Section 2(e) of Chhatt<strong>is</strong>garh Special Public Security Act defines “unlawful<br />

activity” as follows:<br />

“Unlawful activity” in relation <strong>to</strong> and [sic] individual or organization means<br />

any action taken by such individual or organization whether by committing an<br />

act or by words either spoken or written or by signs or by v<strong>is</strong>ible<br />

representation or otherw<strong>is</strong>e;<br />

which constitute a danger or menace <strong>to</strong> public order, peace and<br />

tranquility; or<br />

which interferes <strong>to</strong> [or] tends <strong>to</strong> interfere with maintenance of public<br />

order; or<br />

which interferes or tends <strong>to</strong> interfere which [sic] the admin<strong>is</strong>tration of<br />

law or its establ<strong>is</strong>hed institutions and personnel; or<br />

which <strong>is</strong> designed <strong>to</strong> overawe by criminal force or show of criminal<br />

force or otherw<strong>is</strong>e <strong>to</strong> any public servant including the force of the State<br />

Government or the Central Government in the exerc<strong>is</strong>e of the lawful<br />

powers of such public servant; or<br />

of indulging in or propagating acts of violence, terror<strong>is</strong>m, vandal<strong>is</strong>m or<br />

other acts generating fear and apprehension in the public or indulging<br />

in or encouraging the use of firearms, explosives and other devices or<br />

d<strong>is</strong>rupting communications by rail or road; or<br />

of encouraging or preaching d<strong>is</strong>obedience <strong>to</strong> establ<strong>is</strong>hed law and its<br />

institutions; or<br />

of collecting money or goods forcibly <strong>to</strong> carry out any one or more of<br />

the unlawful activities mentioned above;<br />

Binayak Sen, a doc<strong>to</strong>r who worked on tribal community health <strong>is</strong>sues for over 25<br />

years in Chhatt<strong>is</strong>garh, and an activ<strong>is</strong>t and general secretary of the Chhatt<strong>is</strong>garh state<br />

level unit of the People’s Union for Civil Liberties, was arrested on May 17, 2007, on<br />

charges of indulging in unlawful activities as defined under the Unlawful Activities<br />

(Prevention) Act and Chhatt<strong>is</strong>garh Special Public Security Act, and other crimes<br />
