AN ORDINANCE REPEALING- ORDINANCE 

NO. 3048 N.S. OF TEE CITY COUNCIL. 

BE IT ORDAINED by the Board of Port Commissioners 

of the City,of Oakland as follows: 

Whereas the City Council of the City of Oakland, on 

October 7th, 1924 purported to adopt Ordinance No. 3048 N.S. 

for the alleged purpose of modifying and amending that certain 

lease dated .Tune 15th, 1918, awarded under competitive 

bidding to the Parr McCormick Steamship Line, a corporation, 

and confirmed in a judgment of the Superior Court dated 

March 11th, 1919 in an action between the Parr Terminal 

Company, a corporation,and the City of Oakland, and said 

Council was wholly without power to so modify or amend 

the terms of such lease, and said ordinance is null and void 

and should be stricken from the records of the City, now 

therefore, 

SECTION 1. Ordinance No. 3048 N.S. of the City 

Council is hereby repealed, and said section and all proceeding 

had thereunder is hereby declared Cancelled and stricken 

from the records of the City of Oakland. 

SECTION 2. This ordinance shall take effect immediately.

That he is and was during all the time herein mentioned, a white male citizen 

of the United States, over the age of twenty-one years, not a party to or 

interested in the matter or action herein set forth. 

That he is now and at all times hereinafter mentioned, was the principal 

clerk of THE TRIBUNE PUBLISHING CO., a corporation, the publisher 

and printer of the OAKLAND TRIBUNE, which was during all the time hereinafter 

mentioned, and now is a newspaper of general circulation, as that term 

is defined by Section 4460 of the Political Code, and as provided by said Section, 

is printed and published in the City of Oakland, County of Alameda, State 

of California, for the dissemination of local and telegraphic news and intelligence 

of a general character, having a bona fide subscription list of paying subscribers, 

and is not devoted to the interests or published for the entertainment or 

instruction of a particular class, profession, trade, calling, race or denomination 

or for any number of such classes, professions, trades, callings, races or denominations, 

and as such clerk has now and at all of said times had charge of all 

advertisements in said newspaper. 

That said newspaper has been established, printed and published at regular 

intervals, in the said City of Oakland, County of Alameda, State of California, for 

more than two years preceding the date of the first publication of the notice herein 

mentioned; that said notice was set in type not smaller than nonpareil, and was 

preceded with words printed in black face type not smaller than nonpareil, describing 

and expressing in general terms, the purport and character of the notice 

intended to be given.

The Board of Supervisors of the 

County of Alameda, State of California, 

do ordain as follows: 

SECTION 1. In this ordinance. 

the term , public air navigation facility 

means any municipal, county or 

other airport or landing field for 

aircraft regularly used as a terminaliii? 

Connection witlt , the operation-of' 

aircraft as common carriers for 

transporting passengers, merchandise 

and/or the United States mail 

by air on established schedules between 

cities or other localities. 

SECTION 2. The public safety re- 

. quiring and the welfare of the 

county and its inhabitants making it. 

desirable to insure the protection and 

development of established lines. of 

commerce and navigation by air, it 

is hereby declared to be unlawful 

fat any person, firm or corporation' 

to erect or maintain any smoke 

stack, flag pole, elevated tank, radio' 

station, tower, building, or other 

structure, or obstruction to the operation 

of aircrafts, of a height in 

excess of fifty (50) feet upon unincorporated 

territory within the 

County of Alameda within one thousand 

(1000) feet of any boundary of 

a public air navigation facility lo 

cated upon- either incorporated or 

unincorporated territory within the 

County of Alameda. 

SECTION 3. Any Violation of this 

ordinance shall be deemed a misde- 

3neanor, ;and shall be •punishable by 

a fine not exceeding five hundred 

dollars ($500.00) or imprisonment in "9t 

the County Jail for not. more than 

six (6) months, or both Stich fine 

and imprisonment. Each day's continuation 

of a violation._ of any of 

the provisions of this ordinance 

shall be deemed a separate and distinct 

offense. 

'SECTION 4. This ordinance shell 

take effect and be in force thirty 

(30) days after its passage and before 

the expiration of fifteen (15) 

clays after its passage shall be published 

with the names of the memhers 

voting for and against the same 

for one- week in Alameda Times- 

Star, a newspaper published in the 

County of Alameda.

SECTION 1. Section 10a is hereby added to Port 

Ordinance No. 20 to read as follows: 

Section 10a. It shall be unlawful for any 

person to operate any motor vehicle in excess 

of the speed of fifteen (15) miles per hour 

upon any portion of the Oakland Municipal 

Airport lying between the southwesterly line 

of the railroad right of way claimed by the 

Southern Pacific Company and the southwesterly 

line of the improved roadway leading to and extending 

alongside of the Administration Building 

and hangars of the said airport and also 

lying between the westerly line of County Road 

No. 1434 and a line drawn at right angles to 

and one hundred feet northwesterly from the 

most westerly hangar located on said airnort, 

said area having been set aside (but not dedicated) 

for the traffic and parking of motor vehicles.

by the second party, excIusiely under its direct management, 

under the -name of "Oakland .hirert Restaursnt" and shall be kept

products, peanuts, chewing gum and popcorn, nuts, fruits, soda 

fountain products and articles of p repared food or drink.

7) Notwithstanding that the second p arty is permitted by 

thia agreement to sell certain articles of merchandise as specified 

herein, the second party neheby agrees to immediately withdraw 

from sale on said aircort and not to sell thereon say article 

or articles of merchandise which may, at any time in the 

discretion of said. hoard, prove Objectionable to the first barty, 

on receipt of a written communication or communications from 

its oroper officer specifying any such objectionable article 

articles. 

(3) 

Except as herein provided, the second party shall not

engage in any business or sell or dispose of any article on 

said airport whatsoever which Js not herein mentioned, unless 

it shall first receive the written permission of the first party. 

(d) The second party shall at no time permit any dancing 

to be carried on in said restaurant building, carry on any 

amusement feature, or games of chance, or permit any auction 

sale to he had therein. said premises shall not be used 

for lodpin g or sleeping purposes, excepting that the second par 

ty may, at its own expense, es hereinbelow provided, equip and 

furnish the two rooms of the said restaurant buildih g , shown 

coon the general floor plan thereof attached to the bid as livin 

quarters for the use of its employees. (10)The first Party 

will furnish and install in said restaurant buildin;,? (Sdut not 

in said booth) the

(111 In addition, the first party shall, for the convenience 

and necessity of one second oarty in supplyin the requirements 

of the public at the said air terminal in connection with this 

concession, and in accordance with the plans the first party has 

heretofore sdopted, at once erect a booth, said booth to be located 

between Han gars ITos.2 and, 3 of said air port or be moved to 

such other main point of aeroplane operations as may from time 

to time be designated by the first party. The second party 

shall use said booth for the dispensing of such articles as it 

shall be engar. ped in selling under this concession. All equipment 

and furnishings required for such concession booth shall 

be furnished and installed, in the said booth by the second, party. 

The said booth shall become a part of the premises herein placed 

under this concession and all the terms, conditions and covenants 

of this agreement, except as otherwise mentioned, shall apply 

thereto as fully as if such booth were a part of and included in 

the said restaurant building itself. 

(121 The second pa:atf shall furnish at its own expense all, 

necessary furnishin g s and equi pment required for the operation 

of the said restaus-ant concession which shall not be provided by 

the first party, the equipment to be so furnished by the second 

party to include at least:

(a) ,All furniture and fnrhishinas for the living 

quarters, if any, in restaurant building. 

(b) All aookin utensils, chinaware, glassware, 

dishes, tableware, including silverware and 

table linen. 

(a) Cash resters. 

(d) All cleaning equipment, includina vacuum sweeper.

(f) Ill equipment for concession booth as described

the condition thereof; that no representations as in the condi 

tion or repair thereof have been made by the first party or any

second bartyt;or any other person, for any injury or damage that 

may result from any latent or eatent defect an the construction 

or condition. of said premises, nor for any damage that may result

any damage done or occasioned by or from plumbing, gas, water, 

steam and other pipes or apparatus being out of repair, nor for 

any damage arising from acts oromissions of oaners or occupants 

of adjoining p roperties or of those using the . said airport.

vided) whatsoever upon said demised premises. Second party 

expressly waives the benefit of the provisions of Section 1942 

of the Civil Code of the. State Of California and aarees to keep 

said restaurant building, booth and equi pment in good repair

or the board of Port Commissioners and the laws of the State of 

California in the use of said premises, or the conduct of said

Provided, however, the first party will keep in repair the roof,

restaurant building and booth.

(15) The second party agrees to indemnify and hold the first 

party, its Board of Port Commissioners, officers and em ployees and said 

premises free and harmless from any and all damage, liability or claim of 

any kind howsoever resulting by reason of any injury to any person or persons 

or property while in, upon, or in any way connected with said restaurant 

building or booth during the occupancy thereof by the second party, 

or resulting from the business or other operations carried on therein 

by the second party or arising in connection therewith, or occurring 

from the misuse or neglect of said restaurant building or booth by the se3ond 

party, its employees, patrons, or any person who may be in or upon 

said premises with the expressbr implied consent of the second party, or 

from any failure of the second party Or its employees to abide by or conform 

to the rules and regulations pertaining to said airport, or from any 

mechanic's or other liens which may be . secured or filed against the restaurant 

property herein specified for alterations, changes, or additions 

of any character which shall be made by second party on or to said premises, 

during the term of this agreement or any extension or continuation 

thereof, and not to do or permit to be done on said premises anything 

that will increase or suspend the fire insurance rates now in effect thereon, 

and said second party shall not permit said premises to remain vacant 

or unoccupied for more than ten consecutive days; provided, however, that 

the second party shall not be responsible for any damage caused to said 

restaurant building or booth from the exterior thereof by any person not at 

the time an employee or patron of the Second party. Said second party 

shall not allow any signs or placards to be placed on said premises or attaChed 

-thereto or displayed thereon without the written consent of the 

first party thereto first having been obtained, provided the first party 

agrees to not unreasonably withhold its consent to the second party using 

signs to represent its business. 

(16) The first party reserves the right to enter upon said premises 

at any time to inspect them, or the equipment thereof, or for any 

other purpose, and to make any repairs that it may consider necessary to 

the preservation/of said premises or the buildings of which said premises 

may be a part, and should any such repairs be such as the second party 

should have made hereunder, the second . party shall immediately reimburse 

the first party for the cost of such repairs, but the making ofiany such 

repairs by the first party shall in no event be construed as a waiver of 

the first party's right to require the second party to keep said premises 

in repair as hereinbefore provided. 

(17) No alterations, changes or additions of any character shall 

be made on said premises by said second party without written consent of 

the first party thereto first having been secured, and, if made, shall be 

at the sole cost and expense of the second party, who agrees to hold the 

first party harmless therefor. Alterations or additions so made to 

said premises, including all partitions and awnings shall be made only 

with the approval of the first party, and shall remain on said premises 

and become the property of the first party upon the termination of this 

agreement. 

(18) Should said restaurant premises or booth be wholly or 

partially destroyed by fire or other unusual action of the elements, 

the first party may, at its option and without demand or notice 

of any kind whatsoever, reenter and take possession of said premises 

and remove all persons therefrom; and said first party may thereupon, 

at its option, terminate this agreement upon written notice 

to the second party to that effect andupon returning to the second 

party all unearned rent or concession charge theretofore paid in 

advance, calculated at a daily rate based on the said monthly payment; 

or said first party may repair or reconstruct said premises, redeliver 

possession thereof to the second party, and continue this 

agreement in effect, in which event such repairs or reconstruction 

shall be done with reasonable diligence, and during such time 

as the second party is deprived of the use of any part of such 

premises by reason of such injury and the repair thereof the guaranteed 

minimIlm mentioned in paragraph 3 shall be waived and the 

second party shall only pay the percentage of the gross receipts

as in said paragraph provided, and otherwise the first party 

shall not be liable to the second party for any dama g es that 

may be suffered by Said second party by. reason of any such injury 

or repair thereof. 

(10 - The second. party agrees not to sublet the whole or 

any part of said premises and not to assign or hypothecate this 

concession a greement or any interest herein sr out the written 

consent of the first party thereto first having been obtained. 

In the event of any breach of any one or more of the foregoing 

covenants against subletting, assignment end hypothecation, or 

at any. time durin g the continuation of any such breach, the first 

party may, at its option and without demand or notice of any 

kind. Whatsoever, re-enter and take possession of said premises and 

remove all persons therefrom. Should any other person than tlaa,

any pert thereof under any writ of attachment or execution, or

under any one or more of the conditions described in this agreement, 

the first party may, at its option, either terminate this 

agreement and recover from the second party all damages caused.

(21) No re-entry of said premises by the first party, as 

hereinbefore provided, shall be construed as an election on its 

part to terminate this agreement unless written notice to that

effect is delivered to the second party or mailed to said second 

party at its last known address; and all remedies herein expressly

paid by the first party shall become due and payable by the second 

party to the first party at the next regular rent day as so 

much additional rent. 

(25) Should the second party hold. over and continue in possession 

of seid. restaurant dremises after the end of the period 

of this conceasion, with the expressed or imp lied consent of the

of said concession from month to month at the same charge 

or rental and upon the same terms and conditions as herein provided

of the space herein specified for the sale or selling of 

intoxicating liquors, drugs or drug sundries.

(33) Notwithstanding anythiny in this agreement to the contrary, 

the first party reserves .the ri. gzht, at its option, u pon giving six

to terminate this restaurant concession, and at the end of such

Wherever the approval of the first party is required 

herein, it shall be understood to mean such approval of the first 

party exp ressed by its Port Manager, or other managing officer-. 

(35) For the purposes of this agreement all mechanical appliances, 

furniture and equipment installed by the first barty in 

the said restaurant huiiLdina shall be deemed a p art of such pramses 

and be restored to the first p arty in good order and repair, 

reasonable wear excepted. 

t36) Each and all of the terms and conditions hereof shall inure 

to the benefit of the successors and assi gns of first party, 

and, each and all of the covenants and obligations herein undertaken 

by the second party, particularly including the covenants 

against subletting, assignment, hypothecation and transfer by 

operation of law, and signs and placards, shall also apply to and 

bind all parsons who may become assignees and sub-lessees of the 

second party, or who may come into possession of said premises in 

any manner with the written consent of the second party.

THE LANDS THEREIN TO THE COUNCIL OF THE

BE IT ORDAINED by the Board of Port Commissioners of 


SECTION 1. The Board or Port Commissioners hereby relinquishes 

to the Council of the City of Oakland the control 

and jurisdiction of that portion of the "Port Area" particular 

ly described as follows, to-wit: 

Beginning at a point in the southerly line of 8th 

Street distant thereon easterly 750 feet from the eastern 

line of Fallon Street, said point of beginning being also 

on the boundary line of the "Port Area" in the City of

to Port Ordinance No. 34, by deed of the real properties referred 

to in Section 3 of said Ordinance, subject to the taxes now existing 

on said property and also to a lien for mort , age indebtedness in 

favor of M. J. Fontana, which mortga ge indebtedness the grantors to 

said deed, expressly agreed to assume and pay in full, and those 

certain written agreements under dates of July 12, 1128 and August 

6th, 1125, entered into by the President of this Board with said 

grantors in connection with the acquisition of said properties,

the office of the County Clerk of said. County of Alameda. 

SECTION 5. Payment for said land, properties and 

rights and quit claim deed shall be made by a warrant drawn on 

said 1925 Oakland Harbor Tmprovement Fund in the amount of 

4i5,632.12, being the full purchase price. The Auditor of the City 

of Oakland be and he is hereby authorized, directed and empowered, 

upon the passage of the proper demand therefor by this Board, to 

draw a warrant on the Treasurer of the City of Oakland on the 

said fund in said amount in favor of the said grantors. Said

warrant shall be delivered to the Oakland Title Insurance and 

guaranty Company, as escrowee, for the said grantors, and shall 

be disposed of ror and on their behalf only as provided by agreement 

made and entered into between them and the City of Oakland. 

SECTION 6. The Board shall hereafter approve and allow, 

in addition to the foregoing, demands upon the said Fund 

for the payment of any other incidental expenses in connection 

with this transaction. 

SECTION 7. The President of the Board of Port Commissioners 

and the Port Attorney are hereby authorized, empowered 

and directed to take the necessary steps to carry out the provisions 

of this ordinance.

Local Flights 

Item 8. / A1i persons using the airport for carrying 

of passengers for hire or award where landings are not made 

at other air terminals or flying fields shall at all times, in 

consideration of the right to use the field, abide by_and 

charge at least the minimum rates customarily in force at the 

airport and hereby prescribed as standard by the Board of 

Port Commissioners, as follows: 

For single passenger, ten minute flights $3.00 

For carrying two or more passengers for 

ten minutes 2.50 each 

For flights emeeeding twenty minutes, 

per passenger 5.00

SECTION 2. Unless otherwise specified, all the rates prescribed 

in the foregoing schedule are per plane. Daily rates are 

per day or fraction thereof. Monthly rates are per month or fraction 

thereof, except that storage charges may be assessed for the 

last half of a month at one half of the monthly rates. 

SECTION 3. Storage, commercial and rental charges must be 

paid strictly in advance. Mechanician and other services must be 

paid for upon the completion of the work. All fees for planes in 

transit must be paid in cash. 

SECTION 4. Air transport companies who may operate passenger 

or other air lines on regular schedule between the City of 

Oakland and other cities shall be subject to the foregoing rates 

and charges, provided the Board of Port Commissioners may enter 

into special agreements with any such company for the use of the 

airport and its facilities. 

SECTION 5. Whenever in any specific instance, it may be 

deemed proper or expedient, the Board, or the Port Manager by a 

writing, may authorize a temporary deviation from the rates, charges 

or tolls herein provided for. 

SECTION 6. In addition to the right to bring an action in 

any court of competent jurisdiction, as provided by law, for the 

collection of any rates, tolls or charges provided for herein, the 

City of Oakland shall have and exercise a lien to enforce payment 

for all charges, fees and tolls for storage, rental, commercial 

privileges end other services rendered on, for or on account of 

any aircraft or other property landing upon or stationed at or 

upon the said airport. Such lien shall be of the character and enforced 

in the manner provided by the civil Code of California. No 

person shall remove any aircraft or other property held under any 

such lien unless written authority be given therefor to such

adopted February 14th, 1928, is hereby amended to read as 

follows:

AN ORDINANCE PROVIDING RATES FOR WHARF 

AND PIER STORAGEI TO SUPERSEDE THE 

RATES PREVIOUSLY ESTABLISHED. 



SECTION 1. When space is available and the prompt 

loading and discharging of vessels will in no manner be 

interfered with, cargo may, at the option of the Port Manager, 

be held upon a wharf or pier at the storage rate of two 

(2) cents per ton, weight or measurement, per day; Sundays 

and holidays excepted.' 

SECTION 2. The foregoing provisions and rate 

shall be in lieu of Item 180 of Section4 of Tariff No. 2 

(Ordinance 252$ N.S.) adopted on December 6th, 1922 by the 

City Council. 

SECTION 3., This ordinance shall take effect upon 

its passage.

KNOWN AS THE PORT REVOLVING FUND. 



SECTION 1. There is hereby established a contingent 

or revolving fund. in the amount of seventy five 

hundred (7,500) dollars. 

SECTION 2. Said fund shall be known as the "Port 

Revolving Fund" and shall include the Port Laborer's 

Fund heretofore established. The said fend may be hereafter 

increased or reduced in amount as the business of 

the port may require. 

SECTION 3. Said fund may be used for the prompt 

payment of transient lobsters and the advancement of sums 

of money for freight claaarges and other expenses necessary

fee, by grant, bargain and sale deed or deeds a good and marketable 

title, which title shall be insured by a standard 

policy of title insurance issued by a responsible title insurance 

company, and shall be free and clear of all liens 

and encumbrances and/or outstanding interests whatsoever, excepting 

the lien of taxes for the year 192829 (taxes, however, 

to be pro rated as of the date of the final adoption 

of this ordinance), in and to all that certain real property 

located in the City of Oakland, County of Alameda, State 

of California and more particularly described as follows: 

Beginning at the intersection 

of the center line of Ninth Avenue extended 

south forty seven degrees fifty 

five minutes west on its present course, 

with the 84th course of the exterior 

boundary line of the Rancho San Antonio 

as said Rancho was finally confirmed 

and patented to Antonio Maria Peralta, 

et al, by the United States, said patent 

being recorded in Book "A" of Patents, 

pages 648 to 672, Alameda County Records, 

and running thence along the said exterior 

boundary line of said patent, 

eastwardly and northwardly to the intersection 

of the 88th course of same 

with the said extension of the center 

line of Ninth Avenue; thence south forty 

seven degrees, fifty, five minutes west 

along the said, extension of the center 

line of Ninth Avenue to the point of beginning. 

Being all that portion of the 

Rancho San Antonio (Peralta Rancho) 

heretofore convey ed to E. C. Sessions by 

Maria Hall, et al, by deed dated Tnly 

14th, 1887 and recorded in Deed Book 444, 

at page 365 Alameda County Records, which 

lies southeasterly of the said extension 

of the center line of Ninth Avenue. 

Together with all and singular the tenements, hereditaments 

and appurtenances thereunto belonging or in anyWise 

appertaining, and the reversion and reversions, remainder 

and, remainders, rents, issues and profits thereof. And, also 

all the estate, right, title, interest, possession, claim 

and demand whatsoever, as well in law as in equity, of, in, 

or to the above described premises and every part or parcel 

thereof, with the appurtenances. 

Subject, however, to a right of way for street purposes 

thirty (30) feet in width along the northwesterly boundary.

SECTION 4. Among the rights of way, easements or other 

appurtenances to said real property described above in Section 

3, which the said Sessions Water Front Company shall convey or 

cause to be conveyed to the City of Oakland, and without excluding 

any other rights of way, easements or appurtenances to 

said prop erty which may exist and which shall be conveyed to 

the said city, are those certain rights of way, easements or 

appurtenances more particularly described as follows: 

Beginning at the intersection of 

the southwesterly line of the right of 

way claimed by the Central Pacific Railway 

Company, formerly the Western Pacific 

Railroad Company, with the northwesterly 

line of Ninth Avenue extended southwestwardly 

on its present course and running 

thence southwestwardly along the said 

northwesterly line of Ninth Avenue so extended 

to ship channel; thence southeastwardly 

along said ship channel to the 

point where the same would be intersected 

by the center line of said , Ninth Avenue 

extended southwestwardly on its present 

course; thence northeastwardly along the 

said center line of Ninth Avenue so extended 

to the said southwesterly line of 

the right of way claimed by the said Central 

Pacific Railway Company; thence northwestwardly 

along said line of said, right of 

way to the place of beginning. 

Also beginning at the intersection of 

the southwesterly line of the right of way 

claimed by the Central Pacific Railway 

Company, formerly the Western Pacific Railroad. 

Company, with the northwesterly line 

of said Ninth Avenue extended southwestwardly 

on its present course, and running 

thence northwestwardly along the said line 

of said right of way to its intersection 

with the southeasterly line of Fifth Avenue 

extended southwestwardly on its course as 

it existed in the year 1891; thence southwestwardly 

along said southeasterly line' 

of Fifth Avenue so extended to its intersection 

with a line drawn parallel with and 

one hundred feet (measured at right angles) 

from the said southwesterly line of the 

right of way claimed by the said Central 

Pacific Railway Company; thence southeastwardly 

along the said line that is parallel 

with and one hundred feet distant .from said 

southwesterly line of said right of way to 

its intersection with the said northwesterly 

line of Ninth Avenue, extended southwestwardly 

on its present course; thence northeastwardly 

along the said northwesterly line of Ninth 

Avenue so extended to the place of beginning.

Also all rights of way, easements 

and/ or appurtenances in and to the extension 

in a straight line southwestwardly of that 

portion of 5th Avenue lying between 7th and 

8th Streets of the City of Oakland. 

The above described rights of way, easements 

or appurtenances being also described 

and made appurtenant to the real property 

herein described in Section 3 by that certain 

deed from E. C. Sessions to The Oakland Water 

Front Company, a corp oration, dated July 22nd, 

1891, and recorded in Deed Book 43?, page 392, 

Alameda County Records, and that certain deed 

from The Oakland Water Front Company to E.C. 

Sessions dated July 8, 1891, and recorded in 

Deed Book 437, page 422. 

The said Sessions Water Front Com pany shall have a right to 

reserve, as against the City of Oakland, but not to its exclusion, 

a right of common use in that_ portion of the aforesaid 

one hundred (100) foot easement, adjoining the Central Pacific 

Railway Company's right of way, from the center line of Ninth 

Avenue to the Westerly line of Fifth Avenue as it now exists. 

SECTION 5. The said Sessions Water Front Company shall 

assign or convey or cause to be assigned or conveyed to the 

City of Oakland, free and clear of all liens and encumbrances, 

all the right, title and interest in and to that certain lease 

made and entered into the 30th day of Tune, 1911, by and between 

the City of Oakland and Edward C. Sessions, Jr., and 

recorded in Book 39 of Leases of the Records of the County of 

Alameda, State of California, at page 348, and wherein the 

property leased is described as follows, to-wit: 

"All that certain piece or parcel of 

land situate, lying and being in the City of 

Oakland, County of Alameda,. State of California, 

bounded as follows: 

"Beginning at a point on the center line 

of 9th Avenue extended south forty seven degrees 

fifty five minutes west along its present 

course 1091 feet from its intersection 

with the southwestern line of East 10th 

Street; thence south thirty-two degrees five 

minutes east 130 feet; thence south thirty 

d5grees twenty-two minutes east to the United 

States pierhead line, as now established, or 

as may hereafter be established by the United 

States Government; thence westerly along said 

pierhead line to its intersection with said 

extended center line of 9th Avenue, thence 

northeasterly along said extended center line 

of 9th Avenue to the point of beginning; 

"SAVING, EXORPTING and RESERVING from this 

conveyance a portion of the Peralta Ranch 

patented to Antonio Maria Peralta lying in 

front of or southerly from what was formerly 

the Town of Clinton. Bounded on the north by 

the right of way of the Southern Pacific Company's 

local railroad as now used and on all

other sides by the patent lines of said 

Ranch. Being a portion of the premises 

described in the decree quieting title in 

the case of Maria Hall against James Larue 

and others which lies south and west of 

said right of way, said decree being recorded 

in Vol. 212 of deeds at page 361 in 

the Recorder's office of Alameda County, 

State of California,", 

Together with all claims in respect to-any filling of Said leased 

premises and/or other improvements made thereon, or otherwise 

existing under the terms of said lease or arising therefrom. 

All taxes for the current year which may have been levied 

upon said leasehold interest or the possessory rights therein 

shall be pro rated as of the date of the final adoption of this 

ordinance. 

SECTION 6. The said Sessions Water Front Company shall forever 

quitclaim or cause to be forever quitclaimed to the City of 

Oakland any and all rights of way, easements or other interests 

claimed by it or by the Estate or the heirs of-E. C. Sessions, deceased, 

or the heirs of Mary Drum Sessions, deceased, and in lieu 

of Harry C. Sessions, deceased (being one of her heirs), the 

heirs of said Harry C. Sessions, E. C. Sessions, Jr., also known 

a8 Edward C. Sessions, -Jr., George . L. Sessions and/or Anne 

Sessions Cushing -- 

In or to the extension of that certain 

public street of said City of Oakland 

known and designated as Ninth Avenue southwesterly 

from its-present terminus to the 

southwesterly line of the right of way claimed 

by Southern Pacific Company and the Central 

Pacific Railway Company, said extension of 

Ninth Avenue being reserved as a right of way 

in that certain quitclaim deed from Edward 

C. Sessions, Jr. to Southern Pacific Company, 

dated August 7th, 1902, and recorded in Book 

of Deeds 1772 at page 389 of the Records of 

Alameda County. 

And also in or to that parcel of land. excepted and reserved 

as a roadway and switch track right of way in that certain lease, 

mentioned in Section 5 of this ordinance and described in said 

lease as follows: 

"Beginning at the point of intersection 

of the southern line of the Southern Pacific 

Company's right of way with the center line 

of 9th Avenue extended southwesterly on its 

present course; running thence south forty 

seven degrees fifty five minutes west along 

said extended center line of 9th Avenue to 

a point distant thereon 1091 feet southwesterly 

from its intersection with the southwestern 

line of East 10th Street; thence south thirtytwo 

degrees five minutes east 130 feet; thence 

northerly 132 feet along a curve having a

adius of 96 feet to a point from which 

the center of said circle bears south 

thirty-two degrees five minutes east; 

thence north forty-seven degrees fiftyfive 

minutes east 333 feet; thence easterly 

along a curve drawn tangent to said last 

named line and having a radius of 222.27 

feet to the southern line of said railway 

right of way; thence westerly along the 

southern line of said railway right of 

way to the point of beginning." 

The Fidelit_y and Deposit Company of Maryland, a corporation, 

shall alsdavey or relinquish any interest it may hold 

in or to the area last above described. 

SECTION 7. The Sessions Waterfront Company, as part of 

the transactions herein provided for, shall deliver or cause 

to be delivered to the City of Oakland a good and sufficient 

quit-claim deed or deeds executed by itself and by Edward C. 

Sessions, Tr., George L. Sessions, Anne Sessions Cushing, the 

estate t1.12d heirs of E. C. Sessions, deceased, and the heirs 

of Mary Drum Sessions, deceased, and in lieu of Harry C. 

.Sessions, deceased, (being one Cf her heirs), the heirs of 

said Harry C. Sessions, forever relinquishing, releasing and 

quitclaiming to the said city any and all right, title, claim 

and interest which they, or either of them, may have or claim 

to have in or to any of the properties and/or filled and submerged 

lands included within the boundaries of that certain 

area of the City of Oakland, more particularly described as 

follows: 

Beginning at a point on the center 

line of 9th Avenue extended South forty 

seven degrees fifty five minutes West 

along its present course 1091 feet from 

its intersection with the southwestern 

line of East 10th Street; thence South 

forty two degrees five minutes east 130 

feet; thence south thirty degrees twenty 

two minutes east to its intersection with 

the boundary line of the City of Oakland; 

thence southwestwardly along the said 

boundary line of the City of Oakland to 

its intersection with the northwesterly 

line of said 9th Avenue produced South 

forty seven degrees fifty five minutes 

west on its present course; thence north 

forty seven degrees fifty five minutes 

east along the said production of said 

northwesterly line of 9th Avenue to the 

southwesterly line of the right of way 

claimed by the Central Pacific Railway 

Company; thence southeastwardly along 

said right of way line to its intersection 

with the said southwesterly exten 

sion of said center line of 9th Avenue; 

thence south 47*55 twest along said extension 

of 9th Avenue_to the place of beginning.

Together with all and singular the tenements, hereditaments 

and appurtenances thereunto belonging or in anywise appertaining, 

and the reversion and reversions, remainder and remainders, 

rents, issues and profits thereof. And also all the estate, 

right, title, interest, possession, claim and demand whatsoever, 

as well in law as in equity, of, in or to the above described 

premises and every part or parcel thereof, with the appurtenances. 

SECTION 8. In the event the Sessions Water Front Company 

should secure and record a final judgment against the Estate of 

E. C. Sessions, deceased, quieting its title to all the area of 

property described in Sections 6 and 7, including the easements, 

rights of way and/or appurtenances described in this ordinance, 

and should thereafter forever quitclaim, relinquish and release 

all its rights, titles, claims and interests to the City of Oakland, 

it will not be required that a quit claim deed or deeds be 

executed and, delivered to the City of Oakland for and in the 

name of the said estate, as otherwise in this ordinance provided. 

SECTION 9. Upon the conveyance to the City of Oakland of 

the various titles, rights and interesthereinabove provided 

for in Sections 3, 4, 5, 6, 7 and 8, and the delivery of the - 

necessary deeds and other evidences of title as hereinabove provided 

in said sections, the City of Oaklandshall pay to the 

Sessions Water Front Company, by a warrant drawn on said 1925 

Oakland Harbor Improvement Fund, the sum of two hundred sixty 

five thousand (265,000) dollars, being the full purchase price, 

and the Auditor of the City of Oakland is hereby authorized 

and directed, upon the passage of the proper claim therefor by 

this Board, to draw a warrant on the Treasurer of the City of 

Oakland on the said Fund in said amount in favor of the said 

Sessions Water Front Company in payment of the lands, properties, 

rights, interests and titles, and the other considerations herein 

provided for.

SECTION 10. This Board shale'hereafter approve and allow 

claims from the said 7Und for the p urchase of policies of 

tie insurance, payment of its share of the current taxes, and 

for other incidental expenses in the same manner as other claims 

are allowed and approved by the Board with warrants drawn upon 

the Treasurer of the said City of Oakland. 

SECTION 11. The President of the Board and the Port 

Attorney are hereby authorized and directed to take the necessary 

steps to carry out the provisions of this ordinance.

hereby directed and authorized to execute the said leases 

in the name and on behalf of the City of Oakland with the• 

said corporations, who shall also execute the same. 

SECTICD It is hereby found and determined that the 

said leases are necessary and convenient for the accommodation 

of commerce and navi:Ration and for the Further development 

of the said air p ort as a terminal facility of the 

harbor of the City of Oakland. 

SECTION 5. This ordinance shall take effect at the 

time and in the manner provided by Section 176 of the City 

Charter.

RULES, PRESCRIBING PENALTIES LED RWPEAL- 

ING PORT ORDINANCE NO. 13. 

BE IT ORDAIITED by the Board of Port Commissioners 


SECTION 1. The Oakland Municipal Airport is 

and, shall be conducted and managed as a terminal facility 

of the harbor of the City of Oakland and for the promotion 

and accommodation of shi ppin g:, commerce and navigation. 

SECTION 2. All the provisions and penalties of 

Ordinance No. 4045 T.S. of the Council of the City of Oakland 

adopted on December 14th, 1927, for regulating the flying 

of aircraft and the establishment and maintenance of 

flyin;_, fields, and the provisions of the Air Commerce Regulations 

as established by the United 2tat es Department of 

Commerce (Aeronaut ics Branch ) under the authority of the 

Air Commerce Act of 1926, therein referred to, are hereby 

adopted by reference, made a p art hereof and declared applicable 

to the Port Area of the City of Oakland and particularly 

to the Oakland Municipal Airport, as fully as if 

the same, and each and all of them were completely set 

forth here In

SECTION 3. No person shall use the said airport 

as the base or terminal for the carrying on of commercial 

aviation, or the carryin g of passengers, freight or express, 

or for student flying, communications, or other commercial 

wurpose or transportation without first securin g the p ermission 

of the Board of Port Commissioners or its Port 

Manager, and paying the fees and charges prescribed for such 

privileges, the use of the air p ort, its facilities, and for 

services rendered. 

SECTION . 4. No person shall carry passengers, 

for hire or award, from, to and over or about the Oakland 

Municipal Adrport unless such person is using the airport 

as a permanent base, or shall have first secured permission 

from the Board or the Port Manager, and shall have paid in 

advance the fees and char g es prescribed. 

SECTION 5. No person shall take or use any 

aircraft, or any parts or tools thereof, owned, controlled. 

or operated by any other person, while such aircraft, parts, 

or tools are stored, housed or otherwise left on the said 

air p ort or within its hangars, without the written consent 

of the owner or operator thereof, or other satisfactory 

evidence duly presented to the y ield Superintendent. 

SECTION 6. No person shall engage in smoking, 

or strike any match inside of or within fifty (50) feet of 

any aircraft, or within fifty (50) feet of any containers 

of gasoline or other highly combustible lieuids, or within 

any hangars (except offices thereof)or work shops located 

upon said airport. 

SECTION 7. No person shall take any aircraft 

from the field or hangars or operate the sane while under 

the influence of or using or havin g personal possession of 

intoxicating liquor. 

SECTION 8. No person handling or operating any 

aircraft on or at the said airport shall carry or transport or 

in any manner dispense intoxicating liquor, cocaine or 

other habit forming drugs. 

SECTION 9 No person operating under a letter 

of authority from the Secretary of Commerce and not posessing 

a license as provided by the Air Commerce Regulations 

shall at any time operate any aircraft carrying passengers 

from, to or over the said airport, or operate any aircraft 

over the hangars, Administration Buildin g , automobile parking 

areas, or any gatherings of the public, or nearer than 

five hundred (500) feet thereof, or nearer than one thousand 

(1000) feet in the air from any automobiles or persons upon 

any public streets of the said airport.

SECTION 10. The permission granted by the said 

Board to use the said airport and its facilities, or to fly 

to, from or over the same, shall be at all times conditioned 

upon the assumption of full responsibility therefor by every 

person exercising or taking advantage of such permission. It 

shall be a-further condition thereof that each per son, as a 

consideration for the use of such airport and/or its facilities, 

shall at all times release, hold harmless and idenulify 

the Oity of Oakland, the Board of Port Commissioners and/or 

its agents and employees from any and all responsibility, 

liability, loss or dama ge resulting to any such person, or 

caused by or on his behalf and incident to the manner- in 

which the air p ort is operated, constructed or maintained or 

served from within or used from without. The use of such 

airport by any person for any p urpose, or the paying of any 

fees therefor, or the taking off or landing aircraft thereupon, 

shall be itself an acknowledgement that such person 

accepts such privile ges au the conditions herein set forth. 

SECTION 11. In addition to the foregoing, the 

Board of Port Commissioners shall, by resolution adopt 

from time to time such field rules or administrative regulations 

as may be required to safeguard and regulate the use 

of the Oakland Municipal Airport and protect the public interests 

therein. It shall be unlawful for any person in or 

about the said airp ort to violate any such field rules, and 

any person so violating such rules, or any of the provisions 

of this ordinance, or refusing to comply therewith may be deprived 

of the use of the said air p ort or its facilities or of 

any right to fly therefrom for such reasonable time as may be 

deemed necessary to protect the public and its interests. 

SECTION 12. The term "person" herein used shall 

be construed to include any person, firm, corporation or association, 

plural and singular. 

SECTION 13. Port Ordinance NO. 13, adopted August 

1, 1927, is hereby repealed. 

SECTION 14. Every person who shall violate, disobey 

or refuse to comply with any of the provisions of this 

ordinance, or any of the provisions of law incorporated 

therein, shall, upon conviction, he punishable by fine and penalty, 

not exceedin g Five Hundred Dollars (4500..00), or by imcrisonment 

in the prison of the City of Oakland for not more 

than six (o) months, or by both such fine and imprisonment.





SECTIOP: 15. This ordinance shall take effect.
