VII. RECoMMEndATI<strong>on</strong>S<br />

A. Marijuana Policy<br />

i. legalize Marijuana Use and Possessi<strong>on</strong><br />

The most effective way to elim<strong>in</strong>ate arrests for marijuana use and possessi<strong>on</strong>, the<br />

racial disparities am<strong>on</strong>g such arrests, and the Fourth Amendment violati<strong>on</strong>s that often<br />

accompany such arrests, is to legalize marijuana. For <strong>in</strong>stance, <strong>in</strong> Wash<strong>in</strong>gt<strong>on</strong>, Blacks<br />

were almost three times more likely to be arrested for marijuana possessi<strong>on</strong> as whites,<br />

and the Black/white racial disparity <strong>in</strong> marijuana possessi<strong>on</strong> arrests <strong>in</strong>creased by<br />

42% between 2001 and 2010. By pass<strong>in</strong>g Initiative 502, which legalized possessi<strong>on</strong> of<br />

marijuana for people 21 years or older and thus ended arrests of adults for possessi<strong>on</strong>,<br />

Wash<strong>in</strong>gt<strong>on</strong> has also ended such racial disparities with respect to marijuana possessi<strong>on</strong><br />

arrests of people 21 years or older.<br />

Marijuana legalizati<strong>on</strong> should occur through a system of taxati<strong>on</strong>, licens<strong>in</strong>g, and<br />

regulati<strong>on</strong> under which private bus<strong>in</strong>esses licensed and regulated by the state can<br />

sell marijuana subject to a sales tax. Legalizati<strong>on</strong> through tax<strong>in</strong>g and licens<strong>in</strong>g would<br />

not <strong>on</strong>ly solve the arrests epidemic and its attendant racial disparities by remov<strong>in</strong>g<br />

marijuana possessi<strong>on</strong> and use<br />

jail, and court costs that could be<br />

redirected to support<strong>in</strong>g public<br />

health approaches to drug addicti<strong>on</strong><br />

and c<strong>on</strong>fr<strong>on</strong>t<strong>in</strong>g more serious crime.<br />

For example, <strong>in</strong> 2010, 61% of all<br />

drug arrests <strong>in</strong> Colorado were for<br />

marijuana possessi<strong>on</strong>, the n<strong>in</strong>th<br />

highest percentage share <strong>in</strong> the country. Follow<strong>in</strong>g passage of Amendment 64, which<br />

legalized marijuana possessi<strong>on</strong> for adults, police can re<strong>in</strong>vest those resources toward<br />

other more important public health and safety objectives. At the same time, legalizati<strong>on</strong><br />

through taxati<strong>on</strong> and regulati<strong>on</strong> would raise new revenue that states could apporti<strong>on</strong> to<br />

public schools, substance abuse preventi<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g community- and school-based<br />

programs, as well as to general funds, local budgets, research and health care.
