2009, the <strong>Postal</strong> Service gave notice of changes in rates of<br />
general applicability and of classificati<strong>on</strong> changes for <strong>com</strong>petitive<br />
products including Express Mail, Priority Mail, Parcel Select, Priority<br />
Mail Internati<strong>on</strong>al, GXG, and Express Mail Internati<strong>on</strong>al. Effective<br />
January 4, <str<strong>on</strong>g>2010</str<strong>on</strong>g>.<br />
CP<str<strong>on</strong>g>2010</str<strong>on</strong>g>-11, Establishment of Prices and Classificati<strong>on</strong>s for Inbound<br />
Air Parcel Post at UPU Rates. The Governors established inward<br />
land rates for <strong>com</strong>petitive inbound air parcels tendered by foreign<br />
posts based <strong>on</strong> the out<strong>com</strong>e of the Universal <strong>Postal</strong> Uni<strong>on</strong> (UPU)<br />
rate-setting process. This decisi<strong>on</strong>, filed for PRC review, authorizes<br />
management to annually file with the PRC inward land rates resulting<br />
from UPU Rates formulas.<br />
CP<str<strong>on</strong>g>2010</str<strong>on</strong>g>-72, Competitive Product Prices Global Expedited Package<br />
Service C<strong>on</strong>tracts N<strong>on</strong>-Published Rates. This would establish<br />
minimum and maximum prices for Global Expedited Package<br />
Service agreements, and avert the need for separate filings of<br />
each NSA since the minimum and maximum prices by cell would<br />
be predetermined. At the end of FY <str<strong>on</strong>g>2010</str<strong>on</strong>g>, this is pending before<br />
the PRC.<br />
MARKET TESTS<br />
MT<str<strong>on</strong>g>2010</str<strong>on</strong>g>-1, Experimental Product Samples Showcase. C<strong>on</strong>sumer<br />
packaged goods <strong>com</strong>panies (CPGs) often give c<strong>on</strong>sumers trial-size<br />
samples of their products as a way to build brand awareness. While<br />
sample distributi<strong>on</strong> is a large and growing industry, the <strong>Postal</strong><br />
Service’s “shape and weight” pricing structure makes the mailing of<br />
samples expensive. Accordingly, CPGs tend to use less expensive<br />
sample distributi<strong>on</strong> methods, such as grocery store distributi<strong>on</strong> and<br />
bundling with newspapers. To gain informati<strong>on</strong> <strong>on</strong> operati<strong>on</strong>s, costs<br />
and potential market, the <strong>Postal</strong> Service c<strong>on</strong>ducted a market test<br />
in May <str<strong>on</strong>g>2010</str<strong>on</strong>g> of a parcel box c<strong>on</strong>taining an assortment of product<br />
samples from multiple CPGs mailed to the <strong>com</strong>panies’ target<br />
c<strong>on</strong>sumers; the CPGs shared the cost of postage rather than paying<br />
it individually.<br />
MAIL CLASSIFICATION<br />
MC2009-19, Modificati<strong>on</strong> of Mail Classificati<strong>on</strong> Schedule Product<br />
Lists in Resp<strong>on</strong>se to Order No. 154. During <str<strong>on</strong>g>2010</str<strong>on</strong>g> the PRC added<br />
classificati<strong>on</strong> language to the Mail Classificati<strong>on</strong> Schedule (MCS) for<br />
Address Enhancement Services, Address Management Services, and<br />
Stamp Fulfillment Services.<br />
MC<str<strong>on</strong>g>2010</str<strong>on</strong>g>-20, Transferring Selected Post Office Box Service<br />
Locati<strong>on</strong>s to the Competitive Product List. Transferred to the<br />
<strong>com</strong>petitive product list. Post Office Box service for 49 Post Office<br />
locati<strong>on</strong>s within <strong>on</strong>e-half mile of a private <strong>com</strong>petitor. Effective<br />
June 17, <str<strong>on</strong>g>2010</str<strong>on</strong>g>.<br />
MC<str<strong>on</strong>g>2010</str<strong>on</strong>g>-22, Modificati<strong>on</strong> of Mail Classificati<strong>on</strong> Schedule Regarding<br />
Forever Stamps. Modified the MCS to allow more than <strong>on</strong>e design for<br />
Forever stamps. Effective May 6, <str<strong>on</strong>g>2010</str<strong>on</strong>g>.<br />
MC<str<strong>on</strong>g>2010</str<strong>on</strong>g>-33, Minor Classificati<strong>on</strong> Changes Related to Canada<br />
Post–United States <strong>Postal</strong> Service C<strong>on</strong>tractual Bilateral Agreement<br />
for Inbound Competitive Services. The <strong>Postal</strong> Service filed notice of<br />
a minor classificati<strong>on</strong> change c<strong>on</strong>cerning the Bilateral Agreement,<br />
proposing that inbound surface parcels tendered by Canada Post<br />
would be handled as Priority Mail and subject to the rates for<br />
Xpresspost merchandise established in this Agreement. Effective<br />
August 23, <str<strong>on</strong>g>2010</str<strong>on</strong>g>.<br />
RULEMAKINGS<br />
RM2009-3, C<strong>on</strong>siderati<strong>on</strong> of Workshare Discount Rate Design.<br />
This rulemaking c<strong>on</strong>cerned a provisi<strong>on</strong> of the law — 39 U.S.C. §<br />
3622(e) — that limits workshare discounts to the costs avoided<br />
by worksharing. The PRC’s final rule, issued in September <str<strong>on</strong>g>2010</str<strong>on</strong>g>,<br />
c<strong>on</strong>cluded, am<strong>on</strong>g other things, that this pricing c<strong>on</strong>straint <strong>on</strong><br />
workshare discounts: may apply within or across products,<br />
implements a substantial porti<strong>on</strong> of the policies that underlie the<br />
Efficient Comp<strong>on</strong>ent Pricing rule, and requires the identificati<strong>on</strong>,<br />
within a market of mail that is distinguished from other mail<br />
predominantly by avoided costs due to worksharing activity. The PRC<br />
also c<strong>on</strong>cluded that the selecti<strong>on</strong> of an appropriate base or reference<br />
group from which to calculate the costs avoided by worksharing<br />
depends <strong>on</strong> which of the base group’s <strong>com</strong>p<strong>on</strong>ents are likely to shift<br />
to the workshared group in resp<strong>on</strong>se to changes in their relative<br />
prices. The PRC further c<strong>on</strong>cluded that there is a worksharing<br />
relati<strong>on</strong>ship between presort First-Class Mail and Single-Piece First-<br />
Class Mail that is metered or bears Informati<strong>on</strong>-Based Indicia, and<br />
that the worksharing provisi<strong>on</strong> does not apply to Standard Saturati<strong>on</strong><br />
Mail because it serves a unique market.<br />
