Trial against J.A.I.B. starts this March
18 months state repression reach climax
Starting from the remnants of the § 278** preliminary investigation against J.A.I.B. and at
least six other activists, the judiciary tinkered together a bill of indictment.
The section §277 (criminal conspiracy) and §278 b) c) (terrorist organization and crime,
Austrians criminal code) disappeared, but the political motivation of the whole procedure
remains obvious – criminalization of political engagement. In concrete terms the political
engagement in the course of education protests since 2009. The four activists J.A.I.B.
expect their trail in the near future for “attempted arson” (§ 169 & § 15 StGB) concerning
to two garbage bins which were lit on fire at the AMS 1050 Vienna Redergasse during the
summer of 2010. Penalty reaches form 1 to 10 years imprisonment. The trial will be held
on 13th March 2012, from 9am to 1 o’clock pm, under the direction of Judge Gerald
Wagner.
Brief history of repression in the summer of 2010
On 6th of July 2010 several apartments in Vienna and a club house were searched, in the
sequence three people were arrested, yet another search warrant and arrest took place
on 20th of July.
The four arrested were took in custody for five or seven weeks. They were allegedly
accused of §277criminal conspiracy and §278b,c membership in a terrorist organiziation.
In the course of the investigation several new allegations were raised and withdrawn non
of them were tenable. Several other persons were accused, wiretaped and monitored.
The investigation covered by § 278 against at least ten people have now officially stopped.
Of those designed allegations no evidence was found only the arson attack on the AMS
Redergasse remained.
The procedure follows the logic of all § 278 cases – this is not an isolated case, this is
structurel!
The official charges are based on extensive monitoring measures in the course of
investigations carried out under § 278. Although the construct of the terrorist group was
not included in the indictment, the defendants are still traded as members of this alleged
organization. Affected by this criminalization are not just those four. During the police
investigation of the “Uni-Brennt” austrians student movement at least ten people were
accused by the LVT (Offfice for State Protection and Counter Terrorism) of being part of
terrorist organization*. Leading officials in this investigation were Muik, Zwettler & Friends
all clerks at Austrians secret police. Against how many people this paragraph was actually
used to monitor them remains uncertain. 5
