3. Within a reasonable time before making an eligible rollover distribution from the Fund, the<br />
<strong>Conference</strong> Treasurer shall provide or cause to be provided the written explanation to the<br />
distributee required by Code section 402(f).<br />
XIII.Disability Leave - A minister who is approved for and placed on Disability Leave granted by the<br />
<strong>Conference</strong> may elect to:<br />
A. Continue as an active member and pay one percent (1%) <strong>of</strong> the disability pay received from<br />
all sources. Should Disability Leave be granted between sessions <strong>of</strong> Annual <strong>Conference</strong>, 1%<br />
<strong>of</strong> the disability pay received from all sources computed to a 12 month amount shall be paid.<br />
B. Be treated the same as a transferring member.<br />
C. Receive benefits the same as a retiring member.<br />
D. Terminate from the Fund and receive all benefits within thirty (30) days following the granting<br />
<strong>of</strong> Disability Leave.<br />
<strong>The</strong> minister shall notify the <strong>Conference</strong> Treasurer in writing <strong>of</strong> his or her choice <strong>of</strong> option within<br />
ten (10) days following the granting <strong>of</strong> Disability Leave. In no case would the member receive less than<br />
the member’s assessments plus interest, determined as described in Article IX.<br />
XIV.Leave <strong>of</strong> Absence - A minister who is approved for and placed on Leave <strong>of</strong> Absence by the<br />
<strong>Conference</strong> may elect to:<br />
A. Continue as an active member by paying 1% <strong>of</strong> the <strong>Conference</strong> Average Salary and Utilities<br />
while on leave.<br />
B. Be treated the same as a transferring member under Article XVI.<br />
XV. Less Than Full Time Service - A <strong>Conference</strong> member who is approved for less than full time<br />
service by the <strong>Conference</strong> may elect to:<br />
A. Continue as an active member for no more than three years by paying 1% <strong>of</strong> the <strong>Conference</strong><br />
Average Salary and Utilities (within the meaning <strong>of</strong> Article XIV) while serving less than full<br />
time.<br />
B. Withdraw from the Fund according to the provisions <strong>of</strong> Article XVII.<br />
XVI.Membership Transferring - Any ministerial member who leaves the <strong>North</strong> <strong>Carolina</strong> <strong>Conference</strong><br />
by transfer to another annual conference <strong>of</strong> <strong>The</strong> United Methodist Church cannot make any<br />
further payment to the Fund. He or she may leave his or her account (including dividends, if any)<br />
in the Fund until retirement. If this is done, the benefit under this Fund will be computed as <strong>of</strong> the<br />
date <strong>of</strong> transfer from the <strong>North</strong> <strong>Carolina</strong> <strong>Conference</strong> with interest determined in the manner<br />
described in Article IX, determined from the date <strong>of</strong> transfer to the date <strong>of</strong> retirement. If the<br />
account is left, and the minister returns to the <strong>North</strong> <strong>Carolina</strong> <strong>Conference</strong>, he or she may reinstate<br />
his or her payments and dividend earnings, effective at the time <strong>of</strong> transfer back into this<br />
<strong>Conference</strong>.<br />
XVII.Withdrawing From <strong>The</strong> Fund Prior to Retirement - If a member desires to withdraw from the<br />
Fund prior to retirement, upon a written request to the <strong>Conference</strong> Treasurer, he or she shall<br />
receive the amount he or she has paid into the Fund, plus interest determined in the manner<br />
described in Article IX each year he or she was participating in the Fund. Amounts in the<br />
members account in excess <strong>of</strong> the amount determined under the preceding sentence shall be<br />
forfeited and reallocated as dividends for the year <strong>of</strong> forfeiture pursuant to Article VII.<br />
Each member whose membership is terminated in the Fund in any way will provide the<br />
<strong>Conference</strong> Treasurer with a statement indicating that he or she has received the funds for which<br />
he or she is eligible, and that he or she is no longer a member <strong>of</strong> the Fund. Any minister leaving<br />
the <strong>North</strong> <strong>Carolina</strong> <strong>Conference</strong> to join another denomination other than <strong>The</strong> United Methodist<br />
Church will be required to withdraw from the Fund and payment will be made to the minister<br />
according to the formula set forth in the first paragraph <strong>of</strong> this Article XVII.<br />
XVIII.Reinstatement - A member who has withdrawn from the Fund may not be reinstated, but is<br />
required to begin anew as though he or she were a new member. A minister shall not be<br />
permitted to rejoin the Fund more than two (2) times during his or her ministerial career.<br />
XIX.Hearing Committee<br />
A. <strong>The</strong> Committee - A Hearing Committee consisting <strong>of</strong> the Board <strong>of</strong> Pensions Executive<br />
Committee, <strong>Conference</strong> Treasurer, Director <strong>of</strong> Ministerial Relations, <strong>Conference</strong> Controller,<br />
and the <strong>Conference</strong> Insurance Group Administrator shall have authority to act on behalf <strong>of</strong><br />
the Board <strong>of</strong> Pensions between Annual <strong>Conference</strong> sessions concerning matters that relate<br />
to, but are not specifically covered by, this constitution <strong>of</strong> the Ministers’ Transition Fund. <strong>The</strong><br />
Plan Administrator for the Fund for other plan administrative matters and matters delegated<br />
by the Hearing Committee shall be the <strong>Conference</strong> Insurance Group Administrator.<br />
