If a Passenger is injured or killed, we have to make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation, and according to the severity of the accident. In the event of death, this advance payment in Euros shall not be less than 16.000 SZRs per passenger. This advance payment shall not constitute an acknowledgement of liability and may be offset against amounts subsequently disbursed on the basis of our liability, if applicable. The advance payment must not be refunded, unless it has been subsequently established that individual who received the advance payment caused the damage negligently or contributed towards the damage with his/her negligence or did not have a claim for damages. 13.3 Damage to Baggage (to checked and unchecked baggage) We will not be liable for damage caused to baggage, if we can prove that the damage was not caused by unlawful behaviour or gross negligence by our company or our staff or if the damage can be traced back to unlawful behaviour or gross negligence of a third party. In all remaining cases, in particular regarding damage to unchecked baggage or its contents and the personal belongings or our passengers, we are only liable for damage if it can be proved that the damage was caused by us or a member of our staff. We reserve the right to provide evidence that the claim was totally or partially to blame for the damage; depending on our success in providing this evidence, we will be exempt from liability. We shall have no liability of any damage caused to your baggage or caused by items in your baggage. If these items in your baggage cause damage to another passenger´s baggage or to our property, you shall be held liable by us for any damages and expenses that may be incurred as a result. We shall have not liability for damage to and loss or theft of perishable, delicate or highly sensitive items, computers, laptops, jewellery, percious metals, money, bonds, securities, business papers, passport prototypes, identification papers and items of clothing. We are liable for destruction, loss or damage to baggage up to 1.000 SZRs. We reserve the right to seek a professional opinion on the compensation amount. We are not liable for these costs. 13.4 Schäden aufgrund Verspätung, Nichtbeförderung und Annullierung In case of passenger delay we are liable for damage unless we took all reasonable measurers to avoid damage or it was impossible to take such measurers. In cas of a flight delay of 2 hours or more we offer assistance to the concerned passengers and a ticket refund according to Regulation (EC) No 261/2004. In case of a baggage delay we are liable for damage unless we took all reasonable measurers to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1.000 SZRs. 14 Amendments and waiver None of our Authorised Agents, employees, or authorised representatives is entitled to supplement or amend these General Terms and Conditions of Carriage. 18
15 Court of Jurisdiction and law If there are no other prevailing provisions, Austrian law is applicable. The applicable court of jurisdiction is Dornbirn.
