1. Each State Party shall ensure that education
and information regarding the prohibition against
torture are fully included in the training of law
enforcement personnel, civil or military, medical
personnel, public officials and other persons who
may be involved in the custody, interrogation or
treatment of any individual subjected to any form
of arrest, detention or imprisonment.
Honorable Supreme court has interpreted the
constitutional right to life and liberty as “ an
inbuilt guarantee against torture or assault by the
State or its functionaries,” irrespective of the crime
committed by the person.
In today’s world, media has access to every nook
and corner. Human rights agencies are vigilant and
one mistake can make security forces’ life hell. We
are living in a civilized world, where we must do
away with barbaric form of dealing with criminals/
terrorists/anti national elements.
We, as members of security forces must abide
by the law of the land, international covenants
on civil & human rights and strictly adhere to
Universal Declaration of Human Rights. As a
member of Force we must have knowledge of Dos
and Don’ts to avoid human right violations in our
sphere of duties.
DO’S AND DON’TS WHILE ACTING UNDER
ARMED FORCES SPECIAL POWER ACT, 1958.
ACTION BEFORE OPERATION
a) Act only in the area declared ‘Disturbed
Area u/s 3 of the Act.
b) Power to open fire using force or arrest is
to be exercised under this Act by an officer/
JCO/WO & NCO.
c) Before launching any raid/search definite
information about the activity to be obtained
from the local civil authority.
d) As far as possible co-opt representative of
local civil administration during the raid.
ACTION DURING OPERATION

a) In the case of necessity of opening fire and
using any force against the suspect or any
person acting in contravention to law and
order, ascertain first that it is essential for
the maintenance of public order. Open fire
only after due warning.
b) Arrest only those who have committed
cognizable offence or who are to commit
cognizable offence.
c) Ensure that troops under command do not
harass innocent people, destroy property of
the public or unnecessarily enter the house
of law abiding people.
d) Ensure that women are not searched or
arrested without the presence of female
police. In fact women should be searched
by female police only.
ACTION AFTER OPERATION
Special Feature
a. After arrest prepare a list of the arrested
persons.
b. Hand over the arrested person to the nearest
police station with the least possible delay.
c. While handing over to the police a report
should be accompanied with details
mentioning circumstances leading to arrest.
d. All recovered arms, ammunition, stores etc
should be handed over to the police station
along with the seizure memo.
e. Obtain receipt of persons and arms/
ammunition, stores etc. handed over to the
police.
f. Make records of the area where operation is
launched mentioning the date and time and
persons participating in such raid.
g. Make a record of the commander and other
officers/JCOs/NCOs forming part of such
Force.
