Street Acceptance: Newfield Drive<br />

(Board <strong>of</strong> Selectmen)<br />

To see if the <strong>Town</strong> will vote to accept Newfield Drive as a public way, and any appurtenant<br />

easements thereto, as laid out by the Board <strong>of</strong> Selectmen and as shown on a plan or plans, a copy<br />

<strong>of</strong> which is on file in the <strong>of</strong>fice <strong>of</strong> the <strong>Town</strong> Clerk; to see if the <strong>Town</strong> will vote to authorize the<br />

Board <strong>of</strong> Selectmen to acquire by gift, purchase, eminent domain or otherwise, easements in any<br />

land necessary for laying out and acceptance <strong>of</strong> Newfield Drive, and any appurtenant drainage,<br />

utility or other easements related to said Newfield Drive, and/or to accept grants there<strong>of</strong>; and,<br />

further, to authorize the Board <strong>of</strong> Selectmen and other applicable <strong>Town</strong> <strong>of</strong> <strong>Natick</strong> boards and<br />

personnel to take all related actions necessary or appropriate to accomplish the purposes <strong>of</strong> this<br />

article, or otherwise act thereon.<br />

RECOMMENDATION: By a vote <strong>of</strong> 12-0-0 on September 10, 2009, The Finance<br />

Committee recommends FAVORABLE ACTION with regard to the subject matter <strong>of</strong><br />

Article 20.<br />

Several years ago, representatives <strong>of</strong> the four properties that own Newfield Drive met and<br />

agreed that since the road is open to, and used by, the public it would be in the best interest <strong>of</strong><br />

all that the <strong>Town</strong> <strong>of</strong> <strong>Natick</strong> accept Newfield Drive as a town road. After discussions with <strong>Town</strong><br />

representatives, it was determined that the <strong>Town</strong> would consider acceptance <strong>of</strong> Newfield Drive<br />

only if the road was brought up to <strong>Town</strong> <strong>of</strong> <strong>Natick</strong> road standards at no cost to the <strong>Town</strong>. The<br />

Newfield Drive road, sidewalk and utility upgrades were completed in November, 2008 at a cost<br />

in excess <strong>of</strong> $1 million, an amount borne entirely by the four residential communities. The<br />

completed road has been inspected and approved by town <strong>of</strong>ficials.<br />

PLEASE NOTE THAT THE DISCUSSION POINTS FOR BOTH <strong>ARTICLE</strong>S 19 & 20<br />

WERE DISCUSSED AT THE SAME TIME AND ARE LOCATED AT <strong>ARTICLE</strong> 19.<br />

The Board <strong>of</strong> Selectmen voted 4-0 to recommend favorable action on the subject matter <strong>of</strong><br />

Article 20.<br />

The Planning Board voted 6-0 to recommend favorable action on the subject matter <strong>of</strong> Article 20.<br />

MOTION: (Requires majority vote)<br />

Move that the <strong>Town</strong> vote to accept the following street and any appurtenant easements as<br />

laid out and filed with the <strong>Town</strong> Clerk, and as shown on the street acceptance plans on file<br />

with the <strong>Town</strong> Clerk: Newfield Drive<br />

and to authorize the Board <strong>of</strong> Selectmen to acquire by gift, purchase, eminent domain or<br />

otherwise, easements in any land necessary for laying out and acceptance <strong>of</strong> Newfield<br />

Drive, and any appurtenant drainage, utility or other easements related to said Newfield<br />

Drive, and/or to accept grants there<strong>of</strong>; and to authorize the Board <strong>of</strong> Selectmen and other<br />

applicable <strong>Town</strong> <strong>of</strong> <strong>Natick</strong> boards and personnel to take all related actions necessary or<br />

appropriate to accomplish the purposes <strong>of</strong> this article<br />
