ILLEGITIMATE CHILDREN.<br />

30. An iUegitimate chUd shaU have the legal status of<br />

a legitimate chUd in respect of his mother and her relatives<br />

by blood.<br />

31.—(1) An iUegitimate chUd shaU acquire by reason<br />

of the fact that the father subsequently marries the mother<br />

the legal status of a legitimate chUd in respect of both<br />

his father and mother and their relatives by blood.<br />

(2) In the event of such marriage, the husband of the<br />

mother shallbe deemed to be the father of the chUdif he<br />

has co-habited with her, to the exclusion of all other male<br />

persons, within the period of possible conception specified<br />

in sub-section (3), unless it is evidently impossible under the<br />

circumstances that the mother has conceived the chUd<br />

in consequence of such co-habitation.<br />

(3) The period of possible conception in this section<br />

mentioned is the period between the one hundred and<br />

eighty-first day and the three hundred and second day,<br />

both inclusive, before the birth of the chUd.<br />

32. An Ulegitimate chUd born after the coming into<br />

operation of this Law may be declared legitimate by an<br />

order of a Court or Tribunal made in accordance with,<br />

and subject to the provisions contained in, this Part.<br />

33. No iUegitimate child shall be declared legitimate—<br />

(a) if at the time of the conception of such child a<br />

marriage between the parents would be forbidden<br />

by the doctrines of the religion to which the father<br />

belongs on account of relationship by blood or by<br />

marriage ; or<br />

(fe) if such child is dead ; or<br />

(c) if the father of such chUd is dead.<br />

34. Subject to the provisions of section 33, an order<br />

declaring an illegitimate chUd legitimate may be made only<br />

by a Court or Tribunal within the jurisdiction of which the<br />

father of such chUd resides, and only on the application—<br />

(a) of the father at any time, with the consent of the<br />

mother of the chUd (if such mother is alive and is<br />

not a person under disabUity or an incapable person)<br />

and of the chUd himself if over eighteen years of age<br />

and is not a person under disability or an incapable<br />

person, or<br />

(6) of the mother of the chUd or of the guardian of<br />

the mother if she is a person under disability or an<br />

incapable person within twelve months of the birth<br />

of the child.<br />

35. Nothing in sections 32, 33 and 34 contained shaU be<br />

construed or interpreted as—<br />

(a) restricting the right of an iUegitimate child born<br />

before the date of the coming into operation of this<br />

Law to be declared the child of his father for the<br />

purpose of succession under the provisions of the<br />

Moslem religious law, or<br />

(b) limiting the jurisdiction and powers of a Tribunal<br />

in the determination of the right to succession of<br />

such illegitimate child.<br />

36. An iUegitimate chUd who has been declared legitimate<br />

by an order of a Court or Tribunal as in this Part provided,<br />

shaU, as from the date of his birth, have the legal status<br />

of a legitimate chUd in respect of both his father and<br />

mother and their relatives by blood.<br />
