pecuniary cost to taxpayers.<br />

Therefore, while the crime-mapp<strong>in</strong>g comp<strong>on</strong>ents of COMPSTAT can identify where serious<br />

crimes are occurr<strong>in</strong>g with greater frequency, thus focus<strong>in</strong>g police departments’ resources <strong>on</strong><br />

those areas to address serious crimes, it need not and <strong>in</strong>deed should not be accompanied by<br />

unc<strong>on</strong>stituti<strong>on</strong>al stop and search practices or a focus <strong>on</strong> generat<strong>in</strong>g high numbers of arrests<br />

for m<strong>in</strong>or offenses <strong>in</strong> those areas. To move away from evaluat<strong>in</strong>g progress and productivity<br />

through arrest numbers, police departments should reduce the reliance <strong>on</strong> stops, citati<strong>on</strong>s,<br />

summ<strong>on</strong>s, and arrests and broaden their benchmarks of success, rely<strong>in</strong>g <strong>in</strong>stead more heavily<br />

<strong>on</strong> other measurements of community safety and police-community relati<strong>on</strong>s.<br />

b. The Federal government Should not Include Marijuana Possessi<strong>on</strong> Arrests <strong>in</strong> its<br />

Performance Measures for Byrne justice Assistance grants<br />

Justice Assistance Grants were created with the purpose of curtail<strong>in</strong>g serious, violent crime<br />

and crack<strong>in</strong>g down <strong>on</strong> drug k<strong>in</strong>gp<strong>in</strong>s. However, because arrest statistics — which <strong>in</strong>clude any<br />

arrest, <strong>in</strong>clud<strong>in</strong>g any drug arrest — are <strong>in</strong>cluded <strong>in</strong> law enforcements’ performance measures,<br />

police departments are likely encouraged to <strong>in</strong>crease their arrest numbers by target<strong>in</strong>g their<br />

limited resources <strong>on</strong> low-level drug users and possessors. By <strong>in</strong>clud<strong>in</strong>g marijuana possessi<strong>on</strong><br />

arrests <strong>in</strong> performance assessments of a states’ use of federal funds, the federal government<br />

is rely<strong>in</strong>g up<strong>on</strong> an unreliable measure of law enforcement’s effectiveness <strong>in</strong> fight<strong>in</strong>g crime and<br />

reduc<strong>in</strong>g the traffic and availability of drugs. Indeed, such arrests reduce neither the use nor<br />

availability of marijuana.<br />

Therefore, the Bureau of Justice Assistance should take the follow<strong>in</strong>g steps to reform the<br />

exist<strong>in</strong>g JAG process:<br />

• Cease <strong>in</strong>clud<strong>in</strong>g marijuana possessi<strong>on</strong> arrests as a performance measure for<br />

purposes of federal fund<strong>in</strong>g<br />

• Ensure that federal funds are not provided or used by state and local law<br />

enforcement agencies to make arrests for marijuana possessi<strong>on</strong><br />

• Require law enforcement agencies receiv<strong>in</strong>g federal fund<strong>in</strong>g to enforce a ban<br />

<strong>on</strong> racial profil<strong>in</strong>g and document their pedestrian and traffic stops, arrests, and<br />

searches by race, ethnicity, and gender (designat<strong>in</strong>g m<strong>on</strong>ey for data collecti<strong>on</strong> if<br />

needed)<br />

• Reform performance measures to <strong>in</strong>clude factors such as the numbers of citizen<br />

compla<strong>in</strong>ts, surveys measur<strong>in</strong>g community satisfacti<strong>on</strong> with the police, <strong>in</strong>clud<strong>in</strong>g<br />

community views <strong>on</strong> the legitimacy and fairness of police acti<strong>on</strong>s and decisi<strong>on</strong>s, and<br />

the rates of violent crime<br />
