Art. 256 In case some <strong>of</strong>fence which is subject to Art. 244 – 250, Art. 253 or Art. 254,<br />

but is merely a trifling matter, has been committed, the penalty may be reduced to ? 1)<br />

fines or even entirely cancelled if the guilty party has not previously been convicted in<br />

respect <strong>of</strong> an enrichment <strong>of</strong>fence.<br />

In case a close relative has suffered through an <strong>of</strong>fence referred to in Art. 244 – 250 and<br />

Art. 254, proceedings may be dropped if the relative so requests.<br />

Chapter XXVII. Miscellaneous Offences pertaining to Financial Rights<br />

Art. 257 Anyone destroying or damaging the property <strong>of</strong> another or depriving him/her<br />

there<strong>of</strong> shall be subject to fines ? 1) or imprisonment for up to 2 years. [The same penalty<br />

applies to altering, adding to, erasing or destroying in another manner without authority<br />

data or programs stored in a computerized form and intended for computer processing.] 2)<br />

In case extensive damage to property has been wrought or an <strong>of</strong>fence be in other respects<br />

especially extensive or if the guilty party has previously been convicted in respect <strong>of</strong> a<br />

violation <strong>of</strong> the provisions <strong>of</strong> the present Article or Art. 164, 165, the former para. <strong>of</strong> Art.<br />

168, the former para. <strong>of</strong> Art. 176 or 177, imprisonment for up to 6 years may be applied.<br />

[The same applies in case damage to property be aimed at an aircraft.] 3)<br />

In case an act which is described in para. 2 above has been committed through<br />

inadvertence this will be subject to fines ? 1) or imprisonment for up to 6 months.<br />

Lawsuits arising out <strong>of</strong> <strong>of</strong>fences referred to in para. 1 and 3 shall be brought only<br />

provided this be required by the injured party.<br />

Art. 258 In case a person prevent by means <strong>of</strong> damage to his/her property or concealing<br />

there<strong>of</strong> the possibility <strong>of</strong> one or more <strong>of</strong> his/her creditors being able to obtain payment<br />

therefrom, this will be subject to fines ? 1) or imprisonment for up to 1 year.<br />

Proceedings on account <strong>of</strong> <strong>of</strong>fences in accordance with the present Article will be subject<br />

to the same rules as referred to in the concluding para. <strong>of</strong> Art. 250.<br />
