11 I have to disagree with my friend that to d<strong>et</strong>ermine function<strong>al</strong>ity, you would have to<br />
<strong>12</strong> engage in a -- such a d<strong>et</strong>ailed an<strong>al</strong>ysis. For instance, if we’re able to d<strong>et</strong>ermine that Chief<br />
13 and Council actu<strong>al</strong>ly occasion<strong>al</strong>ly me<strong>et</strong>s to review membership applications as opposed to<br />
14 they’ve never m<strong>et</strong> to review membership applications, I would suggest that’s a very large<br />
15 indicator of function<strong>al</strong>ity that doesn’t require you to go into assessing the merits of each<br />
16 individu<strong>al</strong> application. And at least my current instructions, if we are acting, is not to go<br />
17 into the minutia of each membership application; it’s to try and assess wh<strong>et</strong>her or not<br />

there’s actu<strong>al</strong>ly some function process.<br />
