Before we accept your booking, we will inform you of the scheduled flight times in effect as of that time; and it will be shown on your Ticket. It is possible that we may need to change the scheduled flight time subsequent to issuance of your Ticket. If you provide us with contact information, telephone number or email address, we will inform you of such changes. If, after you purchase your ticket, we make significant changes to our flight times that are unacceptable to you and we are unable to offer you a flight that is acceptable to you, you will be entitled to a refund of the Ticket. 8.2 Cancellation, Rerouting, Delays We have a high rate of reliability and punctuality and we continue to make great efforts in order to avoid delays in future, too. For this purpose and in order to prevent cancellation of a flight, in exceptional circumstances we may arrange for a flight to be operated on our behalf by an alternative carrier or aircraft. In the event that a flight is delayed or cancelled or you are denied due to overbooking, however, you have claims in accordance with Regulation (EC) No. 261/2004 of the European Parliament and of the Council establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No. 295/91. Except as otherwise provided by the Convention, if we fail to operate a flight according to schedule, fail to stop at your final destination or Stopover destination for what reason ever, we shall if not stated different by Regulation (EC) 261/2004, at your option, either: a. carry you on the next of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of your Ticket, or b. offer you a refund in accordance with the provisions of the these Conditions of Carriage These options are the sole remedies available to you in these cases; we do not assume liability for damages financial losses 9 Refunds Will be handled in accordance with Article 4.5 of this document. 9.1 To whom refund made We shall be entitled to make a refund either to the person named in the Ticket or to the person who paid for the Ticket. If the Ticket was paid by a person another than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on the refund, we shall make a refund only to the person who paid for the Ticket. Refunds will only be made on surrender to us of the Ticket and all unused Flight Coupons. 9.2 Loss of the Ticket If you lose a Ticket or a portion of it, upon furnishing us with satisfactory proof of the loss, and payment of a reasonable administration charge, refund on the Ticket will be made after expiry of the validity period of the Ticket, on condition: a. that the lost Ticket, or portion of it, has not been used, previously refunded or replaced b. that the person to whom the refund is made undertakes, in such form as may be prescribed by us, to repay to us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it used 14
If we or one of our Authorised Agents lose the Ticket we shall replace it. 9.3 Currency All refunds are subject to national laws, regulations and instructions of the country where the Ticket was originally bought and of the country where the refund is made. Subject to the provision mentioned above, refunds are usually made in the currency used to pay for the Ticket. If we refund a Ticket in Euros to the rate of exchange in use on the date of payment, this is, in our opinion, a release of guilty. 9.4 Involuntary Refunds You are entitled to a refund of the entire price of the Ticket or for those portions of it that have not been used, if a. we cancel a flight or fail to operate a flight b. we fail to operate a flight according to schedule, or operate a flight very delayed and you will not take the flight therefore c. If we do not carry you to the f destination by other means of transport if the aircraft will not land at the destination 10 Conduct On Board the Aircraft 10.1 General You shall conduct on board of the aircraft such that: a. the aircraft, or any person or property on board, are not endangered b. you do not obstruct the crew in the performance of their duties, or fail to comply with their instructions, including but not limited to those with respect to smoking, alcohol or drug consumption, or c. you do not behave in a manner which causes or is likely to cause discomfort, inconvenience, damage or injury to other passengers or the crew. We may take such measures we deem necessary to prevent continuation of such conduct, including restraint. In such cases you may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft. 10.2 Electronic Devices For safety reasons, the operation of electronic equipment such as mobile telephones, laptop computers, portable radios and recorders, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies is forbidden. The use of hearing aids and pacemakers is permitted. 10.3 Food brought on board We reserve the right to prohibit consume of drinks and food brought on board if necessary. 15
