for payment of the ARI application fee.<br />
The difference is in the specific documentation related to the type of investment in participation units, so<br />
along with the general documents – before mentioned, the following documents must be submitted:<br />
• Stat<strong>em</strong>ent from the bank institution authorized or registered in <strong>Portugal</strong> with the Bank of <strong>Portugal</strong>, certifying<br />
the effective transfer of an amount equal to or higher than the minimum required (€500,000.00);<br />
• Certificate confirming ownership of participation units, free from liens and encumbrances, issued by the<br />
Depositary Bank;<br />
• Declaration issued by the manag<strong>em</strong>ent company of the respective investment fund, attesting to the viability<br />
of the capitalization plan, a maturity of at least five years, and the allocation of at least 60 percent of<br />
the investment in commercial companies headquartered in the national territory.<br />
The process for obtaining the Golden Visa in this modality can only start when the investment is concluded.<br />
In addition, the investor must guarantee that the subscription in the fund guarantees the minimum period of 5<br />
years and, furthermore, fulfil the permanence periods and d<strong>em</strong>onstrate the fulfilment of the minimum periods<br />
of permanence in Portuguese territory (see 4.1.4).<br />

4.1.3. Amendments to the Legal Framework for Golden Visas, in force<br />
since January 1 2022<br />
The Decree-Law 14/2021, of February 12 impl<strong>em</strong>ented changes to the legal framework for Golden Visas<br />
in <strong>Portugal</strong>, which will come into force on January 1, 2022 and will apply to all ap- plications for investment<br />
residency permits related to the Golden Visa requested after that date. However, the obtaining and renewal<br />
requests for the residency permit for investment activity of the cases submitted/approved under the Golden<br />
Visa regime before Decree-Law no. 14/2021, of February 12, as well as its subsequent applications for family<br />
reunion will not be affected by the new restrictions set out in that Decree-Law.<br />
The amendments concern two distinct aspects.<br />
On one hand, there is the revocation of the following investment modalities:<br />
a) Transfer of capital in the amount equal to or greater than €1,500,000.00;<br />
b) Acquisition of real estate with a value equal to or greater than €500,000.00;<br />
c) Acquisition of real estate, either with construction completed at least 30 years ago or located in an<br />
urban rehabilitation area, and carrying out rehabilitation works on the acquired real estate, with a<br />
total amount equal to or greater than €350,000.00<br />
On the other hand, the eligible investment modalities for the Golden Visa, which r<strong>em</strong>ain applicable with the<br />
latest amendment to Law 23/2007, of July 4th, specifically Investment in UPs (Participation Units) of OIC and<br />
Transfer of Funds for the establishment or reinforc<strong>em</strong>ent of share capital with the creation or maintenance of<br />
jobs, now have more stringent eligibility requir<strong>em</strong>ents.<br />
With the new legal regime of the Golden Visa the acquisition of Participation Units in Collective Investmen Undertakings,<br />
shall only be considered as eligible if these UIC`s do not invest directly or indirectly in real estate.<br />

4.1.5. Procedures for obtaining and renewing the Golden Visa<br />
4.1.5.1 Grant/Application:<br />
To apply for a golden visa you must take the following steps:<br />
i. Obtain a Portuguese Tax Number (NIF) and open a Portuguese bank account;<br />
ii. Perform one of the investment activities, as foreseen in the Law;<br />
iii. Submit the application online with the legally required documents and pay the analysis fee;<br />
iv. Once the online application is approved, it is necessary to schedule an appointment with a competent<br />
delegation AIMA Agencia para a Integração, Migrações e Asilo, for the purpose of inperson submission<br />
of the complete physical documentation and subsequent collection of biometric data;<br />
v. After the final approval of the granting of the golden visa, pay the respective fee and wait for the issuing<br />
of the residence permit.<br />
4.1.5.2. Renewals<br />
The application for the renewal of the residency permit shall be made between 90 (ninety) and 30 (thirty) days<br />
prior to the expiry of the title by the following way:<br />
a) Make an appointment with the Foreigners and Borders Service (SEF) office in order to submitt all<br />
the legally required documentation and collect Biometric data;<br />
b) After the final approval of the renewal of the golden visa, pay the respective fee and wait for the<br />
issuance of the residence permit.<br />
4.1.6. Costs associated with the process of obtaining and renewing the Gold Visa<br />

Similarly, regarding the investment in Portuguese commercial companies, the eligibility requir<strong>em</strong>ents for this<br />
investment modality have been altered, with the minimum quantitative criterion of €500,000.00 investment<br />

The golden visa has a minimum duration of 5 (five) years, notwithstanding the fact that the applicant may<br />
continue to request sucessive renewals after this period, provided that the minimum legal requir<strong>em</strong>ents are<br />
maintained.<br />
It should be noted that, since April 2020, as a result of exceptional and t<strong>em</strong>porary measures driven by the<br />
SARS-COV-2 pand<strong>em</strong>ic, the initial ARI residence permits have been issued with a validity of 2 years, and the<br />
subsequent permits issued during renewals are valid for 3 years (previously having initial durations of 1 year<br />
and 2 years, respectively).<br />
For the purposes of renewal of the Residence Permit for Investment Activity (ARI), the applicant shall comply,<br />
among others, with the following requir<strong>em</strong>ents:<br />
i. Maintain the minimum quantitative investment criteria;<br />
ii. Stay and prove compliance with the minimum period of stay in Portuguese territory - 7 consecutive or<br />
Long-stay visas may be for t<strong>em</strong>porary stay or to obtain a residence permit, depending on the length of stay<br />
and entitle the holder to r<strong>em</strong>ain in <strong>Portugal</strong> for the intended purpose: study, training, work, medical treatment,<br />
among others.<br />
The t<strong>em</strong>porary stay visa is intended to allow entry for stays in <strong>Portugal</strong> for a period of less than one year. It is<br />
valid for the duration of the stay and for multiple entries in national territory.<br />
The visa to obtain a residence permit is valid for two entries and for four months, during which time the holder<br />
must apply to the AIMA Service for a residence permit.<br />
Any foreign citizen from a Third Country, not belonging to the European Union, the European Economic Area<br />
(EEA) or Switzerland, who intends to stay or reside in <strong>Portugal</strong> for a period of more than 1 (one) year, must<br />
apply for a visa to establish residence, as is the case of the so-called D2, D3 and D7 Visas.<br />

4.2.1. Benefits of Residence Permit Holders<br />
Holders of Residence Authorization under the D2, D3 and D7 visas benefit from a number of advantages,<br />
namely:<br />
i. Travel and move freely within the EU countries of the Schengen area, without the need for a visa to do so;<br />
ii.To live, work and study in <strong>Portugal</strong> if they desire to so do;<br />
iii. Enjoy the Portuguese national health service;<br />
iv. Access to law and courts;<br />
v. The Family m<strong>em</strong>bers of the main applicant may apply for family reunification, namely:<br />
a. Spouses;<br />
b. The partner that maintains, in national territory or outside it, with the foreign resident citizen, a de<br />
facto union, duly proved under the terms of the law;<br />
c. Children who are minors or incapacitated and who are dependants of the couple or one of the<br />
spouses 1 ;<br />
d. Adult children, dependent of the couple or one of the spouses, who are full-time students in <strong>Portugal</strong>,<br />
single and financially dependent on the applicant;<br />
e. Minors adopted by the applicant when not married, by the applicant or by the spouse, as a result<br />
of a decision of the competent authority of the country of origin, provided that the law of that country<br />
grants to the adopted children identical rights and duties to those of natural parentage and that<br />
the decision is recognized by <strong>Portugal</strong>;<br />
f. Applicant’s stepchildren;<br />
g. Ascendants in the direct line and to the first degree of the resident or his/her spouse, provided<br />
they are dependent on him/her;<br />
h. Minor siblings, provided that they are under the resident’s guardianship, in accordance with a decision<br />
issued by the competent authority in the country of origin and provided that this decision is<br />
recognized by <strong>Portugal</strong>.<br />
vi. After five years, holders of Residence Authorization under D2, D3 and D7 visas (and/or their family<br />
m<strong>em</strong>bers) may apply:<br />
a. The granting of a Permanent Residence Permit, complying with the legal requir<strong>em</strong>ents of the<br />
Foreigners’ Law and the Regulatory Decree No. 84/07 of Nov<strong>em</strong>ber 5 in force; or<br />
b. The acquisition of Portuguese Nationality, by naturalization, once the requir<strong>em</strong>ents of the Nationality<br />
Law (Law no. 37/81, of October 3rd, as amended) have been met.<br />
4.2.2. Tax Benefits<br />

b. Passport or other travel document valid for 3 months beyond the duration of the intended stay;<br />

e. Proof of regular status if the applicant is a national of a country other than the one where he/she<br />
is applying for a visa (for example, a valid residence permit);<br />
f. Application for consultation of the Portuguese criminal record by the AIMA Agency;<br />
g. Certificate of criminal record from the country of origin or from the country where the applicant<br />
has resided for more than one year (those under 16 years of age are ex<strong>em</strong>pt from presenting<br />
documents relating to criminal record);<br />
h. Hold a Portuguese Tax Identification Number (NIF);<br />
i. Hold a bank account in <strong>Portugal</strong>;<br />
j. Proof of accommodation conditions;<br />
a. The proof of accommodation conditions can be made through the presentation of a long term<br />
lease contract, with a minimum duration of 1 (one) year, or through documents proving that the<br />
applicant is the owner of a property in <strong>Portugal</strong>.<br />
k. Evidence of the existence of means of subsistence as defined by decree order from the competent<br />
m<strong>em</strong>bers of the Government.<br />
One of the fundamental requir<strong>em</strong>ents for the granting of any type of Residence Visa in <strong>Portugal</strong> is proof that<br />
the applicant has the means of subsistence for a period of not less than 12 months to live in <strong>Portugal</strong>, or that<br />
he/she will be in a position to obtain th<strong>em</strong> after entry.<br />
In accordance with nº 1 of article 2 of Ministerial Order no. 1563/2007 of 11/12, the criteria for determining<br />
the minimum value of the means of subsistence is made by reference to the national minimum wage in force,<br />
which in 2022 will be of €705.00 (seven hundred and five euros), net of social security contributions with a<br />
per capita assessment in each family unit, as shown in the table below:<br />

This status was approved in 2009 and to enjoy it for 10 consecutive years, the foreign citizen must be considered<br />
a resident under Portuguese law and not have been taxed as a resident for tax purposes in <strong>Portugal</strong><br />
in the five years prior to requesting the status.<br />
4.2.3. Procedure for obtaining any type of Residence Visa<br />
D2, D3 or D7 visas are requested at the Consular Post or Consular Section of the Portuguese Embassy in<br />
the country of origin or area of residence or through VFS Global (https://www.vfsglobal.com/en/individuals/<br />
index.html), by making an appointment in person, where the applicant will submit his/her application, through<br />
presentation of the respective form together with the general documentation and the specific documentation<br />
required for each type of residence visa.<br />
In this sense, the minimum annual amount that the applicant must have to prove the means of subsistence<br />
can never be less than € 9,120.00 (for the year 2023).<br />
This amount must be deposited in the applicant’s Portuguese bank account, to which will be added the<br />
amount of 50% required for each m<strong>em</strong>ber of the household.<br />
However, the proof of possession of means of subsistence may also be made through the presentation of a<br />
term of responsibility, signed by a national citizen or a qualified foreign citizen, with a document of residence<br />
in <strong>Portugal</strong>.<br />

4.2.4. CPLP Visa<br />
The CPLP Visa is a legislative innovation applicable to nationals of M<strong>em</strong>ber States of the Community of<br />
Portuguese Language Countries (CPLP), allowing access to an alternative, more simplified process for the<br />
issue of visas and residence permits.<br />
Who can apply for a visa for CPLP Visa:<br />

• São Tomé e Príncipe<br />
• Timor-Leste<br />
Thus, if applicant, under the terms of article 52 (residencial, t<strong>em</strong>porary stay and short stay visas) is a national<br />
of a CPLP State, where the CPLP Agre<strong>em</strong>ent signed in Luanda on 17th July 2021 is in force, SEF is automatically<br />
informed of the issuance of the visa, being<br />
i. AIMA prior approval not required;<br />
ii. The visa request must be decided within 60 days, counting from the requesting of the visa;<br />
iii. The competent authorities to issue the visa (Embassies or Consulates) have direct access to the SIS<br />
database;<br />
iv. The issuing of the visa is only refused if the applicant’s entry of stay is forbidden by SIS or if the minor<br />
applicant lacks parental authorisation or an equivalent document and is not accompanied by the person<br />
who exercises parental responsibility during the period of stay in national territory.<br />
If the applicant chooses to obtain a CPLP residence visa, he must submit a request for a residence permit<br />
within a maximum period of 90 days, as of the first entry into <strong>Portugal</strong>.<br />
This visa has an initial duration of one year, renewable for successive periods of two years.<br />
These visas must be preliminarily granted (unless the applicant is identified in the Schengen Information<br />
Syst<strong>em</strong> as a person for whom an alert has been issued for the purposes of return or refusal of entry and stay).<br />
It is not necessary to submit the visa application in person.<br />
The following documents are not required for the issuance of a visa<br />
- Valid travel insurance to cover necessary expenses for medical reasons, including urgent medical assistance<br />
and possible repatriation;<br />
- Evidence of the existence of means of subsistence;<br />
- Copy of the return ticket, except when a residence visa is requested.<br />
The grant of a CPLP residence visa entitles the holder to apply for a CPLP residence permit, except in cases<br />
where r<strong>em</strong>aining on Portuguese territory constitutes a danger or serious threat to public order, national<br />
security or public health.<br />
4.3. The D2 Visa<br />
The D2 Visa is a residence visa for the exercise of independent professional activity or for enterprising immigrants<br />
and Start Up Visa.<br />

Specific Documentation:<br />
With regard to self-<strong>em</strong>ployment:<br />
i. Company contract or written proposal of a contract for the provision of services within the liberal professions;<br />
and, if applicable, declaration issued by the competent entity stating that he is qualified to exercise<br />
the activity in <strong>Portugal</strong>.<br />
As for entrepreneurial immigrants:<br />
i. Have carried out investment operations;<br />
ii. Prove to have available financial means in <strong>Portugal</strong>, including those arising from financing obtained from<br />
a financial institution in <strong>Portugal</strong>, and d<strong>em</strong>onstrate, by any means, the intention to carry out an investment<br />
operation in Portuguese territory, duly described and identified or<br />
iii. Declaration of IAPMEI - Agência para a Competitividade e Inovação I.P. (Agency for Competitiveness<br />
and Innovation), proving the celebration of an incubation contract with a certified incubator, according<br />
to Article 6 of the Normative Dispatch no. 4/2018 of the Minister of Economy, of February 2, which regulates<br />
the “Startup Visa” 2 program.<br />
4.4. The D3 Visa<br />
The D3 Visa is the residence visa for highly qualified activities, the exercise of which requires specialized<br />
technical skills of an exceptional nature or an adequate qualification for the respective exercise.<br />
Thus, this Visa covers all foreign citizens from third countries, who have been admitted as higher education<br />
students at PhD level or as researchers working in a research center recognized by the Ministry of Education<br />
and Science, or who will carry out a teaching activity in a higher education institution or highly qualified.<br />
Specific Documentation:<br />
For teaching, highly qualified or cultural activity:<br />
i. Employment contract or promise of <strong>em</strong>ployment contract or contract for the provision of services; or,<br />
ii. Invitation letter issued by an educational or vocational training institution; or,<br />
iii. Term of responsibility of a certified company under the terms defined by a decree of the Government<br />
m<strong>em</strong>bers responsible for the areas of internal administration and economy; or,<br />
iv. An invitation letter issued by a company or entity that carries out a cultural activity in national territory,<br />
recognized by the Government m<strong>em</strong>ber responsible for the area of culture as being of interest to the<br />
country, or as defined by law;or,<br />
v. Invitation letter issued by a research center.<br />
Note: For the purposes of proof of means of subsistence, means from an <strong>em</strong>ployment contract or promise<br />
of <strong>em</strong>ployment contract shall be taken into consideration. The proof of means of subsistence can be done<br />
through the presentation of a term of responsibility by the host entity of workers.<br />
For highly qualified activity carried out by subordinate workers:<br />
i. Valid work contract or promise of work contract with at least one year duration, corresponding to an annual<br />
r<strong>em</strong>uneration of at least 1,5 times the national average gross annual salary or three times the social<br />
support index (IAS);<br />
ii. In the case of a regulated profession, the holder of high professional qualifications, duly proven in compliance<br />
with the provisions of Law No. 9/2009 of March 4, or specific law concerning the recognition<br />
of professional qualifications, necessary for the access and exercise of the profession indicated in the<br />
<strong>em</strong>ployment contract or promise of <strong>em</strong>ployment contract;<br />
iii. In the case of non-regulated professions, holds high professional qualifications appropriate to the activity<br />
or sector specified in the <strong>em</strong>ployment contract or promise of <strong>em</strong>ployment contract. For <strong>em</strong>ployment<br />
in professions belonging to major groups 1 and 2 of the International Standard Classification (ISCO),<br />
indicated by Resolution of the Council of Ministers, upon prior opinion of the Standing Committee for Social<br />
Dialogue, as professions particularly in need of third-country national workers, the salary threshold<br />
provided for in paragraph 1(a) must correspond to at least 1.2 times the national average gross salary,<br />
or twice the value of the IAS.<br />

Note: For the purposes of proof of means of subsistence, means from an <strong>em</strong>ployment contract or promise<br />

In case of doubt as to the framework of the activity and for the purpose of verification of the adequacy of the<br />
professional experience of the third-country national, the ministries responsible for the areas of <strong>em</strong>ployment<br />
and of education and science shall issue an opinion prior to the granting of the visa.<br />
4.5. Tech Visa<br />
The Tech Visa aims to ensure that highly qualified executives from outside the European Union can access<br />
jobs created by Portuguese companies in a simplified manner.<br />
The program is aimed at companies operating in the global market, with their headquarters or permanent<br />
establishment in <strong>Portugal</strong>, who wish to attract qualified and specialized technical staff to <strong>Portugal</strong> from third<br />
countries or who reside outside the European Union.<br />
Companies wishing to be certified to hire foreign citizens must submit an application through IAPMEI’s electronic<br />
platform, which is the entity responsible for certifying candidate companies, involving several entities,<br />
such as the AIMA and the General Directorate of Consular Affairs, in the process of granting residence visas<br />
for professionals hired by certified companies.<br />
After a favorable decision, the certified company has access to the issue of Terms of Responsibility for the<br />
foreign workers hired or that it intends to hire, through a form made available electronically by IAPMEI.<br />
Therefore, the Tech Visa certification simplifies the procedures for obtaining visas and residence permits at<br />
the Consular Posts, with the possibility of waiving the need for an appointment in person and without the<br />
obligation to present a contract or a promissory contract, and at the AIMA, without the obligation to present<br />
a contract.<br />
4.6. Visa D7<br />
Foreign citizens, who are not nationals of EU M<strong>em</strong>ber States, the European Economic Area and Switzerland,<br />
who intend to perform religious functions, live in a congregation, reside in <strong>Portugal</strong> as pensioners or live off<br />
their own income, may apply for a D7 Visa.<br />
In addition to the general documentation referred to in point 3.1. D7 Visa applicants must submit the following<br />
specific documents to the Portuguese Consulate in their country of origin or country of residence:<br />
i. In the case of a retired foreign citizen:<br />
a. a document attesting to your pension and the amount you earn in your country of origin or residence;<br />
ii. In the case of a foreign national living from income from movable or immovable property, intellectual<br />
property or financial applications:<br />
a. document proving the existence and amount of such income; proof that he/she possesses income<br />
that enables him/her to ensure subsistence in <strong>Portugal</strong>.<br />
iii. As for foreign religious citizens:<br />
a. certificate from the church or community to which they belong, provided that they are recognized<br />
by Portuguese law.<br />
This Visa applies to the so-called digital nomads, i.e. natural and legal persons domiciled outside national<br />
territory who prove the <strong>em</strong>ployment relationship or the provision of services outside national territory.<br />
The Digital nomads (for the exercise of professional activity r<strong>em</strong>otely provided outside the national territory)<br />
are required to present all the general documents for any type of residence visa, and also the following<br />
documents:<br />
- Dependent work, one of the following documents:<br />
Work contract;<br />
Promise of <strong>em</strong>ployment contract;<br />
Declaration of <strong>em</strong>ployer proving the <strong>em</strong>ployment relationship.<br />
- Self-<strong>em</strong>ployment, one of the following documents:<br />
Partnership contract;<br />
Contract for the provision of services;<br />
Written proposal of services provision contract;<br />
Document d<strong>em</strong>onstrating services rendered to one or more entities;<br />
Proof of average monthly income earned in the last three months in the exercise of a subordinate<br />
professional or independent activity of a minimum value equivalent to four guaranteed minimum<br />
monthly r<strong>em</strong>unerations;<br />
Document proving their fiscal residence.<br />
These digital nomads will also be required to: (i) provide proof of average monthly income over the last three<br />
months in the minimum amount equivalent to EUR 2820 and EUR 3040 (already in 2030); and (ii) a document<br />
proving their tax residence.<br />
4.7. Work Search Visa<br />
The Work Search Visa is issued to non-national citizens of the European Union, who are searching for subordinate<br />
work in <strong>Portugal</strong>. This Visa is issued for a period of 120 days, with an extension of 60 days.<br />
On the date of issuance of the visa, the applicant is ex<strong>em</strong>pt from providing a work contract or proposal of<br />
a work contract, discharging the <strong>em</strong>ployer from making a job offer available to the IEFP (as happens with<br />
dependent work visas).<br />
The Visa includes an appointment with AIMA so that, during the 120 days of validity and once the work activity<br />
has begun, the applicant can exercise the right to request a residency permit, by fulfilling the requir<strong>em</strong>ents<br />
for the concession of t<strong>em</strong>porary residence.<br />
If the applicant does not fulfil the purpose of the visa, that is, to start a work activity, he/she will have to leave<br />
the country and can only start a new process to obtain a work search visa, one year after the expiry of the<br />
previous visa.<br />
NOTE: Further requir<strong>em</strong>ents for the attribution of a visa and granting of a residence permit, the provisions<br />
for t<strong>em</strong>porary residence visas and t<strong>em</strong>porary residence permits apply.<br />
4.6.1. Residency Visa for the Exercise of a R<strong>em</strong>ote Profession<br />
This t<strong>em</strong>porary residence Visa is granted to workers, both self-<strong>em</strong>ployed and subordinated, for the exercise<br />
of their professional activity, when provided r<strong>em</strong>otely, allowing the establishment of residence in <strong>Portugal</strong>.<br />

The T<strong>em</strong>porary Residence Permit implies that the foreign citizen is habitually resident in <strong>Portugal</strong>, under<br />

4.9. Application for a T<strong>em</strong>porary Residence Permit<br />
Once approved, the Portuguese Consulate in the country of origin or residence issues the Visa sticker (D2,<br />
D3 or D7) in the applicant’s passport, which is valid for a period of 4 months and allows two entries in <strong>Portugal</strong>.<br />
During this period, the applicant will have to attend an appointment at the AIMA Agency in <strong>Portugal</strong>, to request<br />
a t<strong>em</strong>porary residence permit, through the delivery in paper format of all the legally required documentation<br />
and where his/her biometric data will be collected for the issuing of a residence permit.<br />
This will happen if the holder of t<strong>em</strong>porary residence is absent for six consecutive months or eight interspersed<br />
months during the total period of validity of the residence permit.<br />
These prolonged absences indicate that the holder of the authorization no longer resides in the country,<br />
keeping for convenience reasons the resident title, by the facilities that it gives, namely for the purposes of<br />
entry and circulation within the European Union.<br />
However, to avoid the risk of cancellation of the t<strong>em</strong>porary residence permit, the absence be- yond the<br />
limits foreseen in the Law must be justified by means of a request submitted to AIMA before the resident’s<br />
departure from national territory or, in exceptional cases, after his/her departure (for example, the need to<br />
give personal assistance to a seriously ill family m<strong>em</strong>ber, residing in a third country, may be considered an<br />
exceptional case).<br />
4.9.1. Cost of the T<strong>em</strong>porary Residence Permit<br />

mentioned above, when they prove that during their absence from national territory they have developed<br />

After 5 years of legal residence in <strong>Portugal</strong>, the applicant may choose to apply for a Permanent Residence<br />
Permit or Portuguese Nationality, as long as he/she fulfils the requir<strong>em</strong>ents and conditions of the respective<br />
legislation in force.<br />
The application for the granting of a Permanent Residence Permit is made by appointment, delivered in<br />
person with the appropriate form signed by the applicant or his/her legal representative at any AIMA regional<br />
directorate or delegation, which may forward it, after instruction and decision, to the regional directorate or<br />
delegation of the applicant’s area of residence.<br />
4.9.2. Duration of the T<strong>em</strong>porary Residence Permit<br />
Under the terms of number 1 of article 75 of Law no. 23/2007, of July 04, t<strong>em</strong>porary residence permits are<br />
valid for a period of one year, counting from the date of issue of the respective title and are renewable for<br />
successive periods of two years.<br />
It should be noted that since 2020, due to the pand<strong>em</strong>ic caused by Covid-19, residence permits have been<br />
issued on a provisional and exceptional basis, valid for two years and renewed for successive periods of<br />
three years.<br />
Regarding the T<strong>em</strong>porary Residence Permit for teaching activities, highly qualified or cultural activities, the<br />
applicant may be ex<strong>em</strong>pt from a residence visa whenever he/she has entered or r<strong>em</strong>ained legally in <strong>Portugal</strong>.<br />
In addition to other legally required documentation, the application must be accompanied by proof of knowledge<br />
of basic Portuguese, by presenting:<br />
i. Qualification’s certificate issued by a Portuguese official teaching establishment, or private or cooperative<br />
teaching establishment recognized under the legal terms, or<br />
ii. In the case of a person who has attended an official teaching establishment, or private or cooperative<br />
teaching establishment recognized under the legal terms in a country where Portuguese is the official<br />
language, through a qualification certificate issued by that teaching establishment, or<br />
iii. Certificate of success in the basic Portuguese course issued by IEFP, or<br />
iv. Certificate of success in the basic Portuguese language course issued by a legally recognized official<br />
teaching establishment or a private or cooperative teaching establishment, or<br />
v. Certificate of knowledge of basic Portuguese, by taking a test at the Centre for the Evaluation of Portuguese<br />
as a Foreign Language (CAPLE), recognized by the Ministry of Education and Science, or<br />

The Permanent Residence Permit is issued for a period of five years and must be renewed every five years.<br />
If the permanent resident is absent from <strong>Portugal</strong> for 24 (twenty four) consecutive months or, within a period<br />
of three years, 30 (thirty) months interpolated, the permanent residence permit may be cancelled, except if<br />
he/she proves that during his/her absence from the national territory he/she carried out a professional<br />
or business activity or an activity of a cultural or social nature.<br />
On the other hand, foreigners of legal age or <strong>em</strong>ancipated under Portuguese law, who have legally resided<br />
in Portuguese territory for at least five years, provided they have sufficient knowledge of the Portuguese<br />
language, have not been convicted of a crime punishable by a prison sentence of three years or more, in<br />
accordance with Portuguese law, and do not constitute a danger or threat to national security or defense by<br />
their involv<strong>em</strong>ent in activities related to the practice of terrorism, under the terms of the respective law, may<br />
request Portuguese nationality by naturalization.<br />

The request is made through an application addressed to the Minister of Justice, accompanied by the legally<br />
required documentation (including proof of basic knowledge of the Portuguese language), presented in person<br />
or sent by mail to the Central Registry Office.<br />
5. Investment in the Madeira Free Trade Zone<br />
5.1. Companies in the Madeira Free Trade Zone<br />
The International Business Center of Madeira (CNIM), usually referred to as the Madeira Free Trade Zone<br />
(ZFM), was created in the 1980s as a regional development instrument.<br />
Essentially, it has the advantage of bringing a set of incentives, particularly of a fiscal nature, aimed at attracting<br />
foreign investment to the region.<br />
Law n. 21/2021, among other amendments extends, until at least Dec<strong>em</strong>ber 31, 2027 the CINM /ZFM regime.<br />
The main tax benefits and the respective regime are governed by Article 36-A and paragraphs 4 to 20 of<br />
Article 33, both of the Tax Benefits Statute (EBF).<br />
Under Article 36-A of the Tax Benefits Statute, which enshrines Regime IV of the ZFM as agreed with the<br />
European Commission, all types of company provided for under Portuguese law, including branches, holding<br />
companies/SGPS, sole proprietorships and permanent establishments may set up in the IBC of Madeira and<br />
benefit from the inherent regime.<br />
It should be noted that the current benefits apply to entities registered with the CNIM from January 1, 2013<br />
until Dec<strong>em</strong>ber 31, 2023 and apply until Dec<strong>em</strong>ber 31, 2027.<br />
5.2. ZFM Benefits<br />
Companies registered with the CNI M will be able to benefit, as mentioned, from a reduced corporate income<br />
tax rate of 5% until Dec<strong>em</strong>ber 31, 2027.<br />
6. Access to the Portuguese National Health Service (SNS)<br />
The user number is attributed to each person to identify th<strong>em</strong> when accessing services in the public healthcare<br />
units of the National Health Service (SNS).<br />
A foreign citizen with a residence or permanence permit or work visa in <strong>Portugal</strong> can apply for a SNS user<br />
number.<br />
If you don’t have legal residence or a work visa, you will have to ask for a certificate of residence at your local<br />
council, proving that you have been in <strong>Portugal</strong> for more than 90 days.<br />
Documents to be submitted:<br />
i. If you have foreign citizenship and have authorization to reside or stay in <strong>Portugal</strong>, you must present the<br />
following documents at the Health Centre in your area of residence:<br />
a. Residence / stay permit or work visa;<br />
b. Tax Identification Number (NIF).<br />
ii. If the applicant has foreign citizenship, does not have a residence or permanence permit or a work visa,<br />
but has been living in <strong>Portugal</strong> for more than 90 days, the applicant must apply:<br />
a. A certificate of residence at your local council, proving that you have been in <strong>Portugal</strong> for more<br />
than 90 days;<br />
b. Then, the foreign citizen will only need to present the residence certificate and the NIF to register<br />
in the Health Centre and obtain the user number. With a user number he/she will be able to access<br />
the services and establishments of the SNS.<br />
iii. If you have foreign citizenship and live in <strong>Portugal</strong> for less than 90 days, but do not have permanent<br />
residence in <strong>Portugal</strong>, you can make a provisional registration, and for this purpose contact the Health<br />
Line (Linha Saúde) 24 (808 24 24 24), where you will be given instructions on how to create a provisional<br />
user number.<br />
There is no charge for requesting a user number and it is not compulsory for Golden Visa holders, although<br />
it is always recommended.<br />
Alternatively, or even simultaneously, the foreign citizen can take out a health insurance policy in <strong>Portugal</strong>.<br />
To benefit from this regime, however, there are requir<strong>em</strong>ents that must be met:<br />
- Start activity within six months (except industrial activities or maritime and air transport, which have one<br />
year) of the date of licensing:<br />
And, alternatively,<br />
- Creation of one to five jobs in the first six months of activity and a minimum investment of €75,000 in the<br />
acquisition of tangible or fixed assets in the first two years of activity; OR<br />
7. Working in <strong>Portugal</strong><br />
7.1. Obtaining a Social Security Number<br />
In case that a foreign citizen wants to exercise a professional activity in <strong>Portugal</strong>, he/she will need to obtain<br />

a Social Security Identification Number (NISS), whether this activity subordinated (dependent workers) or for<br />
him/herself (independent workers).<br />
Portuguese institutions, namely Social Security, make it possible to obtain an NISS on the spot, through very<br />
simple mechanisms.<br />
7.2. Dependent <strong>em</strong>ployees / <strong>em</strong>ployees on behalf of others:<br />
Foreign citizens who don’t have a Social Security Identification Number (NISS) can apply for a NISS online.<br />
If you start working as an <strong>em</strong>ployee, it is the <strong>em</strong>ployer who applies for the NISS at the Social Security office.<br />
In the case of dependent workers, in order to obtain the NISS, the <strong>em</strong>ployer must proceed according to the<br />
points below, having the following documentation in their possession:<br />
o fill in the form available on the Social Security portal<br />
o attach a scanned copy of the identification document<br />
o have a work permit.<br />
If the application is made by the <strong>em</strong>ployer or legal representative of a foreign national, the following will also<br />
be required:<br />
o Power of Attorney (original document) or Declaration of Authorization to Third Parties - PA12<br />
o Identification document of the person who is the legal representative (Passport, Residence Permit or other<br />
civil identification document from the country of origin)<br />
If the <strong>em</strong>ployer makes the request, they act as the <strong>em</strong>ployee’s legal representative.<br />
The NISS application is free of charge.<br />
7.3. Self-<strong>em</strong>ployed/ Opening of Activity in the ATA<br />
If the foreign citizen intends to develop his professional activity as a self-<strong>em</strong>ployed worker, he should, himself,<br />
make the request for the attribution of the NISS through the <strong>em</strong>ail address ISS-Pedido-NISS@seg-social.pt,<br />
and for this purpose attach the necessary scanned documentation.<br />
It is also mandatory to declare to the Tax Authority, which you can do in a simple way in your personal online<br />
area of the Portal das Finanças.<br />
7.4. Requesting a TIN and opening a business at the ATA<br />
You must also register with the Tax Authority in order to obtain a NIF (Tax Identification Number) in either<br />
situation (dependent or self-<strong>em</strong>ployed worker) and open an activity in the case of a foreign worker, which you<br />
can do simply in your personal online area of the Finance Portal or in person at a Tax Office.<br />
Obtaining a TIN is free of charge.<br />
8. Setting up a Company in <strong>Portugal</strong> / Opening of Branches in <strong>Portugal</strong> / Request<br />
of NIPC for Foreign Companies<br />
If the foreign citizen wants to set up a new company, or open a branch of an existing company, currently the<br />
way to do it in <strong>Portugal</strong> is quite simple, being able to do it almost immediately through the “Empresa na hora”<br />
and “Sucursal na hora” services, available at specialized offices throughout the country.<br />
To set up a company with the “Empresa na hora” (“Instant Company”) service, you need to:<br />

• Choose the company`s name from the pre-approved list on the internet or from the list on the firm on<br />
the spot counter, or present a certificate of admissibility that has already been approved by the National<br />
Register of Legal Persons;<br />
• Choose one of the pre-approved covenant models;<br />
• Appoint a Chartered Accountant (TOC), choose one from the available TOCs Exchange or submit the<br />
declaration of beginning of activity at any tax office (up to 15 days after the creation of the company);<br />
• That the partners of the company have deposited the amount of the company’s share capital or declare<br />
that the amount will be deposited in cash or delivered to the company’s coffers.<br />
If the shareholders are natural persons, they need to:<br />
i. Present an identification document (Citizen Card, Identity Card, Passport or Residence Permit;<br />
ii. Provide your Portuguese Tax Identification Numbers (NIF).<br />
If the m<strong>em</strong>bers are legal persons, the following must be submitted<br />
i. The Legal Entity Identity Card or the e-Card access code;<br />
ii. The minutes of the deliberation of the General Ass<strong>em</strong>bly granting the legal representatives the power to<br />
incorporate the legal person;<br />
iii. The identification documents of the legal representatives of the company to be created (Citizen Card,<br />
Identity Card, Passport or Residence Permit);<br />
iv. The certificate of the deed, document of incorporation or updated m<strong>em</strong>orandum of association of the<br />
collective entities.<br />
All partners of the company to be created must be present at the time of the application to request the entity.<br />
The company’s m<strong>em</strong>orandum, articles of association and commercial registration are carried out at the<br />
On-the-Spot Firm desk. Citizens receive the m<strong>em</strong>orandum of association, the access code to the permanent<br />
commercial certificate, the access code to the Company/Corporate Body Card and the Social Security<br />
number of the company.<br />
Subsequently, the partners must deposit the share capital in a bank account in the company’s name within<br />
five working days of registration - or, alternatively, the partners can deposit the share capital into the company’s<br />
coffers by the end of the first financial year (usually by the end of the year).<br />
The base cost of this operation is € 360,00 Euros, and some costs may be accrued if other el<strong>em</strong>ents are<br />
added (association of the brand with a class of products or services, realization of the share capital through<br />
contributions in assets other than cash, etc.)<br />
In the case of opening a Sucursal na Hora (Branch on the Spot), the basic cost is € 200.00 Euros and the<br />
documents required are:<br />
i. Identification document of the interested person;<br />
ii. Proof of the powers for the envisioned act;<br />
iii. Document proving the legal existence of the entity establishing permanent representation;<br />
iv. Complete and updated text of the m<strong>em</strong>orandum or articles of association of the entity establishing permanent<br />
representation;<br />
v. Company resolutions approving the creation of permanent representation and the appointment of the<br />
respective representative(s);<br />
vi. Portuguese Tax Identification Number (NIF) of the representative(s) of the permanent representation.<br />
Documents written in a foreign language must be accompanied by its corresponding translation (except<br />
when they are written in English, French or Spanish and the official has an understanding of that language).<br />
Finally, to request the Legal Person Identification Number (NIPC) of a foreign company wishing to<br />
operate in <strong>Portugal</strong>, it is necessary to make the respective request through a specific form (RNPC - Model<br />
2) and fill it in with the required documents, depending on the nature and type of the foreign entity. This application<br />
is subject to the payment of a fee of € 50 Euros.<br />

9. The Tax Regime of Non-habitual residents (NHR)<br />
<strong>Portugal</strong> offers a favorable and attractive tax regime for foreigners who wish to become tax residents in the<br />
country and who have not been taxed as such in the last 5 years.<br />
The Non-Habitual Resident (NHR) is a special status aimed at attracting professionals perfor- ming activities<br />
of high added value or intellectual property, as well as persons benefiting from income obtained abroad.<br />
to eligible projects and have contracts for granting tax benefits concluded under the Investment Tax Code,<br />
approved by Decree-Law 162/2014, of October 31.<br />
The following table summarizes briefly the tax regime applicable to non-habitual residents who derive income<br />

9.1. Procedure<br />
The application for the registration as a Non Habitual Resident must be made until March 31st, inclusive, of<br />
the year following that in which he/she becomes resident in Portuguese territory.<br />
In order to be granted the non-habitual resident status in <strong>Portugal</strong>, it is necessary to take the following steps:<br />
a. Obtaining a Portuguese tax identification number (NIF);<br />
b. Registration as tax resident in <strong>Portugal</strong> with the Tax and Customs Authority;<br />
c. Registration as a non-regular resident.<br />
A citizen who is granted the status of non-habitual resident is taxed under this regime for an unextendable<br />
period of 10 (ten) years, starting from the year, inclusive, of his/her registration as a resident in <strong>Portugal</strong>,<br />
provided that in each of these years he/she is considered resident in the national territory. In case they are<br />
no longer considered residents, they don’t lose their status and will benefit from it on the year which they are<br />
again considered tax residents in <strong>Portugal</strong>, benefiting from it on the r<strong>em</strong>aining years of that period.<br />
Thus, although the holders of a residence permit for investment activity (ARI) are not obliged to apply for the<br />
status of non-habitual resident in <strong>Portugal</strong>, it is a more favorable tax regime that has increasingly gained the<br />
sympathy of Gold Visa beneficiaries.<br />
10. Succession Issues and Wills<br />
10.1. Succession<br />
A succession is the transfer, by death, of the assets, rights, and obligations of the deceased person to their<br />
heirs. A transnational (or international) succession is one that involves el<strong>em</strong>ents from different countries, for<br />
example, when the deceased lived in a country that is not their country of origin, and the heirs reside in a<br />
different country, or when the deceased left assets in various countries.<br />
10.2. The European Regulation on Successions<br />
To avoid the complexities of initiating succession proceedings in various countries with different legal syst<strong>em</strong>s<br />
in cases of transnational successions, the European Union (EU) adopted legislation in 2012 to facilitate the<br />
planning and manag<strong>em</strong>ent of transnational successions - the “Succession Regulation” [Regulation (EU) No.<br />
650/2012], applicable since August 17, 2015.<br />
This European regulation applies to EU countries, with exceptions like Ireland and Denmark, and does not<br />
prejudice the application of other international conventions on the matter.<br />
The regulation simplifies rules in the following aspects:<br />
1. Competent Authorities for Dealing with Succession: The regulation establishes, as a principle, that<br />
the competent authorities for handling transnational successions are the judicial bodies of the EU M<strong>em</strong>ber<br />
State in which the deceased had their last habitual residence at the time of death.<br />
2. Applicable Law to Succession: The regulation generally determines that the law applicable to the entire<br />
succession is the law of the State where the deceased had their habitual residence at the time of death,<br />
even if it is not the law of an EU M<strong>em</strong>ber State.<br />
Exceptionally, if the circumstances of the specific case d<strong>em</strong>onstrate that the deceased had a clearly closer<br />
relationship with a different country than their last habitual residence, the law of that country will be applied to<br />
the succession (e.g., if the deceased moved to the country of their last residence shortly before their death).<br />
3. Possibility of Choosing the Applicable Law for Succession: Regarding the law applicable to the<br />
<strong>Portugal</strong> Investment and Residency Guide for Foreigners<br />
succession, the regulation allows individuals to determine the law that will be applied to their inheritance.<br />
They can choose the law of the country of which they are a national at the time of the choice or at the<br />
time of their death. This choice can extend to the law of an EU M<strong>em</strong>ber State or a non-EU country. In<br />
the latter case, the individual must ensure that the chosen law allows for such an option and application.<br />
If one has multiple nationalities, they can choose the law of any of those countries. This choice can be<br />
made in a will or a separate stat<strong>em</strong>ent of equal formality, and its validity is determined by the rules of<br />
the chosen law.<br />
The law applicable to the succession covers the transmission of all assets of the deceased, including movable<br />
property, bank accounts, real estate, etc., regardless of their location (even if they are in different<br />
countries). It regulates issues such as: a) Who the beneficiaries of the succession are (if there is no will);<br />
b) The transfer of property to the heirs and legatees; c) The share of the inheritance allocated to each heir<br />
and, if applicable, what must be reserved for the spouse and children according to the law; d) The powers of<br />
the heirs, testamentary executors, and estate administrators, including selling assets and paying creditors;<br />
e) The testator’s freedom to decide who receives their assets and any consideration for gifts made during<br />
the testator’s life to protect the shares reserved for their children and spouse; f) Conditions for accepting or<br />
disclaiming the inheritance; g) How assets should be managed before being distributed to the successors; h)<br />
Responsibility for the debts of the estate.<br />
The regulation imposes restrictions on the application of the chosen law, including the authority of the EU<br />
M<strong>em</strong>ber State handling the succession to refuse to apply a law that violates fundamental principles of public<br />
order in that EU state (e.g., the authority of the State handling the succession may refuse to apply provisions<br />
that discriminate against heirs based on gender).<br />
In cases where the legislation of the country where certain immovable property (e.g., land or a building) or<br />
certain businesses (e.g., a farm) situated in that country has mandatory special rules for the succession of<br />
these assets based on economic, family, or social considerations (e.g., to preserve the unity of a farm in an<br />
agricultural zone), the EU M<strong>em</strong>ber State authority handling the succession will apply these rules to the succession<br />
of those assets, even if it is not the law applicable to the succession of other assets.<br />
4. Recognition, Enforc<strong>em</strong>ent, and Execution of Decisions: The EU regulation states that judicial decisions<br />
regarding successions made in one EU M<strong>em</strong>ber State will be automatically recognized, accepted,<br />
and enforced in other EU M<strong>em</strong>ber States. It also provides for a simplified procedure to declare such<br />
decisions enforceable if they are contested. This simplifies the acceptance and declaration of enforceability,<br />
for example, of a notarial document in matters of succession (e.g., a will or a succession certificate)<br />
issued in one EU M<strong>em</strong>ber State to be recognized and declared enforceable in another EU M<strong>em</strong>ber State<br />
under these simplified rules.<br />
5. The European Certificate of Succession: This is a document that can be requested by the heirs, legatees,<br />
testamentary executors, and administrators of the deceased’s assets and attests to their capacity<br />
to exercise their rights in another EU M<strong>em</strong>ber State. The certificate can be requested from a court or<br />
other competent authority, as per national legislation, with jurisdiction over succession matters. This<br />
entity issues an authentic document (regarding content and signature authenticity). The European Certificate<br />
of Succession has the same effect in all EU M<strong>em</strong>ber States, regardless of the EU country where<br />
it is issued, and it dispenses with special recognition formalities.<br />
10.3. The Will<br />
A will is a unilateral and revocable act by which a person disposes of all or part of their assets to take effect<br />
after their death. The testamentary act is characterized by being: a) Revocable in that the testator has the<br />
power to revoke it in whole or in part. Revocation can be: (i) Express: by a declaration of the author to that<br />
effect; (ii) Real when its execution becomes unfeasible because the testator has not left any assets; (iii) Tacit<br />
when the testator makes a new will and, without making any reference to the previous one, the new provisions<br />
are incompatible with the previous one. b) Personal because it cannot be made through a representative;<br />
c) Singular: only one person can make a will in the same act.<br />

Forms of the Will: The will can be: • Public - if it is written by a notary in their notary book, in the presence of<br />
witnesses and containing the formalities required by law, and filed in the Notary Office, with a copy given to<br />
the testator. • Closed - if it is handwritten and signed by the testator or handwritten by another person at the<br />
testator’s request and signed by the testator. It must be approved (checking its compliance with the law) by<br />
a notary and can be deposited with the notary.<br />
