Art. 56 [When a person has confessed an <strong>of</strong>fence, [a Prosecutor] 1) may suspend, for a<br />
specified period, the issue <strong>of</strong> an indictment on account <strong>of</strong> that <strong>of</strong>fence, as follows:-<br />
1. On account <strong>of</strong> <strong>of</strong>fences committed by young persons <strong>of</strong> the age <strong>of</strong> 15 - 21 years.<br />
2. When the situation <strong>of</strong> the <strong>of</strong>fender is such that supervision or other measures under<br />
para. 3, Art. 57, may be considered more likely to have more durable result than a<br />
penalty, provided the <strong>of</strong>fence is not such as to necessitate prosecution with a view to<br />
public interest.<br />
The period <strong>of</strong> conditional suspension may not be shorter than 1 year and no longer than 5<br />
years. <strong>General</strong>ly this period shall be laid down as 2 - 3 years. [The Prosecutor] 1) shall, in<br />
each case, specify the point in time at which the period <strong>of</strong> suspension commences.<br />
When indictment is suspended, the conditions provided for in para. 3, Art. 57, may be<br />
laid down as deemed suitable. The conditions may be altered during the period <strong>of</strong><br />
suspension, including by an extension <strong>of</strong> the period, however no longer than a total <strong>of</strong> 5<br />
years.<br />
[The Case <strong>of</strong> a person may be resumed if police investigation commences against him/her<br />
as a suspect prior to the end <strong>of</strong> the period <strong>of</strong> suspension on account <strong>of</strong> a new <strong>of</strong>fence<br />
committed during the period <strong>of</strong> suspension or before a Case was suspended and also if<br />
he/she fails to a significant effect to heed the conditions laid down.] 2)<br />
When [an investigator] 3) considers that indictment may be suspended under this Article<br />
he/she shall refer the matter to [the Prosecutor] 1) with his/her proposals.<br />
In case the issue <strong>of</strong> indictment is suspended in accordance with the provisions <strong>of</strong> this<br />
Article [the Prosecutor] 1) shall meticulously explain the conditions to the <strong>of</strong>fender and<br />
clarify for him/her the consequences <strong>of</strong> a failure to heed these.] 4)<br />

Art. 57 [A Judgment may decide that a decision on the following may be suspended:-<br />
a. Determination <strong>of</strong> penalty.<br />
b. Enforcement <strong>of</strong> penalty.<br />
The conditional period may not be shorter than 1 year and no longer than 5 years. The<br />
period generally determined shall be 2 - 3 years. The time at which the period<br />
commences shall be laid down by Judgment on each occasion.<br />
Suspension shall be made subject to the condition that the party does not commit a new<br />
<strong>of</strong>fence during the period <strong>of</strong> the suspension, cf. Art. 60. Suspension may also be made<br />
subject to the following conditions:-
