Whereas by section 13 of the Main Roads Act 1930, it is provided that the Governor may on the 

recommendation of the Commissioner, by proclamation declare that any section or part of a road 

shall cease to be Main Road; and whereas the Commissioner has recommended that the road section 

delineated on the Plan specified in Schedule 2 hereto shall cease to be Main Road. Therefore, I the 

Governor, acting with the advice and consent of the Executive Council, in exercise of the powers 

conferred by section 13 of the Main Roads Act, and pursuant to the said recommendations do hereby 

declare the York-Merredin Road M41 as is delineated on MRD Plan 7622-670-2 and as generally 

described in Schedule 2 hereto shall cease to be Main Road with effect on and from July 1, 1991.

Made by His Excellency the Governor in Executive Council. 

Citation 

1. These regulations may be cited as the Weights and Measures Pre-Packed 

Articles Amendment Regulations 1991. 

Commencement 

2. These regulations shall come into operation on the day on which they are 

published in the Government Gazette.


Schedule 2 amended 

3. The Weights and Measures Pre-Packed Articles Regulations 1987* are 

amended in Schedule 2a 

by inserting in the appropriate numerical order in column D opposite

of section 35C of the Fisheries Act 1905, onboard licensed fishing boat "Freda Jess" registered

That the processing establishment- 

1. Shall comply with the requirements of the Fisheries Act 1905, and all Regulations, Orders 

in Council and Notices and Ministerial Directions issued thereunder. 

2. Shall not be used for the processing of western rock lobster, tuna, abalone, scallops or 

salmon. 

3. Shall comply with the requirements of the Health Act 1911 amended. 

4. Shall be registered as an export establishment pursuant to the provisions of the Parliament 

of the Commonwealth Export Control Act 1982, and Orders ‘made thereunder, more 

specifically the Prescribed Goods General Orders and the Fish Orders, should it be used 

to process fish for export. 

5. Shall not be used for the processing of marron Cherax tenuimanus unless a licence is held 

under section 39C of the Fisheries Act 1905. 

6. Shall not be used for the processing of fish or crustacea caught by any other vessel. 

In accordance with the provisions of section 35K, any person aggrieved by this decision, may within 

fourteen days after publication of this Notice, appeal against the decision or order by serving on 

the Minister for Fisheries a statement in writing on the grounds of their appeal.

1. These regulations may be cited as the Main Roads Engineering Cadets 

Amendment Regulations 1991.

2. In these regulations, the Main Roads Engineering 

1982* are referred to as the principal regulations.

Detention or cancellation of pilot 

106. 1 Where a pilot attends a vessel in accordance with an application 

referred to in regulation 105 and his services are not required at that 

time a charge of $278 per hour or part thereof shall be paid for the period 

the pilot was in attendance. 

2 Where a pilot is detained on a vessel until the vessel is ready to 

leave the berth a charge of $278 per hour or part thereof shall be paid 

for the period the pilot was detained. 

3 Where a pilot attends a vessel in accordance with an application to 

conduct the vessel over the pilotage area between the sea pilot boarding 

ground and Gage Roads and the vessel does not arrive at the boarding 

ground at the appointed time a charge of $278 per hour or part thereof 

shall be paid for the period the pilot was detained. ". 


7. Regulation 115 2 of the principal regulations is amended by deleting 

"$500" and substituting the following- 

" $572 ". 


8. Regulation 121 of the principal regulations is amended by deleting after 

"issued" in subregulation 1 the followingupon 

payment of the fee of $535.00, ".






General rates payable 

127. Subject to regulation 128 the tonnage rates payable shall be 

assessed at the rate ofa 

$0.0057; 

b where a vessel has an inboard incinerator $0.0055; or 

c where regulation 126 2 applies to the vessel $0.0017, 

for each ton of the registered tonnage of the vessel for each hour or part 

thereof during which the vessel occupies a berth. ". 

Regulation 129 repealed 

10. Regulation 129 of the principal regulations is repealed. 

Regulation 130 repealed and a regulation substituted 



130. 1 Thgs which are normally engaged in the berthing or sailing of 

commercial shipping in the Inner Harbour shall each pay tonnage rates 

of 50% of the rates assessed under regulation 127. 

2 Hulks, tugs other than those to which subregulation 1 applies, 

passenger craft, licensed launches, lighters, barges, and workboats using 

the wharves or waters of the Port shall pay, as Tonnage Rates, an annual 

fee as follows- 

100 tons to 200 tons gross measurement $190.00 

over 200 tons gross measurement $382.00 

Fees shall be payable in advance for each year or part thereof to be 

calculated from the first day of July in each year. 

3 In addition to the annual fee set out in subregulation 2 every hulk, 

tug, passenger craft, lighter, barge and licensed launch shall pay a fee 

of $24.60 for every week during which at any time it has utilised any of 

the wharves, jetties, landings or other facilities provided for the berthing 

or tying up of vessels. ".

131. 1 The charges for the mooring and unmooring of a vessel in the 

Port are set out in the Table.

VALUATION OF LAND AMENDMENT REGULATIONS 1991 


Citation 

1. These regulations may be cited as the Valuation of Land Amendment 

Regulations 1991. 

Commencement 

2. These regulations shall come into operation on 1 July 1991. 


3. Regulation 5 of the Valuation of Land Regulations 1979* is amended by 

repealing subregulation 1 and substituting the following subregulation- 

" 1 Subject to this regulation, the charges to be paid by a rating or taxing 

authority in respect of the matters referred to in section 38 of the Act shall 

be determined as followsa 

where valuation is not of the kind referred to in paragraph bi 

valuation charge $41.00 per hour; 

ii clerical charge $23.00 per hour, 

with a minimum charge of $37.50 per valuation; 

b where the valuation is based on any of subparagraphs b i to vi 

in the definition of "unimproved value" in section 4 1 of the Acti 

valuation charge $41.00 per hour; 

ii clerical charge $23.00 per hour; 

iii fixed service charge $21.00 per correspondence, 

but in any event shall not exceed the cost of the service. ".

LAND DRAINAGE ACT 1925 

Notice is hereby given that I, Ernest Francis Bridge, Minister for Water Resources, determine, 

pursuant to section 90A of the Land Drainage Act 1925 and in respect to the rating year ending 

30 June 1992 for the Albany, Busselton, Harvey, Mundijong, Roelands and Waroona drainage 

districts, that the maximum amount of the rate to be paid in respect of any land classified for the 

purposes of section 88 of the Land Drainage Act 1925 shall be an amount that is 40 per cent greater 

than the amount of the rate chargeable for the whole of the year ended on 30 June 1991, but if 

the land was improved or subdivided in that year the maximum shall be an amount that is 40 per 

cent greater than the amount of the rate which would have been payable if the land had been 

assessed for rates for the full year having regard to that improvement or subdivision, and if the 

land is improved or subdivided in the year ending on 30 June 1992 the maximum shall be increased 

by the additional rates assessed having regard to that improvement or subdivision.
