marijuana possessi<strong>on</strong> c<strong>on</strong>victi<strong>on</strong>. 63 In resp<strong>on</strong>se to these data limitati<strong>on</strong>s, two simplify<strong>in</strong>g<br />

assumpti<strong>on</strong>s are made, both of which are <strong>in</strong>formed by data that are available for specific<br />

local jurisdicti<strong>on</strong>s: (1) the average c<strong>on</strong>victi<strong>on</strong> rate <strong>in</strong> cases where a dispositi<strong>on</strong> is sought<br />

<strong>on</strong> an arrest for marijuana possessi<strong>on</strong> is 0.3 or 30%; 64 and (2) the average time spent<br />

<strong>in</strong> local jail or county correcti<strong>on</strong>al facilities <strong>on</strong> a marijuana possessi<strong>on</strong> c<strong>on</strong>victi<strong>on</strong> is 5.5<br />

days, with an additi<strong>on</strong>al 74.5 days spent <strong>on</strong> local or community supervisi<strong>on</strong>. 65<br />

Based <strong>on</strong> a review of other studies exam<strong>in</strong><strong>in</strong>g the fiscal impact of mass <strong>in</strong>carcerati<strong>on</strong>,<br />

this report estimates the average per diem cost of local or community supervisi<strong>on</strong><br />

as $2/day for all 50 states, as well as the District of Columbia. 66 In additi<strong>on</strong>, the<br />

report calculates the average per diem jail cost <strong>on</strong> a state-by-state basis us<strong>in</strong>g<br />

publicly available data <strong>on</strong> the total jail populati<strong>on</strong>, coupled with the correcti<strong>on</strong>s<br />

expenditure data for jail and county correcti<strong>on</strong>al facilities used to calculate the High<br />

Estimate. 67 Specifically, the report estimates the nati<strong>on</strong>al average per diem jail cost as<br />

approximately $95/day.<br />

Us<strong>in</strong>g these estimates, the average correcti<strong>on</strong>s cost of a marijuana possessi<strong>on</strong><br />

c<strong>on</strong>victi<strong>on</strong> <strong>in</strong> the United States is calculated as $672 (= $95*5.5 + $2*74.5), where the<br />

first term corresp<strong>on</strong>ds to estimated average jail costs and the sec<strong>on</strong>d term corresp<strong>on</strong>ds<br />

to estimated average local or community supervisi<strong>on</strong> costs. The estimated annual<br />

correcti<strong>on</strong>s cost of marijuana possessi<strong>on</strong> enforcement <strong>in</strong> the United States is readily<br />

obta<strong>in</strong>ed by multiply<strong>in</strong>g the average correcti<strong>on</strong>s cost, $672, by the estimated total<br />

number of c<strong>on</strong>victi<strong>on</strong>s for marijuana possessi<strong>on</strong> offenses, recall<strong>in</strong>g that 27% (= 0.9*0.3)<br />

of all arrests for marijuana possessi<strong>on</strong> offenses are assumed to result <strong>in</strong> a c<strong>on</strong>victi<strong>on</strong>.<br />
